6. CONSENT AGENDA
Items on the consent agenda are defined as routine in nature that do not
warrant detailed discussion or individual action by the Council; therefore, all
items remaining on the consent agenda shall be approved and adopted by
a single motion, second and vote by the City Council. Items on the consent
agenda are not subject to discussion. One of the most basic rules of a
consent agenda is that any member of the City Council may remove any item
from the consent agenda simply by verbal request at the City Council
meeting. Removing an item from the consent agenda does not require a
motion, second or a vote; it would simply be a unilateral request of an
individual Councilmember.

A. US 1 Arterial Investment Study (AIS) - Purpose is to identify needed
transportation improvements along US 1 corridor, from south
of S.R. 442 to north of 1-95 at Ormond Beach.
B. Special Event - Veteran's Day Parade - Edgewater American Legion
Post #285 requesting permission to hold a parade on
November 11, 1998, at 9:00 a.m., commencing at Veteran's
Park.
C. Camp Out at Rotary Park - Cub Scouts requesting usage of Rotary
Park for overnight camping (Cub Scout Family outing) the
weekend of October 11 and 12, 1998.

1998 Local Law Enforcement Block Grant
BACKGROUND:
The purpose of the Local Law Enforcement Block Grant Program (LLEBG) is to provide the means
for local agencies to reduce crime and improve public safety. The Police Department was selected
to receive a Grant in the amount of $16,734.00 with a 10% ($1,670.00) match by the City bringing
the total amount to $18,400.00. These funds will be utilized in purchasing radio and computer
equipment.
The Application (copy attached) for acceptance has been forwarded to the Department of Justice and
the City is currently awaiting receipt of the Grant Agreement. Due to time constraints on the
Application and Agreement Council is being asked to consider approval of execution upon receipt
of the documents.
RECOMMENDATION /CONCLUSION:
Staff recommends that the City Council accept the $16,734.00 Grant and provide the 10% match of
$1,670.00 along with approval of the Mayor to execute the Agreement.

MANAGEMENT DISTRICT; PROVIDING FOR CONFLICTING
PROVISIONS, SEVERABILITY AND APPLICABILITY; PROVIDING FOR
AN EFFECTIVE DATE; PROVIDING FOR ADOPTION AND
CODIFICATION.
WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
1. The City currently has an exemption from stormwater permitting requirements for
alterations or improvements to existing structures which incorporates 1,000 square feet or less of
impervious area as a result of the improvements. St. Johns River Water Management District's
1r.► ( "SJRWMD ") permit threshold is 4,000 square feet or more impervious surfaces subject to vehicular
traffic and/or when 5,000 square feet or more building or an impervious surface is created.
2. The City currently requires that projects comply with SJRWMD and City permitting
requirements.
3. It has been determined that the current duplication in . the permitting process may
create unnecessary delays and unforeseen financial obligations for developers.
4. The City Council has determined that it is in the best interests of the citizens of
Edgewater to modify the permitting requirements reflecting all projects that currently require
duplicate permits to now require either a City or SJRWMD permit, not both.
NOW, THEREFORE, BE IT ENACTED by the People of the City of Edgewater, Florida:

PART A. AMENDMENT OF CHAPTER 9.5 (FLOOD CONTROL AND
DRAINAGE), SECTION 9.5 -56 (EXEMPTIONS) OF THE
CODE OF ORDINANCES, CITY OF EDGEWATER,
FLORIDA.
Section 9.5 -56 is amended as follows:

Section 9.5 -56. Exemptions.
For the purpose of this article, the following activities shall be exempt from the formal
permitting procedures of this article:
(1) Maintenance work on utility or transportation systems, if performed on established
rights -of -way or easements; provided such maintenance work does not alter the
purpose and intent of the system as constructed.. -j
(2) Maintenance work performed on existing mosquito control drainage canals for the
purpose of public health and welfare;
(3) Any maintenance, alteration, renewal, use or improvement to any existing structure
not changing or affecting the rate or volume of runoff as determined by the methods
defined in section 9.5 -57;
(4) The acceptance of a plat by the city council in accordance with the subdivision

regulations, or approval of a site plan in accordance with the zoning ordinance, shall
be construed as a permit and a separate permit under this article is not required, but
compliance herewith shall be demonstrated as a part of the review procedure
pursuant to Ordinance No. 880 or Ordinance No. 79 -0 -7. Subsequent changes or
additions not reflected by the accepted plat, or site plan, however, shall be subject to
the terms of this article; afiel-
(5) Any maintenance, alteration, renewal, use or improvement to an existing structure
not changing or affecting rate or volume of stormwater runoff; and the one time
construction of any structure or addition not otherwise exempt not exceeding one
thousand square feet of impervious area on or parallel to the ground.. -; and
(6) Any maintenance, alteration, renewal, use, or improvement subject to both Saint
Johns River Water Management District and the City of Edgewater permitting shall
only require the former permit if the design standards comply with City code. The
design must meet the intent of the City's general drainage requirements, such as, for
example, onsite pollution abatement, equivalent pre- development and post -
___ development peak discharge rates and volume for a 25 year, 24 hour storm event, and
equivalent pre- development and post - development peak discharge rate from a 100

PART B. CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance,

If any portion of this ordinance is for any reason held or declared to be unconstitutional,
inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this
ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or
circumstances, such holding shall not affect its applicability to any other person, property, or
circumstance.
PART D. CODIFICATION.
Provisions of this ordinance shall be incorporated in the Code of Ordinances of the City of
fir.+ Edgewater, Florida, and the word "ordinance" may be changed to "section ", "article ", or other
appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish
such intention; provided, however, that Parts B through F shall not be codified.

approval of lifting the three (3) employee cap in the B -2 Light Manufacturing District. On July 6,

in both, Light Manufacturing and Machines and Repair Districts.
City Council requested that Ordinance No. 98 -0 -05 be drafted showing the proposed amendments
to Section 606.01 (B -2 Neighborhood Business District) by lifting the employee cap for Machines
and Repair and Light Manufacturing.
RECOMMENDATION /CONCLUSION:
Staff recommends that the City Council consider approval at first reading of Ordinance No. 98 -0 -05.

(b) The project shall be completely fenced, walled, and designed to limit
ingress and egress through a controlled and lockable access point.
This shall be limited to one two -way access points or two (2) one -way

(c) Miniwarehouse units shall not contain any provision for electric,
potable water, or sewer services within the confines of the warehouse
units. Lighting and hose bibs for cleaning purposes may be installed
on the outside of the warehouse structures.
(d) Bathroom facilities will be provided at a central facility at a ration of
one bathroom per each fifty (50) units, or fraction thereof.
(e) Miniwarehouses are to be used solely for storage purposes. No other
commercial use or business shall be permitted within the facility.
However, one office unit attached by common walls or floors as a
part of the miniwarehouse facility may be provided for use of the
warehouse manager.
(f) No storage of flammables, weapons, ammunition, explosives,
hazardous, or illegal substances or materials is allowed.

Planning Organization initiated the US 1 Transportation Study in January of
1997. The purpose of the project is to identify needed transportation
improvements within the US 1 corridor extending from south of SR 442 in
Edgewater to north of 1 -95 near Ormond Beach. Several public open houses
have been held during the course of the project to inform the public of the
results of data collection and analysis.
The 15- minute presentation to Council /Commission members will cover an
overview of the project and identify transportation deficiencies and preliminary
altematives under consideration. The questions and input received at this
session will be considered in the development of alternative transportation
improvements. The proposed alternative improvements will be presented to the
public at an open house meeting to be held on September 8, 1998, at Riverside
Pavilion, 3431 Ridgewood Avenue, Daytona Beach, Florida.

The Florida Department of Transportation and the Volusia County Metropolitan Planning
Organization are conducting the U.S.1 Arterial Investment Study. (Herbert•Halback, Inc. is
assisting in the implementation of the project's public involvement plan.) The U.S. 1 Arterial
Investment Study was initiated in March 1997. The purpose of the study is to identify needed
transportation improvements along approximately 33 miles of the U.S. 1 corridor. The study area
extends from south of S.R. 442 at Edgewater to north of I -95 at Ormond Beach. A copy of our last
newsletter is enclosed. This newsletter provides basic information regarding the project.
The study team has held two sets of open houses since the inception of the study. Another round
of open houses will be held in September 1998. At these upcoming meetings, the study team will
display information regarding the development of preliminary transportation alternatives. The
public will be asked to provide their input on the alternatives presented.
The U.S. 1 Arterial Investment Study will conclude in January 1999. At that time, the study team
will provide a list of recommended transportation projects for further study at the project level. The
recommendations address the results of the technical analysis of the transportation corridor as well
as public input. It is the study team's intention to keep the City Council informed throughout the
process.
Therefore we request that the study team be placed on the City Council's July 20 agenda to
present the status of the U.S. 1 Arterial Investment Study. The presentation is informational in
purpose, and no action will be requested of the Council. Our presentation is approximately 10
Now minutes in length, and we would be pleased to respond to any questions or comments from the
Council.
The presentation provided at the Council meeting would constitute both summaries of the activities
completed and input received to date, as well as a preview of the upcoming open house information.
The presentation to the Council will focus on those issues of importance to the City of Edgewater.

As Commander of the Edgewater American Legion Post # 285, it is my pleasure to
request your permission to hold a Veterans Day Parade on November 11 at 9:00 AM. All
entries will be checked in between 8:00 and 9:00 AM on the morning of Nov. 11 at the
Menard May Park.
At 9 :00 AM the parade will commence south on Riverside Drive ending at Veteran's
Park_ We will try to have a reviewing stand around New Hampshire Avenue. Will
disembark and assemble in the Veterans Park for a program and ceremony_ Following the
ceremony we plan to have a catered Bar B Q and entertainment for everyone present.
Bahia Shrine Temple has agreed to participate calling on their parade units to come out
and help us celebrate Veteran's Day. It is the policy of Bahia Shrine Temple to receive
the request in writing, on City letterhead and submit it to the Divan for approval. It will
be necessary for the City to assist us in this matter.
In the next few months we plan to post flyers inviting all local business to participate in
this festive celebration. We would also like to invite the schools to participate. Knowing
that this is a school day, we hope it can somehow be worked out
These are our preliminary plans which hinge on your approval. It is our hope that you will
want to get on the band wagon and make your float a 1 prize winner. It our sincere hope
that Veteran's Day, 1998 will be a day to remember for everyone of all ages in
Edgewater_

Request from Cub Scouts to camp out at Rotary Park the weekend of October 10 and
11 1998.
BACKGROUND:
Local Cub Scout groups in the Halifax area are asking to use Rotary Park for a Cub Scout
Family outing the weekend of October 1 lth and 12th, 1998. This event will require
overnight camping at the park. Ordinance No. 84 -0 -29, Section I.5 prohibits the use of
City parks for overnight camping. Ordinance No. 89 -0 -14, Section 12.5 -2 states that City
Council may change hours in order to accommodate special events and any other event
the Council deems appropriate.

RECOMMENDATION /CONCLUSION:
Staff recommends that City Council permit usage of Rotary Park for this event (Cub
Scout Family outing) on the weekend of October 11 and 12 1998.

The purpose of this letter is to inquire, to you and the City Council,
about the use of Edgewater's Rotary Park in October of 1998. As we have
discussed, the local Cub Scouts in the Halifax District are looking for
a place to camp out overnight for a family camping area.

We would be cooking dinner and breakfast and, of course, the families
would be staying overnight. It would be our purpose to make sure that
we left the area in better condition than when we found it.
If there is a deposit required,or anything of that nature, please let
me know.
We hope that the City Council agrees with this wise use of this excellent
piece of property. Our goal would be to have a family 'outing for the Cub
Scouts, and by having it at the Rotary Park it would expose the Cub Scouts
to the public, so that the public will realize that Scouting is alive in
America today.

As we discussed yesterday, our plans for the Cub Scout Family Outing
would be to have it at Edgewater's Rotary Park on October 10th and
11th.
The Boy Scout Troop, which acts as a support group for this, would
arrive early Saturday morning or possibly late Friday night. The
Cub Scouts and their families would arrive Saturday, October 10, 1998
and leave around noon on Sunday, October 11, 1998.
As we have discussed, liability insurance is not a problem and the
Cub Scouts in your family are covered fully by the Boy Scouts of America
policy.
We look forward to displaying Boy Scouts of America in the city of Edge-
water and letting the people in the area know that Scouting is alive and
well.
