02-06-1979 ~ <.) CITY OF EDGEWATER ZONING BOARD REGULAR MEETING February 6, 1979 Chairman Mackie called the regular meeting of the Zoning Board to order at 7:31 P.M. in City Hall. Wheel er John Gross, Sr. Clair Bowser Present Present Present Present Present Present Present Richard Diamond, City Planner Also Present: Present Mr. Mackay Mr. Asting Mr. Poland Mr. and Mrs. Loescher Mrs. Murphy Mr. Shira APPROVAL OF MINUTES Mr. Siciliano made a motion that the Zoning Board approve the minutes of the January 2, 1979 Regular Meeting and the January 9, 1979, Special Meeting. Mr. Wheeler seconded the motion. The motion CARRIED 7-0. HOME OCCUPATION LICENSES The Board discussed Ordinance 972 which deals with requirements for Home Occupational licenses. Mr. Siciliano said that he felt the section on woodworking equipment, jigsaws, etc. should be deleted from the ordinance. This equipment is alright for hobbies but that type of a business should not be permitted in residential areas. Mr. Siciliano made a motion that the Board hold a workshop to study this ordinance so that they could make recommendations to the Council for any changes the Board might feel would strengthen this ordinance. Mr. Opal seconded the motion. The motion CARRIED 7-0. The Board agreed to set up the workshop on February 13, 1979 at 1:30 P.M. PUD - Public Hearing Mr. Diamond discussed the letters that had been received from Mr. Caldwell, owner of the property in question, concerning the Public Hearing to rezone the property. Mr.Caldwell stated that he had not applied for extensions of the PUD zoning because he had received a letter from Mr. Dale Bryant, then City Manager, telling him'that it was not necessary to apply for yearly extensions. The City Attorney has advised the Zoning Board that due to the fact the PUD zoning had expired, the area should be zoned back to its original zoning before the Board considers the property as a planned urban development area. The Zoning Board has scheduled a Public Hearing on February 20, 1979 at 7:30 P.M. to discuss this problem. However, in view of the letter from a former Edgewater City Manager, the Zoning Board has questions about whether this letter has obligated the City to retain the PUD zoning and if they can legally go ahead and rezone this area. , G ~ T Mr. Opal made a answer from the this property. It was decided that the Board should hold a Special Meeting before the Workshop on February, 13, 1979, in the event that is was necessary to take some action before the Public Hearing. Mr. Engle made a motion that the Zoning Board request that the City Attorney be present at this Special Meeting. Mr. Wheeler seconded the motion. The motion CARRIED 7-0. INDUSTRIAL DEVELOPMENT BOARD The Board discussed the establishment of an Induatrial Development Board. Mr. Siciliano said that he was in favor of such a Board and that it should be established soon in order to work with the Planning Board regarding the development of industrial areas in the City. Mr. Opal felt that the establishment of such a Board at this time would be premature. The Comprehensive Plan should be completed before such a Board is established. Mr. Siciliano made a motion that the Zoning Board continue discussion of an Industrial Board at their Workshop Meeting on February 13, 1979. He added that the Board should invite Councilman Rotundo to that meeting to discuss his ideas on establishing an industrial board. Mr. Gross seconded the motion. The motion CARRIED 7-0. BY-LAWS The Board discussed new by-laws. Mr. Engle made a motion that the Zoning Board approve these revised by-laws. Mr. Siciliano seconded the motion. The motion CARRIED 7-0. Copies of these new by-laws will be prepared for presentation to the City Council for their approval. PUBLIC HEARING APPLICATIONS Mr. Mackay submitted an application requesting that the requirements in R-4 Multi-Family Zoning be changed to allow a three dwelling unit to be built on 15,000 sq. ft. Mr. Mackay explained to the Zoning Board that current circumstances allow for a 4 unit complex to be built on 4 adjacent lots and a duplex to be built on 2 adjacent lots but does not allow for ,a triplex to be built on 3 lots. He does not feel that this situation is logical or fair to owners of three lot parcels in Florida Shores Multi-Family Zoning area. The Board discussed this request particularly in regard to side yard setbacks. The Zoning Board will set a date for a Public Hearing on this request. Mr. Mackay will be notified when the Public Hearing will be held. Mr. Shira of Seahorse Mobile Home Park has filed an application for a Public Hearing to rezone the mobile home park from B-3 and R-3 to MH-IA. The Board discussed this application and informed Mr. Shira that if this area were rezoned to MH-1A, any changes within the park such as the removal of a trailer or the addition of trailers would have to conform to Ordinance 880 and might possibly result in a loss of revenue because fewer trailers would be allowed in the area. The Board will set a date for a Public Hearing and notify Mr. Shira. Mr. John Gross, Sr. was excused from the meeting at this time. Mr. James Poland has filed an application for a Public Hearing to have Service Stations A,B, & C and Wholesale Distribution of Parts added to B-1 as a Permitted Use. Mr. Poland pointed out that the area in question has had these type of businesses in operation for a number of years. These businesses have been grandfathered in but it would be difficult to sell these businesses unless they were added as permitted use. The Zoning Board will set up a Public Hearing and notify Mr. Poland. o ., Q <J i The Zoning Board considered an application from Mr. and Mrs. Loescher for a Special Exception to operate a used car lot. After discussion, by the Board, it was agreed that they would recommend that the Board of Adjustments grant this Special Exception. Mr. Siciliano made a motion that the Zoning Board recommend to the Board of Adjustments that this request for a Special Exception to operate a used car lot be granted. The number of parking and loading spaces must be considered and also it should be noted that no car repairs are to be allowed on the premises. Mr. Opal seconded the motion. The motion CARRIED 6-0. The Zoning Board considered an application by Mr. Weisenberger .for a Special Exception from the Board of Adjustments to change the zoning boundary line that separates his property between B-3 and R-3. Mr. Weisenberger has requested the entire property be zoned B-3. Mr. Diamond presented new information to the Zoning Board and a map that shows the property in question and where the possible boundary lines are located. It is obvious, from this map, that even if the line is moved within the 50ft. allowed it will not cover the entire property. Mr. Siciliano made a motion that the Zoning Board recommend that the Board of Adjustments DENY this request because regardless of where the line is, it will not cover the entire property and since this is primarily a residential neighborhood a B-3 zoning could impair the char.acter of the neighborhood. Mr. Opal seconded the motion. The motion CARRIED 6-0. .The Zoning Board discussed applications for licenses to operate a woodworking business in the 1-1 zoning area. There are two applications, one from Mr. Conlin and one from Mr. Bosworth. The Board discussed the possibility of making this type of business a permitted use in all the industrial zones. The Zoning Board will set up a Public Hearing and also consider what type of woodworking should be allowed in these industrial zones. Mr. Kent has filed an application for a Public Hearing to request that mini-warehouses be added as a permitted use in the B-2 zone. Mr. Diamond suggested that the Zoning Board consider a wholesale business district that would not generate a lot of traffic but would be a buffer between commercial and residential. Mr. Siciliano made a motion that the Board include a discussion of mini-warehouses in B-2 at the Workshop on Feb. 13, 1979. Mr. Engle seconded the motion. The motion CARRIED 6-0. This application will be set for a Public Hearing after the Board has had more time to study the problem. The Zoning Board discussed a review of Ordinance 880 to start preparations for a new zoning ordinance. Mr. Opal made a motion that the Zoning Board be given copies of Ordinance 219 to compare it with Ord. 880. Mr. Wheeler seconded the motion. The motion CARRIED 6-0. Mr. Diamond requested that this information, along with other information he has concerning zoning ordinances, be supplied when the Board actually starts work on a new ordinance. At the regular Zoning Board Meeting of January 2, 1979, the Board ~iscussed the possible addition of used cars and automobile sal~s as'a permitted use in B~3, The original intent of adding car sales as a special exception was to control this type of -business. "The Board belt~ves that some type of control is necessary. Mr. Wheeler made a motion -to retain auto sales as a Special E~ception and to also include Boats, Motor and Boat Trailer Sales and Service, Mobile Home Sale and Car Washes as Special _E~ceptions rather than permitted uses. The Board is recommending that-the Council change the wording of " the SpeGial E~ception para, of B~3 District toread~ SP.eciar Except-ions: -- # .0 - - Outdoor display or storage of equipment or material, provided that, in-the interest of safety to children and adjacent property owners, btitdoor s~orage sales ~ill- be encompassed by a fence or wall- at least six .(6) feet high; the bottom four !eet being-sealed and_the top two feet being open. Outdoor display, storage or sale of operative automobile, boat motor and boat trailer sales and service, car washes, and mobile home- sales provided that an appropriate opaque fence or plant- materials be provided to screen adjacent properties where deemed -appiopriate. . At the present time, it is necessary to get a special exception from "the Board of Adjustments to obtain a license to operate a used car lot. The same process would be necessary if anyone desired to open up a new car dealership in Edgewater. The special exception, under B-3, is not clear because it deals with fences reauired and states that mobile home sales and the sale of operative automobiles are excluded. Mobile home sales are permitted in B-3 but not the sale of operative auto- mobiles. It has been requested that automobile sales be made a permitted use in B~3. The Council would like the Zonina Board to study this situation and make their recommendation whether or not' automobile sales (new and/or used cars) be made a permitted us~ in B~3 and what, if any, conditions might be placed on the sale of automobiles if it is made a permitted use. I cannot understand why a variance is necessary to sell used cars in a Commercial B3 zone. If used car sales are not allowed in B3 Commercial, where are they allowed? After reading the B3 Commercial zone ordinance my interpretation is that used cars are included. How can you include Boats, Trailers, and Mobile Homes sales and exclude car sales?
