Section 607.03(c)(2) is created to read as follows: Section 607.03 PID Planned Industrial Development District. (c.2) Conditional uses: One (1) modular dwelling unit in conjunction with a permitted primary use, provided the dwelling is needed to accommodate security personnel employed by the owner or operator of the permitted primary use. The modular unit shall be occupied only by security personnel. NO.: 95 -47 Date: April 24, 1995 low PUBLIC HEARING 05/01/95 RESOLUTION ORDINANCE OTHER CONSENT BUSINESS CORRESPONDENCE ITEM DESCRIPTION /SUBJECT: Public Hearing Ordinance No. 95 -0 -05 - Amending the Code Enforcement Board Ordinance to be consistent with State Law. BACKGROUND: On April 17, 1995, the City Council approved Ordinance No. 95 -0 -05 on first reading. The proposed ordinance will amend the Code Enforcement Board Ordinance to be consistent with Chapter 162, Florida Statutes. These changes were enacted by the Legislature in 1994 and have already been incorporated into the Code Enforcement Board section of the Land Development Code. It is necessary to include these changes in the Code of Ordinances as well. Notice of Now the public hearing was published on April 20, 1995, in the News Journal. The first revision, which is in Section 2 -50, clarifies that appointments to the Code Enforcement Board shall be made in the sole discretion of the City Council. Section 2 -52(d) would be amended to provide that a hearing may be requested immediately when the code inspector believes that a condition causing a violation represents a serious threat to the public health, safety and welfare. As amended, Section 2 -53 (b) would provide that if Staff is successful in prosecuting a case before the Board, that the City would be entitled to recover all costs incurred in prosecuting that case. Previously only a fine could be collected. The next amendment relates to the notice requirements. Previously notice could be achieved by certified mail, hand delivery or publication. This proposed amendment of Section 2 -55 would authorize posting of the notice at two locations, the property and City Hall. This will reduce the costs involved in those cases where the alleged violator refuses to accept service of the notice by mail or hand delivery. Nay The first proposed change to Section 2 -56 relates to the time frame for the imposition of the fine in the case of a repeat violation. Previously, the fine could begin on the date of notice to the violator of the repeat violation. The amendment provides that the fine may begin on the date the violation is found to have occurred by the code inspector. A second amendment to Section 2 -56 would allow the City to make repairs and charge the violator for the cost of those repairs in cases where the violation or condition causing the violation represents a serious threat to public health, safety and welfare or is irreparable or irreversible. The cost of repairs is in addition to any fine assessed. vow Sections 2 -56(e) and 2 -57 would be amended to clarify that a code enforcement lien runs in favor of the City and that the City may collect all costs incurred in recording and satisfying a valid lien. Organization; membership; standards of conduct; conflict of interest. (a) Composition; qualifications. The city council shall appoint a seven - member citizen code enforcement board based upon the following standards and qualifications: (2) Appointments shall be made on the basis of experience or interest in code enforcement in the sole discretion of the city council. The membership of the enforcement board shall whenever possible include an architect, a businessman, an engineer, a general contractor, a subcontractor, and a realtor. Sec. 2 - 52. If the city prevails in prosecuting a case before the enforcement board, the city shall be entitled to recover all costs incurred in prosecuting the case before the board. Sec. 2 -55. Notices. (b) In addition to providing notice as set forth in subsection (a), notice may also be served by publication or posting, as follows: (3) In lieu of publication as described in (1) above, such notice may be posted for at least 10 days in at least two locations, one of which shall be the property upon which the violation is alleged to Now exist and the other shall be City Hall. (d) Evidence that an attempt has been made to hand deliver or mail notice as provided in subsection (a), together with proof of publication or posting as provided in subsection (b), shall be sufficient to show that the notice requirements of this part have been met, without regard to whether or not the alleged violator actually received such notice. Sec. 2 -56. Fines, costs of repairs, andler. liens. (a) The enforcement board, upon notification by the code inspector that an order of the board has not been complied with by the set time, or upon finding that a repeat violation has been committed, may order the low violator to pay a fine in an amount specified in this section for each day the violation continues past the date set for compliance or, in the case of a repeat violation, for each day the repeat violation continues beginning with the date the repeat violation is found to have occurred by the code inspector past thc date of noticc to thc violator of thc repeat violation. In addition, if the violation is a violation described in Section 2- 52(d), the enforcement board shall notify the city council, which may make all reasonable repairs which are required to bring the property into compliance and charge the violator with the reasonable cost of the repairs along with the fine imposed pursuant to this section. If a finding of a violation or a repeat violation has been made, a hearing shall not be necessary for issuance of the order imposing the fine. (b) A fine imposed pursuant to this section shall not exceed two hundred fifty dollars ($250.00) per day for a first violation and shall not exceed five hundred dollars No a"" Struek through passages are deleted. Upon petition to the circuit court such order may be enforced in the same manner as a court judgment by the sheriffs of this state, including levy against the personal property, but such order shall not be deemed a court judgment except for enforcement purposes. A fine imposed pursuant to this section shall continue to accrue until the violator comes into compliance or until judgment is rendered in a suit to foreclose on a lien filed pursuant to this section, whichever occurs first. A lien arising from a fine imposed pursuant to this section runs in favor of the city and the city council may execute a satisfaction or release of lien entered pursuant to this section. After three (3) months from the filing of any lien which remains unpaid, the enforcement board may authorize the city attorney to foreclose on the lien. No lien created pursuant to the provisions of this section may be foreclosed on real property which is a homestead under 4ww Section 4, Article X of the State Constitution. Sec. 2 -57. Duration of lien. No lien provided by this article shall continue for a longer period than twenty (20) years after the certified copy of an order imposing a fine has been recorded, unless within that time an action to foreclose on the lien is commenced in a court of competent jurisdiction. In an action to foreclose on a lien, the prevailing party is entitled to recover all costs, including a reasonable attorney's fee, that it incurs in the foreclosure. The city shall be entitled to collect all costs incurred in recording and satisfying a valid lien. The continuation of the lien effected by the commencement of the action shall not be good against creditors or subsequent purchasers for valuable consideration without notice, unless a notice of lis pendens is recorded. PART B. CONFLICTING PROVISION. All conflicting ordinances and resolutions, or parts thereof iftw in conflict with this ordinance, are hereby superseded by this ordinance to the extent of such conflict. PART C. SEVERABILITY AND APPLICABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. We are now faced with one of the trailers having a completely worn out chain that adding an occasional link will not resolve. With the endless chain being the only method to remove the waste from the trailer the broken worn out chain has effectively eliminated the trailer from use. The City has three (3) of these trailers, and uses two of them on a daily basis. Replacement of this worn out chain is necessary, and is a "Sole Source Item" that can only be obtained from the trailer manufacturer in California. Appointment to Beautification and Tree Committee due to the resignation of Helen Janda Councilman Mitchum Mitchum moved to table, second by Councilman Hays. %ow GENERAL CITIZEN COMMENTS1CORRESPONDENCE Doris Hill, 112 Lincoln Road, stated she is a little upset. It seems the County Council is debating the pros and cons of waiving the impact fees in the County which would create over $5 million plus shortfall in the County income. She further commented on impact fees and the growth of Edgewater. Ms. Hill reminded the Council of the survey that was conducted regarding the feelings and wishes of the people of Edgewater as to the direction and needs of this City. She reminded the Mayor they cannot afford to pay the freight for County improvements when they are already hurting from trying to pay for our own improvements. Ms. Hill spoke about dropping the impact fees that help pay for the growth so builders can make more profit on the new homes and make it impossible for the people who already own homes to sell without losing money. Mayor Hayman elaborated on Ms. Hill's concerns. Paul Jenkins thanked Council for looking at the water rates again. He has a problem which initially was encouraging conservation. He doesn't understand how it can encourage conservation without taking into effect the ratio of how much water versus how many people are using it into that formula. Mr. Jenkins stated there is no way he can get down below the tier. There is no encouragement in this rate for the people at 6500 gallons to get below the 3000 mark because there is no way they can do that. Mr. Jenkins feels that more of this ended up a political decision because of the number of people it affects versus whether it was equal or not. Mr. Jenkins commented on impact fees. He spoke about the money and taxes that are paid into the system by the undeveloped properties. ANY OTHER COMMENTS City Attorney Storey commented on correspondence distributed to Council regarding the issue with S & E and the correction of the defective work. The proposal for correcting the work that Mr. Spofford outlined in his letter is not acceptable to the City Engineer and we will expect S & E to do the work as they should have done. City Attorney Storey stated City Engineer Fegley did speak with Mr. Spofford and they had an amicable conversation about getting together and Mr. Spofford bringing his crew and beginning work when the City would have inspectors available to verify they were meeting the contract specifications. She feels communication is ongoing and that is a positive step. Mr. Spofford appears to be willing to come over and correct the work. We have advised S & E we would withhold $250,000. We are currently hoiding $440,000, which leaves $190,000 and that work, based on Mr. Fegley's estimate, has been completed and persuant to our demand letter, we have advised S & E we would pay them the $190,000, retaining the $250,000. We want to confirm with Council that it is appropriate to release the $190,000, retaining the $250,000 until *ow all of the other issues are resolved. Jan & Lib's Hi Tops Lounge request to stay open until 3 a.m. for remainder of Bike Week Elizabeth Fenical, Jan & Lib's Hi Tops Lounge, requested to stay open until 3 a.m. for Bike Week. Councilman Hays asked Chief Schumaker if there have been any problems in the past. Chief Schumaker stated one of the main reasons he believed there was no opposition was the fact that New Smyrna was staying open until 3 a.m. He stated this year New Smyrna has opted not to do that. He stated over the past few years they have not had any major problems with the extended time. He stated if you allow one bar to stay open until 3 a.m., you have to extend that to every other bar in the City also. Councilman Hays made a motion to approve this request, second by Councilman Hatfield. The motion CARRIED 5 -0. F. Porta Prqd:'ucts Corporation request to erect off site sign for P' new location 211 Dale Street Mayor Hayman commented on Mr. Karet's memo regarding Off -site Sign Requests. Thomas Alcorn, Vice President, Porta Products Corporation, explained they are looking to place signage on the road to direct people back to the property they now have. Mayor Hayman asked what type of sign is permissible under these conditions. Mr. Karet stated by code, no off -site signs are permissible. Councilman Mitchum asked what he needs to do. Mr. Karet stated in the past, Council on occasion has granted specific off -site signs. Councilman Mitchum asked if we have done it under this format. Mr. Karet stated Pelican Cove West recently came before Council and received an off -site sign for their recreation center. ‘ — Councilwoman Martin asked the size of the sign. He feels the type of sign needs to be defined as to what Council will approve and he asked this be • brought back to Council. Mr. Alcorn steted they would like to have a temporary sign due to the Vice President of the United States coming to Maglev. Councilman Hatfield asked him if he needed a sign immediately. err He asked what if they gave him a temporary sign immediately and address what type of sign with him and bring it back to Council at a later date. Councilman Hatfield stated he has no problem with a 4' X 4' temporary sign. Mr. Alcorn stated that would be sufficient. Mayor Hayman reiterated the motion as being approving a temporary sign with the applicant presenting a rendering of what the temporary sign will look like and the dimensions of it and then working with Council for the future development of signage and location and the advertisement on that site. He stated Mr. Alcorn will be working on the permanent sign at .a later date with staff. _ The motion CARRIED 5 -0. G. Kevin Pate request to operate tatoo parlor and leather retail sales from new business location at 101 N. Ridgewood Ave. Kevin Pate, White Lightning Tatoos, thanked Council for allowing it them to do their temporary tatoo parlor and leather sales at Wayne's World. He stated this was all contingent with the amendment of the zoning. He spoke about getting a lot of people from the community wanting tatoos and leather. He stated his request is to close down the Wayne's World location and move into the other building and have a temporary permit until the decision on the amendment comes through. Councilman Hays questioned medical supervision and the criteria of the Florida Statutes. Mr. Pate stated they exceed the medical standards and they have biohazard containers. Councilman Mitchum questioned if there is going to be a problem with having a permit with the zoning amendment. Mr. Karet stated Mr. Pate is referring to an application for text amendment to the list of permitted uses in the B -3 District. Councilman Mitchum informed Mr. Pate if he does not get the text amendment that will be the end of it. He stated what they are doing tonight does not give Mr. Pate a permanent facility. He stated there may not be any problems with the text amendment but he wanted Mr. Pate to be aware. Councilman Mitchum made a motion to let them operate but readdress this once the text amendment is taken care of, second by Councilman Hays. The motion CARRIED 5 -0. OFFICER REPORTS Councilman Hays Councilman Hays stated he feels they need to look into some new signage designating where our Water Plant is. AGENDA REQUEST Date: April 24, 1995 UNFINISHED CONSENT NEW BUSINESS BUSINESS X PUBLIC HEARING RESOLUTION ORDINANCE ITEM DESCRIPTION /SUBJECT: "Tour of Home" Construction Bid. BACKGROUND: On January 9, 1995, City Council authorized Staff of the Parks and Recreation Department to go out for bids for construction of a house to be used for a fundraising project, "Tour of Home ". Now Discussion of home included approximate square footage, type of construction material and optional accessories. Bid also required optional bid of a swimming pool with screen enclosure. Advertisement (required by law) in area newspapers and additional random invitations were sent out to area Builders. On April 19, 1995, bids were received and opened. One (1) bid was submitted. RECOMMENDATION /CONCLUSION: Review of plans finds that this is the type of home Staff would like to showcase as a start to our fundraising project. Review of contractors pricing documents indicates that allowances for plumbing fixtures, lights, carpet and etc. are reasonable. The cost of the home is somewhat higher than initial estimates, however, the size of the home is also bigger. As indicated on the plans, the living space of the home is 1,766 sq. ft. The garage is 663 sq. ft., the porch is 328 sq. ft. and the entry is 61 sq. ft. You should also note as specified in the bid plans low that ceiling height is 10 ft. The fireplace is gas operable with remote and appliances are Kenmore. Other notables include wall shelves, 6 panel interior doors, pre -wire for security system, double front door and a large covered porch. 1. Staff recommends that City Council accept the bid from T &T Builders of Volusia County, Inc. for the sum of $106,000.00 (One hundred and six thousand dollars) for the construction of the home called "The Edgewater." 2. The optional bid for swimming pool with screen enclosure and pool vac is for $16,134.00. Staff recommends discussion on pros and cons of swimming pool before decision is made. 3. If City Council decides against construction of swimming pool, Staff recommends an additional cost to House Bid to include screening in the rear porch for Immo 4. Councilman Hays stated it is very sound for i them to go ahead with this project with the growth and the environmental concerns in that area. He feels it is important to continue. There was a discussion regarding the payback time. Mr. Wadsworth stated it will be approximately five years before the City would start to recover a good portion of the monies. Mayor Hayman spoke about a lady that went before Council regarding the present lines going into the college. He asked if they will have anymore problems like that if we go north of Indian River Blvd. Mr. Wadsworth stated that will depend on how the road is dedicated and the property owners associated with it. He commented on prescriptive rights roads. Mr. Wadsworth explained the three separate items he needs approved. Councilman Mitchum made a motion to approve Mr. Wadsworth's request to waive the non - substantial irregularity, award water line project to Parnell Well Drilling in the amount of $87,575.00 and declare this project impact fee eligible, second by Councilman Hays. The motion CARRIED 5 -0. F. Authorize Quentin L. Hampton Associates to perform engineering services related to water line design for Palm Breeze Drive at cost not to exceed $5,200 and declare project design and construction to be impact fee eligible Utilities Director Terry Wadsworth made a brief presentation at this time. He stated it is his intention that wlen the design is done we will go ahead and evaluate and depending'oii the work load go ahead and install these improvements with City forces. Councilman Mitchum questioned why the design could not be done in- house. Mr. Wadsworth explained because of the work load of ;ft„ the City Engineer due to the CIP closeout. BACKGROUND: The Edgewater City council approved the expenditure of $19,368 for a lift station maintenance truck during the budget process. The cost of this vehicle through the state bid is $14,847.00. The heavy duty crane and utility box will be added after receipt of the base unit. RECOMMENDATION /CONCLUSION: Purchase the pickup truck as budgeted and specified.
