PLANNING COMMISSION MEETING
December 2, 1982, 7:00 PM

Chairman Bennington called the meeting to order at 7:00 PM in the conference
area of the Community Center.
ROLL CALL
Members present: Messrs. Bennington, Towers, Hetu. Also present: Mrs.
Winks.
APPROVAL OF MINUTES
Moved by Mr. Hetu, seconded by Mr. Towers, and CARRIED 3-0, to approve the
minutes of November 17, 1982.
SITE PLAN REVIEW
SP-8226, Weaver/Wheaton, Commercial Warehouse, 1518 Industrial Road, I-2
Preliminary/Final Approval
Mrs. Wheaton was present to discuss this site plan for a commercial warehouse.
The Department Head comments were reviewed, noting that the Fire Department
is concerned as to what will be stored in the warehouse. Mrs. Wheaton
stated that no chemical will be stored in the building, and at present it
will be used for their personal use. Per Mr. Murphy's letter any building
valued over $5,000 must have an architect's seal on the plans. Mrs. Wheaton
did not have an architect's sealed plan.
Moved by Mr. Towers, seconded by,Mr. Hetu, and CARRIED 3-0, to approve
Preliminary and Final Site plan Approval for SP~226 with the condition that
two architect sealed plans be submitted beforg~ building permit is issued.
SP-78, Rev. #3, FEC, Stepp & Upham, Industrial Subdivision, PID
Review for Comments
Mrs. Winks noted that Mr. Parker Mynchenberg is now the engineer for this
project and he had decided not to attend this meeting. A letter was
received from him that he would like to know what is needed for Final plat
Approval. Mrs. Winks noted that SP-78 had only received Preliminary
Approval for Phase I, and the Commission felt that he would have to come
back for Preliminary on the entire project. There was a discussion on
the entrances to the industrial park. Mrs. Winks asked for the Commissions
opinion on whether this proJect should comply with the PID ordinance alone
or should it comply with both PID and Subdivision regulations. The Commission-
felt that this question should be asked of thelCity Attorney. It was noted
that there is a future road shown to connect to New Smyrna Beach. Mr.
Hans Wolfer, City Engineer for New Smyrna Beach, stated that New Smyrna
Beach is not interested in connecting with a road. /
OLD BUSINESS
Mrs. Winks read a letter to the Planning Commission from Mrs. Taylor,
secretary to the Board of Adjustments, which stated that the special excep-
tion for a 24 unit apartment development for Mr. Harold Brown was denied
by the Board of Adjustments. Mrs. Winks noted that SP-8223 is now closed.
SP-8224, Trolley Car Restaurant, Amended Site Plan
Mrs. Winks explained that the site plan had the restrooms in the wrong
location concerning setbacks and they are going to move them to meet the
10 foot setback. Mr. Murphy will not inspect the plumbing for them until
the Planning Commission approves this amendment to the site plan. Mr. Hans
Wolfer was present to discuss this amendment. The Commission felt there
was no problem in changing the location of the restrooms. \
Moved by Mr. Towers, seconded by Mr. Hetu, and CARRIED 3-0, to approve
Amended Site Plan SP-8224

SP-8216, George Workman, Building Addition
Mr. Bennington noted that he had received a call from Earl Wallace who
told him that a permit had been issued for Tommy's Lounge building addition.
They have decided to put a bathroom in the front of the building and Mr.
Murphy stated that they would have to come back to the Planning Commission
for this change. The concensus of the Commission was that this was an
interior change and this is not a concern of the Planning Commission.
Mr. Murphy will be sent a letter to this effect.
Zero Lot Lines
Mr. Bennington brought it to the attention of the Commission that a
revision to Ordinance 82-0-13 pertaining to Zero Lot Lines was never
brought to Council's attention. This change was unanimously approved
by the Planning Commission on 5/5/82 with that recommendation to the
Council.
Moved by Mr. Hetu, seconded by Mr. Towers, and CARRIED 3-0, to recommend
to Council that Section 718. Zero Lot Lines, (1) and (5) be changed as
follows: (1) The minimum yard shall be the same as for the Zoning Classi-
fication in which the subdivision is located or proposed, except that the
interior side yard may be zero in the case of structures which adjoin.
(5) All parcels are to be equally divided, excluding setback areas.
NEW BUSINESS
Mr. Bennington mentioned that we have discussed a Tree Ordinance in the
past and noted that we now have a copy of the County Tree Ordinance. Mr.
Bennington read this ordinance and noted that we should be able to compose
our own ordinance similar to this.
SP-8227, Gas Lite Square Subdivision
Mrs. Winks briefed the Commission on the status of this subdivision and
that it would be going to a Department Head meeting before it comes to
the Commission for Sketch Plan approval.
The meeting was adjourned at 8:08 PM.
