5.A.l) Councilwoman Bennington re: Home Occupational Licenses
The majority of our home occupational licenses are issued to sub-contractors
and in effect are home-office licenses. The licensee has to sign a statement
agreeing to the terms (see attached). Many cities leave all licensing under
the City Clerk's office and since the statement has to be signed, it does not
appear that it would be necessary for Council to approve this type of license.
A follow up system should be set up to have the area checked by the Police
Department on perhaps a 30 day, 6 month, and just prior to re-issuance of the
license time period, to ascertain they are complying with their agreement. A
true home occupational license would be for a business such as a piano teacher,
seamstress, tax consultant, and similar occupations where the actual work is
done in the home and not where the home is merely used as an office and for
telephone answering. Councilwoman Bennington discussed this subject with me
and requested it be an agenda item for further discussion by the Council.
5C. City Clerk Reports
1. Pilch Construction re: Hyser Property - Mr. Pilch was sent a letter with return
receipt requested. Mr. Earl Copeland was noticied that it would be necessary
for him to check on this. As of March 30th Mr. Hyser reported that there has
been little progress in correcting the situation. Hopefully, I will be able
to give a verbal update on this subject at the meeting.
2. Briley, Wild Breakdown of Road Paving Bills - We have not yet received this
information from Briley, Wild.
3. Briley, Wild Drainage Study Status - We are still investigating this and will
report back to Council as soon as possible.
4. Code Book of Former City Attorney - The former City Attorney still maintains
that the book was given to him 6 or 7 months prior to when he became our City
Attorney. He has requested that our City Attorney contact him about returning
the b~ok.
50. Merit Board
1. Outside Employment - This was brought to the attention of the Merit Board as
there was a discrepancy between the Code of Conduct and the Personnel Guide
as it pertains to outside employment. The Merit Board suggested adopting the
wording in the Personnel Guide. This has been cleared and approved with all
union representatives in an effort to avoid any mid-year negotiations. Since
all union contracts recognize both the Code of Conduct and the Personnel Guide,
this change would affect all employees. See attached.
2. Safety Policy - At the regular meeting on March 23rd, the Merit Board reviewed
the Safety Policy recommendations and are forwarding them to Council for approval.
The establishment of a formal Safety Policy in this City has been recommended
by Management Risk, handlers of our workers compensation, and the Bureau of
Industrial Safety and Health. It is only necessary for Council to approve the
cover letter to be sent to all employees and to establish a Safety Committee
which would consist of the Merit Board and four City employees. It has been
suggested that the Safety Committee could meet during working hours which would
eliminate any possibility of overtime for City employees. It is further
recommended that the employees be designated by a department head and represent
as many departments in the City as possible. Once the committee is established,
then further recommendations to initiate safety policies can be forwarded to
Council for their approval.

5.E. Parks and Recreation Board
1) Recreation Director Summary - Attached is the summary from the Parks
and Recreation Board as requested by Council.
2) Recreation Director Appointment Request - The recommendation regarding
a temporary recreation director appointment is being sent to you from
the Parks and Recreation Board for your consideration.
8. Unfinished Business
A. Councilwoman Bennington re: Change in Voting Order - If Council wishes
to change the voting order, an ordinance will be necessary amending the
current ordinance. (Section 2-24 (B), page 202)
B. Proposals from Auditing Firms - This item was tabled for full Council to
be present.
D. Planning Commission re: Request to Rescind F. Opa1's Appointment - This
item was tabled for full Council to be present.
