No. 2002-R-25, repealing Resolutions 90-R-63, 84-R-40 and 80-R-149 in their entirety and adopting/enacting a new public records policy and fee schedule. 7. CONSENT AGENDA Items on the consent agenda are defined as routine in nature that do not warrant detailed discussion or individual action by the Council; therefore, all items remaining on the consent agenda shall be approved and adopted by a single motion, second and vote by the City Council. Items on the consent agenda are not subject to discussion. One of the most basic rules of a consent agenda is that any member of the City Council may remove any item from the consent agenda simply by verbal request at the City Council meeting. Removing an item from the consent agenda does not require a motion, second or a vote; it would simply be a unilateral request of an individual Council member. A. Law Enforcement Trust Funds - staff requesting approval to use Trust Funds in the amount of $2,450 to purchase Citizens Assisting Police (CAP's) uniforms and equipment. 9. OTHER BUSINESS A. Continuing Professional Engineering Services - staff recommending to negotiate contracts with CPH Engineers, Gierok Engineering, Professional Engineering Consultants (PEC), Quentin L. Hampton (QLH) and Weldon Land Development to perform engineering services and authorize the Mayor to execute the contract(s). B. ParkTowne Industrial Center Phase I Additional Engineering Services - staff requesting approval to extend the agreement with Gierok Engineering, Inc. until December 4, 2002, at the current monthly billing rate of $9,233, and authorize the City Manager to execute the agreement. C. ParkT owne Industrial Center Phase I Change Order #2 - staff requesting approval of Change Order #2 in the amount of $237,677.76 and a time extension of 142 days to Star Base Development Company, Inc. and to authorize the City Manager to execute the document. 10. Ignasiak FROM: Officer Brian Mallard SUBJECT: Letter of Appreciation to Citizen Chief Ignasiak, On September 4, 2002, I was transporting a prisoner to the Volusia County .Jail, and while enroute the prisoner managed to get his handcuffs in front of him and he attempted to escape from my patrol vehicle by attempting to break out the rear window. I stopped the patrol vehicle and went to the rear of the vehicle and attempted to make contact with the prisoner in an attempt to keep him from breaking the window. As soon as I opened the rear door ofthe patrol car the prisoner lunged from the car and attacked me. While I was in the midst of attempting to restrain the subject to keep him from further escape, a civilian passerby named Brian Coffey who lives at 2625 Orange Tree Drive, observed that the escapee was actively resisting my efforts to prevent his escape and Mr. Coffey stopped to assist me in restraining the escapee. I would like to respectfully request that a formal Letter of Appreciation be presented to Mr. Coffey in response to his actions in assisting me in restraining the felon. I am sure that without citizens of Mr. Coffey's caliber, our jobs as Law Enforcement Officers would be far more difficult than it already is. Thank you for your consideration on this matter. Ignasiak Chief of Police Mr. Brian Coffey 2625 Orange Tree Drive Edgewater, Fla 32141 September 18, 2002 Mr. Coffey, It has come to my attention that on Wednesday, September 4th, 2002 that you were of great assistance to the Edgewater Police Department, which I feel needs, recognized. On that date one of our Officers was transporting a violent offender to the Volusia County Jail after an arrest. Somehow, during the transport process the defendant managed to get his handcuffs in front of him and was attempting to break out the vehicles windows to escape. The Officer stopped the vehicle and attempted to regain control of this violent suspect where a struggle ensued. o Upon opening the rear door, the suspect immediately assaulted the Officer in his attempt to escape. The Officer in question stated that a passerby (you) saw what was happening and immediately came to his assistance in helping to physically subdue and regain control of the arrestee. Your active physical assistance helped prevent a potential serious situation where injury, escape, or other consequences might have occurred. We would not only like to extend our appreciation for your efforts but also recognize your actions our local Commission meeting. All parties entered into a Stipulation and Settlement Agreement where 6 of the 9 local amendments would be repealed and the other 3 would be restated and remain active. ST AFF RECOMMENDATION: Staff recommends approval of Ordinance #2002-0-16 in an effort to comply with the Stipulation and Settlement Agreement. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: WHEREAS, a public records policy was enacted by adoption of Resolutions Numbered 80- R-149, 84-R-40 and 90-R-63; and WHEREAS, the City of Edgewater public records policy has not been modified since 1990 and upon review, it has been determined that said policy should be replaced and brought up-to-date; and WHEREAS, in order to update the policy, the City desires to enact a new public records policy and establish a schedule of fees. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida: Section 1. Resolutions numbered 80-R-149, 84-R-40 and 90-R-63 are hereby repealed in their entirety. Section 2. The following public records policy and schedule offees is hereby established: A. B. All records shall be under the possession and custody of the City Clerk or his/her designee while being inspected, reproduced or copied. D. The City Clerk shall not relinquish possession and/or control of any original public records of the City of Edgewater except when directed to do so by an order from a court of competent jurisdiction, or when directed to do so by at least a three fifth affirmative vote of the City Council. o E. Additional policy requirements and the schedule of fees are contained and further described in Exhibit "A" which is attached hereto and incorporated herein. Section 3. Severability. If any section, subsection, sentence, clause, phrase or portion of this Resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. "Public records" means all documents, papers, letters, maps, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of the physical form, characteristics, or means of transmission, made or received pursuant to law, ordinance, or in connection with the transaction of official businesses by the City (9119.011 (1), F .S.). Pursuant to 9 119.07(1)(a), Florida Statutes, "every person who has custody of a public record shall permit the record to be inspected and examined by any person desiring to do so, at any reasonable time, under reasonable conditions, and under supervision by the custodian of the public record or the custodian's designee." F or the purpose of this policy, "reasonable" time to provide access to public records is during normal business hours - Monday - Friday, 8:00 a.m. - 4:30 p.m.. "Reasonable" time-frame to provide copies, dependent upon the volume of records requested, shall be five (5) working days. For the purpose of this policy, "extensive clerical or supervisory assistance" is determined to be requests that require more than one hour of an employee's time to research, retrieve and copy the requested records. For public records requests requiring more than one hour, the requester will be required to pay the hourly salary of the employee doing the research, copying the records and/or supervising the requester's research. This hourly fee will begin after the first hour of clerical or supervisory assistance is completed. For requests estimated to require more than one hour of a City employee's time, a minimum deposit of$25 .00 will be required (deposit will be adjusted depending on the volume of records/research requested). The deposit will be applied to the final cost of the public records request. Any requestor of public records who submits a request for records to be delivered by facsimile transmission shall be informed that the charge for the records/documents would be the normal charges listed herein (which would cost less per page) versus the charge for facsimile transmission. BACKGROUND: The CAPs unit provides valuable crime prevention, awareness, and Community services to the Citizens of Edgewater and it's Police Department. As part of their regular duties they patrol the residential neighborhoods and commercial zones looking for crime, checking on vacant houses, and assisting with traffic control in local School zones freeing Officers for other duties. CAPs Officers work in the Community in uniform and operate marked vehicles for both high visibility and easy identification for the public. In an effort to increase these services the Edgewater Police Department has expanded the number of CAPs Officers in the unit to fifteen (15). To facilitate this I am requesting that we expend $2,450.00 in Law Enforcement Trust Funds to outfit all new and present members for field duty. STAFF RECOMMENDATION: Staff recommends that the City approve the use of Law Enforcement Trust Funds in the amount of $2,450.00 to purchase CAP's uniforms and equipment. The City Manager appointed a selection committee to review the proposals and select the firm(s) best suited to provide engineering services to the City based on current and projected project lists.
