ITEM DESCRIPTION:
Developers Ed Grant and Jim Scott are seeking development approval of a single-family residential
subdivision consistent with a Joint Stipulation and Motion for Final Judgement issued by a Federal
Court and recorded September 20, 1988 (the "Court Order"). The development request is to obtain
from the Edgewater City Council development pursuant to the terms of the Court Order. The
developers are seeking approval of a preliminary development plan that was designed to be
consistent with the specific conditions defined in Section 6A, 6B (1 thru 4) on page three (3) of the
Court Order.
BACKGROUND:
The property consists of approximately 26.5 acres located west of US I, south of the Silver Ridge
Subdivision, east of Glenwood Road and north of the Edgewater Mobile Home Park located in
unincorporated V olusia County (the "Property"). The Property was rezoned from R-l to R-R PUD
(Resort-Residential Planned Unit Development) by the Edgewater City Council (Ordinance 768) on
August 7, 1972. The original approval included an approval for 347 dwelling units. As of 1972, the
Property was owned by Mike Caldwell. No development occurred on the Property as of April 16,
1979, and the Edgewater City Council, in accordance with the 1979 land development regulations,
rezoned (down-zoned) the Property from R-R PUD back to R-l.
Mr. Caldwell filed a Federal lawsuit against the City claiming a property loss and civil rights
discrimination due to the City's action to down-zone the property from R-R PUD to R-l in 1979.
He alleged the City approved several extensions to the development time frame criteria and that he
was denied a preliminary plan due to lack of water, sewer, police and traffic while other similar
development projects were approved. Several public meetings were conducted by the City Council,
City Attorney (Jose Alverez), Mr. Caldwell and his attorney (Alan Watts) to find a compromise
position for all entities. At the City Council meeting of July 20, 1987, the Edgewater City Council
voted to direct the City Attorney (Alverez) to coordinate with Mr. Caldwell's attorney (Watts) and
enter into a settlement which the Federal court accepted as evidenced by the issuance of the Court
Order.
The Court Order contains specific language related to the development of the Property. The
conditions for development approval are described on Page 3 of the Court Order. In summary, the
City Council's review of the subdivision is limited to ensuring that the Property be developed
consistent with a development plan which shows:

A maximum of 200 units on the Property.
Only single-family homes being built on lots adjoining the Silver Ridge Subdivision.
Lots adjoining the Silver Ridge Subdivision having a depth of not less than ISO feet.
Lots adjoining the Silver Ridge Subdivision include a 45 foot buffer of which the
first 25 feet is natural vegetation and shall not be included in the platted rear lot with
the remaining 20 feet being a utility easement which is to be included as a portion of
the platted rear lot.
Roads within the Property shall not connect to the Silver Ridge Subdivision.
Lots adjoining or separated by an east-west street from the northerly tier of single-
family lots shall be utilized only for one and two family dwellings.
A minimum floor area for each unit on the Property which does not exceed the
current R-2 zoning district (currently 1,200 feet).

The subdivision consists entirely of single-family units.

minimum of 9,000 square feet adjacent to the Silver Ridge Subdivision and 6,900
square feet throughout the balance of the proposed subdivision).
Lots adjoining the Silver Ridge Subdivision include a 45 foot buffer with the first 25
feet being natural vegetation and the remaining 20 feet being a utility easement.
No connection to any roadways in the Silver Ridge subdivision.
The subdivision consists entirely of single-family units.
The floor area for each unit on the Property is no less than 2,800 square feet.

Scott Cookson, City Attorney, and I have reviewed the Court Order and conclude the following:

1. The City Council should review the proposed development plan for the Property to
determine strict compliance with the Court Order.
2. If the City Council finds the proposed development plan consistent with the Court
Order, the developers should be authorized to proceed with a development
agreement, construction plan approval and final plat.
3. If the City Council makes a specific finding that the proposed development plan is
inconsistent with the Court Order, City Council should make a clear directive for the
developers to obtain consistency with the Court Order followed by a development
agreement, construction plan approval and final plat.
STAFF RECOMMENDATION:
Staff has reviewed the proposed development plan and finds it is consistent with the terms and
conditions of the Court Order.

ITEM DESCRIPTION:
Waving building permit application fees for Habitat For Humanity.
BACKGROUND:
Habitat For Humanity has constructed seven (7) houses since 1999 and has requested a waiver to
numerous review fees, impact fees and permits fees. Staff recommends that the City Council should
review and adopt a consistent policy for the waiving of development fees related to Habitat For
Humanity housing.
U Table 1 is a listing of all City mandated review fees, impact fees and permit fees to construct a
single-family house. Fees 1 through 8 are local and can be waived without creating a conflict. Fees
9 throughl8 are restricted by the state (Radon Surcharge) or bond covenants (water, sewer,
connection, deposits) or impact fees to pay the pro-rata share of public safety improvements.
STAFF RECOMMENDATION:
Waiving fees I through 8 of the attached Table I.
ACTION REOUESTED:
Motion to approve the waiving of plan review; building, electrical, plumbing, mechanical, use, tree
and fill permits for Habitat For Humanity houses.
