CITY OF EDGEWATER ZONING BOARD SPECIAL MEETING December 9, 1980 Chairman James Mackie called the special meeting of the Zoning Board to order at 7:00 P.M. in the Edgewater City Hall. ROLL CALL James Mackie Sebastian Siciliano Earl Wallace William Phinney M. F. Wheeler Ray Troian James Dyett Present Present Present Present Present Present Excused Also Present: Nancy F. Blazi, City Clerk The purpose of the special meeting was to discuss the following: Outdoor Displays Mr. Siciliano stated at the present time outdoor displays are only allowed in B-3 zones under special exceptions. The Board discussed the difference between "flea markets" and outdoor displays and the enforcement of these sales. '-, The City Clerk stated the Police Department does not enforce the zoning laws. There was further discussion concerning the Code Enforcement Board. Mr. Phinney made a motion to table this outside display review until the first meeting after the establishment of the Code Enforcement Board. Mr. Wallace seconded the motion. Mr. Mackie stated he felt the Board would be established. Upon roll call the motion CARRIED 5-1. Mr. Mackie voted NO. Flea Markets Mr. Mackie presented a copy of the Port Orange zoning book and the County zoning ordinance. Sections concerning flea markets were discussed. Fees and restrictions for flea markets in other cities were reviewed, however more detailed information was needed before a recommendation could be made. Mr. Troian made a motion to approve the City Clerk research license fee structures from other cities having flea markets. Mr. Phinney seconded the motion. Upon roll call the motion CARRIED 6-0. Mr. Siciliano made a motion to recommend flea markets as a permitted use in B-3 with the following conditions: (1) They operate only on Fridays, Saturdays, Sundays and legal holidays, from the hours of 7:00 A.M. to 5:00 P.M. (2) Adequate refuse containers are provided. (3) The area is completely clear of litter and other refuse after each day of operation. , ~ u (4) The minimum lot size be one (1) acre. (5) They contain at least three off-street parking spaces, ten feet by twenty feet in size, for each rental space or structure; all parking areas to have a hard, stabilized, but not necessarily paved, surface. (6) They do not offer for sale: automobiles, motorcycles, water- craft or any type of personal services, or any item which is prohibited by local, state or federal law. (7) All merchandise displayed or offered for sale shall be removed from the premise at the end of each day. (8) They provide no more than one permanent advertising sign, and no more than two removable advertising signs displayed during actual operation. (Signs must comply with sign ordinance.) (9) A sketch plan demonstrating compliance with these requirements is submitted at the time of application. (10) A letter stating compliance with applicable Health Department regulations is submitted at the time of application. Mr. Wheeler seconded the motion. Upon roll call the motion CARRIED 6-0. Pilch Site Plan The Board reviewed the Pilch site plans for a commercial building. Mr. Phinney made a motion to approve the site plans, subject to approval by the Fire Department. Mr. Wheeler seconded the motion. Upon roll call the motion CARRIED 6-0. Home Occupational Licenses The issuance and enforcement of regulations governing home occupational licenses was discussed, as well as the penalties imposed for not obtaining a license. Mr. Sargeant spoke on the City Council granting licenses without thought to the impact caused on neighborhoods and without enforcement there are many violations of the original requests for licenses. A letter was presented from City Attorney Woods suggesting the limitation of permitted uses to control the issuance of the home occupational licenses. Mr. Phinney made a motion that since the Zoning Board is at a standstill for a recommendation mainly because of the lack of enforcement procedures, the request for home occupational licenses be returned to the Council. Mr. Troian seconded the motion. Mr. Sargeant said his original letter recommended the enforcement of these licenses be tightened. Mr. Phinney suggested the ordinance could be revised and insist on enforcement. Mr. Siciliano suggested revising the ordinance and limiting the. categories. Upon further discussion Mr. Phinney withdrew his motion and Mr. Troian withdrew his second. Mr. Troian made a motion to table this matter until the next regular meeting and Mr. Wheeler seconded the motion. Upon roll call the motion CARRIED 6-0. Upon roll call the motion CARRIED 6-0. BOARD COMMENTS Mr. Phinney made a motion to hold the regular meetings of the Zoning Board at 7:00 P.M. instead of 7:30 P.M. Mr. Wheeler seconded the motion. There was a brief discussion by the Board members concerning the time change. Upon roll call the motion CARRIED 6-0.
