05-02-1978 o o ZONING BOARD REGULAR MEETING May 2, 1978 Chairman Wolfe called the regular meeting to order at 7:36 P.M. Mackie Mr. Nichols asked for a clarification of the 50 foot restriction for duplexes in R-3. He questioned whether or not duplexes in R-4 could be considered within 50 ft. of R-3 allowing duplexes in the R-3 area of Florida Shores. Mr. Mackie said that the recommendation specifically stated R-3 only for the restriction of 50 feet. This would protect Florida Shores R-3 area. No one could jump from R-4 to R-3 for duplexes. In September of 1977, the Zoning Board sent a recommendation to the City Council to upgrade Florida Shores to R-3B, which would protect them from certain zoning changes. No action was taken by the Council. The Zoning Board sent another request in January, 1978. There has been no action yet from the Council. Maybe the Zoning Board should hold their own Public Hearing on this and send their decision to the City Council. Mr. Nichols said that the Council has approved putting the duplexes in R-4 and also in R-3 as a special exception with the Board's recommendation for existing duplexes. They also approved the change in B-3 for assemblage. There was a question whether the Council included the mlnlmum lot size for duplexes. Chairman Wolfe requested that the secretary contact Mr. Woods, City Attorney, to find out if this will be included in the Ordinance. The Board discussed the other proposed changes in Florida Shores. This includes some changes from R-4 to B-2, from R-3 to B-2 and from R-3 to R-4 in certain areas. The Board members reviewed these areas on the map. Mr. Nichols said that the original idea was to have business area near railroad tracks, R-4 multi-family dwellings in R-4 as a buffer zone .before R-3 for single family homes. However, some of the areas were not put in the legal description and therefore not added to the map. This needs to be corrected. There was a question on whether some earlier changes had been made by the Council. The map is not up to date. The secretary will check on this. The Board discussed the request that single family dwellings in R-4 and R-5 follow all dimensional requirements for yard lot set backs as per R-3 specifications. This request was sent to the Council in January 1978. The Board diSCU~d where single family d~ingS could be built. The City Planner said he did not believe that single family dwellings could be built in an industrial zone. Mr. Mackie suggested that the Zoning Board find out what the Council has done concerning recent recommendations from the Zoning Board and then the Zoning Board can set up a Public Hearing. Chairman Wolfe talked about rezoning Trailer Parks. He said that they could not write up a legal description of each lot and should write the owners of the trailer parks and ask for their legal descrip ion. Mr. Nichols said that none of the trailer parks except Camerons were zoned MH-l.. ~ There was a discussion about individually owned trailer lots. Only Pyramid Park has individually owned lots. Mr.Diamond will contact the trailer park owners to get a legal description of their property. The Board discussed when they could hold a Public Hearing on a zoning change for trailer parks. The Board discussed having a Public Hearing on zoning changes that the Council has not advertised for as yet. MH-l - Trailer Parks R-4 and R-5 - single family dwelling dimensional requirements R-l from 1200 to 1300 sq. ft. R-I-A from 1200 to 1300 sq. ft. Block 245 of Florida Shores from R-4 to B-2 lots 7447 to 7510 inclusive. Plus the changes on page 2 of the Zoning Board memo dated (originally 9-9-77) reissued January 1978. The secretary will check to find out if the Council plans any Public Hearing on these zoning changes. The Council discussed Mr. Cole's property.-There is a request that a portion of it be zoned I-I. The secretary said that Mr. Cole would have to apply for a Public Hearing before the Zoning Board. There was a discussion about PUD. Mr. Diamond said it was his opinion that the only time PUD exists is when it is ready to be developed. If a permit is not used and the area is not developed it reverts back to its old zoning. Chairman Wolfe said they were told they could not do that but if that was the case the area would now be R-l. The permits were issued a couple of years ago. The discussed some enclaves on the map. Chairman Wolfe said the City (, write to the County these areas wish to be annexed into the City. Mr. Diamond said that the new statutes make it necessary for the landowner to voluntary request annexation. Chairman Wolfe said the area owned by Sacred Heart Church could probably be voluntarily annexed in, if the City were to write the Church. Mr. Diamond said that he believed the City Attorney had furnished the Board with copies of guidelines for zoning changes. Mr. Wiggins made the second. The motion CARRIED 7-0. Lots 7,B,and 9 Block 2 Riveredge Acres be changed from its present zoning B-4 to R.l. Lots 1,2, and 3, Block 3 Riveredge A c res . be c h a n g e d . fro m B - 4 . to" R'.~ 2 . Lots 10, 11 - 12 Block 2 Riveredge Acres Lots:~20,21 ,and 22 Block 3 Riveredge Acres be change to B-3.
