6. PUBLIC HEARINGS, ORDINANCES AND RESOLUTIONS
A. 1st Reading, Ord. No. 2000-0-12, staff recommending approval of the new
Land Development Code and Official Zoning Map. Sections concerning the
storage of boats and recreational vehicles, restoration of vehicles and the
prohibition of temporary carports have been deleted and will be reviewed by
an appointed Citizen Ad-Hoc Committee (tabled from June 5, 2000).
7. CONSENT AGENDA
Items on the consent agenda are defined as routine in nature that do not warrant detailed
discussion or individual action by the Council; therefore, all items remaining on the consent
agenda shall be approved and adopted by a single motion, second and vote by the City
Council. Items on the consent agenda are not subject to discussion. One of the most basic
rules of a consent agenda is that any member of the City Council may remove any item
from the consent agenda simply by verbal request at the City Council meeting.
Removing an item from the consent agenda does not require a motion, second or a vote; it
would simply be a unilateral request of an individual Council member.
D. Recreation/Cultural Services Board Appointments (3) - Councilwoman
Lichter, Mayor Schmidt and Councilman Brown, respectively, to consider
Board's recommendation to appoint David Turner to fill the remaining term
of Maurice Remillard: Jo Hagan to replace Shirley Pittman and Diane Trout
to replace James McGinnis, both for full three-year terms.

A. Budgeted Roadway Resurfacing - Environmental Services Director
requesting authorization to contract with Halifax Paving based on existing
County of Vol usia bid prices to perform resurfacing of eleven (11) streets for
a cost not to exceed $100,000.
B. Purchase Item - Environmental Services requesting approval to purchase a
new garbage truck from Clark Waste Systems, Inc. for $70,621, as a bid
extension for FY 1999 City of Edgewater bid.
C. Forming of Citizen Ad-Hoc Committee - Council to appoint a committee,

Southeast Volusia County YMCA at Edgewater
PROJECT PROPOSAL AND COSTS
The development of facilities, which will allow a full range of YMCA programming, is scheduled to
be achieved in four phases which will produce a safe, modern, well - supervised and user- friendly
facility. Phase I and Phase II are listed with approximate costs with scheduled completion dates
indicated. Completion dates and costs of Phases III and IV have yet to be determined.
PHASE I
• GYMNASIUM COMPLEX to be completed October 1, 2000 $1,600,000.00
Includes a full -size gymnasium with bleachers, a wellness center with resistance and
cardiovascular equipment, a teen/senior center with kitchen, locker rooms and administrative
and office space. Funding for construction provided by the City of Edgewater,
wellness /exercise and office equipment provided by the YMCA.
PHASE II
• FAMILY AQUATIC CENTER to be completed April 1, 2001 $600,000.00
An outdoor pool with areas for family (fountains, sprays, easy entry /handicapped access), lap
swimming and aquatic exercise. Also includes bathhouse /changing facilities and a food
vending area. Included in the cost are site preparation, fundraising, marketing and
contingency expenses to support a public fundraising effort in the area.
PHASE III
• CHILDCARE CENTER, MULTI - PURPOSE ROOM, $500,000.00
AND FAMILY /SPECIAL NEEDS CHANGING AREAS (Estimated)
The Childcare Center will be utilized for After School Programs, Pre - school activities and
babysitting requirements for members while they are working out. Multi - purpose space for
fitness /exercise classes, meetings and additional programs along with a family /special needs
locker room with private dressing stalls separate from the traditional male /female locker
areas. Cost includes site preparation work and construction.
PHASE IV
• TWO RACQUETBALL COURTS $200,000.00
(Estimated)
Indoor courts with paneled walls and glass back walls for viewing purposes. Cost includes
site work and construction costs.

Southeast Volusia YMCA
Edgewater Facility
The Southeast Volusia YMCA and the Edgewater Parks and Recreation
Department will work together to provide the following programs for the
community. The Greater Daytona Beach Area YMCA will manage all operating
expenses of the Southeast Volusia Area YMCA.
Edgewater Parks and Recreation Department will continue to provide the following
programs:
• Youth Baseball (5 -14 years of age)
• Youth Soccer (5 -14 years of age)
• Tennis Lessons (all ages)
• Senior Men's Softball (over 55)
• Youth Girl's Softball (8 -14 years of age)
• Adult Co -ed Softball (adult men & women)
• Shuffleboard Club League
• Concerts in the Park
Programs that will be provided in the new Southeast Volusia YMCA Edgewater facility
are:

Questions and Answers
What does the Facility include?
Full size Gymnasium, Fitness Center, Teen/Senior Center, Two Locker Rooms, Aerobic Area,
Family Outdoor Aquatic Center and Administrative Offices.
How did the project come about?
The concept was developed in January of 1999 when the City of Edgewater and the Greater
Daytona Beach Area YMCA signed an agreement for a three -phase project.
Phase I: City of Edgewater will build Gymnasium, Fitness Center, Locker Rooms, and
Office Space for approximately $1.6 million. The YMCA will equip the facility.
Phase II: Family Aquatic Center constructed with funds raised by the YMCA.
Phase III: Child Care and multi - purpose space funded from money raised by the YMCA.
Who are the major participants?
The City of Edgewater owns the land and the buildings. The YMCA will manage the facility and
conduct all programs that take place in the facility.
When will the Southeast Volusia YMCA open?
They Gymnasium Complex is scheduled to open in October 2000. The Family Aquatic Center is
scheduled to open April or May 2001.
Who will the facilities serve?
The YMCA will serve the friends, neighbors, families and employees of Edgewater, New
Smyrna Beach and Oak Hill. Most will become full members. Others will use the facilities on an
occasional basis through individual programs. The facilities and programs will be open to all.
What will fees be?
Fees will be $18.00 /month for Youth, $25.00 /month for College Students, $30.00 /month for
Seniors, $33.00 /month for Single Adults, $36.00 /month for Single Parent Families,
$39.00 /month for Senior Families, and $45.00 /month for Families. Some fee reductions will be
available, based on need. A one -time joiners fee of $50.00 for Families and Adults, and $25.00
for Youth and College Students will be charged to each new member.
Do Membership fees cover all costs?
They will, for many participants. Membership fees cover core classes, but not things such as
child care, camping and specialty classes. However, members will get a reduced rate on all
programs not included in membership.
When will the facilities be open?
The programs will be offered seven days a week: Monday through Friday 6:00 am to 9:00 pm,
Saturday 8:00 am to 5:00 pm and Sunday from 1:00 pm to 5:00 pm.

Approval of new Land Development Code and Official Zoning Map
BACKGROUND:
In conjunction with Florida Statutes, the City has prepared a new Land Development Code
(LDC) and Zoning Map. Staff has sought comments from various agencies, boards, developers
and the general public. In an almost two -year process, five revised draft documents were
developed. After many workshops and public hearings, the document presented is a culmination
of that process. Based on the public comments (meeting of June 5, 2000) and City Council
direction, sections of the proposed Land Development Code concerning: Watercraft, Trailers,
Recreational Vehicles (RV's) and Campers; Vehicle Restoration and Permits; Tents /Temporary
Carports have been removed and will be reviewed by an appointed Citizen Review Committee.

WHEREAS, on May 21, 1990, the City of Edgewater adopted the City's Comprehensive
Plan (Ordinance 90 -0 -18) pursuant to the requirements of Chapter 163, Part II, Florida Statutes and
Chapter 9J -5, Florida Administrative Code; and
WHEREAS, on November 23, 1992, the Florida Department of Community Affairs
determined the City's Comprehensive Plan was IN COMPLIANCE with the requirements of Chapter
163, Part II, Florida Statutes and Chapter 9J -5, Florida Administrative Code; and
WHEREAS, Chapter 163, Part II requires the City to implement the adopted Comprehensive
Plan by Land Development Regulations; and
WHEREAS, Chapter 163.3202, Florida Statutes requires adoption of a unified Land
Development Code which contains all regulations related to the development of land in the City; and
WHEREAS, the Local Planning Agency held a public workshop on December 16, 1998, and
public hearings on January 27, 1999, January 19, 2000, and April 12, 2000, to consider the proposed
Land Development Code, (Chapter 21 of the City Code); and
WHEREAS, after consideration of the public testimony at those hearings, the Local Planning
Agency determined the proposed Land Development Code is consistent with the City's
Comprehensive Plan and that it substantially meets the requirements of Chapter 163.3202, Florida
Statutes; and
WHEREAS, the City Council conducted public workshops on May 8, 2000, and May 25,
2000; a first reading /public hearing on June 19, 2000; and a second reading and public hearing on
July 10, 2000; and

WHEREAS, the public was provided notice of these meetings by advertisements in the
Observer (a newspaper of general circulation in the City of Edgewater) and by posting the schedule
at City Hall and the Edgewater. Library; and
WHEREAS at these public meetings, the City Council received and considered the public
testimony and input regarding the proposed Land Development Code; and
WHEREAS, the City has complied with the procedure for enacting ordinances as described
by Chapter 166.041, Florida Statutes; and
WHEREAS, the City Council recognizes that it is critical to adopt a Land Development
Code which meets the requirements of Chapter 163.3202, Florida Statutes; and
NOW, THEREFORE, BE IT ENACTED by the City Council of the City of Edgewater, Florida:
PART A. CREATION OF A NEW CHAPTER 21
There is hereby created a new Chapter 21 of the City Code known as the Land Development
Code. The new Chapter 21 of the City Code is attached hereto as Exhibit A and incorporated herein
by this reference. The Land Development Code shall contain all City regulations concerning the
following:
(1) Zoning, subdivision and use of land within the City
(2) Compatibility between adjacent land uses
(3) Requirements concerning open space in development projects
(4) Consistency with the land and water uses in the adopted Comprehensive Plan
(5) Protection of potable wellfields and sensitive lands
(6) Provisions for stormwater management

(7) Control of signage and billboards

PART B. CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof, in conflict with this ordinance,
are hereby superseded by this ordinance to the extent of such conflict.
PART C. SEVERABILITY.
If any portion of this ordinance is for any reason held or declared to be unconstitutional,
inoperative, or void, such portion shall be deemed a separate, distinct and independent provision and
the holding shall not affect the validity of the remaining portions of this ordinance.
PART D. EFFECTIVE DATE.
This Ordinance shall take effect immediately upon passage and adoption.

PART E: CODIFICATION
It is the intention of the City Council that the provisions of this Ordinance shall become and
be made a part of the City Code and that sections of this Ordinance may be renumbered or relettered
and the correction of typographical errors which do not affect the intent may be authorized by the
City Manager without need of public hearing, by filing a corrected or recodified copy of the
Ordinance with the City Clerk.

ITEM DESCRIPTION: Request to use (Piggy -Back) existing Volusia County Paving Bid
For City of Edgewater's Budgeted Resurfacing Program
BACKGROUND: The current (FY 2000) City of Edgewater budget appropriated $100,000
for street resurfacing. Halifax Paving, Inc. of Ormond Beach, Florida has
agreed to extend the County of Volusia's bid prices to the City of
Edgewater. Current bid will expire 7/31/00. Total proposed resurfacing
is $99,644.00.
STAFF RECOMMENDATION: Authorize contract with Halifax Paving based on the existing
County of Volusia bid prices to perform resurfacing of 11 streets.
ACTION REQUESTED: Motion by the Edgewater City Council to approve a contract with Halifax
Paving at a cost not to exceed the $100,000 budgeted.

I'T'EM DESCRIPTION: Request to purchase new garbage truck as budgeted for FY 2000 from
Clark Waste Systems, Inc. as a bid extension from FY 1999 City of
Edgewater bid.
BACKGROUND: In FY 1999, the City of Edgewater entertained competitive bids for a
vendor to supply a new 18 cubic yard rear loading refuse truck. The low
bidder and recipient of the bid award was Clark Waste Systems, Inc. of
Davie, Florida. Staff has found the unit provided to be compliant with all
bid specifications and the unit has performed well. Upon hearing we were
preparing to advertise for an additional garbage truck, Clark offered to
extend their current bid price to the City through 6/31/00.
STAFF RECOMMENDATION: As the offered price was derived from the competitive bidding
process by the City of Edgewater, as the already acquired unit has
performed well, and the maintenance and spare parts would be
identical, staff is recommending purchasing the budgeted garbage
truck from Clark Waste Systems, Inc. at a bid price of
$70,621.00.
ACTION REQUESTED: Staff respectfully requests the Edgewater City Council approve
the staff recommendation.
