02-09-1983 Special - .. (.) Q SPECIAL PLANNING COMMISSION MEETING February 9, 1983, 7:00 PM Minutes The minutes will be verbatim per a request by Chairman Bennington. CALL TO ORDER Mr. Bennington: 7:20 to order. I call the Special Planning Meeting of February 9, at Roll call. ROLL CALL Mrs. Winks: "Here". Mr. now should I not sworn in Mr. Bennington - "Here". Mr. Hetu has been excused. Mr. Opal - Winter isn't present yet. Mr. Finn - "Here". Mr. Chenoweth, put him as absent, well he's not even a member cause he's yet, I suppose. Mr. Bennington: Just put him as not here, because he's not here. Mrs. Winks: Well, there's a difference between absent and excused. Mr. Opal: He's absent, he should have been here. Mr. Bennington: OK, the first thing is the Tree Ordinance and the Landscape Ordinance. Mr. Opal: Mr. Chairman I'd like to read this off here and I'd like to be excused after that. I want to go to the meeting next door. Mr. Bennington: Is that on our agenda? Mr. Opal: No, I just, something took place last week that I want to get clarification on. We spoke of... Mr. Bennington: I don't think we can discuss things not on the agenda for a special meeting, can we? Mr. Opal: You don't want to discuss it, OK, fine. Mrs. Winks: I don't have any... Mr. Bennington: I'm not sure, I know that at a Workshop you can't. Mr. Opal: I'm just talking about this item in the paper and I want to, as a matter, bring this issue up. Mr. Bennington: What reason do you want to be excused for? Mr. Opal: I'm going next door to a meeting I consider that important also. Mr. Bennington: You don't care to attend the meeting of the Planning Commission? Mr. Opal: No, I'm here but I want to be excused. I ask to be excused. Mr. Bennington: As far as I'm concerned, my personal opinion is that, if you are going to serve on a Board, you ought to serve. Mr. Opal: That's right. I'll serve on the Board, but I just challenge this item on what took place last week, and I'm challenging on the grounds th~t you got to have a vote of three to pass any, it's that way with the Council, it's that way with the Boards, it should be and if it isn't we better get it changed. Now we spoke about the By-Laws, I didn't see anything there, that's just five constitutes a Board and three is a quorum, but there's no mention that two can cast a vote. Mr. Bennington: Do you have a copy of the By-Laws handy Debbie? Mr. Opal: Get your- By-Laws changed. As far as I'm concerned no two vote - even the Council. . & I~- o o Mr. Bennington: Membership to the Commission shall be appointed and subject to removal as set forth by the Council. Mrs. Winks: Section H, is there a Section H in there. Mr. Bennington: Voting - the vote of a majority of those members present who are eligible to vote shall be sufficient to decide matters before the Commission providing there is a quorum present. The Chairman shall vote. A quorum was present, to rule a majority. Mr. Opal: Well, I'm going to challenge that vote. Mr. Bennington: You're not going to challenge it here becuase that's not what we are here for. Mr. Opal: No, I want to be excused. Let's see I don't know if I got a copy of the By-Laws. Would you get me, how come you never mentioned this to me when I came in to see you? Mrs. Winks: Mention what? Mr. Opal: About By-Laws, that it's in the By-Laws. I asked you when and that was the end of it. When I came in here to see you about this. Mrs. Winks: And you asked me what it was, what the ruling was or how it worked. Mr. Opal: Well, I see it in the paper. Mrs. Winks: And I said it was the majority of the members present. Mr. Opal: Present. So the majority vote but it doesn't say anything about three, three got to vote yes, but just the majority present. Mrs. Winks: Right, that's what I explained to you. Mr. Opal: Why didn't you show me the By-Laws or mention the By-Laws? We had a discussion here. Mrs. Winks: I just answered your question. I... Mr. Bennington: Mr. Opal, your questions, excuse me, have been answered, Debbie's not on trial. We are here to conduct a special meeting on the ~Tree Ordinance and Landscape Ordinance. Mr. Opal: Well, I want to be excused. I ask to be excused. Kindly give me a copy of the By-Laws. Mr. Bennington: Are you refusing to attend the meeting Mr. Opal? Mr. Opal: No, no, just asking to be excused, I want to go next door to another meeting. Mr. Bennington: You feel that meeting is more important than this meeting? Mr. Opal: No comment. Mr. Bennington: Would the minutes please reflect that Mr. Opal is leaving the meeting and doesn't want to attend, feels that the workshop next door is more important. Mr. Opal: OK, thank you. Mr. Bennington: We no longer have a quorum present, can't continue the meeting. Mrs. Winks: Shall we adjourn? Mr. Bennington: I assume the meeting is adjourned. The meeting was adjourned at 7:35 PM.
