11-28-1983 , - ~ Q , CITY OF EDGEWATER ZONING COMMISSION REGULAR MEETING NOVEMBER 28, 1983 Minutes Vice-Chairman Stewart called the regular meeting to order at 7:07 P.M., in the Shuffleboard Court building. ROLL CALL Members present: Messrs. Stewart, Wheeler and Sadowski. Mr. Landry was absent. Also present: Frank Opal, Earl Wallace, Glen Raulerson and secretary, Susan Mista. APPROVAL OF MINUTES Moved by Mr. Wheeler and seconded by Mr. Sadowski to approve the minutes of the November 15, 1983, meeting. Motion CARRIED 3-0. NEW BUSINESS Application for City Occupational License by Lee Jones to operate auto repair business at 2526 Hibiscus. Vice-Chairman Stewart noted that Mr. Jones was not present to discuss his application. He also advised that the Board would need additional information before they could determine whether or not his occupational license should be issued. There is not a complete floor plan of his proposed building, showing which stalls are occupied in same, and to verify there is only one restroom in the entire structure. Based on previous similar applications, the Board decided that each business in the building must have a restroom facility, separate from the others. Mr. Wheeler made a motion to table this matter until next time and the additional required information be secured from Mr. Jones. Mr. Sadowski seconded the motion. Motion CARRIED 3-0. A lication b Glen E. Raulerson to 0 erate cabinet sho at 2108 Hibiscus in retail storage building. Mr. Raulerson and Mr. Earl Wallace were present to discuss this applic- ation. Mr. Stewart advised that the item on the agenda regarding Earl Wallace's request that the Board add new permitted uses to the B2 zone concerns this application. Mr. Wallace explained to the Board that this project is between 20th and 30th Street on Hibiscus that is set as a retail situation. According to the zoning Ordinance in B2 it does permit auto body shops, etc., and it does permit cabinet shops under 5,000 square feet. This project is designed around the permitted uses. It has 20 plus parking. It was presented to the Planning Board and did meet the requirements for the B2 zoning. The concern here appears to be on page 1598, item d1, which states Ordinance 880 is amended to permit three new classifications of permitted uses in the B3 zone in that area of land zoned B2 along the Florida East Coast railroad to 20th and 30th Street. He further stated that less parking will be utilized and each unit has restroom facilities. Mr. Wheeler pointed out that the building is not complete and the rest- rooms have not been installed. Mr. Wallace advised that they will be installed upon completion of the building and the CO will not be issued until this structure complies with all the Code requirements. Mr. Wallace further stated that Mr. Raulerson is being held up from getting his occupational license due to the fact of the uncertainty of how the Code is written. He said if you take the Code as it is written, a cabinet shop is allowed in this area, under 5,000 square feet, as long as a retail area is used and as long as there are restroom facilities. Mr. Raulerson does comply with the Code requirements. o Q Vice-Chairman Stewart stated that the Board must consider whether or not they wish to incorporate a cabinet shop in the B2 zone, between 20th and 30th Street on Hibiscus. They then have to recommend whether or not this is condusive, provided that the business complies with the parking and restroom regulations. A discussion then ensued concerning this matter. Mr. Wallace explained to the Board that this is not a mini-warehouse ln that it has 20 plus parking spaces, there will be a retail portion in the front of the building, and the cabinet shop will also be located in the building, and the square footage is larger than a mini-warehouse. Mr. Sadowski made a motion that a cabinet shop be permitted in the B2 zone, between 20th and 30th Streets on Hibiscus, and same be included in Ordinance 79-0-18, referencing the 880 Ordinance. Mr. Wheeler seconded the motion. Motion CARRIED 3-0. The secretary was instructed to send a letter to Susan Wadsworth and Connie Kinsey concerning this recommendation. Mr. Stewart suggested that the ordinance needs to be changed, it is too restrictive, everything tends to fall into the mini-warehouse category. He stated that they would review this ordinance at the next meeting. and it should be added to the agenda. OLD BUSINESS Review recommendations that have been sent to Council. Vice Chairman Stewart read to the Board the list of recommendations that have been sent to Council and the secretary's notations concerning same. In regards to the request from Council that more information is needed regarding the recommendation that rezoning applications be heard six times a year and the 1,000 square foot minimum living area for single family dwellings in R4 and R5A, the Board decided that the six times a year rezoning be enforced due to the fact that at the present time there is a three month waiting period for applicants and that is too long a time. With rezoning being heard six times a year there would only be a two month waiting period. Concerning the minimum living area being required to be 1,000 square feet for single family dwellings in the R4 and R5A zones, there presently is no minimum requirement for single family. The Board decided that this figure was based on the minimum square footage of living area for the other zones and this requirement was needed as a guideline for single family construction in these zones. There being no further business to come before the Board, upon motion duly made by Mr. Wheeler to adjourn, seconded by Mr. Sadowski, the meeting was adjourned at 8:05 P.M.
