B. Res. No. 2002-R-02, staff recommending authorization to submit a Ponce de

7. CONSENT AGENDA
Items on the consent agenda are defined as routine in nature that do not warrant detailed
discussion or individual action by the Council; therefore, all items remaining on the consent
agenda shall be approved and adopted by a single motion, second and vote by the City
Council. Items on the consent agenda are not subject to discussion. One of the most basic
rules of a consent agenda is that any member of the City Council may remove any item
from the consent agenda simply by verbal request at the City Council meeting.
Removing an item from the consent agenda does not require a motion, second or a vote; it
would simply be a unilateral request of an individual Council member.

A. Waterwav Park Subdivision Water Distribution System - staff requesting
authorization to issue a "Notice of Intent to Award" to McMahon Construction
Company, Inc. for construction of a water distribution system for $396,000
and authorize City Manager to execute the contract documents upon receipt
of insurance, bonds and other documentation.
B. Bank Loan - staff recommending approval to award RFP to Bank of American
for "bank qualified" loan not to exceed $7,680,000 and authorize the City
Manager or Mayor to execute the loan agreement after City Attorney Scott
Cookson reviews and approves closing documents.

WHEREAS, Hawks Park, a twenty-six (26) acre recreational complex, is located at 148
West Turgot A venue.
WHEREAS, the City of Edgewater, purchased an additional seven (7) acres which will
connect to Hawks Park and provide additional benefits to area residents, businesses and tourists.
WHEREAS, the City wishes to develop the additional seven (7) acres, located at 1108 South
Ridgewood Avenue.
WHEREAS, the City Council of the City of Edgewater, Volusia County, Florida, has
authorized submission of a Volusia ECHO 2002 Grants-In-Aid application to Volusia County's
Growth and Resource Management Department.
WHEREAS, a copy of the ECHO 2002 Grants-In-Aid application is attached and
incorporated herein as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED by the City Council of The City of
Edgewater, Florida
Section 1.
The City Council hereby authorizes submission of the Volusia ECHO 2002 Grants-
In-Aid application to the County of Vol usia's Growth and Resource Management
Department.
Section 2.
The project name for which the grant is requested will be known as Hawks Park
Project.

Section 3. The total cost of the project is estimated to be one million forty-six thousand five
hundred seventy-four and noll 00 dollars ($1,046,574.00).
Section 4. The City is requesting a grant in the amount of four hundred sixty- four thousand nine
hundred thirty-one and noll 00 dollars ($464,931.00).
Section 5. The City has already expended four hundred eighty-seven thousand one hundred ten
and noll 00 dollars ($487,110.00) on the Project. The City hereby assures dedication
and availability of additional matching funds, in the amount of ninety-four thousand
five hundred thirty-three and nollOO dollars ($94,533.00) within ninety (90) days of
the Grant award funding notification, which exceeds the required fifty percent (50%)
match.
Section 6. The City Council hereby authorizes the appropriate City Officials to enter into a
binding grant award agreement and restrictive covenants.
Section 7. The City is fiscally and legally responsible to satisfactorily develop, operate and
maintain the Project.
Section 8. The City Council hereby designates Jack Corder, Director of Parks and Recreation,
to transmit a copy of this resolution, the certification and the original grant
application and twenty copies to the County of Volusia's Growth and Resource
Management Department.
Section 9. An official, adopted and certified resolution of the City of Edgewater, shall be
included with the application.
Section 10. That all resolutions or parts of resolutions in conflict herewith be and the same are
hereby repealed.
Section 11. This resolution shall take effect upon adoption.

The purpose of this project is to upgrade public access to existing
boat ramps by c~nstructing a stationary/gangway and floating dock to
accomodate the general public and the physically challenged~ The
project is located at George Kennedy Memorial Park along the Intracoastal
Waterway in the City of Edgewater.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, VOLUSIA COUNTY, FLORIDA,
AUTHORIZING SUBMISSION OF A VOLUSIA COUNTY
PONCE DE LEON INLET & PORT DISTRICT JOINT
PARTICIPATION PROGRAM GRANT FUNDING
APPLICATION TO THE COUNTY OF VOLUSIA; ASSURING
DEDICATION AND AVAILABILITY OF THE REQUIRED
FIFTY PERCENT (50%) MATCHING FUNDS;
AUTHORIZING THE APPROPRIATE CITY OFFICIALS TO
ENTER INTO AN INTERLOCAL AGREEMENT;
PROVIDING FOR TRANSMITTAL OF THE VOLUSIA
COUNTY INLET & PORT DISTRICT JOINT
PARTICIPATION PROGRAM GRANT APPLICATION AND
CERTIFICATION TO VOLUSIA COUNTY; PROVIDING
SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE

WHEREAS, George Kennedy Memorial Park, is located on the east side of Riverside Drive,
across from 104 North Riverside Drive.

WHEREAS, the City of Edgewater, wishes to provide recreational public access that
benefits area residents and tourists.
WHEREAS, the City wishes to upgrade one dock at the existing Boat Ramp Facility to a
gangway and floating dock at George Kennedy Memorial Park on Riverside Drive.
WHEREAS, the City Council of the City of Edgewater, Volusia County, Florida, has
authorized submission of a V olusia County Ponce De Leon Inlet & Port District Joint Participation
Program Grant fund application to Volusia County's Inlet and Port District office.
WHEREAS, a copy of the Volusia County Ponce Inlet & Port District Joint Participation
Program grant fund application is attached as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED by the City Council of The City of
Edgewater, Florida
Section 1.
The City Council hereby authorizes submission of the V olusia County Ponce De
Leon Inlet & Port District Joint Participation Program grant fund application to the
County of Vol usia's Inlet and Port District office.

The project name for which the grant funds are requested will be known as Kennedy
Park Boat Dock.
The total cost of the project is estimated to be $28,000.
The City is requesting grant funds in the amount of Fourteen Thousand and nollOO
($14,000) dollars.
The City hereby assures dedication and availability of matching funds in the amount
of$14,000 upon receipt of the Grant Fund Award Notification, which will meet the
required fifty percent (50%) match.
The City Council hereby authorizes the appropriate City Officials to enter into an
Interlocal Agreement.
The City is fiscally and legally responsible to satisfactorily develop, operate and
maintain the Project.
The City Council hereby designates Jack Corder, Director of Parks and Recreation,
to transmit a copy of this resolution, the certification and the original grant fund
application with ten (10) copies to the County of Volusia's Inlet & Port District
Office.
Section 9. An official, adopted and certified resolution of the City of Edgewater, shall be
included with the grant fund application.
Section 10. That all resolutions or parts of resolutions in conflict herewith be and the same are
hereby repealed.
Section 11. This resolution shall take effect upon adoption.

The purpose of this project is to improve and enhance an area that is
used for fishing and sight-seeing. Development of this fishing pier and
gazebo will provide fishmermen access to deeper water. The gazebo area will
provide an area for viewing for sight~seeing. Development of this project
will improve the aesthetics of the park.
3. Briefly characterize, describe or otherwise quantify the need for the project detailing any
user groups specifically served.
Development of this project will benefit both fishermen and sight-seers.
Extending the pier out 10 ft. along the wall will enable the fishermen~to
reach deeper waters along the river. Second, it will enable sight-seers
to sit or move around comfortably away from the vehicles.

Currently, the existing seawall provides access to the Intracoastal

The area where the project is to be constructed consists of a seawall;
placing of pilings to hold up the fishing pier will help break up waves

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, VOLUSIA COUNTY, FLORIDA,
AUTHORIZING SUBMISSION OF A VOLUSIA COUNTY
PONCE DE LEON INLET & PORT DISTRICT JOINT
P ARTICIP A TION PROGRAM GRANT FUNDING
APPLICATION TO THE COUNTY OF VOLUSIA, ASSURING
DEDICATION AND A V AILABILITY OF THE REQUIRED 50
PERCENT MATCHING FUNDS, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO ENTER INTO AN
INTERLOCAL AGREEMENT AND; PROVIDING FOR
TRANSMITTAL OF THE VOLUSIA COUNTY INLET &
PORT DISTRICT JOINT P ARTICIP A TION PROGRAM
GRANT APPLICATION AND CERTIFICATION TO
VOLUSIA COUNTY; PROVIDING SEVERABILITY; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, George Kennedy Memorial Park, is located on the east side of Riverside Drive,
across from 104 North Riverside Drive.
WHEREAS, the City ofEdgewater, wishes to provide recreational public access that benefits
area residents and tourists.
WHEREAS, the City wishes to construct a fishing pier, platform and gazebo at George
Kennedy Memorial Park on Riverside Drive.
WHEREAS, the City Council of the City of Edgewater, V olusia County, Florida, has
authorized submission of a V olusia County Ponce De Leon Inlet & Port District Joint Participation
Program Grant fund application to Volusia County's Inlet and Port District office.
WHEREAS, a copy of the Volusia County Ponce Inlet & Port District Joint Participation
Program grant fund application is attached as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED by the City Council of The City of Edge water, Florida
Section 1.
The City Council hereby authorizes submission of the V olusia County Ponce De
Leon Inlet & Port District Joint Participatio)1 Program grant fund application to the
County of Vol usia's Inlet and Port District office.
Section 2.
The project name for which the grant funds are requested will be known as Kennedy

Park Pier.
The total cost of the project is estimated to be one hundred thirty-five thousand three
hundred dollars and no/lOO ($135,300.00)
The City is requesting grant funds in the amount of sixty thousand eight hundred and
eighty-five dollars and no/lOO ($60,885.00.)
The City has funds in the amount of $13,530.00 or 10 per cent dedicated to this
project and hereby assures availability ofthe remaining matching funds, in the amount
of $60,885.00 upon receipt of the grant fund award notification, which meets the
required 50 percent match.
The City Council hereby authorizes the appropriate City Officials to enter into an
Interlocal Agreement.
The City is fiscally and legally responsible to satisfactorily develop, operate and
maintain the project.
The City Council hereby designates Jack Corder, Director of Parks and Recreation, to
transmit a copy of this resolution, the certification and the original grant fund
application and ten copies to the County ofVolusia's Inlet & Port District office.
Section 9. An official, adopted and certified resolution of the City of Edgewater, shall be
included with the grant fund application.
Section 10. That all resolutions or parts of resolutions in conflict herewith be and the same are
hereby repealed.
Section 11. This resolution shall take effect upon adoption.
