Background: The proposed development is a 2l-unit single-family home subdivision. The
developer is proposing the lots to be approximately 8,000 square feet with a minimum width of
70-feet and depth of 11 O-feet. On-site infrastructure has been completed.
The property shall be developed per the associated RPUD Agreement as adopted in November
2003.
Land Use Compatibility: The proposed subdivision is compatible with the residential uses to the
east, north, and south. Commercial properties with US Highway 1 frontage are located to the
west of this site.
Adequate Public Facilities: This site has access to Canal Drive. City water is available; sewer
is available via lift station installation and a tie into the force main.
Natural Environment: Soil types for this parcel is Orsino Fine Sand, 0-5% Slope. Vegetation
on this site is Generalized Urban, Pine/Xeric Oak.
The subdivision includes property designated as conservation and will be dedicated to the
Homeowners Association for ownership and maintenance.
Consistency with Comprehensive Plan: The proposed subdivision IS consistent with the
densities of the Low Density Residential Future Land Use Designation.
Other Matters: There are other known matter associated with this request.
STAFF RECOMMENDATION:
Staff recommends final plat approval of Pinehurst based on the condition that prior to recording
the final plat, all revisions required by the City Surveyor, City Attorney, City Engineer, and City
Staff are successfully completed, as well as the formal acceptance by the City of a bond/surety
device for all infrastructure accepted by the City.

Motion to send a favorable recommendation to City Council for final plat approval of Pinehurst

Comprehensive Plan Consistency
Policy 1.4.3 of the Future Land Use Element of the Comprehensive Plan states that, "If necessary,
the City may reduce limitations on infill and redevelopment activities consistent with the land uses
and densities indicated in this Plan in situations that will not jeopardize public health, safety or
welfare."
Other Matters:
Staff has received no objections from the surrounding property owners. Property owners within a
300' radius are required to be notified of a variance request.
Per the City of Edgewater Land Development Code Section 21-10.04, in order to grant a non
administrative variance, the P&ZB shall make the following findings of fact:
1. That granting of the proposed variance is not in conflict with the Comprehensive Plan;
2. That granting of the proposed variance will not result in creating or continuing a use which
is not compatible with adjacent uses in the area;
3. That granting of the proposed variance is the minimum action available to permit reasonable
use of the property;
4. That the physical characteristics of the subject site are unique and not present on adjacent
sites; and
5. That the circumstances creating the need for the variance are not the result of actions by the
applicant, or actions proposed by the applicant.
STAFF RECOMMENDATION:
Staff recommends approval of All Season Swimming Pools vanance request from the City of
Edgewater Land Development Code:

Background: A site plan was submitted to the Planning Department for this project on
September 21, 2006. The Technical Review Committee (TRC) met on October 24, 2006 to
discuss each City department's comments generated by their review of the site plan. These
comments included but were not limited to storm water, parking, landscaping, building and
fire safety. The Development Services Department is awaiting resubmittal of a site plan
addressing the comments discussed at the October TRC meeting.
The owner has also requested two variances from the City of Edgewater Land Development
Code: (1) to allow a driveway located within 483.03 feet of an intersection in lieu of the
required 660 feet and (2) to allow a reduction in the number of required loading berths from
two to one.
Land Use Compatibility: Development of a 27,000 square foot retail center is compatible
with the current commercial land usage along US Highway 1.
Adequate Public Facilities: City water and sewer are available to this site. This site will
have access via South Ridgewood Avenue and Oak Branch Drive. All other concurrency
standards shall be fulfilled prior to final site plan approval.
Natural Environment: A Threatened and Endangered Species Assessment provided to the
City on September 22, 2006 indicated the property does not provide suitable habitat for
listed threatened or endangered species. Staff has requested a 100% Gopher Tortoise Study
for verification of that finding.
Other Matters: Prior to development, the Technical Review Committee must approve the
proposed site plan.
STAFF RECOMMENDATION:
Staff recommends sending a favorable recommendation to City Council for site plan
approval for 3.20 :l: acres of land located south of Silver Circle and north of Oak Branch
