03-30-1981 Public Hearing l.J q CITY OF EDGEWATER ZONING BOARD PUBLIC HEARING March 31, 1981 CALL TO ORDER Chairman James Mackie called the public hearing of the Zoning Board of the City of Edgewater to order at 7:00 P.M. in the conference room. Wheeler Ray Troian James Dyett Present Present Present Present Present Absent Also present: City Attorney Clay Henderson; City Clerk Nancy Blazi The purpose of the public hearing was to discuss the application for subdivision and a variance within a subdivision for Jaketta, Inc. for Villa Verde South Townhomes, located at Boston Road and Riverside Dr. It was stated the ajoining property owners had been sent notice of the public hearing, however they were not present at the meeting. Mr. Paul Katz, attorney for Jaketta, Inc. was present and said he had conferred with the City Attorney concerning the project. He stated an exception to the subdivision would be more appropriate than a variance since there were many items not applicable. City Attorney Clay Henderson said in researching the matter found the R-4 zoning restrictions and the subdivision ordinance was in conflict (Article 10 (B) Exceptions, page 1736). Mr. Henderson felt the projec- was in compliance with the comprehensive plan and the board had the authority to accept the project under the subdivision ordinance, now that a public hearing had been held. There was further discussion by the board members concerning the private driveway which would be maintained by the homeowners association. It was the consensus of 'opinion of the board members that the developer had tried to comply with all of the R-4 restrictions and comply with the subdivision ordinance and the project could be of benefit to the City. Mr. Phinney pointed out to the board that the Council should be aware that the ordinance should be brought up to date to reflect the current building trends. Mr. Mackie asked if there were.any further comments from the board members or the audience and there were none. Mr. Wheeler made a motion to declare the public hearing completed and Mr. Wallace seconded the motion. The motion CARRIED 5-0. Mr. Troian made a motion to except the Villa Verde development from the requirements of the subdivision ordinance and Mr. Wheeler seconded the motion. The motion CARRIED 5-0. Mr. Troian made a motion to approve the final plat plan and refer this to the City Council, which was seconded by Mr. Wallace. Upon roll call the motion CARRIED 5-0.
