03-12-1981 Special . o u CITY OF EDGEWATER ZONING BOARD SPECIAL MEETING March 12, 1981 CALL TO ORDER Chairman James Mackie called the Special Meeting of the Board to order at 7:00 P.M. in the Conference Room. APPROVAL OF MINUTES Mr. Troian made a motion to accept the minutes of the regular meeting of February 3, 1981 and Mr. Wheeler seconded the motion. The motion CARRIED 5-0. Mr. Wheeler made a motion to accept the minutes of the special meeting of February 25th and Mr. Dyett seconded the motion. The motion CARRIED 5-0. PRELIMINARY SITE PLANS Villa Verde South Townhomes - The site plans for this project were reviewed and the comments from the various departments were read. The letter from Briley, wild and Associates was read regarding their recommendations. Mr. Parker, Engineer with Zev Cohen and Associates, was present and the Board questioned him on various matters. The City Attorney stated the drawings were a replat and therefore would be considered a major subdivision, since the land would be divided into fifteen units and sold fee simple. Mr. Parker stated this had been designed according to the R-4 zoning. There was further discussion regarding the townhouse design of the units with common walls. The R-4 zoning allowing multi-family , dwellings and the steps to be taken for a maj or subdivision were. Teviewed. 'lIt was: stated -0 a'. public.:.hea~ing would have :to be:_held. Mrs. .. Kane, owner of. the property, stated she had contacted the City Planner in October of last year regarding the zoning of the property and nothing was stated at the time regarding being a sub- division, so consequently the plans were designed for R-4 zoning. She further stated that the development would not be applicable to a major subdivision in most respects. v Rezoning to R-5 and other possible alternatives with variances was d1scussed since this did create a hardship. The fact there had been a ohange in the City Planners was also discussed. Mr. Phinney made a motion to have the City Clerk advertise for a public hearing on Tuesday, March 31, 1981 at 7:00 P.M. for a variance to the subdivision ordinance for the Villa Verde project and at 8:00 P.M. have a public hearing for the final plat approval, conditioned upon the applicant filing the proper forms and tendering the proper fee. Mr. Troian seconded the motion. The motion CARRIED 6-0. o o A short recess was called. Hermosa Palms Condominiums - The site plans for this project were reviewed and the comments were read from the various departments. There was a discussion regarding the project being four stories in height and the City Attorney questioned if this would be a problem with the Comprehensive Plan. Mr. Mackie read a letter from the Fire Department regarding their equipment only being adequate for two stories, or 24 feet. The project representative, Mr. Sander, stated provisions had been met for fire prevention through cement walls, etc. There was a lengthy discussion regarding part of the property being in the B-3 zone and part being in the R-5 zone. Rezoning of the B-3 to allow condominiums was discussed, however this would apparently be "spot zoning", and would be in conflict with the Comprehensive Plan. The Board discussed rezoning versus various alternatives for the project, such as redesign. It was the concensus of opinion of the Board that the project should make application for rezoning. The City Attorney said there were several options available to the project: (a) build under the R-5 specifications, except the front 200 ft. and seek a variance from the Board of Adjustments to build R-4 in that area; (b) build a condominium in the back and a shopping center in the front; (c) seek an amendment to the ordinance which created the R-4 in the B-3 zone to allow R-5 specifications; and (d) apply to have the front 200 ft. on the highway to R-5. He further stated at any event it would require a public hearing. The subject was left to the builder to decide what option he wished to pursue before the Board could take any further action. COMMUNICATIONS Mr. Frank Hall had requested to address the Board, however he had not arrived at the meeting.
