CITY OF EDGEWATER
SELF-INSURANCE COMMITTEE MEETING
SEPTEMBER 21, 1987
MINUTES
The meeting began at 3:20 P.M. in the City Hall Conference
Room. Present were City Clerk/Administrator Connie Martinez;
Jose' Alvarez, City Attorney; Gary Schad, Insurance Agent; and
Sue Koser, recording secretary.
The following items were discussed and numbers were assigned
where applicable:
Bus Benches #87-8-1 - Insurance policy provided by Associated
Marketing was reviewed at length. City Attorney Alvarez suggested
a contract as an exhibit to the contract that has a City map
which shows present locations of the benches. He noted that
future benches will be subject to approval of this Committee
after prior notice of where the benches will be placed, so
that it can be inspected for safety, etc. He also said there
should be a limit on the number of benches and their locations,
i.e., not in residential. City Clerk Martinez asked if City
Attorney Alvarez could prepare a contract for this and City
Attorney Alvarez replied that he'll review the existing contract
but in the contract will be a requirement that someone insures
that if a claim is made against the City for personal or property
damage as a result of a bench being there, the City will be
defended and will be indemnified against any judgements entered
against the City.
Mr. Schad reviewed the status of the Surplus Lines compared to
other carriers. He noted that the Insurance Commissioner will
not pursue this.
It was agreed that the Committee would request a current map and
a copy of the complete policy for review of indemnification.
Cindy D'Emilio Auto Accident - Roberts Road at Pine Tree #87-5-1 -
City Attorney Alvarez noted that her attorney has sent letters and
wants the City to payor they'll file a lawsuit, and he III wait the
six months. He reviewed prior discussions at a previous meeting.
Stanley Steemer & City Vehicle #87-7-1-The Committee reviewed statements
taken. It was agreed to get a cost on our tractor damage for
repair parts and labor, and we will then send a letter after it's
decided if the costs would be split 50-50. There were questions
as to the title holder for the Stanley Steemer vehicle and who
paid for it. It was determined that Gary Schad will handle this.
Cracked Windshield #87-7-2 - It was determined that the City is
not responsible for this damage to the windshield. It was agreed
to send a letter to Mrs. Thompson and suggest that she provide
the Committee with any information that would be evidence to the
contrary.
Becky Constable #87-7-3 - Mr. Pat DiLeva, Safety Inspector, was
present briefly at this time. It was determined that the burden
of proof would be on Ms. Constable.
City Clerk Martinez brought up the accident at the Jiffy Store and
City Attorney Alvarez suggested they get a release signed.
Further discussion of Constable claim was she had a camera on top
of some boxes which appeared to be trash. It was noted that our
employees did not feel they did anything wrong since they did
their job and threw it away.

Southern Bell Claim - Damaged Cable, 1800 Hibiscus Drive #87-9-1 -
City Clerk Martinez stated Terry Wadsworth is not denying the claim.
It was agreed to pay the claim and tell them that after this it
will come from their own budget. City Attorney Alvarez suggested
they request a statement from the operator and a counselling session
with him.
Accident involving City vehicle #87-8-2 - City Attorney Alvarez
suggested they send a letter to Allstate. Mr. Schad suggested
they send the total packet with the accident report and the ticket
and the damages, with a statement from Detective Frazee and two
estimates to the Claims Office in Daytona asking for their prompt
attention.
Skate Board Ramps - Mr. Schad pointed out that private individuals
cannot afford to sell them because of liability insurance.
The meeting was then adjourned at 5:05 P.M.
