attached contract will be an extension of the program from October
1, 1993, through September 30, 1994. Cost to the City is $11.50
per employee and this amount was included in the current fiscal
year budget.

EMPLOYEE ASSISTANCE PROGRAM CONTRACT
THIS CONTRACT is entered into on this 1st day of October, A.D. 1993, between Act,
Inc., hereinafter referred to as "Act" and the City of Edgewater, to provide an Employee
Assistance Program (hereinafter referred to as EAP);
WITNESSETH:
For and in consideration of the agreements to be performed by. the other, the parties agree
as follows:
SCOPE OF SERVICES
Act agrees to provide the following services to the City of Edgewater, employees of the
City of Edgewater and their immediate families at no cost to the Employees:
A. A 24 -hour phone service and face -to -face response for crisis counseling and
assessment, information, and referral.
B. Short term counseling, assessment (average 6 sessions, but not limited to) for
mental health, substance abuse, family dysfunction, or financial problems.
C. Referral, when appropriate, for specialized care or residential/medical treatment.

D. Presentation of comprehensive EAP orientation for all City of Edgewater
supervisory personnel.
E. Presentation of four workshops annually for employees on topics determined by
EAP and City of Edgewater.
F. Presentation of two training programs annually for supervisors on topics
determined by EAP and City of Edgewater.
G. Management consultation for all supervisors who may require assistance with a
personnel problem, including on -site consultation when appropriate.
H. Assist in developing promotional materials which will inform employees how to
recognize a problem, what the EAP can do to assist in solving the problem, and
how to make contact with EAP services. (Materials are to be printed at City of
, Edgewater expense.)
I. Preparation of quarterly statistical reports for the City of Edgewater which include
utilization of services, disposition of referrals, breakdown of data by type of
presenting problem and any other information required by the City of Edgewater
to determine the success of the EAP without compromising client confidentiality.
. 2. DEFINITION OF EMPLOYEE
Employee for the purposes of this contract is defined as any City of Edgewater employee
who is eligible to participate in the City of Edgewater health insurance benefit program.
3. LOCATION OF SERVICES

Act will maintain at least two offices (one on each side of the County) with 24 -hour
phone coverage for all EAP participants.

4. CONFIDENTIALITY
All services and records of EAP participants will be strictly confidential. No information
will be released without a proper release of information which conforms with Act's
confidentiality policies and procedures. Additionally, no information will be released by
Act or any subcontractor which could be used to identify any EAP client or family.
5. REFERRALS
Initial telephone contact with the EAP will result in a referral for a clinical assessment.
If the existence of a problem is confirmed, the clinician will determine which of two
courses of action is most appropriate for the client:
A. The problem is judged to be resolvable on a short-term basis (averaging 6
' tar sessions, but with no limit); or
B. The problem will require either long term care or the services of specialist or
facility to whom a referral will be made.
The parties hereto expect that at least 70% of the cases which enter EAP will be handled
on a short term basis within the structure of the EAP.
6. COST
The cost of the EAP contract will be calculated in the following manner:
The City of Edgewater will pay Act $11.50 per employee per year. Reimbursement for
the EAP contract will be accomplished in the following manner:
On the first day of each three month period, beginning on the effective date hereunder,
the personnel office of the City of Edgewater will determine the total number of EAP
eligible employees and inform a designated EAP representative at Act. Act will send an
invoice to the designated City of Edgewater office for that number of eligible employees
multiplied by $2.875.
7. TERM OF CONTRACT
The term of this contract shall be from October 1, 1993, through September 30, 1994,
with one year renewal at City of Edgewater option upon the same terms and conditions.

8. INDEMNIFICATION
Act will indemnify and protect and save harmless the City of Edgewater from any loss,
cost or claim of damages whatsoever sustained hereunder, if such loss is occasioned by
the negligence of Act, through its agents or representatives.
9. LITIGATION
In connection with any litigation arising out of the terms of this agreement, including
Appellate proceedings, the prevailing party shall be entitled to reasonable attorney's fees
and costs.
10. CANCELLATION
This contract may be cancelled without cause by a thirty (30) days written notice by
either party hereto each to the other.

SUBJECT: Defective Road Paving /CIP
Attached are two previous memos, one sent to me by the City
Engineer and subsequently my memo to the City Council. We have
further analyzed the situation regarding the roadway restoration
and my recommendation previously made in my October 20, 1993, memo
is reiterated. The recommendation is for alternative 2 on Kyle
Fegley's enclosed memo. The exact cost is being reviewed by the
City Engineer and will be presented to the City Council on Monday,
together with this recommendation.
`.r The design engineer of this project may or may not have been
responsible for the problems, however,'it should be assumed that
had the specifications for additional asphalt been included at that
time, the cost would be approximately the same to provide the
necessary paving because of the additional cost of asphalt.
It is requested that the City Council authorize the City staff to
move forward with the appropriate change orders to provide the
necessary overlay and acceptable restoration of the CIP paving.
Although at this time the responsibility of the specifications will
have to be researched further, it is recommended that Council
direct a full investigation of this matter prior to determining
responsibility and at that time to take appropriate action as
determined by the research.

SUBJECT: Analysis of Defective Paving /CIP
The enclosed preliminary technical analysis of the CIP street
restoration from the City Engineer defines primary reasons of
failure characteristics in the current Capital Improvements
Program.
Kyle has explained the technical testing and analysis that has been
ongoing during the CIP.
Although more information will be received as the remaining streets
are restored, it becomes very clear at this time to me that the
City should take remedial., action to stabilize streets and increase
longevity of pavement. This will involve change orders to the
original contract and is estimated at approximately $100,000 per
phase to follow the City Engineer's recommendation to mitigate
problems, which is option 2, page 2.
Unless additional information is determined which would alter this
recommendation, I will be requesting Council authorize these change
orders at the November 1st Council meeting to address the problems
before the CIP is completed. First, it will correct the problems
in a timely manner, extending pavement life to at least 10 years
without serious deterioration. Second, the cost of change orders
can be accomplished within the existing CIP budget, which is
currently under budget. Delay in making this decision will not
reduce the cost of remedial action and would probably have to be
funded outside the scope of this project either through the
Utilities or General Fund expenditures. This would either
dramatically increase user fees, general ad valorem taxes, or both.
Change orders at this time would further reduce future costs by
using the contract unit bid price for work in progress and not
requiring extension of contract time at substantial additional cost
to the City.

A decision to make appropriate change orders at this time in no way
eliminates or reduces responsibilities and accountability of the
engineering firm or contractor should litigation be necessary.
Therefore, the City can only benefit from this decision.
Should the project be completed in compliance with the contract and
original contract specifications, I predict the City will
experience rapid deterioration of roads and costs much greater than
change orders now.
A more perfect solution obviously is to spend considerably more
money to mill and stabilize sub - grade, which I estimate would
exceed $1,000,000. When looking at the cost benefits of this
solution, the additional 3 - 4 years pavement longevity does not
justify alternative 1 in this report.
Many remaining questions need to be asked of the City's consulting
engineers and discussions prior to finalizing specifications for
``ow the Capital Improvements Program. This cannot be concluded quickly
and regardless of any mistakes possibly made, the corrective work
should be completed now, and I strongly urge Council to authorize
the necessary changes promptly.

Roadway Restoration of Flexible Pavement
The City has expressed concern regarding premature pavement failure within
Phase 2 and 3 of Florida Shores C.I.P. project. In order to define the cause
of pavement deterioration a meeting was conducted on October 11, 1993, which
included representatives from the City, DRMP, 5 & E Contractors, Inc.,
Universal Engineering Sciences, Inc. and MacAsphalt. A field inspection was
also conducted on said date to determine the type of failures and if there
were any consistencies in the failure characteristics.
Prior to any analysis of the pavement failure it is evident there are three
(3) primary reasons for the present condition of the streets: •
Saw
1) Lack of quality control in the field.
2) Deficient thickness of roadway cross - section.
3) Inappropriate /undesirable design for this application.
I do not believe the problems are a result of reason no. 1, as Universal
Engineering Sciences, Inc. (Universal) is on site on a daily basis to provide
quality control. Our Inspectors also thoroughly peruse the road base prior to
placement of the asphaltic pavement and direct Universal to conduct LBR and
thickness tests where areas appear not to meet the minimum standards. If test
results are unsatisfactory, the Inspector notifies the Contractor and paving
is postponed until the deficient area is addressed and retests prove
satisfactory.
Reason no. 2 regarding problems with the roadway cross- section appeared to be
the cause of immediate pavement failures that were evident during the 10/11/93
inspection. Specifically, the asphaltic concrete developed thin spots in
areas that could not withstand the impact loads and therefore rapidly
deteriorated. Other pavement failures appear result of deficient base due to
insufficient compaction efforts which have created longitudinal cracks in the
asphalt that shove towards the edge of pavement. These two causes of pavement
failure are proven by the appropriate test methods (coring, LBR's & in -place
density tests) and once proven will be rectified by the responsible party
(Contractor and /or Asphalt Subcontractor). Although it is impossible to
inspect and test every square inch of base and asphalt material, I have
instructed our Inspectors to intensify the number of field tests, and in order
to qualify the asphalt material in which we are receiving further analysis
will be done on such. This involves extraction, gradation and stability tests
to be performed on the asphaltic concrete for comparison to the approved
design mix. Also to improve edge of pavement stability I have requested the
Contractor to extend the stabilized base material a minimum of six (6) inches
from edge of pavement.

Nov► The design cross- section of the roadway is an eight (8) inch thick shell base
(98Y max. density per AASHTO T -180) placed on top of existing grade with a
surface course of one (1) inch thick type S -III asphaltic concrete.
As we have discussed in the past it is my understanding that a moderate number
of north -south streets in Florida Shores had a soil- cement base with the same
thickness or thicker friction course as called for in the C.I.P. roadway
restoration. Obviously, soil - cement if placed at the same thickness will
provide longer serviceability as according to FDOT Design Standards it has a
higher structural coefficient. This in combination with my analysis of the
roadway, conversation with design technicians, and FDOT design Engineer leads
me to believe the City needs to consider alternate roadway designs.
Two possible alternatives to strengthen the roads that have already been paved
under Phase nos. 2 & 3 are as follows:
1) Mill the road, stabilize the sub -grade ( ±10 "), mix in -place soil- cement
( ±6 ") and construct the surface course with type S -III (1'¢ "). This
alternative is extensive and would not be monetarily feasible at this
time. •
2) Overlay the existing surface course with 1" of type 5 -III asphaltic
concrete, thus establishing a total of 2" of asphaltic concrete. This
alternative extends the serviceability of the road to an extent, but
will not rectify any problems that are attributable to subgrade failure.
Alternative No. 2 is the most practical and cost effective. I do not
have a cost estimate from the Contractor at this time, but I estimate
the cost to be approximately $100,000 extra per phase.
At this stage of the project there is only one street in which the Contractor
has not sand - sealed the base, that being Willow Oak from 24th to 30th Street.
Since this street has a high volume of trips generated I would recommend
stabilizing the subgrade and placing l" to 2" of asphaltic concrete as the
surface course, both these items are again above and beyond what is called for
in the Contract Documents, thus would require an additive change order.
I also recommend constructing the remaining roads with a 2" type 5 -III surface
course in lieu of the specified 1 ".
The Contractor is aware of these alternatives through verbal means only. I am
currently working on a. formal requisition such that I can receive some
%re concrete costs, at which time I will forward to
you and ultimately the City
Council for a determination on whether or not we should pursue such
alternatives.

ITEM DESCRIPTION /SUBJECT: Change Order No. 2 for the Roberts Road '
Bicycle Trail Project, which decreases the Contract Price by one
thousand five hundred dollars (31,500.00).
BACKGROUND: The Project had outstanding construction items that
remained stagnant in excess of two years. The City was recently
approached by the Contractor (Central Coast Contracting) who
attempted to resolve the outstanding issues in order to closeout
the project. Upon final inspection of the Project the City
star determined some items did not meet the intent of the project
plans and would require a monetary sum of $1,500.00 to rectify,
as such the Contractor chose to deduct the monies from the
Contract Amount.
RECOMMENDATION: Approve the change order for a net decrease of
$1,500.00.

AN ORDINANCE CREATING CHAPTER 7A (CABLE
TELEVISION REGULATION) OF THE CODE OF
ORDINANCES, CITY OF EDGEWATER, FLORIDA;
PROVIDING FOR CABLE TELEVISION RATE REGULATION
CONSISTENT WITH FEDERAL COMMUNICATION
COMMISSION REQUIREMENTS; PROVIDING FOR
CONFLICTING PROVISIONS, SEVERABILITY AND
APPLICABILITY; PROVIDING FOR CODIFICATION, AN
EFFECTIVE DATE AND FOR ADOPTION.

WHEREAS, the City Council of the City of Edgewater, Florida,
has determined that in order to qualify to regulate cable
television rates a rate regulation ordinance consistent with the
Federal Communication Commission's rate regulation rules must be
adopted.
NOW THEREFORE, BE IT ENACTED by the People of the City of

PART A. CREATION OF CHAPTER 7A (CABLE TELEVISION REGULATION) OF
THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA
Chapter 7A is hereby created to read as follows:
Section 7A -1. Rate Regulation.
A. Any rate or charge established for cable television
service, equipment, repair and installation shall be reasonable,
lust and fair to the public. In determining whether a rate or
charge is reasonable, just and fair, the City shall apply the cable
television rate regulation criteria established by the Federal
Communications Commission (FCC).

B. Should a Franchisee desire to change any rate or charge,
it shall submit a written proposal for the amounts and effective
date of such change to the City Manager who shall evaluate the
proposal in a manner consistent with FCC cable television rate
regulation standards and report this evaluation to the City
Council. The City Manager's report shall be placed before the
Council at a duly noticed public hearing. The Franchisee shall
notify each subscriber, in writing, of the proposed rate change
and the date and time of the public hearing. At such hearing,
evidence shall be taken and received on whether the proposed rate

or charge is consistent with FCC standards. Upon conclusion of the
public hearing, the City Council shall decide the matter by
majority vote and adopt a Resolution approving, disapproving or
modifying the proposed rate changes and providing such relief as is
appropriate and authorized by FCC rate regulation standards. The
resolution shall set forth complete findings of fact and
conclusions regarding all of the basic elements considered in the
City Council's determination.
PART B. CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof
in conflict with this ordinance, are hereby superseded by this
ordinance to the extent of such conflict.
PART C. SEVERABILITY AND APPLICABILITY.
`w'' If any portion of this ordinance is for any reason held or
declared to be unconstitutional, inoperative, or void, such holding
shall not affect the remaining portions of this ordinance. If this
ordinance or any provisions thereof shall be held to be
inapplicable to any person, property, or circumstances, such
holding shall not affect its applicability to any other person,
property, or circumstance.
PART D. CODIFICATION.
Provisions of this ordinance shall be incorporated in the Code
of Ordinances of the City of Edgewater, Florida, and the word
"ordinance ", may be changed to "section ", "article ", or other
low
appropriate word, and the sections of this ordinance may be
renumbered or relettered to accomplish such intention; provided,
however, that Parts B through F shall not be codified.
PART E. EFFECTIVE DATE.
This ordinance shall take effect upon adoption.
PART F. ADOPTION.

,Resolution No. 93 -R -27 Urging an End or Limit to State Mandates
without Adequate Funding.
BACKGROUND:
The Florida League of Cities is having a legislative session in
Tallahassee November 4 -5, 1993. The main issue I would ask that
the Council express concern about and request legislative action
on is the issue of mandatory regulations being promulgated by State
agencies, which under the guise of regulations are really State
mandates which end up causing all cities major expenses. An
example of this is the Comprehensive Development Plan which has
cost the City of Edgewater to date in excess of $150,000 to
$250,000. Currently, the Department of Community Affairs is also
Notor in the process of promulgating additional regulations under the
Comprehensive Development Plan rule 9.J5, referred to as ICE, and
other associated regulations which will significantly increase the
cost to all cities and developers. Furthermore, these regulations
will have a negative effect on growth and development and will
continue to adversely effect the economic recovery of the State and
Volusia County.
RECOMMENDATION /CONCLUSION:
I would ask that Council consider adoption of Resolution No. 93 -R-
27 in an effort to effectuate change.

STATE LEGISLATURE TO END OR LIMIT STATE
MANDATES WITHOUT ADEQUATE FUNDING; ENCOURAGING
ALL CITIZENS TO RECOGNIZE THE SEVERE PROBLEMS
THAT UNFUNDED STATE MANDATES IMPOSE ON CITIES;
REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the number of unfunded State mandates on cities and
counties have significantly increased during the last decade; and
WHEREAS, many State programs, which were made available to
local governments to ease the burden of carrying out State
programs, have been terminated or drastically reduced; and
Now WHEREAS, these mandates have been added to the financial
hardships that some cities and counties are experiencing and have
resulted in the need for many local governments to increase
revenues or curtail services; and
WHEREAS, studies have shown these mandates consume a large
portion of most city and county budgets, meaning that these local
dollars are used to fund State priorities rather than local
priorities; and
WHEREAS, there are proposals before the Legislature to limit
unfunded mandates and the burdensome regulations that accompany
many State laws.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Edgewater, Florida:
Section 1. That the City of Edgewater requests the Chiles
administration and the Legislature pass meaningful legislation to
end or limit the practice of unfunded State mandates, and to
include in any future mandate, provisions requiring local
government input, cost /benefit analyses, and scientifically sound
assessments of purported health, safety, and or environmental risk.
