NO.: 94 -102 Date: September 19, 1994 NEW UNFINISHED CONSENT BUSINESS BUSINESS PUBLIC HEARING RESOLUTION 09/26/94 ORDINANCE ITEM DESCRIPTION /SUBJECT: Resolution No. 94 -R -18 and 94 -R -19 - Adopting a Millage Rate and Final Budget for Fiscal Year 1994 - 1995. BACKGROUND: In compliance with the requirements of Section 200.065(2)(c), Florida Statutes, a public hearing was held on September 7, 1994, at which time a tentative budget was adopted pursuant to Resolution No. 94 -R -17. In addition, the proposed millage rate of 6.13178 mills was announced. Pursuant to Section 200.065(2)(d), Florida Statutes, the next step in the process is an advertised second public hearing at which time the millage rate for Fiscal Year 1994 - 1995 and the final budget must be adopted. The advertisement is scheduled for publication on September 21, 1994, in the News Journal, as required within 15 days of the first public hearing and not less than 2 nor more than 5 days before the second hearing. RECOMMENDATION /CONCLUSION: First, Staff recommends that the City Council consider adoption of Resolution No. 94 -R -18 adopting a millage rate of 6.13178 mills per $1,000 of assessed valuation which is a 5.00% increase over the rolled back rate. Pursuant to Section 200.065(2)(d), Florida Statutes, the resolution must be publicly read in full prior to its adoption. Subsequent to the adoption of Resolution No. 94 -R -18, Staff recommends that the City Council adopt Resolution No. 94 -R -19 adopting the final budget for Fiscal Year 1994 - 1995. The amount of $5,958,855 is anticipated to be collected from the sources of revenue for the Water and Wastewater Fund during Fiscal Year 1994 - 1995. From those anticipated sources of revenue for the Water and Wastewater Fund $5,958,855 is the estimated amount of expenditures for Water and Wastewater Fund for Fiscal Year 1994 - 1995. A more detailed explanation of the revenues and expenditures of the Water and Wastewater Fund is set forth on pages 40 through 50 of the attached Exhibit A. Section 6. The amount of $1,196,297 is anticipated to be collected from sources of revenue for the Refuse Collection Fund during Fiscal Year 1994 - 1995. From those anticipated sources of revenue for the Refuse Collection Fund $1,196,297 is the estimated amount of expenditures for the Refuse Collection Fund for Fiscal Year 1994 - 1995. A more detailed explanation of the revenues and expenditures of the Refuse Collection Fund is set forth on pages 51 through 53 of the attached Exhibit A. 94 -R -19 2 Section 7. The amount of $530,037 is anticipated to be collected from the sources of revenue for the Stormwater Management /Maintenance Fund during Fiscal Year 1994 - 1995. From those anticipated sources of revenue for the Stormwater Management /Maintenance Fund $530,037 is the estimated amount of expenditures for the Stormwater Management /Maintenance Fund for Fiscal Year 1994 - 1995. A more detailed explanation of the revenues and expenditures of the Stormwater Management /Maintenance Fund is set forth on pages 54 through 56 of the attached Exhibit A. Section 8. The amount of $114,600 is anticipated to be collected from the sources of revenue for the Internal Service /Self Insurance Fund during Fiscal Year 1994 - 1995. From those anticipated sources of revenue for the Internal Service /Self Insurance Fund $114,600 is the estimated amount of expenditures for the Internal Service /Self Insurance Fund for Fiscal Year 1994 - 1995. The City Manager is hereby directed and authorized to appropriate and spend the anticipated reveues as set forth in Section 3, 5, 6, 7, and 8 and the attached Exhibit A when the revenues are received and collected. In addition, the City Manager is authorized to transfer line items within specific funds and from contingency as needed, but shall transfer monies from Fund to Fund without City Council approval. The City Council shall be notified within thirty (30) days of any transfer from contingency. Section 10. It is cost effective and in the best interest of the citizens of Edgewater to delete the additional charge for items not considered to be trash. NOW, THEREFORE, BE IT ENACTED by the People of the City of Edgewater, Florida: PART A. AMENDMENT OF SECTION 19 -63 (SERVICE CHARGES AND RATES) OF ARTICLE IV (SOLID WASTE DISPOSAL) OF CHAPTER 19 (UTILITIES AND SERVICES) OF THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA. Section 19 - 63 is amended as follows: Section 19 - 63. Service Charges and Rates. (a) The city shall maintain and operate a service for the collection and disposal of garbage and trash, and all persons whose premises are serviced thereby shall pay to the city for such Struck through passages are deleted. Underlined passages are added. 94 -0 -20 1 services the following monthly rates: (1) Residence: Ten dollars and fifty tcn cents ($10.50 10.10) per month up to a maximum of three (3) cans or equivalent per pickup. (2) Multiple dwelling: Ten dollars and fifty test cents ($10.50 10.10) per month to a maximum of three (3) cans or equivalent per pickup. A charge of nine dollars and seventy - five thirty -five cents ($9.75 9.35) per month per unit shall be made if the garbage and trash is centrally located. (3) Business or commercial: Twelve Elcvcn dollars and sixty ccnta ($12.00 11.60 ) per month for each commercial or business unit up to a maximum of three (3) cans or equivalent per pickup. For each additional can in excess of three (3) there shall be an additional charge of one dollar and twenty cents ($1.20 1,44) per can. (4) Professional: Ten dollars and fifty tcn cents $10.50 10.10) per month for each professional unit up to a maximum of three (3) cans or equivalent per pickup. For each additional can in excess of three (3) there shall be an additional charge of one dollar and twenty cents ($1.20 1.00) per can. (5) Trailer park: Ten dollars and fifty tcn cents ($10.50 14,10) per trailer or mobile home unit up to a maximum of three (3) cans or equivalent per pickup. For each additional can in excess of three (3) there shall be an additional charge of one dollar and twenty cents ($1.20 1,44) per can. A charge of nine dollars and seventy -five thirty -five cents ($9.75 9.35) per month per trailer or mobile home shall be charged if the garbage and trash are centrally located within the mobile home park. (6) Equipment reserve fund: in addition to the above stated refuse account, there is an equipment reserve fund in the Struck through passages are deleted. Underlined passages are added. 94 -0 -20 2 City of Edgewater, Florida, created on September 28, 1981, for the purposes of financing equipment used in the collection and disposal of garbage and trash within the city in addition to the above stated charges. Each account shall be charged an additional fifty cents ($0.50) per month, per account, said funds being placed in the separate equipment reserve fund for the aforementioned purpose. (7) Citywide residential recycling fee: One dollar ($1.00) per month, for weekly curbside collection service for paper, glass, plastic, corrugated cardboard, aluminum, and metal cans beginning June 28, 1991. PART B. AMENDMENT OF SECTION 19 -66 (PREPARATION OF TRASH) OF ARTICLE IV (SOLID WASTE DISPOSAL) OF CHAPTER 19 (UTILITIES AND SERVICES) OF THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA. Section 19 - 66 is amended as follows: Section 19 - 66. Preparation of trash. (eb) Piles of trash shall be stacked in piles not to exceed four (4) feet in height, four (4) feet in width, and four (4) feet in length. (dc) No trash pickups will be made from vacant lots; provided however, the owner of any vacant lot may make arrangements with the city for pickup of trash, and a reasonable charge for such service shall be determined by the supervisor. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstance. PART E. CODIFICATION. Provisions of this ordinance shall be incorporated in the Code of Ordinances of the City of Edgewater, Florida, and the word "ordinance ", may be changed to "section ", "article ", or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that Parts C through G shall not be codified. PART F. EFFECTIVE DATE. This Ordinance shall take effect October 1, 1994. PART G. ADOPTION. The above stated fees shall be applicable irrespective uf whether the residence, the multiple dwelling, the business or commercial establishment, or the trailer park is using city water or sewer services. The city • shall make an initial determination of the number of units within hotels, motels, and multiple businesses, and the number of lots, plots, or spaces within trailer parks with trailers thereon, and each hotel, motel, multiple b i , , , / p e us ness, and trailer park shall be billed for garbage on the basis of the units or lots therein. The city may adjust the number of billable units when it shall determine that the actual number of units or lots has changed during the billing period. The charges and fees prescribed by this section are due and payable for the services of garbage and trash collection and its availability to the user, whether such service is used or not, except as expressly provided otherwise herein' A delinquency charge of ten (10) percent of the amount due for garbage and trash service shall be charged against the customer by the city if the customer shall fail to pay the charges due for garbage and trash service within twenty (20 days uf the billing date of said service. Should there be a failure by the customer receiving garbage and trash service to pay his bill in full for said service not later than thirty (30) days from the billing date for said service, then said garbage and trash service shall be terminated. The city shall have a lien un all lands or premises serviced by the garbage and trash collection service charges and fees until paid in full. Notice and enforcement of such liens shall be in accordance with the laws of the State of Florida. Such liens, when delinquent for more than thirty (30) days, may be foreclosed by the city in the manner provided by the laws of Florida for foreclosure of mortgages un real property. The owner of real property upon which a lien is filed shall be responsible for attorney's fees incurred in any action brought by the city, for lien enforcement or lien foreclosure. Any business conducted upun or in a homestead shall be an additional charge; otherwise the regular business or commercial rate shall apply. RECYCLABLE MATERIALS Sec. Unauthorized collection uf recycling containers or recyclable materials. (1) Definitions. Fur the purpose of this section, the following terms shall have the o/eaninys indicated in this subsection. Recycling containers shall mean the receptacles purchased and distributed by or on behalf of the city to City residents for the intended use or recyclable materials. Recyclable materials shall mean those materials which are capable of being recycled and which •would otherwise be processed or disposed of as solid waste including newspapers, glass and plastic containers, aluminum cans, tin cans, cardboard, phone books and such other materials as designated by resolution of the city council. (2) Prohibited. No person, firm or corporation shall be permitted to collect or remove either recycling containers ur recyclable materials placed in or near the recycling containers or designated collection location unless previously authorized by the city, (3) Penalties for unauthorized collection. A multiresidential unit includes residential dwellings of two (2) or more units and includes town- houses, apartments, duplexes, condominiums and mobile home parks, all of which are served by a single water meter. Each mctcr installation serving multircsidcntial units shall be allowcd to uoc two thousand (2,000) gallons per unit per month. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. Mr. McMahon's memorandum may have given you the impression that there is only one proposal. I discussed this concern with Mr. McMahon prior to his leaving to attend an out -of -state conference. He agreed that some clarification is in order and asked me to do so in his absence. There are actually two (2) proposals that have been submitted for your consideration at the September 19, 1994 Council Meeting. The first proposal is dated August 15, 1994 and the second dated September 15, 1994. They are titled respectively as: Proposed Initiative #1: A Business Climate Analysis and Natural Linkage Study for the City of Edgewater, Florida. Proposed Initiative #2: A Tourism / Industrial Development Cooperative Opportunity Analysis and Recommendations Study. The cost of proposed initiative #1 is $5,500 and $7,500 for proposed initiative #2. The total cost of the proposed initiatives is $13,000. McMahon, City Manager ^5, - SUBJECT: City's Health Insurance Plan As you know, we have been with Florida Municipal League's Health Insurance Plan over the past year. This plan provided us the lowest cost of insurance at the time that we contracted with Florida League October 1, 1993. The plan worked well, however, recently we were advised by the Florida Municipal League that our rates would increase a minimum of 42% with a renewal of our contract on October 1. Recognizing this several months ago, I contacted our insurance broker of record, Jack Ascherl, and requested that he solicit bids on the basis of the City's current health insurance plan. Although this took several months because of the data and information involved, which had to be provided to various firms interested in bidding, this has now been completed. Nine firms, out of 30 requested to bid, have submitted their bids. Analysis of the details of these plans strongly indicates that the Massachusetts Mutual Health Insurance Plan (same plan as New Smyrna Beach) has submitted the most cost efficient and economical plan to the City. The amount of money necessary to fund this plan is available through the budget previously proposed to you. Although the cost of insurance increases 13.93 %, this compares very favorably to the cost of renewing the current plan with the Florida Municipal League (42 %). I am very confident this plan will serve the best economic interest for the City while providing current benefits and I will be recommending Council accept this plan effective October 1, 1994. Our costs will be stabilized and are certainly in line with the cost of health insurance increases projected by the industry for next year. Jack Ascherl will give a brief presentation on this matter Monday evening after the budget hearing and I request Council take action to approve this plan with Massachusetts Mutual to meet our contract deadline of October 1, 1994.
