06-01-1983 Q 0 CITY OF EDGEWATER Planning Commission Regular Meeting June 1, 1983 Minutes Chairman Bennington called the regular meeting to order at 7:05 P.M. in the conference area of the Community Center building. ROLL CALL Members present: Messrs. Bennington, Opal and Chenoweth. Excused were Messrs. Winter, Quaggin and Finn. Also present: Ron Carwile, Mr. and Mrs. Garthwaite, Councilman Jack Spencer, Susan Mista, secretary, and one member of the press. APPROVAL OF MINUTES Moved by Mr. Opal and seconded by Mr. Chenoweth to approve the minutes of the May 18, 1983, meeting. Motion CARRIED 3-0. SITE PLAN REVIEWS SP-8307 - Robert Gaffney Mr. Bennington advised that Mr. Gaffney would not be present at the meeting as he was out of town. Mr. Opal made a motion to table all the business regarding Mr. Gaffney to the next meeting. Mr. Chenoweth seconded the motion. Motion CARRIED 3-0. SP-8311 - Ron Carwile - Coastal Tire Co.-Preliminary/Final Report Mr. Bennington advised that there was a Department Head meeting regarding this matter, at which time he read the comment report to the audience. Mr. Benn~ngton questioned Mr. Carwile as to whether or not this addition was to be used for storage only. Mr. Carwile replied, yes. He advised the Board he would be putting in one receptacle on each wall. Mr. Bennington discussed with Mr. Carwile the problems concerning indicat- ing retention area on sites that are under one acre. In a conversation with the Building Inspector, Mr. Bradshaw, he suggested that a point be designated on the property - preferably a corner, and you call that point anything you want to - for example - zero or ten, etc. For each corner you would put the elevation as to how many feet it is above that point. For example, the front left point was the highest corner and you used the figure 100, then you designate the remaining corners with a figure computed in accordance with your highest figure of 100, to show your water retention areas; then you show arrows on the drawing, pepicting the drain pattern to the retention area. This would give us an idea of the retention area. Mr. Bennington advised that Mr. Carwile has provided on his drawing the setback measurement, which is 351, at the east end, which is within the setback requirement of 101. He stated he could find no problem with drainage, and the Building Inspector agreed with him. Mr. Chenoweth made a motion to accept the plan, as submitted, that it is in compliance with the Comprehensive Plan for Edgewater. Mr. Opal seconded the motion. Motion CARRiED 3-0. OLD BUSINESS Concerning Zero Lot Lines, Mr. Chenoweth moved to table discussion of this matter until there is a full Board present. Mr. Opal seconded the motion. Motion CARRIED 3-0. o o COMMUNICATIONS Mr. Bennington read the letter from the Department Head Supervisors concerning changes in site plan requirements. He stated this has come about from several cases. Projects of less than one aare do not require a topo, but something needs to be furnished so that the Building Inspector and the Board can be satisfied that the water is being controlled. They are asking that for projects under an acre, a diagram of the land be submitted, showing the elevation at the critical points, and the depth of the swale. Mr. Bennington stated Mr. Bradshaw would like to see actual figures on the drawings. Mr. Bennington advised that if this would be required, it would be expensive. He stated they are requesting a new site plan requirement list be drawn up for commercial and industrial additions only, eliminating the various requirements needed for a new building; that the Building Inspector would check to be sure no changes have been made and all requirements have been met, wherein he would report his findings to the Planning Commission. Mr. Opal stated that he felt this came about because of Mr. Montesano's addition, that he was not given a permit,which caused a lot of problems. Mr. Bennington said he knew nothing about that matter. He stated that the preliminary site plan requirement is for a new pnoject. If someone wants to make an addition, they should not have to comply with all the requirements of a new project as they have already complied with the requests. Mr. Bennington feels all the requirements are not necessary. The Building Inspector would check into the plans for additions and report his findings to the Board for approval. Mr. Chenoweth stated he thought it was a good idea and he supported the recommendation of the Building Inspector to handle the review of applications for additions of industrial and commercial projects. Mr. Bennington suggested that the Board study the list and alter it for additions, only, discussing same at the next meeting. Landscape Ordinance Mr. Bennington stated he has made a couple of changes to the Ordinance Mr. Alvarez submitted. Mr. Spencer raised a question concerning Section 8, in a previous discussion with Mr. Bennington regarding this Ordinance. He stated that it acutally reads that the landscaping would have to be in before they could be issued a building permit. Under Section 9, Item E - lawn grass - the Board added that the swales have to be sodded to prevent soil erosion. He stated he wanted to have the Ordinance read that the swales had to be sodded before a permit was issued, however, he found that this would be almost impossible to do this in that the trucks would tear them up, bringing in supplies for construction. He suggested that maybe it should be required that so much of the drains be sodded to prevent dirt from plugging up the drains after it rained. Mr. Bennington advised that was the only problem he could see with the Ordinance. Mr. Garthwaite suggested that it be changed to certificate of occupancy before a building permit is issued. Mr. Bennington agreed with his suggestion; He stated he liked the idea of having a subdivision put in t he i. r b u f fer s fir s t, e s p e cia 11 y when go i n gin n e x t to an other sub d i vis i on , thereby alleviating the problem of dirt blowing over into existing houses. Mr. Bennington again stated he liked Mr. Garthwaite's idea of changing Section 8 that prior to the issuance of a CO - to strike "building permit" and write "certificate of occupancy". Mr. Bennington stated he still had a problem with Section 9E. After reviewing Section 11, he felt his problem was solved, under the heading "maintenance". The owner of the property shall be responsible for the maintenance of all landscaping in good condition. That should also include if the swale was eroded they would have to replace it. -2- Planning Commission Meeting Minutes - June 1, 1983 ~ o o Mr. Chenoweth made a motion to send the Landscape Ordinance to Council as amended, to include certificate of occupancy in lieu of the building permit in Section 8; the rest as drafted in the May 18, 1983, Landscape Ordinance, for approval of Council. Mr. Opal seconded the motion. Motion CARRIED 3-0. Mr. Bennington wanted it noted that if Council questions why the vote was only 3, there were only 3 people at tonights meeting. Impact Fees Concerning the Impact Fees submitted by Mr. Alvarez, Mr. Bennington stated that this was quite lengthy and more time should be allowed to review it. The other Board members agreed to his suggestion. MISCELLANEOUS In regards to the letter from Briley, Wild as to why they requested the Board to review the Subdivision Ordinance, Mr. Bennington advised the Board that they had not yet answered this request. Mr. Chenoweth motioned that the meeting be adjourned, seconded by Mr. Opal. The meeting was adjourned at 7:35 P.M.
