Zoning Commission Meeting Minutes
March 22, 1982
Chairman Vanzin called the meeting to order at 7:06 PM in the conference
area of the Community Center.
ROLL CALL
Members present: Messrs. Vanzin, Landry, Gaffney, Slaney, Petty, Mrs.
Griffith. Also present: City Attorney, Mr. Clay Henderson, Mrs. McCann,
Mrs. Winks.
APPROVAL OF MINUTES
In reference to the paragraph on Landscape and Tree Ordinances in the
March 8, 1982 minutes, Mr. Henderson requested that it be noted in these
minutes that he was directed by the Zoning and Planning Commissions to pre-
pare an ordinance similar to that of New Smyrna Beach, and it was not a
proposal or recommendation from his office.
Moved by Mrs. Griffith, seconded by Mr. Landry, and CARRIED 5-0, to approve
the minutes of 3/8/82 as corrected.
Rezoning Request - C.W.W. Construction Co., 35 Unit Apartment Multi-Family
Project, 620 W. Park Ave, Zoned I-I and MH-l
Mr. George Cook, President of C.W.W. Construction Co. was present to discuss
his request. Also present was Mr. C. H. Fudge, C.W.W. Construction Co., and
the present owners of the subject property, Mr. and Mrs. E. C. Dunning.
Mr. Cook stated that they are proposing a 35 unit multi-family apartment
complex, each unit will be at least 750 square feet and the complex will
cover 14% of the total land area. Mr. Henderson questioned the adjoining
land uses. Mr. Cook explained that the Dunning residence is on the subject
property, and there is vacant land to the east and west. Mr. Cook also
explained that this complex is not government subsidized, but they will
receive interest relief through the government on the 50 year mortgage;
this allows the rent to be arpund $210 per month. Several other areas in
Edgewater have been looked into for this complex, but it is difficult finding
an area not in the flood plane. Spot zoning was discussed and the develo~er
felt that a rezoning of this property would upgrade the area and would '.
benefit the public.
Moved by Mrs. Griffith to rezone the subject property and west to Wildwood
to R-4 from I-I and MH-l. The motion DIED for the lack of a second.
Moved by Mr. Gaffney to refuse this application as there are other possible
alternate sites for this type of complex without changing an I-I district.
The motion DIED for the lack of a second.
Moved by Mr. Slaney to rezone the MH-l area on the east side of the subject
property I-I and rezone the subject property and the property to the west
to Wildwood R-4. The motion DIED for the lack of a second.
Mr. Cook asked that their application stand on its own merit and not be
included in other rezoning.
Mr. Slaney made a substitute motion, seconded by Mr. Landry, and CARRIED 4-1,
to recommend to Council that the subject property be rezoned to R-4 from MH-l
and I-I. Mr. Gaffney voted NO.
Moved by Mr. Landry, seconded by Mr. Gaffney, and CARRIED 3-2, to reconsider
the vote on the previous motion. Messrs. Slaney and Vanzin voted NO.
Moved by Mr. Slaney to recommend to Council that the subject property be
rezoned R-4 from MH-l and I-I. The motion DIED for the lack of a second.

Moved by Mr. Gaffney, seconded by Mr. Slaney, and CARRIED 5-0, to recommend
to Council that the subject property be rezoned R-4 from MH-l and I-l.
Also to recommend to Council that the portion of the property zoned MH-l
from the east line of the subject property to Mango Tree be rezoned I-l.
The meeting was adjourned at 8:35 PM.
