Hea r i n g s D. 82-0-11 .Fireworks control The Fire Company will have a report as to whether or not the champagne party popper should be banned, but otherwise this ordinance is ready for final enactment. E. 81-0-42 Burning controls (cancel) In January the Department of Environmental Regulation and the Division of Forestry signed an agreement which has the net effect of el iminating backyard burning. The key clause in this agreement has to do with the fact that if the City has weekly rubbish pickup, backyard burning is not allowed so that no local ordinance would do any good. I suggest, therefore, that this effort to gain local control be abandoned at this time. 5. Communications C. Harold Breuilly See attached. He wants the Council to vacate the west end of Plaza Lane (501 x 1501). This must be researched to see if it wasn't already vacated. 7. Unfinished Business A. Barracuda Band donation See attached letter from Ms. Susan Lewis, Corresponding Secretary of the Barracuda Band Parents Association. Contrary to popular bel ief, the Council does not have unl imited funds for such pur- poses. The request is for $500.00 but I would advise the Council that if it does donate, it donates on the basis of a 50-50 share together with the New Smyrna Beach City Commission and that the maximum the Council spend for this particular charity would be $100.00. Please bear in mind that once the gate is opened for this type of donation there is no tell ing where the matter will end. For example, the Juvenile Detention Center has requested a donation to buy certain equipment - see attached letter from them. B. Sewer blockage report At the request of Councilman Ledbetter we have negotiated a settle- ment with Mr. Merle Johnston of 122 Sanchez to pay $50.00 of a bill for $110.00. I might say at this time that this is very tricky ground and the Council would be wise to not get involved any more in these settlements. The policy establ ished for you by Terry Wadsworth is a very thorough and effective one and would not result in any settlements except in the most unusual cases. C. Road Assessments The City Attorney should have ready resolution #82-R-22 which is the resolution necessary to begin the assessment process. D. B r i 1 ey , Wi 1 d bill in g s A conference was held with Harry Wild and his Operations Chief and Terry Wadsworth regarding the bill ings questioned at the last meeting. We are satisfied with the explanation and trust that the conference will result in more quickly produced work and the el imination of some of the costs we have been encountering. o EXPlan~Ory Page two. Safety Inspections officer A need to inspect various commercial and industrial buildings for safe materials storage can be met by the appointment of a Safety Inspections Officer. The Fire Company also wants this and will submit names to the City Manager. Your approval of this idea in concept is asked. The $100.00 a month is already budgeted. 8. New Business A. Purchase of land for borrow pit See attached report. B. Approval of Community Development Block Grant appl ication See previous report mailed out. Since that report was mailed the federal people have denied the request to use money for Menard Park so that the funds will go directly for road construction. C. Re-zoning requests 1) The C. W. W. Construction Co., Inc. appeared before the Zoning Commission March 22 and they have recommended that Council re-zone some property fronting on Park Avenue from 1-1 and MH-l to R-4 to allow for 35 multi-family rental apartments. Mr. Fudge of the C. W. W. Construction firm will be present to explain this. See attached. 2) When the Zoning Commission recommended the C. W. W. Construction Co. re-zoning, they also recommended that the MH-l property behind the 1-1 property just East of the C. W. W. Construction site be made 1-1. D. Juvenile Detention Center donation The Juvenile Detention Center has requested a donation. See attached letter. E. Hermosa Palms permit renewal See attached - this is a construction trailer. F. Indian River bridge While the problem of getting across the North and South Causeways in New Smyrna Beach is primarily that of New Smyrna Beach, it has a lateral impact on us in terms of people who 1 ive or work here doing business or going to and from work or home there. It is unnecessary to explain the nature of this problem as you are well aware of it. It has been suggested that perhaps the issue of completing the planned bridge from Indian River Boulevard eastwardly terminus across to the oceanside might be in order. Mayor Christy has expressed an interest in following this up if Council so wishes. G. Home Occupational Licenses 1) Will iam E. Doran, 414 North Ridgewood Avenue, Painter, zoned MH-1A. No visible activity. '2) Barbara Newman, 16 Silver Circle, zoned R-l. Arts and crafts to be taken to art shows. No visible activity.
