ZONING COMMISSION MEETING
APRIL 26, 1982, 7 :00 PM
CHAIRMAN VANZIN CALLED THE MEETING TO ORDER AT"7:04 P.M. IN THE CONFERENCE
AREA OF THE COMMUNITY CENTER.
ROLL CALL
MEMBERS PRESENT: MESSRS. VANZIN. LANDRY, SLANEY. GAFFNEY, PETTY, MRS.
GRIFFITH. ALSO PRESENT: MR. NOLAN, PLANNING COMMISSION CHAIRMAN.
APPROVAL OF MINUTES
MRS. GRIFFITH MOTIONED TO APPROVE THE MINUTES OF APRIL 12, 1982, WHICH
WAS SECONDED BY MR. LANDRY. THE MOTION CARRIED 5-0.
COMMUNICATIONS
CHAIRMAN VANZIN REQUESTED MR. NOLAN OF THE PLANNING COMMISSION TO REVIEW
THE EDITED VERSION OF THE LANDSCAPE ORDINANCE FROM THE ATTORNEY. MR.
GAFFNEY QUESTIONED THE 10 FOOT BUFFER AREA REQUIREMENT IN SECTION 3. AND
STATED HE WOULD FILE A CONFLICT OF INTEREST FORM BECAUSE OF A RECENT
SITE PLAN HE HAD SUBMITTED TO THE PLANNING COMMISSION. A LENGTHY
DISCUSSION CONCERNING THE BUFFER AREA FOLLOWED AND IT WAS THE CONSENSUS
OF THE BOARD TEN FEET WAS TOO MUCH OF A REQUIREMENT.
MR. GAFFNEY MOTIONED TO RECOMMEND SECTION 3 (A,) BE CHANGED TO A 5 FOOT
BUFFER REQUIREMENT INSTEAD OF 10 FEET. WHICH WAS SECONDED BY MRS. GRIFFITH.
THE MOTION CARRIED 5-0.
AFTER FURTHER DISCUSSION, MRS. GRIFFITH MOTIONED THE LANDSCAPE ORDINANCE
SHOULD CLEARLY STATE WHAT ZONING DISTRICTS ARE ~FECTED (INDUSTRIAL. ~
COMMERCIAL AND MULTI-FAMILY). MR. LANDRY SECONDED THE MOTION, WHICH
CARRIED 5-0.

THE BOARD NOTED SECTION 5/.REG-\RD1-N-G EXISTING BUILDINGS COMPLIANCE WITH
THE ORDINANCE) HAD BEEN ADDED SINCE THE FIRST DRAFT. MR. SLANEY FELT THIS
REQUIREMENT WOULD PLACE A HARDSHIP ON EXISTING DEVELOPMENTS. MR. PHINNEY.
FROM THE AUDIENCE STATED THE SIGN ORDINANCE WAS RETROACTIVE WITH A TIME
REQUIREMENT OR CHANGE OF OWNERSHIP. MR. HOLAHAN, ALSO FROM THE AUDIENCE,
FELT IT WOULD BE IN VIOLATION OF EXISTING OWNERS RIGHTS AND SUGGESTED AN
URBAN RENEWAL PROGRAM TO BEAUTIFY U.S. 1.
~ MR. LANDRY MOTIONED TO ACCEPT THE ORDINAN~E AS DRAFTED. WITH THE EXCEPTIONS
}t~AS RECOMMENDED ABOVE, AND ADD 36 MONTHS TO SECTION 5 FOR COMPLIANCE.
'MRS. GRIFFITH SECONDED THE MOTION. UPON ROLL CALL THE MOTION CARRIED 4-1.

THE LETTER FROM THE CITY MANAGER CONCERNING THE RECREATION TASK FORCE WAS 1
NOTED FOR INFORMATION PURPOSES. ~
OLD BUSINESS
REZONING OF PARK AVENUE FROM I-I & MH-l
THE RESULTS OF THE MEETING WITH SEVERAL RESIDENTS OF THE WILDWOOD SUBDIVISION
WERE SUMMARIZED BY THE CITY MANAGER IN HIS LETTER OF APRIL 23RD. THE RE~
ZONING REQUEST IS THE RESULT OF A MULTI-FAMILY DEVELOPMENT OFF PARK AVENUE
NEAR CAROL ANN DRIVE. THE RECOMMENDATIONS INCLUDED THE MH-l PORTION BETWEEN
THE MULTI-FAMILY DEVELOPMENT EASTWARD TO MANGO TREE DRIVE BE ZONED I-I; THAT
A 200 FT. STRIP FROM PARK AVE. BE ZONED B-2 AND THE REMAINDER R-2A; AND
THE BALANCE R-2A OR R-4.
~~MR. GAFFNEY MOTIONED TO APPROVE THE "ZONING RECOMMENDATIONS TO COUNCIL AS
~~IDETAILED BY THE CITY MANAGER IN HIS LETTER OF APRIL 23RD, PROVIDED THE
. REZONING REQUEST IS APPROVED AFTER THE PUBLIC HEARING TO R-4. MRS. GRIFFITH
SECONDED THE MOTION. UPON ROLL CALL THE MOTION CARRIED 5-0.

ANNEXATION OF PROPERTY EAST/WEST OF U.S. 1 SOUTH TO AOAMS ROAO
As REQUESTED AT THE LAST MEETING, MRS. GRIFFITH OBTAINED A CURRENT TAX
ROLL AND MR. SLANEY DISTRIBUTED STREET MAPS. AFTER VIEWING THE PROPERTY
IN QUESTION THE BOARD FELT THE PROJECT WAS TOO LARGE FOR THEIR MEMBERS
ALONE.
MRS. GRIFFITH MOTIONED TO HAVE THE PLANNING COMMISSION ASSIST THE ZONING
COMMISSION IN THEIR EFFORTS TOWARD ANNEXATION, WHICH WAS SECONDED BY
MR. SLANEY. THE MOTION CARRIED 5-0.
MR. NOLAN, CHAIRMAN OF THE PLANNING COMMISSION INDICATED THEY WOULD BE
HAPPY TO HELP OBTAIN THE PROPER PETITION FORMS AND SEEK QUALIFIED PEOPLE
TO APPROACH THE OWNERS OF THE PROPERTY.
THE COMMISSION SEPARATED THE PROJECT INTO THREE AREAS: (1) EAST AND WEST OF
U.S. 1, THE RIVER TO ARBOR LANE, EXCLUDING WASHINGTON PARK SUBDIVISION,
(2) PARK AVENUE TO MISSION ROAD TO HIGHWAY 442, AND (3) HIGHWAY 442 TO COW
CREEK ROAD TO VOLCO ROAD. MR. GAFFNEY VOLUNTEERED TO OBTAIN THE NAMES AND
ADDRESSES OF THOSE EAST OF U.S. 1 AND MRS. GRIFFITH OF THOSE WEST OF U.S. 1.
MR. HOLAHAN QUESTIONED A CONFLICT OF INTEREST SINCE MR. GAFFNEY AND MRS.
GRIFFITH ARE BOTH LICENSED REALTORS, AND PERSONAL CONTACTS COULD RESULT
IN MONETARY GAIN. IT WAS STATED THE CITY ATTORNEY SHOULD CLARIFY THIS
MATTER.
MR. SLANEY MOTIONED TO MOVE FORWARD WITH PHASE A AS DESCRIBED BEFORE
TACKLING PHASE B, WHICH WAS SECONDED BY MR. GAFFNEY. THE MOTION CARRIED 5-0.
THE MEETING WAS ADJOURNED AT 8:30 P.M.
