02-14-1983 ." o o . - ZONING COMMISSION MEETING February 14, 1983, 7:00 PM Minutes vice Chairman Cochran called the meeting to order at 7:02 PM in the conference area of the Community Center. SWEARING IN OF NEW MEMBER Mrs. Susan Wadsworth, Deputy City Clerk, was present to swear in Mr. Roman Sadowski, the new Alternate member. ROLL CALL Members present: Messrs. Siciliano, Stewart, Landry, Cochran, Wheeler, and Sadowski. Also present: Mrs. Winks. APPROVAL OF MINUTES Mr. Siciliano stated that there is of the January 24, 1983, minutes. B-6 from the special exceptions in should be deleted from the B-zones an error in the last paragraph of page 2 He did not discuss removing B-2 through the I-I zone. He stated that residential and the I-zones. Moved by Mr. Siciliano, seconded by Mr. Wheeler, and CARRIED 5-0, to approve the minutes as submitted and the above change will be noted in the minutes of the February 14, 1983 meeting. ELECTION OF CHAIRMAN Vice Chairman Cochran opened the floor for nominations for Chairman. Mr. Wheeler nominated Mr. Siciliano, seconded by Mr. Stewart; Mr. Wheeler moved to close nominations, seconded by Mr. Stewart; upon roll call Mr. Siciliano was UNANIMOUSLY elected Chairman. Vice Chairman Cochran turned the Chair over to Chairman Siciliano. OLD BUSINESS Mr. Siciliano asked if the required affidavits were received on the Stuckey rezoning. Mrs. Winks replied that, yes they had all been received. It has gone to Council, and a Public Hearing will be scheduled. Mrs. Winks presented the file on this and showed the affidavits to the members. She stated that the Public Hearing will be published in the paper, the property posted with a sign, and real property owners will receive a copy of the notice and it will also be posted in the lobby of City Hall. Mr. Siciliano questioned if there were other requirements to be met for this rezoning. Mr. Cochran stated that he felt if you are looking for industry and you have industrial property, you shouldn't put it back to residential, because then you don't get the industry. Mr. Wheeler stated that there is very little industrial property other than the FEC property, and if we keep rezoning it, where will industry be able to move in. There was a discussion on the FEC industrial development, and Mrs. Winks said that the engineers had said they would be coming in this month for Preliminary approval for the entire project. Mr. Landry asked about the updating of the Zoning Appendix. Mrs. Winks noted that it was in limbo because there haven't been any Workshop meetings of the Planning and Zoning Commission, because of the lack of members. Mr. S:iciliano.mentioned that the Planning Commission is reviewing Zero Lot Lines and feels that this is a Zoning matter, not a Planning matter. Mrs. Winks stated that the duties of each Commission are listed in Sections 14-31 and 14-32 of the Edgewater Code Book (pagesl134 and 1135). Mr. Siciliano stated that the Zoning Commission should go over the Zoning Ordinance. He requested copies of the proposed Omnibus Ordinance and copies of the Workshop work for all the members. Mrs. Winks also noted that the Zoning Commission was working on annexation of property south of the City, east of US 1 to the river and west of US 1 to Cow Creek Road, south to Adams Road. The Planning Commission was asked to help in this work. .~ ~ ~o Mr. Siciliano stated that we would wait and see what the changes to the Zero Lot Lines section would be. Mrs. Winks noted that the proposed changes have already gone to Council, and authorization has been given to the City Attorney to draw up the Ordinance. She noted the changes to Items 1 and 5 of Section 718.00 in answer to Mr. Wheeler's question. Mr. Siciliano feels that this is not under the jurisdiction of the Planning Commission to recommend zoning changes to the Council, it should be the Zoning Commission. Mr. Cochran agreed. Mr. Siciliano feels that the Powers and Duties should be straightened out and taken to Council. Mr. Siciliano stated that residential as a permitted use should be taken out of the business and industrial zoning. Mr. Garthwaite, a member of Board of Adjustment, noted that multi-family is a special exception in the business districts. Mr. Siciliano would like to hold a workshop-type meeting at the regular meetings when there isn't alot of zoning applications. Starting at the next meeting, the Zoning appendix can start to be reviewed. Mr. Siciliano said he would see what work has already been done and plan an agenda to follow for this work. There was a discussion on the annexation work that had previously been done. The Fong/Rankin property annexation was discussed. NEW BUSINESS Mr. Landry questioned if there was a specific time period that the Zoning Commission had to act on rezoning applications. Mrs. Winks stated it was 30 days. Moved by Mr. Landry, to set up a committee to screen rezoning applications before action is taken on them. Mr. Cochran seconded this for discussion. Mr. Siciliano stated that he understands that there really isn't enough time to investigate all aspects of a rezoning, from the time you pick up the packet to the next meeting. Mr. Landry feels that a group looking at the property would be more beneficial than each individual looking at it by themselves. Mr. Stewart suggested that at the first meeting, find out what needs to be looked intol and pick three members to investigate it. Mr. Siciliano questioned whether this would be a violation of the Sunshine Law. Mr. Cochran stated that the meeting could be continued to the following day and held at the property for discussion. Mr. Siciliano stated that if there are any doubts about a rezoning, it should be tabled and looked into further. Mr. Siciliano suggested that if there is a question on a rezoning, a Committee be set up at the meeting and a date set when this Committee will go and look at the property, then this would be public. Mr. Cochran seconded the above motion. Mr. Siciliano suggested adding the words "when necessarY"ito the motion. Mr. Cochran suggested that it be either a Committee of three or the whole Commission. Mr. Landry stated that this should be added to the motion. Upon roll call the motion CARRIED 4-1. Mr. Wheeler voted NO. Mr. Garthwaite questioned what an "interior" side yard setback is in the B-3 zone. Mr. Siciliano stated that he believes it means between two buildings on the same lot, there would be ten feet from one building to their side yard and then ten feet from this line to the next building. Mr. Garthwaite questioned what the word "way" meant under definition of "Building, front of:". Mr. Cochran stated that it would be a "way" serving the building. Mr. Garthwaite noted that this was in reference to the professional plaza being built on US 1 where the two buildin~face each other. The meeting was adjourned at 8:19 PM.
