ZONING BOARD REGULAR MEETING
February 3, 1981
Chairroall. James Mackie called the regular meeting of the Zoning
Board to order at 7:00 P.M. in the Edgewater City Hall.

APPROVU OF MINUTES
There was a brief discussion regarding flea markets on the
previous minutes, concerning the Council workshops held during
January, which were pertaining to the fees and licenses required
for both the City and County.
Mr. Phinney made a motion to accept the minutes of the regular meeting
of January 6th and Mr. Wallace seconded the motion.
Upon roll 'call the motion CARRIED 4-1. Mr. Wheeler voted NO because
he was excused from that meeting.
NEW BUSINESS
Combining the Planning and Zoning Boards
Mr. Macino and Mr. Nolan, members of the Planning Board, were
present to discuss the proposed combination of the Planning and
Zoning Boards, provided this is a requirement of the Comprehensiv~
Plan.
Mr. Macino stated the first public hearing on the subject was held
on February 2nd and he had suggested that four members from the
Planning Board and four members from the Zoning Board be appointed,
along with one outside member.
Mr. Nolan said he felt now is not the proper time for the combination
of these boards since the Zoning Board is not familar with the
pending Comprehensive Plan at this point.
There was further discussion regarding joint meetings of the Boards
and it was recommended both boards send a letter to the Council
stating their feelings to keep the boards separate and perhaps
meeting jointly occasionally. It was further suggested the chairmen
receive minutes of the other board's meetings.
It was noted there was a Council workshop with the Planning Board
on February 17th at 1:00 P.M. to discuss the Comprehensive Plan,
along with a public hearing on February 23rd at 7:00 P.M. It
was a mutual feeling to have a public hearing of the joint boards
on February 25th at 7:00 P.M., with the hopes of keeping the boards
separate at this time, since the Comprehensive Plan still must be
implemented after adopted. The City Clerk was asked to invite the
City Attorney, and advertise for the public hearing.
The City Clerk was also asked to write a letter to the Mayor and
City Council notifying them of the proposed joint Board public
hearing on February 25th for the purpose of discussing the
combination of these boards.

Wagner Zoning Request
Mr. Wagner was present at the meeting and asked the Board if
he could build two ,story office/apartments on certain lots he
was proposing to purchase.
There was a discussion regarding the B-3 zoning requirements for
height restrictions. It was the concensus of opinion Mr. Wagner
would have to go to the Board of Adjustments for multi-family
dwellings, however there would be no problem with the office portion.
Mr. Mackie suggested Mr. Wagner bring in a sketch as a preliminary
drawing for the board to look at. He also suggested Mr. Wagner
contact the Sewer and Water Department for a preliminary opinion.
OLD BUSINESS
Zero Lot Lines
Mr. Mackie and Mr. Wallace presented the plans used by New Smyrna
Beach.
Mr. Wallace stated their plan has been in effect since in the
early 70's and have been improving on it ever since. Setback
requirements were discussed concerning single or multiple owner-
ship and building in phases.
The selling of duplexes separately under fee simple was also
discussed. It was stated the lending institutions were approving
the sale of these units separately using zero lot lines without
any problems. This is not covered in the present Edgewater
ordinances.
A workshop with the City Attorney was suggested for February 12th
at 1:00 P.M. The City Clerk was asked to invite Mr. Bob Ferrin
of New Smyrna Beach.
Horne Occupational Licenses
This was previously referred to the Council and sent back to the
Zoning Board. The problem is 75% of the licenses are issued to
sub-contractors, which is not a home occupation. The telephone
company is billing some businesses as commercial. Enforcement of
the licenses is the major problem. Categories for home occupations
were discussed.
There was a lengthy discussion regarding the person responsible
for enforcing the violations or eliminating the home occupational
licenses except the categories approved.
Mr. Troian made a motion to recommend to the City Council that the
only solution for the problem of Horne Occupational Licenses is
that the City hire an inspector specifically to police all licenses
in the City of Edgewater, including sign permits and home
occupational licenses. Mr. Wheeler seconded the motion.
Upon roll call the motion CARRIED 5-0.
There was no further business and the meeting was adjourned.
