The maintenance specified in the agreement will be provided every 90 days for a period of one year for a fee of $276.00 per visit. RECOMMENDATION /CONCLUSION: The Agreement has been approved as to legal form and correctness. Staff requests that the Council consider approval of the Planned Maintenance Service Agreement. NO.: 94 -124 Date: October 31, 19994 NEW UNFINISHED CONSENT 11/7/94 BUSINESS BUSINESS PUBLIC HEARING RESOLUTION ORDINANCE ITEM DESCRIPTION /SUBJECT: Agreement for Janitorial Services BACKGROUND: As the result of the impending retirement of City employee Jo Anne Sikes, it was necessary to investigate the options for cleaning City Hall, the Community Development area, and the Community Center restrooms. The City Clerk solicited informal bids to perform the required janitorial services. Kathleen DeRosier, who has been Ms. Sikes substitute in the past, agreed to perform the required services for the budgeted amount of $740.00 per month. Attached is a proposed Agreement for Janitorial Services. Pursuant to the Agreement, Ms. DeRosier would be an independent contractor and not a City employee. As drafted, the Agreement would be effective through September 30, 1995. This will allow alternatives to be considered as part of next year's budget process. RECOMMENDATION /CONCLUSION: Staff recommends that the Council consider approval of the Agreement for Janitorial Services with Kathleen DeRosier. NOW, THEREFORE, in consideration of the agreements, premises, and covenants set forth herein and other good and valuable `ur consideration, the parties agree as follows: 1. Scope of Services DeRosier shall provide the City with janitorial services for City Hall, the Community Development area, and the Community Center restrooms as set forth in Exhibit A which is attached hereto and incorporated by reference. 2. COMPENSATION DeRosier shall provide the services specified in Exhibit A for a total fee of seven hundred forty and 00 /100 dollars ($740.00) per month. DeRosier shall be compensated on a monthly basis upon the submittal of an invoice sufficient for audit purposes. 3. Term and Termination This agreement shall be effective from November 4, 1994, through September 30, 1995, unless terminated earlier as provided herein. City or DeRosier may terminate this Agreement without cause upon thirty (30) days written notice to the other party. City may terminate this Agreement for cause upon written notice to DeRosier. 4. Independent Contractor r DeRosier is and shall be an independent contractor and 1 operator, responsible to all parties for all of her acts or omissions and the City shall in no way be responsible for such acts or omissions. 5. Compliance Consultant shall observe, obey, and comply with all ordinances, laws, rules, and regulations of the City, State of Florida, and other governmental units or agencies which may be applicable to DeRosier's performance under this Agreement. 6. City's Performance The City agrees to provide all necessary cleaning supplies, paper products, trash liners, mops, brooms, etc. to enable DeRosier to provide the required it janitorial services. 7. Amendments This Agreement may only be amended by a written document signed by both parties. 8. Entire Agreement This Agreement embodies the whole understanding of the parties. There are no promises, terms, conditions, or obligations other than those contained herein, and this Agreement shall supersede all previous communications, representations, or agreements, either verbal or written, between the parties hereto. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. Pursuant to the requirements of Section 163.3202, Florida Statutes, the City is required to adopt land development regulations to implement the goals, policies and objectives of the `or Edgewater Comprehensive Plan. 2. In a series of meetings, the LDRA /Local Planning Agency has reviewed the administrative portion of the proposed Land Development Code, found it to be consistent with the Comprehensive Plan and has recommended its approval to the City Council. 3. It is in the best interest of the citizens of Edgewater, Florida, that the administrative portion of the Land Development Code be adopted. NOW THEREFORE, BE IT ENACTED by the People of the City of Edgewater, Florida: Now PART A. ENACTMENT OF THE ADMINISTRATIVE PORTION OF THE LAND DEVELOPMENT CODE OF THE CITY OF EDGEWATER, FLORIDA. The administrative portion of the Land Development Code of the City of Edgewater, Florida, consisting of Chapters 1 through 10, which is attached hereto and incorporated by reference as Exhibit A is hereby adopted. PART B. REPEAL OF CERTAIN PROVISIONS OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA. The following provisions of the Code of Ordinances of the City of Edgewater, Florida, are hereby repealed: 1. Articles I through VIII and Articles X and XI of Chapter 7, Buildings and Building Construction; Fire Safety, Code of Ordinances, City of Edgewater, Florida. 2. Article III and Section 14 -57 of Chapter 14, Planning and Zoning Generally, Code of Ordinances, City of Edgewater, Florida. Nore 3. All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance, are hereby superseded by this ordinance to the extent of such conflict. PART D. SEVERABILITY AND APPLICABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such *o "' holding shall not affect its applicability to any other person, property, or circumstance. BACKGROUND: On September 28, 1994, the LDRA voted 6 -0 to recommend approval of a development agreement that would allow construction of two additional single- family residences at 1904 South Riverside Drive. The City is authorized to enter into development agreements pursuant to the provisions of the Florida Local Government `'sw Development Agreement Act. Section 163.3225, Florida Statutes, requires the City to hold two public hearings before adoption of a development agreement. The first public hearing was held on October 17, 1994. At that time, Ray Anderson submitted a revised Exhibit A. On October 31, 1994, notice of the second public hearing was published in the News Journal. In addition, as required by Section 163.3225, the date of the second public hearing was announced at the first public hearing. RECOMMENDATION /CONCLUSION: Staff recommends that the City Council consider approval of the attached Development Agreement including revised Exhibit A. The Development Agreement has been approved as to legal form and correctness. Karet Director of Community Development KAS /rmw • Attachment Copy to: File Reading Nary DEVELOPMENT AGREEMENT 1904 SOUTH RIVERSIDE DRIVE EDGEWATER, FLORIDA „► THIS AGREEMENT made and entered into this day of , 1994, by and between the CITY OF EDGEWATER, FLORIDA, a municipal corporation, (hereafter "City "), FLORENCE ANDERSON, (hereafter "Owner "), and RAYMOND L. ANDERSON, (hereafter "Developer "). NOW, THEREFORE, in consideration of the agreements, premises, and covenants set forth herein and other good and valuable consideration, the parties agree as follows: 1. LEGAL DESCRIPTION AND OWNER: The land subject to this Agreement is located at 1904 South Riverside Drive, Edgewater, Florida, and its legal description is: Now Lot 6, Block 2, RIVEREDGE ACRES, as recorded in Map Book 9, Page 260 of the Public Records of Volusia County, Florida, less and except the following portion thereof: Commence at the Northwest corner of said Lot 6; thence runt South 0 °16'20" East along the West line of said Lot 6, a distance of 110.62 feet to the Southwest corner of said Lot 6; thence North 61 °51'40" East along the Southerly line of said Lot 6, a distance of 51.71 feet; thence North 28 °08'20" West, a distance of 97.79 feet to the Point of Beginning. The owner of the land is Florence Anderson. 2. DURATION OF AGREEMENT: The duration of this Development Agreement shall be five (5) lore years from the date of execution. However, the Owner /Developer shall apply for approval of construction plans for the proposed water, sewer and stormwater improvements no later than two (2) years from the date of execution of this Agreement. These construction plans must be approved by the City Engineer and the Director of Utilities prior to the commencement of work. This Development Agreement, and the terms provided for herein, may extended by the mutual consent of the City and the Owner /Developer, subject to a public hearing in accordance with §163.3225, Florida Statutes. After the improvements have been completed the Owner /Developer shall record a copy of the replat of Lot 6 described in paragraph 1 along with any easements. No newly (agreemnt /anderson.dev) October 31, 1994 1 created lots shall be conveyed until the replat is recorded. 3. DEVELOPMENT USES PERMITTED: The land subject to this Agreement shall be developed in `'fire accordance with the September 12, 1994 conceptual plan prepared by Geil Development Services, Inc., a copy of which is attached hereto and . incorporated by reference as Exhibit "A ". Construction of the improvements shall be in conformance with the physical requirements set out in the conceptual plan. Additionally, the Owner /Developer shall comply with any and all other applicable ordinances in effect at the time this Development Agreement is executed by the parties, regulating or restricting the physical disposition of improvements, including aesthetic amenities, consistent with and not contrary to the terms of this Development Agreement. As shown in the conceptual plan, there is an existing single family residence which fronts on Riverside Drive. Three (3) lots will be created to allow the construction of two (2) additional single family residences . The land subject to development is approximately one (1) acre in size. 4. PUBLIC FACILITIES: The Owner /Developer agree to extend the City's existing public water system and public wastewater treatment system to each of the newly created lots. Extensions to said public systems shall be provided by the Owner /Developer. A concurrency review shall be ,,, conducted to assure public facilities are available concurrent with the impacts of the development. 5. STORMWATER DRAINAGE: Pursuant to the Storm Water Management Ordinance of Edgewater, Florida, sufficient areas on the land subject to development will be utilized for the establishment of detention /retention areas. Retention areas will be sized to retain the increased run -off due to site development. The storage volume and discharge rate shall meet City stormwater requirements. 6. CONSISTENCY OF DEVELOPMENT: The City agrees to permit the development of this site in the Imy manner defined by this Development Agreement, the attached or (agreemnt /anderson.dev) October 31, 1994 2 referenced exhibits, and applicable City ordinances consistent with, and not contrary to, the terms of this Development Agreement. The Owner /Developer shall provide any agreements necessary to assure that the project site is developed consistently with all such City rules, regulations, restrictions and ordinances in effect on the date of the execution of this Development Agreement. The Owner /Developer are required to obtain construction plan approval and building permits and all other applicable local, State and Federal permits to allow construction as provided herein. 7. STATUTORY CONFLICT: To the extent that there is a conflict between this Development Agreement and any existing City resolution, regulation or ordinance, this Development Agreement shall control. However, 'rr► the Owner /Developer agree to be bound by all other applicable City ordinances in effect at the time of execution of this Development Agreement, not in conflict with the terms of this Development Agreement. Further, the failure of this Development Agreement to address a particular permit, condition, term or restriction shall not relieve the Owner /Developer of the necessity of complying with the law governing said permitting requirements, conditions, terms or restrictions. 8. AMENDMENT: This Development Agreement may be amended or revoked after ,,ow compliance with the public hearing provisions of §163.3225, Florida Statutes. 9. APPEAL: If the Owner /Developer is aggrieved by any decision of any City officer interpreting the terms of this Development Agreement, the Owner /Developer shall first file a written appeal with the Secretary to the Land Development and Regulatory Agency (hereafter LDRA). After receiving the written request, the matter shall be placed on the next available LDRA agenda after the appeal is received. If the Owner /Developer is aggrieved by the decision of the LDRA, the Owner /Developer shall then appeal to the City Council. The appeal shall be initiated by the Owner /Developer by (agreemnt /anderson.dev) October 31, 1994 3 filing a written request with the City Manager for placement of the issue on the City Council agenda. After receiving the written request, the City Manager shall place the matter on the next Now available City Council agenda after the appeal is received. 10. PERMITTED USES: The City hereby asserts that the land is suitable in size, location and character for the use proposed, and that the proposed use meets the needs of the City and is consistent with the City's long -range comprehensive plan. Permitted uses are as follows: (a) One (1) existing single family residence. (b) Two (2) additional single family residences and normal amenities. The requirements of the R -1 Single- Family Residential district %rv' shall be applicable including a maximum building height of thirty - five (35) feet above finished grade. 11. PERFORMANCE GUARANTEES: Should the development site be sold to an individual or corporation, the purchaser of the site shall be required to develop the site in compliance with the terms of this Development Agreement and applicable regulations of the City not inconsistent with, or contrary to, this Development Agreement. 12. BINDING EFFECT: The provisions of this Development Agreement, including any ,, and all supplementing orders and resolutions, and all final site plans, shall bind and inure to the benefit of the Owner /Developer or their successors in interest. The provisions of this Development Agreement and all approved plans shall run with the land and shall be administered in a manner consistent with the laws of the State of Florida. 13. RECORDING: Pursuant to Section 163.3239, Florida Statutes, within fourteen (14) days after the City enters into the Agreement, the City shall record the Agreement with the Clerk of the Circuit Court in Volusia County. A copy of the recorded Development Agreement truir shall be submitted to the state land planning agency within (agreemnt /anderson.dev) October 31, 1994 4 fourteen (14) days after the Agreement is recorded.
