ZONING BOARD
AUGUST 12, 1978
The Zoning Board meeting of the City of Edgewater was called to order
by Vice Chairman Mackie.

Mr. Wiggins made a motion to accept the minutes, being seconded by
Mr. Brittingham. Said motion CARRIED.
The board discussed the item of 51% of a subdivision being developed,
then the rest of the subdivision should be developed in the like
manner.
Mr. Mackie stated that we should make a list of items to be put on
the agenda for the meeting with the Council.
Mrs.Webber stated that one item is that all properties for rezoning
shall submit a site plan to the Zoning Board and a copy of the survey.
Mr. Brittingham stated that this could possibly be a sketch, or a
non professional plot plan and site arrangement, because it is not
fair for the board to tell a man to go out and hire 8 surveyor.
At this point there was some discussion in regard to the Zoning
Ordinance not being interpreted in detail as far as allowing someone
to have a certain business in a certain zone.
Mr. Mackie stated that we had suggested to the City Manager to make
a list of things which have been problems with the Zoning Ordinance,
so that we would know what to make changes on.
Mrs. Webber stated that no two businesses may be placed on one piece
of property unless square footage is sufficient.
There was discussion in regard to two different businesses on the
same property and what the regulations should be.
Mrs. Webber stated that she feels that something should be put into
the Zoning Code whereby it says for each business, you shall follow
the Zoning Code and have the amount of square footage necessary for
each business.
Mr. Mackie stated that we can not do anything about the businesses
which were established years ago, however we should control what
is going up since the Ordinance.
Mr. Brittingham stated that the Ordinance can be interpreted in
different ways.
There was conversation about a junk yard being put out on Industrial
Road. Mrs. Webber stated that the man has been referred to the Board
of Adjustments and they are only a variance board.
Mr. Brittingham stated that they will need a variance to build a
junk yard because it is not allowed.
Mr. Mackie read his list of suggested changes to the Ordinance.

Mr. Brittingham stated that this recommendation has gone to the Council.
Mr. Mackie stated that we want this put in the Ordinance in the form
of a flyer or something so we know what the changes are. He began
reading his suggestions:
2. All other than single family homes shall be restricted to site
plan approval.
Mr. Brittingham said that he believes this is in the Ordinance
somewhere because he knows we discussed this.
Mr. Mackie stated that this was forgotten about or something.
3. All zoning that reads in Ordinance 880 shall be changed from
"per dwelling unit" to read "square foot living area" which shall
not include carports, garages, porches, laundry rooms, workshops,
etc. which is not living area.
Mr. Brittingham read the definitions from the Ordinance.
He stated that this is exactly the d~finition for floor area, so
therefore we are covered.
Mr. Mackie stated that this is not being enforced.
Mrs. Webber questioned whether we have any say over government homes?
Mr. Brittingham said that we don't as long as they comply with the
building codes.
4. Fruit stands shouad be elliminated from Ordinance 880 unless taey
are in connection with business stores on sight if they are to be
left in then they should provide a ladies and men's rest rooms.
There was discussion in regard to this being eyesores and some of
them near causing accidents on the highway. If we are going to
have these stands, at least they should adhere to the Zoning laws.
5. All listings pertaining to business shall not be allowed any
other type of business on the same property unless it is approved
by the Zoning Board and the City Council, by site plan approval.
It was stated that letters have been sent to the City Manager and
the City Attorney and we have not received answers.
Mr. Wiggins stated that we did mention at one time something about
fences.
Mr. Brittingham stated that this was about the heighth of fences in
theefront and back yards.
There ~as more discussion about fences.
Mr. Mackie read a letter from Attorney Ross in regard to Mr. Rotundo's
property in Silver Ridge.
Mrs. Webber asked what was going to be done about squaring off the
City as the County wanted?
Mr. Mackie stated that he understood that this has been turned over
to Mr. Weaver to find out about.

There was some discussion about this, and questions about how it
could be done.
It was discussed that the board should get together with the Council
to talk about some of these suggested changes.
Mr. Brittingham made a motion to adjourn being seconded by Mr. Wiggins
