8. CONSENT AGENDA
Items on the consent agenda are defined as routine in nature that do not warrant detailed
discussion or individual action by the Council; therefore, all items remaining on the consent
agenda shall be approved and adopted by a single motion, second and vote by the City
Council. Items on the consent agenda are not subject to discussion. One of the most basic
rules of a consent agenda is that any member of the City Council may remove any item
from the consent agenda simply by verbal request at the City Council meeting.
Removing an item from the consent agenda does not require a motion, second or a vote; it
would simply be a unilateral request of an individual Council member.

9. OTHER BUSINESS
A. Recycling Services - staff recommending approval to authorize a Notice of
Intent to Award to Florida Recycling Services, Inc. for curbside residential
recycling services at a bid proposal of $1.43 per residential unit and authorize
the City Manager to execute the contract documents upon receipt of
insurance, bonds and other documentation.
B. Investment Policy - staff recommending approval of the Investment Policy
to update existing policy dated September 1995 in order to comply with
Florida Statute 218.415.
C. Red Cross Agreement - staff recommending renewing Agreement between
the Florida's Coast to Coast Chapter of the American Red Cross and the City
of Edgewater and authorize the Mayor to execute the document.
D. Insurance - City will receive insurance bids prior to October 1, 2002
expiration. Staff requesting authorization for City Manager/Mayor to execute
contract with low offeror for FY 200212003 policy.

Dear Edgewater City Councilman/woman,
In reference to the city budget meeting, and the increase in the millage rate for 2002.
I was very disappointed in the reaction to the increase in the millage rate from 24.9258 to
25.809D. I feel that this is a major increase. I understand the cost ofinsurance going up, but if
this is tb'bail out the retirement money that was bad investments than I think its terrible. Everyone
that in~ted in the stock market lost money. Those poor people that were with Enroll, had to go
back t<i:irork instead of retiring. We the citizens of Edgewater paid once toward their retirement
why shQ!Jld we have to bailout the cities bad investments. No one is bailing me out of mine or
the others ~ho lost money.
I woui~preciate if you could try and "Nickel and Dime" down the budget. Not everyone can
afford that increase.
The wolffim on the board at least could see a problem, but to just pass it and stop whining about
it, I feel that we are headed for the same problems as Daytona Beach. I don't think that for the
one fire that we had in Edgewater, that we just give them whatever they want. Besides didn't they
say it was a volunteer fire fighter that did that job? These guys on the fire department work two
24 hour days, are they awake the whole time? No, you may find them over at the YMCA working
out and reading a book. I think they also work other jobs. Please reconsider this increase.
Also enclosed is a copy of the mans trim notice who spoke on Monday night who said his taxes to
the city of Edge water went up. I highlighted the amount he pays just to the city of Edge water.
See the City Manager is giving you a estimate of increase on $60,000. Mine went up more than
his average, and so did a lot more other people. Its going to be tough to get a new city building
the way its going.

ITEM DESCRIPTION:
Ordinance 2002-0-13 amending the City Budget for the Fiscal Year Ended September 30, 2002.
BACKGROUND:
During the fiscal year 2001-2002, many additional projects and purchases evolved that were not
known during the budgeting process for FY2002. Since that time, various opportunities have risen
which require a budget amendment both for revenues and expenditures. Some of these items are the
purchase of the house for fire administration/animal control/code enforcement and the expenditures
associated with consolidated dispatch, as well as Waterway Park water lines and the Bank of
America debt issue. Based on a recommendation from our auditors, special revenue funds have been
created to account for impact fees and special law enforcement trust fund monies.
STAFF RECOMMENDATION:
Staff recommends approval of Ordinance #2002-0-13 to amend the budget for fiscal year ending
September 30, 2002.

BACKGROUND:
In accordance with Florida statutory requirements, the City of Edgewater advertised a Notice of
Public Hearing informing the public/citizens of the Special MeetinglPublic Hearing regarding the
final millage rate and budget for the fiscal year 2002 - 2003.
o On July 15, 2002, Council approved advertising a millage rate of 6.95 mills per $1,000.00 of
assessed taxable value. This millage rate is a 1 mil increase over fiscal year 2002-2003.
On July 8, 2002, Council conducted a work session to review the preliminary budget for Fiscal Year
2002-2003. The tentative budget is attached with all changes requested by Council at the work
session.
STAFF RECOMMENDATION:
Staff respectfully recommends that Council consider approval of Ordinance No. 2002-0-14 and
Ordinance No. 2002-0-15 which adopts the final millage rate and budget for fiscal year 2002 - 2003.

Any employee who is temporarily assigned to a position of higher rank for five (5)
working days or more shall be compensated at a rate equivalent to the greater of the
minimum salary for that classification or five (5) percent above his current salary from
the first day of assignment.
While serving in a temporary assignment, the value of any monetary benefit received,
such as. paid sick accrual, the cashing in of vacation time, shall be based on the
employee's regular rate of pay.

5.02 PROBATION
The probationary period is an important part of the employee review process and shall be utilized for
appraisal of an employee's performance, adaptability to the position, and for rejecting any employee
who does not meet the desired standards of performance. This time period may also be used to
establish the appropriate salary for an individual. A new employee and/or a promoted employee
may receive an increase in their pay upon successful completion of the probation, with the
recommendation of the Department Director, and the approval of the City Manager. An
employee on probation is considered an "at will" employee. A probationary employee may be released
from City service during the probationary period without cause, without notice and without appeal.:.
Subsequent to any employee being released from probation a drug screen may be required.
A. An employee hired into a regular full-time position is subject to the satisfactory completion
of a six (6) month probationary period before being deemed a regular City employee. An
employee hired into a police or fire full-time position is subject to the satisfactory
completion of a one (1) year probationary period before being deemed a regular City
employee. An individual who does not successfully complete the probationary period will be
required to reimburse the City for all education_and training expenses incurred.
B. Employees who are promoted, demoted or transferred will serve a six (6) month
probationary period in the new position commencing with the first day in the new position.
Police and Fire employees shall serve a one year probationary period.
C. During the probationary period, the employee's supervisor will carefully observe job
performance. Weaknesses in performance will be brought to the employee's attention and
may be put in writing by the supervisor, and submitted to the Personnel Director for
placement in the employee's personnel file.
D. Upon completion of the probationary time period, the Personnel Department will prepare a
Personnel Action Form to be executed by the Department Director and a copy given tothe
employee when releasing them from probation and into regular employment. Until such
document is executed it shall not be assumed that the probation has been successfully
completed. The probationary period may be extended at the discretion of the Department
Director, Personnel Director, or the City Manager for reasons which will be documented and
explained to the employee.

The Personnel Director has the primary responsibility for the administration and maintenance
of the Classification Plah and is authorized to:
1 . Conduct periodic ~tudies to assure that the Classification Plan and compensation for
positions remains :current and uniform.
2. Request the completion and submission of position questionnaires or other related
information when Iconsidered necessary for proper maintenance of the plan.
3. Conduct studies of an existing position when there has been a substantial change in
the duties and resbonsibilities which justify consideration of possible reclassification.
4. Maintain a position authorization summary identifying all authorized positions in the
City service.

Composition of the Compensation Plan.

Salary Ranges and proJession.
1. The Compensation I Plan consists of a salary schedule containing salary ranges, the
compensation associated with the ranges, and a schedule listing the assignments of

each class in the Classification Plan to a grade in the Salary Schedule.
2. Pay increases are n6t automatic, but may be achieved through performance
evaluations, promdtion, reclassification, or pay range adjustment. In the event an
I
employee, through education and/or training, increases his value to the City,
the Department Director and the Personnel Director may make a
recommendation for an increase in that employee's salary, and upon approval
of the City Manager, the employee's salary may be adjusted.
3. The City Manager shall have final authority to place approved position within the
Classification Plan.

7.02 CITY SERVICE
A. Continuous Service.
1. An employee's continuous service date is established as the most recent date of hire
and cannot precede the date the employee reported for and began work as a full time

2. The continuous s~rvice date for an employee who was initially hired as a temporary or
part time employ~e and becomes a regular employee is the date of full time regular
hire. I

No employee shall be entitled to vacation time without taving completed a full year's
employment. Upon completion of one (1) year of employment with the City, an
employee shall be credited with ninety-six (96) hours (12 work days for Police) of
vacation leave. Subsequent to the completion of one (1) year of employment, an
employee shall accrue vacation leave on a monthly basis.
C. Vacation leave accrued, but not used, within any given anniversary period may be
carried over and accumulated. Employees may accumulate vacation leave up to a
maximum of five hundred (500) hours. (Police & Fire personnel on 12 hour days 750
hours)
D. Upon termination of employment, except for the commission of a criminal act as
determined by the City Manager, an employee shall be paid for any unused portion of
accrued vacation time. The payment shall be determined by using the rate of pay
received by the employee at the time of termination. Immediately prior to
retirement, an employee may cash unlimited accrued vacation to insure those
hours be included in their pension calculations.
E. In lieu of taking vacation leave, vacation leave may be cashed in an amount equal to
one half of that accrued within the current anniversary period. The amount of
compensation shall be determined by using the employee's hourly rate at the timethe
vacation leave is cashed in.
F.
Vacations must be scheduled with the approval of the Department Director.
8.04 LEAVE OF ABSENCE
A. Leave of Absence With Pay.
1. Jury Duty or Witness Leave: Any employee shall be given necessary time off without
loss of pay when performing jury duty or when called by proper authority to be
a witness in a legal proceeding concerning City of Edgewater business, provided
such call to duty is reported in advance to his Supervisor and approved by the
Department Head. Any fees paid to the employee for the performance of jury
duty or being a witness shall be turned over to the City. Jury duty and witness
leave shall not be considered as hours worked for the purposes of determining
whether overtime is due.
2. Military Leave: Any employee who is a member of the National Guard or an
organized military reserve unit of the United States will be allowed a maximum
of twenty (20) calendar days leave of absence at anyone time when called to active
duty or for training. During such period of leave with pay, the employee's benefits shall
continue uninterrupted in the same manner as if they were on active duty with the City.

8.07 SICK LEAVE

Sick leave will be earned at the rate of eight (8) hours for each month of service (one

three hundred and twe~ty (320) hours (40 days for police and fire personnel).

leave, an employee shall receive as additional pay the hours in excess of three hundred and
twenty (320) (40 days)1 up to an additional eight (8) hours (full day's pay) for each month
thereafter that he does not use any sick leave. If, however, the employee uses any

sick leave after accumulating the three hundred and twenty (320) hours (40 days)
maximum sick leave, th1e employee must restore his accumulated sick leave to the

maximum again before he shall be eligible for any additional pay.
Upon termination of eniployment, except for the commission of a criminal act as
determined by the City 'Manager, an employee is entitled to a lump sum payment for
any unused portion of abcrued sick leave. Immediately prior to retirement, an employee
may cash unlimited a~crued sick to insure those hours be included in their pension
calculations. In the event of death, an employee's beneficiary shall be entitled to a lump
sum payment for any I unused portion of accrued sick leave. The payment shall be
determined by using the rate of pay received by the employee at the time of termination.

Sick leave may be used for illness in the immediate family or donated to any City
employee who has an ~mergency or long term illness. Immediate family is defined as:
spouse/co-habitant, paients, grandparents, children, grandchildren, brothers, sisters,
step-children and steptrents of either the employee or spouse.
DONATION OF SICKNAC:;ATION/PERSONAL TIME
Employees may donate laccrued sick, vacation or personal time to a City employee who has

SECTION VIII - EMPLOYEE BENEFITS
8.00 PURPOSE
In order to achieve the City's general poky to provide reasonable compensation, benefits, assurances
and safeguards to its employees, the City has developed and maintains a comprehensive package of
benefits and programs for its employees.
Benefits are automatically granted to employees based on the criteria described herein. Employees must
meet eligibility guidelines described in this section. The benefits described herein apply to regular
employees and part time employees on a pro-rata basis.
8.01 HOLIDAYS
A. The City will recognize the following as paid holidays:

Thanksgiving Day
Day After Thanksgiving

Christmas Eve
B. Whenever a holiday falls on Sunday, the holiday will be observed by the City on the Monday
following the holiday.
C. Whenever a holiday falls on Saturday, the holiday will be observed on the Friday before the
holiday.
D. For those employees working rotating shifts, if the actual holiday falls on an employee's
off duty day, he shall receive an additional day's compensation paid at his regular rate
of pay.
E. For those employees working rotating shifts, if the actual holiday falls on an employee's on
duty day, he shall be compensated at the rate of time and one-half his regular rate of pay
for all hours worked in addition to his holiday pay.
F. In lieu of holiday pay, an employee shall be allowed a day off with pay with the concurence
of the Department Head. The day taken off in lieu of the holiday must be taken within
thirty (30) calendar days after said holiday.
G. In order to be eligible for holiday pay an employee must work both his last schedulw work
day before the holiday and the first scheduled work day after the holiday unless the
absence is due to compensated leave.

8.05 BEREAVEMENT LEAVE

A. When a death occurs in the immediate family of an employee, that employee shall be
granted up to three (3) Idays bereavement leave without loss of pay. Additional time
may be taken by the e~ployee as vacation leave, personal days, sick leave, compensatory
time, leave of absence l.vithout payor a day off without pay. 0
B. The City agrees that imlediate family is defined as spouse/cohabitant, parents, mother-in-
law, father-in-law, gr~ndparents, children, grandchildren, brothers, stepbrother, sisters,
step-sister, stepchildrJn and stepparents of either the employee or spouse/cohabitant.
C. The City has the right tb request a verification of the death.

8.06 LEAVE OF ABSENCE WITHOUT PAY
A. Personal Leave

1 . The Department Director may grant a regular employee a leave of absence
without pay for a period not to exceed thirty (30) working days. Leaves of absence
without pay for a period in excess of thirty (30) working days shall be approved by
the City Manager. Such leaves may be granted only to employees who have
completed their p~obationary period and who have exhausted all of their sick,
vacation and persbnal time accrued.

2. The taking of a day off without pay shall not constitute a leave of absence without
pay until an emplc!>yee has accumulated five (5) days off without pay within any
twelve (1 2) month period
3. Benefits shall not kccrue during a leave of absence without pay. Benefits shall accrue
during a leave of 1bsence with pay until such time as the leave of absence with pay

exceeds sixty (60) working days. Benefits shall not accrue during a leave of absence
with pay exceedi~g sixty (60) working days.
4. The City shall coJer the employee under its group health plan through the end of
the month in whi6h the employee requests that the leave begin. Thereafter,
employees on lea~e may continue their benefits under the City's group health
insurance plan pr6vided the employee pays the entire monthly premium due
during the leave. I Employees who wish to continue their insurance coverage
should so advise the Personnel Director before beginning their leave.
5. Because operatio~s sometimes require that vacant positions be filled, a personal
leave of absence does not guarantee that the job will be available when the employee
returns from a le~ve. An effort, however, will be made to place the employee in the
previous position lor a comparable job which the employee is qualified to perform.
If no such positio~ is available, the employee will be given preference when a position
does become vac~nt if he has the necessary qualifications.
Family and Medical Leale - All eligible employees will be given Family and Medical Leave in
accordance with the FJmily and Medical Leave Act. All Family and Medical Leave will be

8.09 WORKERS' COMPENSATION CLAIMS
A. Eligibility.
All employees injured in the line of duty are eligible for workers' compensation benefits, in
accordance with Chapter 440, Florida Statutes. A workers' compensation managed care
arrangement is a health care delivery system which provides quality medical care while
ensuring proper treatment and containing medical costs which became mandatory on
January 1, 1997. (440.134F.S.)
8. Procedures.
1 . If an on the job injury occurs the supervisor must be notified immediately and either
the supervisor or the Personnel Department will call the managed care arrangement
representative. Of course in the case of a Ife threatening emergency someone should
first call 911. Once the managed care representative has been notified and given the
necessary information about the injury, they coordinate all medical needs, which will
include a drug screen in all cases. Information will have to be provided to ensure the
workers compensation benefits are calculated and reported accurately.
2. The injured employee must report to the Personnel Department as soon as possible
(after medical attention is administered in emergency cases) to complete all necessary
paperwork and receive necessary information.
3. An Incident report shall be completed by the employee and supervisor in each case of
a work related injury or accident, regardless of severity or whether medical attentions
required. The report shall be submitted to the Safety Officer as soon as possible for
follow up into prevention of a reoccurrence.
4. No injured employee will be allowed to return to work without medical release.
C. Questionable Injuries
If the Supervisor or Department Director is suspicious of the reported injury, this shall be
communicated to the Personnel Director and/or the Safety Officer for appropriate action.
D. Workers' Compensation Benefits.
A regular employee covered hereunder who is temporarily disabled in the line of duty shall
receive paid leave, and benefits for the period of this disability subject, however, to
compliance with all of the following conditions:
1 . The disability involved must have resulted from an injury or an illness directly related
to or sustained in the performance of the employee's work.
2. Paid leave shall not exeeed The injured employee will remain at full pay status,
not to exceed ninety (90) work days (1 35 work days for police and fire
personnel) for anyone injury. If, as a direct result of the continuation of the
disability involved, the employee is unable to return to work at the end of the period,
the employee may petition the City Manager for an extension of full pay status. If the
City Manager decides not to permit the employee to remain in full pay status beyond
the period, the employee shall revert to normal Workers' Compensation benefits.

A.
A valid pertinent Florida driver's license is required foranyone who operates a City vehicle.
Any employee whose license is suspended, revoked, canceled, or expired shall not drive any

3. Using any controlled substance not prescribed for the employee by a physician or
alcoholic beveragJ which may adversely affect job performance. This may include
both use while onLduty and use while off-duty which can adversely affect on-duty
performance. I
4. Reporting to work! with the presence of illegal drugs or alcoholic beverages in the
body system whidh is equal to or exceeds the cutoff detection levels established
pursuant to Chapter 440, Florida Statutes.
When reasonable cauJ exists to believe that an employee is under the influence of any
controlled substance, n~rcotic drug or alcohol, the employee's Department Director and
Personnel Director upori approval by the City Manager or his designee shall have the
authority to require em~loyees to submit to testing designed to detect the presence of
such controlled substarice, narcotic drug, or alcohol. In the event the City requests that an
employee submit to te~ting and the employee chooses not to submit to such tests, this

refusal shall be grounds for appropriate disciplinary action.

An employee who must use a prescription drug which the employee has been advised
will or which the empldyee may reasonably expect to cause adverse side effects such

as drowsiness, impaired reflexes, or reaction time shall inform his Department Director that
he is taking such medidation on the advice of a physician and of the possible side
effects of the drug and expected duration of use.

The City of Edgewater, Florida is firmly committed to prohibiting discrimination on the
basis of race, color, sex, age, religion, national origin or disability status. This
commitment applies through the entire City employment process from the advertisement
review, selection hiring and disciplinary procedures up to and including termination of
employment. This commitment shall also be firmly in place as regards to job training
and other terms and conditions and privileges of employment. The City of Edgewater is
committed to a program that will insure the fairest employment practices in all
departments, divisions and units. Each department head, supervisor or other management
position is responsible to understand, communicate, and strictly enforce this policy of the
City.

All policies, procedures and practices of the City will be continually scrutinized to insure
any form of discrimination does not occur. Discrimination has no place in the City of
Edgewater and the City will use all of its facilities and resources available to insure this
does not occur. It is the City's ultimate goal and responsibility to insure that every
measure possible is taken to insure all individuals receive equal opportunity for
employment and promotion regardless of age, sex, national origin or disability status.
The City's Personnel Department shall routinely review all job classification, disciplinary
actions, applications for employment, terminations of employment, transfers, layoffs, re-
employment, and other personnel issues to insure equal treatment of all employees and
applicants. The Personnel Department of the City will insure equal treatment and insure
that the system is free of any discrimination.
The City of Edgewater utilizes a variety of pre-employment tests, exams or review
boards, and other resources to insure that it selects qualified candidates without
discrimination in the process. Promotional tests are utilized by the Police and Fire
Departments in compliance with City polices and collective bargaining agreements,
which also comply with the City's EEO Plan.
The Personnel Director of the City is appointed as the Equal Opportunity/Americans with
Disabilities Acts Coordinator with primary responsibility for implementing appropriate
polices and practices in compliance with the EEO Plan. Any concurs, questions, or
recommendations regarding the EEO Plan should be directed to the Personnel Director
who will insure the plan is up to date and in compliance with all federal, state, county and
municipal laws.

All complaints, allegations or other charges that relate to discrimination of any type by
any employee, supervisors or other within the City, shall be immediately referred to the
Personnel Director as the coordinator who in turn investigate and make referrals to the
appropriate agencies for civil or criminal review.

The overall primary responsibility for the plan rests with the office of the City Manager
who supervises the EEO/ AD !A Coordinator. All levels of management and supervisory
personnel are responsible tol insure full implementation and management of this plan.

Administrative Responsibilities:
It is the direction of the City Council and the City Manager's Office that all department
heads, supervisors and employees support the policy of non-discrimination and equal
employment opportunity and to fully implement the policies and procedures set forth in
this plan within their respective areas of authority and to bring about the proper and

The City of Edgewater will preserve various records that will contain notations on the

The names, addresses, telephone numbers and information regarding the racial or ethnic

employment or promotional opportunities within the City, when collected, will be
preserved. The Personnel Department may provide a supplemental information form to
collect additional data as necessary to facilitate the collection of this information. The
Personnel Department may also retain this form with all applications. These records will
be maintained pursuant to state and federal archive laws and should be available under
the Public Records Law as well.

The City shall maintain and retain reports that reflect the race and sex composition i.e.,
white males, white females, black males, black females, other males, other females, of
employees in each of the eight EEO-four job categories in accordance with the EEO

The City shall obtain and retain relative information of the labor market composition in
the immediate area of Edge~ater indicating that composition by sex, age and race. This

approved job descriptions. This data shall also identify those positions that have different
work shifts in a particular dbpartment and the number of employees assigned to those
types of assignments by race, sex, and national origin.

Recruitment and Application Procedures:
The City of Edgewater will attempt through all available means to disseminate
information relative to open positions within the City to females, minorities, and disabled

City's web site and the bulletin boards throughout the City departments and at City Hall.
The City may also advertise in the local newspaper and send job announcements to the
local unemployment office and the Job Service office in the local area.
All applicants shall be recruited on a basis of minimum experience and education
requirements established through the classification system for each job classification and
job description. Application procedures have been simplified as much as possible to
insure employment candidates for minority, female, disabled, and eligible veterans are
provided easy accessibility to employment and promotion within the City.
To insure all employees who are minorities, females, disabled, and eligible veterans are
equally notified of all employment opportunities in the City, all job announcements shall
be posted conspicuously on bulletin boards in all department and City buildings and work
areas. The Personnel Director shall periodically conduct sight visits to insure this policy
is being carried out and to determine whether the bulletin boars are conspicuous and
accessible to all employees.
The City will not solicit information on employment applications, which could be

be collected at a later time through the pre-employment medical and drug screen process
and then only after an offer of employment has been given. This information will be

Upward Mobilitv and Career Development:
The City of Edgewater strongly supports upward mobility for all its employees. To this
end, the City has policies to encourage promotions from within the City government. All
vacancies within the classifibation system will first be advertised to City employees. ...- '\
When the City employees sl1;bmit their internal applications and meet all the minimum '-'
qualifications for the positions, the selection process will be completed and
recommendations made to thJ respective department head for review and approval. If no
qualified City employees are kvailable, the position will be advertised outside pursuant to
the EEO program. The City has also developed a program to encourage upward mobility
and career development thrdugh educational incentive payment programs. This also
includes all collective bargaihing agreements the City has entered into. In compliance
with City policies the City will pay for college courses, advanced training and other skill
development programs up tol and including a masters degree for required work-related
courses and for the betterment of the City operations. This will include, but shall not be
limited to: books, tuition, tra~el and other related expensed based on the particular need
of the department divisions br units. The employees must receive a passing grade in
order to be eligible for reimbursement or payments pursuant to this policy. In

classifications and job descriptions to insure educational standards are applicable and
current so as to insure local ~ducational institutions can be aware of and provide those

It is the policy of the City to provide procedural due process and to adjudicate any
grievance of a City employee who believes they have received any type of discriminatory
treatment because of some condition of their employment. The City provides a grievance j - \

Recommendation of Notice ofIntent to Award for Bid #02-ES-02 Curbside Residential Recycling
Services.
BACKGROUND:
The City has a contract for Curbside Residential Recycling Services which expires on September 30,
2002. The contract was initially entered into in 1993 with Southard Recycling for a period of five
years, with the option to renew for two additional two year terms. Southard Recycling has been
performing the service for the last nine years. Although the City has been satisfied with the
performance of Southard Recycling, the City was required to go out to bid for these services since
there were no further options for renewal. On September 9,2002 the City of Edgewater received
four bids for Curbside Residential Recycling Services. The bids ranged from $1.43 per residential
unit to $1.79 per residential unit. The low bid was received from Florida Recycling Services, Inc.
The next low bidder was Southard Recycling at $1.47 per residential unit.
Florida Recycling Services, Inc.'s bid was complete and references were checked. One of the
references checked was with the City of Daytona Beach. Joe Briarton, the General Manager for
Florida Recycling Services, Inc. stated that they have an operating facility in Daytona Beach and a
transfer station in New Smyrna Beach.
The City's purchasing policy states that the City will only give preference to bidders in a tie bid
situation. It does not address giving a preference to any "local" bidder over another low bidder.
STAFF RECOMMENDATION:
After review of all available information, Staff recommends the bid be awarded to Florida Recycling
Services, Inc. and that a Notice of Intent to Award be issued for the City of Edgewater Curbside
Residential Recycling Services, Bid #02-ES-02 based on a bid proposal of$I.43 per residential unit.
After Florida Recycling Services, Inc. provides the necessary paperwork, the contract documents will
be signed.
ACTION REQUESTED:
Motion to authorize a Notice ofIntent to Award to Florida Recycling Services, Inc. for Curbside
Residential Recycling Services at a bid proposal of $1.43 per residential unit and authorize the City
Manager to execute the contract documents on behalf of the City upon receipt of insurance, bonds
and other documentation.

Recycling stated that they have a transfer station located in New Smyrna Beach and an
operating facility in Daytona Beach. After reviewing and discussing all the criteria for the

Approve Investment Policy to update existing policy dated September 1995 in order to comply with
Florida Statute 218.415.
BACKGROUND:
The City currently has an investment policy which was drafted by City Staff and approved by the
City Council in September of 1995. Due to changes in the Florida Statutes, the City's external
auditors have recommended updating the investment policy to comply with these changes. One of
the changes is to require the Finance Director and staff members who would deal with investments
to complete eight hours of continuing professional education in investment practices and products
annually. The investment policy places the highest investment priority on the safety of principal
and liquidity.
STAFF RECOMMENDATION:
Staff recommends City Council approval of the investment policy.

INVESTMENT POLICY
o
This policy, adopted by the City Council on , adopted under the authority of
Section 218.415, Florida Statutes, sets forth the policy of the City of Edgewater with regard to the
investment of funds in excess of those required to meet short-term expenditures. The City
Manager shall be responsible for implementing this policy through the Finance Director. No
person may engage in any investment transaction with City funds or funds held in a trust
relationship by or for the City, except as authorized by the City Manager or authorized designee.
Provided, however, this policy shall not apply to pension funds, trust funds, or funds related to the
issuance of debt.
AUTHORITY
The responsibility for managing the investments is granted to the City Manager. Responsibility
for the operation of the investment program is hereby delegated to the Finance Director, who has
the responsibility to insure the proper management, internal controls, safekeeping and recording
of all investment assets held or controlled by the City. No person may engage in any investment
transaction with City funds or funds held in a trust relationship by or for the City, except as
authorized by the City Manager or authorized designee.

SCOPE
This policy sets forth guidelines with regard to the investment of funds in excess of those required
to meet short-term obligations and does not apply to pension funds, trust funds or funds related to
the issuance of debt. All financial assets held or controlled by the City, not otherwise classified as
restricted assets requiring separate investing, shall be identified as "general operating funds" of
the City for the purpose of this policy, and shall be invested using the guidelines as herein set
forth. This Policy is promulgated pursuant to and consistent with the provisions of Section
218.415, Florida Statutes. Although restricted assets such as pension funds, certain bond-related
funds and trust funds are not required to be covered by this Policy, such funds may
be invested under this Policy, when deemed to be in the City's best interest to do so, and when
permitted by governing policies or documents.
OBJECTIVES
Safety of capital is regarded as the foremost objective of the investment program. Investments of
the City shall be undertaken in a manner that seeks to ensure the preservation of capital in the
overall portfolio. Each investment transaction shall be entered into with every effort to prevent
capital losses, whether they are from securities defaults, theft, or the impact of adverse market
conditions. The City's investment strategy will provide sufficient liquidity to meet operating, payroll
and capital requirements. Investments shall be made to maximize income on surplus funds but
only after the objectives of security and liquidity have been met.

ETHICAL STANDARDS
The standard of prudence to be used by the City of Edgewater is that of the Prudent Person Rule,
which states that: "Investments should be made with judgment and care, under circumstances
then prevailing, which persons of prudence, discretion, and intelligence exercise in the
management of their own affairs, not for speculation, but for investment, considering the probable
safety of their capital as well as the probable income to be derived from the
investment." The Finance Director and authorized designee, acting in accordance with
established policies and procedures and exercising due diligence, shall be relieved of personal
responsibility for an individual security's credit risk or market price changes, provided deviations
from expectations are reported in a timely fashion and appropriate action is taken to minimize
adverse developments. The Prudent Person Rule shall be applied in the context of managing
all assets investment under this Policy. Employees of the City who are involved in the investment
process shall refrain from personal business activity that could conflict with State Statutes, City
Ordinances, proper management of the City's investment program, or which could impair their
ability to make impartial investm1ent decisions.
CONTINUING EDUCATldN 0
The Finance Director and appropriate staff shall annually complete eight (8) hours of continuing
education in subjects or courses of study related to investment practices and products.

PERFORMANCE MEASUREMENT
The City of Edgewater seeks to bptimize return on investments within the constraints of safety
and liquidity. The investment portfOlio shall be managed in accordance with the parameters
specified within this policy. The Iportfolio should obtain a market average rate of return during a
market/economic environment cif stable interest rates. Portfolio performance should be
compared to appropriate benchmarks on a regular basis. After review of the City's operational
cash flows and capital improvement needs, it is decided that this Policy will serve to limit
maturities of investments to onelyear or less with a special provision allowing up to 20 percent of
the investment portfolio to have a maturity of not more than five years. The State Board of
Administration Investment Pool is the most appropriate benchmark given the imposed limits in
maturities. I
AUTHORIZED INVESTMENTS
The following is a list of authoriz1d investments as provided by Florida Statutes 218.415(16):
I
(a) The Local Government Surplus Funds Trust Fund (State Board of Administration, SBA) or any 0
intergovernmental investment pool authorized pursuant to the Florida Interlocal Cooperation Act
as provided in section 163.01. I
(b) Securities and Exchange Commission registered money market funds with the highest credit
quality rating from a nationally recognized rating agency.

(c) Interest-bearing time deposits or savings accounts in qualified public depositories as defined
in section 280.02. I
(d) Direct obligations of the United States Treasury.
(e) Federal agencies and instruJ,entalities. .
(f) Securities of, or other interestk in, any open-end or closed-end management-type investment
company or investment trust registered under the Investment Company Act of 1940, 15 U.S.C.
ss. 80a-1 et seq., as amended frbm time to time, provided that the portfolio of such investment
company or investment trust is lifnited to obligations of the United States Government or any
agency of instrumentality thereo~ and to repurchase agreements fully collateralized by such
United States Government obli9'iitions, and provided that such investment company or
investment trust takes delivery of such collateral either directly or through an authorized
custodian. I
(g) Other investments authorized by law or by ordinance for a county or a municipality. 0
Additional investments types per~itted by the City of Edgewater are granted authority through a
separate ordinance approved byjthe Edgewater City Council. Investments not listed in this Policy
or that have not been given separate approval by City Council are prohibited.

Investment in any derivative product or the use of reverse repurchase agreements is specifically
prohibited by this investment policy. A "derivative" is defined as a financial instrument the value
of which depends on, or is derived from, the value of one or more underlying assets or indices or
asset values.
o
BID REQUIREMENTS
The City of Edgewater will attempt to make investments with local banks that have been
approved by the State Treasurer to act as qualified public depositories (QPDs) as governed by
Chapter 280, Florida Statutes, and Rule 4C-2, Florida Administrative Code. In the case where
interest rates of the local banks are not competitive, investment-banking firms with national
reputation can be selected at the Finance Director's discretion. The City of Edgewater will
engage in a competitive bid selection with a minimum of three bids solicited. The bid deemed to
best meet the investment
objectives will be selected. These bids will be recorded and retained in the Finance Department.
Competitive bids are not applicable for the placement of funds with the SBA. In certain
circumstances where a dealer or bank informs the City of a potential purchase or sale that must
be completed within minutes of notification, the competitive bidding policy will be waived, where it
is in the best interests of the City. The Finance Director will have final approval on these
particular transactions before they have been completed.

PORTFOLIO COMPOSITION
There are no limits set by this Policy as to the maximum amount that any particular institution can
hold. The institution will set its own limits by virtue of its ability to collateralize the investments.
Certificates of deposit purchased under the authority of this Policy will be purchased only from
Qualified Public Depositories of the State of Florida as identified by the State Treasurer, in
accordance with Chapter 280 of the State Statutes. Repurchase agreements shall only be
entered into with the City's primary depository, (currently Wachovia Bank), which is also identified
as a qualified public depository. Dollar limits for types of investments such as, Treasury's,
Agencies or Certificates of Deposit, will be based on market conditions at the time of the
investment or will be governed by the Finance Director's discretion. Other securities shall be
purchased only through financial institutions which provide the service of a securities dealer, or
through the "primary government securities dealer" as designated by the Federal Reserve Bank
of New York. The Finance Director or his designee will keep a source list of authorized
institutions, dealers and issuers of the various security types.
These institutions, dealers and issuers must meet capital adequacy guidelines as determined by
their respective regulatory agencies, and certify that no material adverse events have occurred
since the issue of their most recent financial statements. They must also agree to notify the City
in the event of material adverse events affecting their capital adequacy. All securities purchased
shall be only those securities from authorized issuers of the various security types. A list of these
authorized institutions, dealers and issuers of the various security types will be maintained by the
Finance Director or his designee.
Criteria for addition to or deletion from the list will be based on the following:
o
(a) State law
(b) the City's investment policy requirements where applicable
(c) perceived financial difficulties
(d) consistent lack of competitiveness
(e) lack of experience or familiarity of the account representative in providing service to large
institutional accounts
(f) request of the institution or dealer
(g) when deemed in the best interest of the City
Maturities will be limited to not more than one year with a special provision allowing up to 20
percent of the investment portfolio to have a maturity of not more than five years.

SAFEKEEPING AND CUSTODY
All securities purchased by the City's Finance Director under this Policy, except certificates of 0
deposits, shall be properly designated as assets of the City of Edgewater and shall be protected
through a third-party agreement. The City shall enter into a formal agreement with an institution of
such size and expertise as is necessary to provide the services needed to protect and secure the
investment assets of the City. Certificates of deposit may be held in safekeeping at the issuing
financial institution or may be held in physical custody by the City's Finance Department.

The City's Finance Director shall establish appropriate safekeeping procedures so that, whenever
possible, all investments are custodied in accordance with Governmental Accounting Standards
Board Statement Number 3, Category (1), which specifies that all securities are insured or
registered, or held by the City or its agent, in the City's name. Repurchase Agreements are
disclosed as Category (2) as un'insured and unregistered investments for which the
securities are held by the counter party, or by its trust department or agent in the City's name.
COLLATERAL I
Collateral for public deposits is regulated by the State of Florida through Florida Statutes, Chapter
280. The City shall not be unde~ any obligation to secure additional collateral beyond the
provisions set forth in Chapter 280, except in the case of Repurchase Agreements. Collateral
requirements for Repurchase Agreements are contained in the Master Repurchase Agreement.
MASTER REPURCHASE IAGREEMENT
I
The City may enter into an Master Repurchase Agreement. Such agreements, called 0
overnight or "sweep" Repurchase Agreements are collateralized by full faith or general faith and
credit obligations of the United $tates Government or United States Government Agency
securities. All Agreements should adhere to the following guidelines:
(a) Purchased only from the CiJ,s contracted banking service provider.
I
(b) Securities used as collateralization for the overnight (sweep) Repurchase Agreement will be
held for the benefit of the City with a third party, the Federal Reserve Bank or the contracted
bank's correspondent bank in ah amount not less than 100% of the overnight amount of the
Repurchase Agreement. I
(c) The City's primary depository must have on file an executed copy of the City's Master
Repurchase Agreement for overnight repos and an executed Sweep Investment Service
Agreement. I
(d) Repurchase Agreements for the City of Edgewater will exist only for the purposes of an
overnight "sweep".
INTERNAL CONTROLS
The Finance Director has estab'ished internal controls to prevent loss of funds by fraud,
employee error, misrepresentation by third parties, or imprudent actions by employees of the City.
The internal controls are as follows: U
(a) Investment transactions aut~ority is limited to specific persons within the Finance Department.
(b) All investment transactions rlqUire approval of the Finance Director.

(c) Staff in the Finance Department reconciles the City's Accounts Payable account on a monthly
basis by comparing the City's general ledger with the applicable bank account statements. The

INVESTMENT POLICY
This policy, adopted by the City Council on ' adopted under the authority of
Section 218.415, Florida Statutes, sets forth the policy of the City of Edgewater with regard to the
investment of funds in excess of those needed to meet current expenses. required to meet E:hort

AUTHORITY
The responsibility for managing the investments is granted to the City Manager. Responsibility
for the operation of the investment program is RereGy delegated to the Finance Director, who has
the responsibility to insure the proper management, internal controls, safekeeping and recording
of all investment assets held or controlled by the City. No person may engage in any investment
transaction with City funds or funds held in a trust relationship by or for the City, except as
authorized by the City Manager or authorized designee.
SCOPE
This policy sets forth guidelines with regard to the investment of funds in excess of those required
to meet current expenses chort term oblig:ations and does not apply to pension funds, including
those funds in Chapter 175 and 185-,- trust funds or funds related to the issuance of debt where
there are other existinq policies or indentures in effect for such funds.. All financial assets held or
controlled by the City, not otherwise classified as restricted assets requiring separate investing,
shall be identified as "general operating funds" of the City for the purpose of this policy, and shall
be invested using the guidelines as herein set forth. This Policy is promulgated pursuant to and
consistent with the provisions of Section 218.415, Florida Statutes. Although restricted assets
such as pension funds, certain bond-related funds and trust funds are not required to be covered
by this Policy, such funds may
be invested under this Policy, when deemed to be in the City's best interest to do so, and when
permitted by governing policies or documents.
OBJECTIVES
Safety of capital is regarded as the foremost objective of the investment program. Investments of
the City shall be undertaken in a manner that seeks to ensure the preservation of capital in the
overall portfolio. Each investment transaction shall be entered into with every effort to prevent
capital losses, whether they are from securities defaults, theft, or the impact of adverse market
conditions. The City's investment strategy will provide sufficient liquidity to meet operating, payroll
and capital requirements. To the extent possible. an attempt will be made to match investment
maturities with known cash needs and antici ated cash-flow re uirements. Investments shall be
made to maximize income on E:Urp1U6 funds but only after the objectives of security and liquidity
have been met.
ETHICAL STANDARDS
The standard of prudence to be used by the City of Edgewater in carrvinq out its investment
activities is that of the Prudent Person Rule, which states that: "Investments should be made with
judgment and care, under circumstances then prevailing, which persons of prudence, discretion,
and intelligence exercise in the management of their own affairs, not for speculation, but for
investment, considering the probable safety of their capital as well as the probable income to be
derived from the investment." The Finance Director and authorized designee, acting in
accordance with established policies and procedures and exercising due diligence, shall be
relieved of personalliabilitv responsibility for an individual security's credit risk or market price
changes, provided deviations from expectations are reported in a timely fashion and appropriate
action is taken to minimize adverse developments. The Prudent Person Rule shall be applied in
the context of managing all assets investment~ under this Policy. Employees of the City who are
involved in the investment process shall refrain from personal business or investment activity that
could conflict with State Statutes, City Ordinances, proper management of the City's investment
program, or which could impair their ability to make impartial investment decisions.
CONTINUING EDUCATION
The Finance Director and appropriate staff included in investinq decisions shall annually complete
eight (8) hours of continuing education in subjects or courses of study related to investment
practices and products.
PERFORMANCE MEASUREMENT
Tho City of Edgcw3ter seeks to optimize return on investments within the constr3ints of saf€ty
3nd liquidity. The investment portfolio shall be managed in accordance with the parameters
specified within this policy. The portfolio should obtain a market average rate of return during a
markeUeconomic environment of stable interest rates. Portfolio performance should be
compared to appropriate benchmarks on a regular basis. The State Board of Administration
Investment Pool is the most appropriate benchmark qiven the imposed limits in maturities.
After review of the City's oper3tion31 c3sh flows and c3pital improvement needs, it is decided that
This Policy will serve to limit maturities of investments to one year or less with a special provision
allowing up to 20 percent of the investment portfolio to have a maturity of not more than five
years. The 5t3te B03rd of Administr3tion Investment Pool is the most 3ppropriate benchm3rk
given the imposed limits in maturities.
AUTHORIZED INVESTMENTS
The following is a list of authorized investments as provided by Florida Statutes 218.415(16):
(a) The Local Government Surplus Funds Trust Fund (State Board of Administration, SBA) or any
intergovernmental investment pool authorized pursuant to the Florida Interlocal Cooperation Act
as provided in section 163.01.
(b) Securities and Exchange Commission registered money market funds with the highest credit
quality rating from a nationally recognized rating agency.
(c) Interest-bearing time deposits or savings accounts in qualified public depositories as defined
in section 280.02.
(d) Direct obligations of the United States Treasury.
(e) Federal agencies and instrumentalities.
(f) Securities of, or other interests in, any open-end or closed-end management-type investment
company or investment trust registered under the Investment Company Act of 1940, 15 U.S.C.
ss. 80a-1 et seq., as amended from time to time, provided that the portfolio of such investment
company or investment trust is limited to obligations of the United States Government or any
agency of instrumentality thereof and to repurchase agreements fully collateralized by such
United States Government obligations, and provided that such investment company or
investment trust takes delivery of such collateral either directly or through an authorized
custodian.
(g) Other investments authorized by law or by ordinance. for a county or a municip3lity.
Additional investments types permitted by the City of Edgewater are granted authority through a
separate ordinance approved by the Edgewater City Council. Investments not listed in this Policy
or that have not been given separate approval by City Council are prohibited.
Investment in any derivative product or the use of reverse repurchase agreements is specifically
prohibited by this investment policy. A "derivative" is defined as a financial instrument the value
of which depends on, or is derived from, the value of one or more underlying assets or indices or
asset values.
BID REQUIREMENTS
The City of Edgewater will attempt to make investments with local banks that have been
approved by the State Treasurer to act as qualified public depositories (QPDs) as governed by
Chapter 280, Florida Statutes, and Rule 4C-2, Florida Administrative Code. In the case where
interest rates of the local banks are not competitive, investment-banking firms with national
reputation can be selected at the Finance Director's discretion. Based on a determination of the
approximate maturity date and cash flow needs and market conditions, the City of Edgewater will
select one or more types of investment and engage in a competitive bid selection with a minimum
of three bids solicited. The bid deemed to best meet the investment objectives set forth herein will
be selected. These bids will be recorded and retained in the Finance Department. Competitive
bids are not applicable for the placement of funds with the SBA. In certain circumstances where
a dealer or bank informs the City of a potential purchase or sale that must be completed within
minutes of notification, the competitive bidding policy will be waived, where it is in the best
interests of the City. The Finance Director will have final approval on these particular
transactions before they have been completed.
PORTFOLIO COMPOSITION
There are no limits set by this Policy as to the maximum amount that any particular institution can
hold. The institution will set its own limits by virtue of its ability to collateralize the investments.
However. investments held are to be diversified to the extent practicable to control the risk of loss
resultinq from overconcentration of assets in a specific maturity. issuer. instrument. dealer or
bank throuQh which financial instruments are bOUQht and sold. Diversification strateQies within
the established Quidelines are to be reviewed and revised periodicallv. as deemed necessary bv
the appropriate manaQement staff.
Certificates of deposit purchased under the authority of this Policy will be purchased only from
Qualified Public Depositories of the State of Florida as identified by the State Treasurer, in
accordance with Chapter 280 of the State Statutes. Repurchase agreements shall only be
entered into with the City's primary depository, (currently Wachovia Bank), which is also identified
as a qualified public depository. Dollar limits for types of investments such as Treasury's,
Agencies or Certificates of Deposit, will be based on market conditions at the time of the
investment or will be governed by the Finance Director's discretion. Other securities shall be
purchased only through financial institutions which provide the service of a securities dealer, or
through the "primary government securities dealer" as designated by the Federal Reserve Bank
of New York. The Finance Director or ffis designee will keep a source list of authorized
institutions, dealers and issuers of the various security types.
These institutions, dealers and issuers must meet capital adequacy guidelines as determined by
their respective regulatory agencies, and certify that no material adverse events have occurred
since the issue of their most recent financial statements. They must also agree to notify the City
in the event of material adverse events affecting their capital adequacy. All securities purchased
shall be only those securities from authorized issuers of the various security types. A list of these
authorized institutions, dealers and issuers of the various security types will be maintained by the
Finance Director or ffis designee.
Criteria for addition to or deletion from the list will be based on the following:
(a) State law
(b) the City's investment policy requirements where applicable
(c) perceived financial difficulties
(d) consistent lack of competitiveness
(e) lack of experience or familiarity of the account representative in providing service to large
institutional accounts
(f) request of the institution or dealer
(g) when deemed in the best interest of the City

SAFEKEEPING AND CUSTODY
All securities purchased by the ~City's Finance Director under this Policy, except certificates of
deposits, shall be properly designated as assets of the City of Edgewater and shall be protected
through a third-party agreement. The City shall enter into a formal agreement with an institution of
such size and expertise as is necessary to provide the services needed to protect and secure the
investment assets of the City. Certificates of deposit may be held in safekeeping at the issuing
financial institution or may be held in physical custody by the City's Finance Department.
No withdrawal of securities, in whole or in part. shall be made from safekeepinq, except by an
authorized employee of the City. Securities transactions between a broker-dealer and the
custodian involvinq purchase or sale of securities by transfer of money or securities must be
made on a "delivery vs. payment" basis. if applicable. to ensure that the custodian will have the
security or money. as appropriate, in hand at the conclusion of the transaction.
The City's Finance Director shall establish appropriate safekeeping procedures so that, whenever
possible, all investments are custodied in accordance with Governmental Accounting Standards
Board Statement Number 3, Category (1), which specifies that all securities are insured or
registered, or held by the City or its agent, in the City's name. Repurchase Agreements are
disclosed as Category (2) as uninsured and unregistered investments for which the
securities are held by the counter party, or by its trust department or agent in the City's name.
COLLATERAL
Collateral for public deposits is regulated by the State of Florida through Florida Statutes, Chapter
280. The City shall not be under any obligation to secure additional collateral beyond the
provisions set forth in Chapter 280, except in the case of Repurchase Agreements. Collateral
requirements for Repurchase Agreements are contained in the Master Repurchase Agreement.
MASTER REPURCHASE AGREEMENT
The City may enter into an Master Repurchase Agreement. All approved institutions and dealers
transactinq repurchase aqreements shall execute and perform as stated in the Master
Repurchase Aqreement. All repurchase aqreement transactions shall adhere to the requirements
of the Master Reourchase Aqreement. Such agreements, called overnight or "sweep"
Repurchase Agreements are collateralized by full faith or general faith and credit obligations of
the United States Government or United States Government Agency securities. All Agreements
should adhere to the following guidelines:
(a) Purchased only from the City's contracted banking se/Vice provider.
(b) Securities used as collateralization for the overnight (sweep) Repurchase Agreement will be
held for the benefit of the City with a third party, the Federal Rese/Ve Bank or the contracted
bank's correspondent bank in an amount not less than 100% of the overnight amount of the
Repurchase Agreement.
(c) The City's primary depository must have on file an executed copy of the City's Master
Repurchase Agreement for overnight repos and an executed Sweep Investment Se/Vice
Agreement.
(d) Repurchase Agreements for the City of Edgewater will exist only for the purposes of an
overnight "sweep".
INTERNAL CONTROLS
The Finance Director has established internal controls to prevent loss of funds by fraud,
employee error, misrepresentation by third parties, or imprudent actions by employees of the City.
The internal controls are as follows:
(a) Investment transactions authority is limited to specific persons within the Finance Department.
(b) All investment transactions require approval of the Finance Director.
(c) Staff in the Finance Department reconciles the City's Accounts Payable account on a monthly
basis by comparing the City's general ledger with the applicable bank account statements. The
reconciliation of the Accounts Payable account would reveal any difference in investment
transaction recording and the actual movement of funds.

Renew agreement between the Florida's Coast to Coast Chapter of the American Red Cross and
the City of Edgewater.
BACKGROUND:
The renewal of this agreement permits the Florida's Coast to Coast Chapter of the American Red
Cross the use of a city facility during natural disasters and peacetime disaster emergencies. It has
been evaluated and planned to utilize the Hawks Park facility (Edgewater YMCA) as a host
(non-impact) shelter for residents and guests during times of isolated evacuations. The facility
can also be utilized as a host shelter for out of town evacuees. The Florida's Coast to Coast
Chapter of the American Red Cross agrees to defend, hold harmless, and indemnify the City
against any legal liability including reasonable attorney fees, in respect to bodily injury, death,
and property damage arising from the negligence of the Florida's Coast to Coast Chapter of the
American Red Cross during its use of the property.
STAFF RECOMMENDATION:
Staff recommends the renewal of the agreement.

This Statement of Agreement is entered into by the following parties:

Pursuant to the terms of Federal Statutes, the Red Cross provides
emergency services on behalf of individuals and family victims of

result in making the said facility available to the American Red Cross
for use during an emergency.
