ZONING BOARD
WORKSHOP
March 27, 1978
Chairman Wolfe stated that all the members are present and accounted
for. Guests are, Mayor Christy, Councilman Shell, Mrs. Irene Mackie
Mr. Dave McGinnis and Mr. Charlie Murphy, Building Official.
Chairman Wolfe asked about the minutes of the March 7th meeting.
Mr. Nichols stated that there should be a change in regard to the
attorney's answer to Chairman Wolfe's question about the 5,000 square
feet on the B3 special exception. The attorney said that he doesn't
see any reason why this can't be done.
This correction is to be made on the original set of minutes.
There was also a correction in the discussion about the mobile home
parks. This is not going to be rezoned, they are going to get their
old zonings back.
Mr. Nichols made a motion to accept the March 7th minutes as reread,
being seconded by Mr. Bartholomew. Said motion CARRIED 6-0.
Chairman Wolfe asked about the minutes of the March 14th meeting,
which was a workshop. It was decided that workshop minutes do not
have to be approved.
Chairman Wolfe stated that Mr. Dave McGinnis is present and he would
like to handle this problem. His letter says that he is asking for
a variance, but he does not think that this is what he wants.
Mr. McGinnis stated that he was shocked when he found out that the
30 foot strip that he is talking about was zoned for Shopping centers.
He does not know how this could be utilized as a shopping center,

the block the way it started out to be which is putting a front on it
facing Western Avenue.
Chairman Wolfe explained that basically this was future planning zoning
when it was done. Now the City has to go under a State comprehensive
planning which will cause the entire City to be rezoned again. Public
hearings are being he}d now for this purpose. He added that he has
been asked about making that back part Industrial.
Mr. McGinnis talked about an expansion he is planning for his plant
sometime in the future. ·

Chairman Wolfe stated that he does not really want a variance; he
thinks that he should get a permitted use.
Mr. Murphy spoke to the board about this. At the present time the
problem is that the entire operation is non conforming. He can't
tear a building down to rebuild or add to a building. Also according
to the ordinance as it reads now, within ten years he has to have the
whole place torn down. The feasible way to do this is to make it I-l
right down to the railroad, then you are returning the 1-1 and you are
not spot zoning.
There was discussion among the board members, the mayor and Mr. Murphy
as to how this should be handled. It was suggested that instead of
changing this to 1-1, perhaps we could add food processing of honey
as a permitted use under the present zoning. This was discussed and
the feeling was that this would be the easiest way to go.
Mr. McGinnis asked if this has to be restricted to honey only. They
may want to produce some type of honey product at some time in the
future.

Mr. Nichols made a motion that we add to the 8-5 Planned Shopping
Center District under permitted uses, Food Processing, Honey Products
Only, being seconded by Mr. Mackie. Said motion CARRIED 7-0
Chairman Wolfe stated that Mayor Christy is present, and he would
like the Resolution which was made the other night explained to the
board. This resolution says that duplexes will be allowed in all
R-3 districts.
Mayor Christy stated that he does not have the tapes of the meeting
with him.
Chairman Wolfe asked if it is that the Council would like to see
duplexes built in all R-3 areas?
Mayor Christy explained that in the one case there are already three
duplexes built in the area and the man who is wanting to build a
duplex will be the fourth. Land wise this man would not quite be
able to build two separate houses.
Chairman Wolfe explained that there is a large area of R-3 in Florida
Shores, and if duplexes are allowed in R-3 Districts it would have to
be allowed in this undeveloped part of Florida Shores, which is going
to cause the City a lot of trouble. He suggested that if the duplexes
are going to be allowed in R-3 zones, then perhaps all the R-3 zones in
the Florida Shores area could be changed to R-2.
Mr. Murphy questioned why the particular area in question couldn1t be
zoned R-38.
There was discussion about this among the board members and Mr. Murphy.
