Mr. Opal said that the minutes did not include everything that had transpired at the last meeting was not included in the minutes. Mrs. Blazi said that they were trying to cut down some on the length of the typed minutes but she believed that all pertinent information had been put into the minutes. Mr. Opal said that the most important part of the meeting had been missed. Mrs. Blazi asked what Mr. Opal was referring to. Mr. Opal said that Mrs. Blazi should know because she had the tapes. Mr. Mackie said that if Mr. Opal wanted something inserted in the minutes he would have to let the secretary know what he was referring to. Mr. Opal said he was referring to the discussion the Board had. Mr. Mackie asked if Mr. Opal was referring to the arguement the Board had pertaining to what was in the newspaper. Mrs. Blazi said that the minutes referred to the discussion concerning the charges brought against the Board and that the members were disturbed about the fact that some members may not be aware of what was going on at the meetings. There was a long discussion on this but the conclusion was that the Board did not know why the charges were made. A verbatim transcript was not requested. Mr. Mackie said that he had to agree with the secretary because if you read the minutes it states that a motion was made to discuss the charges. After the discussion, the Board decided that everything was in order and they dropped the whole issue. Mr. Opal said that there was a motion made and seconded. Mr. Mackie asked what the motion pertained to. Mr. Opal said to go back to the tapes and check it out. Mr. Mackie said that he felt the secretary had too much work to be spending time listening to tapes of past meetings. If Mr. Opal would tell the Board what he was referring to then they could check it out. Mr. Opal said that there was a motion and the vote was 3-3. Mrs. Blazi asked if this was in connection with the motion to discuss the charges. She was under the impression that the vote was unanimous to discuss the charges. o o Mr. Opal said that yes that was but there was another motion that followed it. Mr. Mackie asked what that motion was. Mr. Opal said he did not know offhand but he knows there was a vote taken and then we went into the normal business. Mrs. Blazi said that Mr. Mackie asked each Board member how they felt about these charges. She did not think there was a motion on that. Mr. Mackie said that the minutes state that each member said they did not know why these charges were made. Mr. Opal said that there was another vote taken. Mr. Mackie said that all Board members in favor of accepting the minutes with the stipulation that Mr. Opal's question on another vote be checked out. All the members indicated that they were in favor of accepting the minutes. Mr. Mackie said that the record should show that all members were in favor of accepting the minutes with the correction. Mrs. Blazi said that she was still not sure what Mr. Opal was referring to. Mr. Mackie said that he did not know either but he would like the tapes checked when the secretary could find the time. Mr. and Mrs. Somnitz requested to speak to the Board concerning some property they owned in Edgewater. They own the Azalea Motel and have their private residence at the rear of the property. They would like to sell the motel but keep their private residence and they wanted to know whether they could do this and what setbacks might be required for their private residence. They have owned this property since before the Zoning Ordinance went into effect. The Board studied a drawing of the property. There fire several buildings on the property and a pump house that is no longer in use. Mr. Mackie said that possibly this might be a problem for the Board of Adjustment. They might be able to give a variance on the setbacks even though there will be no buildings added. The print that the Board has to study is not too clear and they would need something more concrete and where the property lines would be before any decision is made. Mr. Engle made a motion that the Zoning Board table this until they can get more detailed information. Mr. Wheeler seconded the motion. Upon roll call the motion CARRIED 7-0. Belmont Homes had requested to be put on the agenda. However, there was no representative there from Belmont Homes. Mr. Mackie said that he would like to discuss the FPL property that the Board had originally requested be zoned R-4. The Council rejected this. The Boar,d'then~recommended that this larea be changed~.to"I-l with _.......~__. electrical substations as a special exception. This was accepted by the Council and they will hold a public hearing on this. In reference to the site plan approval the City Attorney had questioned why the Board was requesting an ordinance on this when they already had this power under Section 715.02 of the Code. Mrs. Blazi said that she had talked with the City Attorney and he~ questioned wht the Board had requested site plan approval in the - multi~family zones, comm~rcial and industrial zones. He thought they already Bad 'thata~thority under the.Code.'" ' Mr. Siciliano said that this is still not clear. Obviously> everyone has always thought that the site plan approval concerned rezoning. 2 o (,) The Board discussed 715.02 that appears to give site plan approval authority to the Boards. Mr. Siciliano made a motion that the Zoning Board have the secretary (Mrs. Blazi) check with the City Attorney to see if his interpretation agrees with the Zoning Board. If he agrees, then they should rescind the request for site plan approval to the Council and also have the Board Chairman write to the Building Official stating that this section should be complied with in its entirety (715.01 and 715.02). Mr. Troian seconded the motion. Mr. Siciliano added that if the City Attorney did not agree that the Boards already have this authority then the request to the Council for site plan approval should be followed up. Mr. Troian said that he would accept this addition and second it. Upon roll call the motion CARRIED 7-0. Mr. Mackie asked if any of the members wanted to bring up any of the zoning request amendments that the Council tabled at the Public Hearing. The Board went over the list of requested zoning changes.tabled by Council. No. 3 - zoning of School, Cemetary and Church No. 4 - deleting Agriculture Districts No. S - changing maximum height restrictions No. 11- adding public schools as special exception The question was raised on whether or not residences could be built in industrial areas. Originally, the Zoning Board had discussed Ordinances 922, 925 and 926 which,make residences permitted in the commercial areas and also what is permitted in commercial areas can be permitted in industrial areas as a special exception. Mr. Siciliano said that permitted uses in the Commercial zones are allowed in the Industrial zones under Special Exception. The Zoning Board members asked if they could have copies of the new Municipal Code Book. r: 'The Zoning Board had originally planned to request repealing 922 and, i~ 925. However, the Public Hear-ing-advertised only the changes in B-2 B-3, B-4 and B-6 to add multi-family as special exception in these zoning districts (#12 on list for Public Hearing (Nov. 19, 1979). The Board discussed the Comprehensive Plan and Land Use Map. There are some existing areas that would be in conflict with the Comprehensive Plan. Mr. Hurley, City Planner, stated that technically the Comprehensive Plan and the Land Use Map are supposed to agree. Once the plan is passed, ordinances must be passed that will affect zoning, planning, building codes, etc. Mr. Siciliano said that hypothetically speaking for example, Highway B-3 zoning should be all Highway business, but there is a great deal of the B-3 area that is residential. Would the Comprehensive Plan change this? Would this put these people out of their homes? Mr. Hurley said the plan is very general, the changes would be gradual as specific ordinances are passed and present ordinances are updated. The City Planner will review the recommended zoning changes and items tabled by the Council, specifically Public School, Cemetery and Church zoning and report back to the Zoning Board. ~, The Zoning Board discussed the possibility of creating another zoning district. - 3 - . . Q o Mr. Mackie told the Board that on January 17th there would be a joint meeting between the Planning, Zoning and the Industrial Boards. This is to discuss the area owned by F.E.C. and the proposed road into that area to open up this part of the City possibly for Industrial development. Mr. Opal asked about the Massey property. Mr. Siciliano said that the proposed road did not affect Mrs. Massey's property. He believes it is located in the 1-1 area along Park Avenue. The Board next discussed the height restrictions they had recommended to the Council. The Board would like some recommendations from the City Planner on height restrictions. Mr. Opal asked if the new warehouses Mr. Sullivan was building, was legal. Mr. Mackie said an Ordinance was passed making B-2 warehouses legal. Mr. Opal said that he opposed to thi s at the t-ime, as the shops were there illegally. He asked that the minutes be checked for this information.' Mr. Siciliano made a motion that the Board Secretary check on the minutes on warehouses for the next meeting. Mr. Engle seconded the motion. The motion CARRIED 7-0. Mr. Opal asked about the time Mr. Sullivan came before the Board. Mr. Mackie said we told him he needed a sketch plan and he did not bring anything back. Mr. Engle made a motion to adjourn.
