FLORIDA The IDown Council has turned down New Smyrna Beach's demand that Edgewater grant 'New Smyrna Beach a 20 year electric light fran- chise. The reasons are stated '8.t length in the resolution which is available for pUblic inspection. In substance they are: 1. Poor service and'high rates. 2. Disclaimer of responsibility for railure or inability to serve. 3. Existance of a franchise to get electricity from Florida Power & Light Co. from which service has been demanded. The distribution system in Edgewater is the property of the town and its inhabitants, who paid New Smyrna Beach the expense of ser- vice connections and extensions. No franchise was ever given New 8.1:Dy.rna Beach, and it has never claimed ownership by reporting , it for taxation or paying taxes on it. Nevertheless, Edgewater will voluntarily pay New Smyrna Beach a sum of money to be agreed upon (based upon the present depreciated value of the system) for a release or quit claim of whatever interest in it New Smyrna Beach feels it has, in order to settle the matter amicably. The Town Council has called upon the Florida Power & Light Company to perform under its existing franchise vdth Edgewater and furnish electricity to Edgewater and its inhabitants, and will insist that it perform its duty as rapidly as possible. The Florida Power & Light Company prefers not to construct a distribution system parallel- ing and duplicating the existing one, but if it did so with or without a Court order, the value of the existing one t' \.., 'wi' \ ......, ... u ~ system would be reduced to a salvage value, irrespective of its o~nership. The. critical condition which New Smyrna Beach officials say exists at their electric plant~ can be cured immediately by cutting off Edgewater from it. The Florida Power & Light Company would then serve Edgewater directly, thus relieving the municipal plant considerably, and would also furnish an additional 400 KW to the municipal plant direct, which would enable New Smyrna.Beach to improve its service immediately in New Smyrna Beach, and lessen the chances of a general breakdown until the new engine arrives in New Smyrna Beach.
