BE IT ADOPTED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. AUTHORITY FOR THIS RESOLUTION. This resolution is adopted pursuant to the provisions of Chapter 166, Part II, Florida Statutes, Sections 1.01 and 3.12 of the Charter of the City, the Assessment Act, Section 6.06 of the Master Resolution and other applicable provisions of law_ SECTION 2. FINDINGS. It is hereby ascertained, determined and declared that: A. The City Council (the "Council ") of the City of Edgewater, Florida (the "City "), on August 15, 1994, duly adopted a resolution referred to by title in the title above (the "Master Resolution ") authorizing the issuance of Capital Improvement Bonds. B. It is necessary and desirable and in the best interests of the City that the Master Resolution be amended to allow for Franchise Fees to be included in the Excise Tax Revenues pledged to the security of the Bonds. SECTION 3. AMENDMENTS TO RESOLUTION. The Master Resolution is hereby amended as follows: A. Section 1.02 of the Master Resolution is hereby amended by amending certain definitions to read as follows: "Excise Taxes" or "Excise Tax Revenues" means, collectively the Gas Tax Revenues, the Guaranteed Entitlement Revenues, the Utility Services Tax Revenues, the Franchise Fee Revenues and such other excise tax revenues as may be provided for by supplemental resolution. "Series Excise Taxes or Series Excise Tax Revenues" means collectively, the Series Gas Tax Revenues, the Series Guaranteed Entitlement Revenues, the Series Utility Service Tax Revenues, and the Series Franchise Fee Revenues. "Series Pledged Revenues" means, with respect to a Series, (a) the Series Special Assessments, (b) the Series Stormwater Revenues, (c) the Series Excise Tax Revenues, (d) the moneys on deposit in the Series Subaccounts in the Funds and Accounts, and (e) the Series Investment Earnings. B, Section 1.02 of the Master Resolution is hereby amended by adding thereto certain definitionslo read as follows: "Franchise Fee Revenues" shall mean the amounts due and payable to the City under franchises granted by the City, more particularly described below, as such franchises may be renewed or extended from time to time. 1, Franchise granted to Cablevision Industries of Central Florida, Inc. for a cable television communication system within the corporate limits of the City, pursuant to Ordinance No. 84 -0-8, enacted June 4, 1984, 2. Franchise granted to Southern Bell Telephone and Telegraph Company for a communication system pursuant to Ordinance No, 86 -0 -19, enacted August 4, 1986. 3, Franchise granted to Florida Power & Light Company for electric light and power facilities, pursuant to Ordinance No, 83 -0 -16, enacted November 7, 1983. 4. Franchise granted to South Florida Natural Gas Co., a franchise for operation of a gas distribution system pursuant to Ordinance No. 85 -0 -4, enacted February 5, 1985. " "Series Franchise Fee Revenues" means so much of the Franchise Fee Revenues as are specifically pledged to secure payment of Debt Service on a particular Series pursuant to a series Resolution. C. Article V of the Master Resolution is hereby amended by adding thereto a new subparagraph (H) to read as follows: 324VE11009. 001 /R-AMEND.MAST!R..RES 9- 12.1994n5:09pm "(H) ENFORCEMENT AND /OR EXTENSIONS OF COLLECTIONS; ELIGIBILITY FOR RECEIPT. The City will diligently enforce and collect the Pledged Revenues herein pledged; will take all reasonable steps, actions and proceedings for the enforcement and collection of such Pledged Revenues as shall become delinquent in order to provide for the payment of the Debt Service on the Bonds secured thereby; and will maintain accurate records with respect thereof. All such Pledged Revenues shall, as collected, be held in trust to be applied as herein provided, and not otherwise. In addition, to the extent one or more of the Excise Tax Revenues are pledged to secure the payment of the Debt Service on the Bonds the City shall (1) remain eligible to receive such Excise Tax Revenues; (2) use its best efforts to extend or renew the ordinances pursuant to which such Excise Tax Revenues are levied or collected, as the case may be, in the event such ordinance expires prior to the maturity of the Series of Bonds so secured and (3) not repeal any existing ordinance pursuant to which such additional Exo se Tax Revenues are levied or collected unless such repeal would not take effect until after the maturity of the Series of Bonds so secured; unless in each case such Excise Tax Revenues are first released from the lien of this Resolution in accordance with the supplemental resolution providing for the pledge thereof to a particular Series of Bonds. " SECTION 4. SEVERABILITY OF INVALID PROVISIONS, If any one or more of the covenants, agreements or provisions of this resolution should be held to be contrary to any express provision of law or to be contrary to the policy of express law, though not expressly prohibited, or to be against public policy, or should for any reason whatsoever be held invalid, then such covenants, agreements, or provisions shall be null and void and shall be deemed separate from the remaining covenants, agreements, or provisions of, and in no way affect the validity of, all the other provisions of this resolution or of the Bonds. SECTION 6, REPEALING CLAUSE. All resolution and resolutions of the City, or parts thereof, in conflict with the provisions of this resolution are to the extent of such conflict hereby superseded and repealed. SECTION 7. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA: SECTION 1. AUTHORITY OF RESOLUTION. SECTION 2, FINDINGS, It is hereby found, determined and declared by the City Council (the "Council") of the City of Edgewater, Florida (the "City"): A. The Council has previously determined pursuant to Resolution No, 94 -R -15, adopted August 15, 1994 (the "Initial Assessment Resolution "), based on the presentations to the Council by City staff and members of the public to provide for the acquisition and construction of certain paving improvements (the "Project ") within the area of the City known as Florida Shores Improvement Area Special Assessment District ( "Florida Shores Improvement Area"), and to assess a portion of the cost thereof against property specially benefitted thereby. B. There has been prepared and filed with the City Clerk (the "Clerk ") a preliminary assessment roll, which is incorporated herein by this reference (the "Preliminary Assessment Roll"). C. By notice to the owners of the benefitted properties within Florida Shores Improvement Area, the City has duly notified such owners of the unit of measurement according to which the assessments would be levied, of the number of units contained in the subject property, of the amount of the assessment to be levied against the subject property, and other information relating to the manner of payment of the assessments. D, By notice duly published and mailed, the City has provided notice of the public hearing to be held on this day with respect to said assessments. The Council, after notice duly given in accordance with Section 197.3632(4)(b), has held a public hearing on the matter of the Project and the assessments during which all interested persons were given the opportunity to present written objections and testimony. F. The Council, sitting as an equalizing board (the "Board") has equalized and adjusted the amounts set forth in the Preliminary Assessment Roll. SECTION 3. APPROVAL OF PROJECT AND ASSESSMENTS. The Council hereby determines and declares, based on the presentations to the Council by City staff and members of the public that: (a) the undertaking of the Project is in the best interest of the health and welfare of the citizens of the City; (b) the properties to be benefitted by the Project will receive benefits in an amount not Less than the amount of the assessments against the various properties; (c) it is in ihe best interests of the City to finance a portion of the cost of the Project through the levy of the assessments (d) the preliminary plans and specifications and cost estimates on file with the City with respect to the Project are hereby approved; and (e) the assessments shall be levied in the amounts shown on the Preliminary Assessment Roll. SECTION 4. ADOPTION AND APPROVAL OF PRELIMINARY ASSESSMENT ROLL, The Preliminary Assessment Roll, as adjusted and equalized at the public hearing heretofore held, is hereby adopted and approved, SECTION 5. ROLL CONFIRMED, The Preliminary Assessment Roll, as herein approved, is hereby confirmed and the assessments, as set forth therein, shall stand as a lien against the benefitted properties until satisfied. The Preliminary Assessment Roll shall be (a) filed with the Clerk and recorded in the Improvement Lien Book of the City and (b) certified to the tax collector as required by Section 197.3632(5), Florida Statutes. The Initial Assessment Resolution is hereby confirmed. SECTION 6. DETERMINATION OF INTEREST RATE ON ASSESSMENTS; PREPAYMENT OF ASSESSMENTS. The interest rate on the Assessments shall not exceed one percent in excess of the interest rate on the bonds issued to finance the Project with a final interest rate to be determined at or prior to the date of sale of such bonds. Interest on the Assessments shall accrue from the last date such Assessments may be prepaid until payment thereof. The Assessments may be prepaid on or prior to October 12, 1994. If prepaid, such Assessments shall be discounted to a rate of $736.19 per equivalent residential lot. If not prepaid on or prior to October 12, 1994, such Assessments shall be payable at the non - discounted rate of $815.85 per equivalent residential lot in fourteen equal annual installments, together with interest thereon at the rate described above. SECTION 7. SEVERABILITY. I was assessed $1648.88 with an annual payment of $178.72. I do not understand this assessment nor do I accept it due to the fact that I already live on a paved street (Willow Oak Dr.). It is my understanding that only North -South running streets are to be paved, and East -West running streets are to be left unpaved. If this is true then I am being assessed for work that will not be done. If I am incorrect in my assumption and the assessment is for the East -West portion of 36TH Street adjacent to my property, then I would object to the pav- ing at this time. I am a single, one income home owner who is struggling just to make ends meet. I just recently spent six months saving for the sewer system improvements ($700 for hook -up alone), and do not have the finances for this newest IMPROVENIfENT. I also strongly object to the fact that according to your letter, if I can't afford to pave my street, I lose my house. A quote from your letter which I'm sure you are familiar with: "Failure to pay any assessment when due may subject the property owner to loss of title to the property." This is my first home. I bought it at the age of twenty. I have owned my lot sine 1968 and have by this time paid a considerable amount of money in property taxes. As determined by the Volusia County Taxing Authorities, my lot currently has a property value of $1,136.00 (which is less than I paid for the lot originally). It seems to me that to be assessed over 72% of the property value for street improvements is entirely out of line. Further, in the last several years, I have tried to sell my lot and have been informed that because of its width, it is almost unsalable unless combined with one of the lots on either side. If I am forced to pay the $824.44 for the street improvement assessment, it will hardly be sensible to keep my lot as I will have paid the full amount of value in taxes and street improvements, to say nothing of the eventual cost for the sewage system. I feel this is an unnecessary expense for the tax payers of Edgewater at this time. After all, we have already accepted the burden of higher water rates for the sewer installation ( not to mention the costs incurred by each who had to pay for the installation itself to some plumbing company) now higher refuse rates, tax increases, etc. Isn't there a law as to how much of a tax burden we must endure from our elected officials? I'm sure our rates must have increased by close to two hundred percent since five years ago. Enough is enough. Don't try to make Edgewater a thriving booming metropolis on the backs of taxpayers who already have accepted your decisions so far. Put this program off until later. I have lived here for over thirty years. I have lived with dirt roads longer than most of the new residents that are recently transplanted here. We got along fine for this many years, let's not do everything all at once. Give us some time to pay off the debts already levied on us by this and the prior council. My comments are as follows: 1. I am totally in favor of the paving project in terms of its scope but not the cost allocated to the abutting property owners. 2. The perception received when Councilman Mitchum presented the paving proposal was that the paving program would be in two parts; Part A. storm water removal per state engineering requirements, and, Part B, paving the shell roads with about a fifteen year life surface for normal, low speed residential traffic. 3. I do suggest, as a means of some cost reduction, to pave 34th Street in lieu of the 35th /36th zig -zag. This would simplify engineering requirements and reduce costs. 4. I have also heard "rumors" that some people are wanting to establish priorities as to the streets to be paved first. This should be a contractor's option with the incentive to reduce costs, providing a cost share of the saving to him, i.e. he can better control the utilization of his equipment for maximum efficiency, productivity and again a reduction of cost to the abutting property owner and the city. 5. The street width is 20 feet, as measured on Traveler's Palm, a paved street. 6. In 1992 the city budget for scraping the shell roads was in the order of $480K which, naturally, was reduce to about $200K during the sewer line installation. Now that the sewers are in and roads returned to resemble their original condition the scraping costs would rise in excess of the $480K figure, accounting for annual inflation. Those funds of $480K would be utilized to reduce the cost of paving for the unassessable properties pending legal action, if appropriate. I feel that this letter must be written so that you are aware that we have concerns about this assessment. Several families as well as ours live paycheck to paycheck, but the City keeps taxing us more and more. We have already been charged over $3400 for the sewage system and now you want to charge us for paving the streets. My husband and I would love to live on a paved street, however, how do you expect us to be able to afford to keep living in our home when the City keeps charging these whopper assessments. There has to be some other way to go about paving these roads. Not all of the citizens of the Florida Shores Subdivision are rich and can afford all of these tax assessments. The Zakaluzny family moved to Edgewater in July of 1987 because of the nice, quiet area and a large factor that it was a lot cheaper to own a home. Now we are finding out that Edgewater is raising taxes too high just like the other high dollar cities which we did not want to live in. WE LIKE LIVING IN EDGEWATER BUT HOW DO YOU EXPECT US TO CONTINUE TO DO SO. Continued ... . I wish to oppose such assessments in the strongest possible terms. Initially, I note that certain other assessments were adopted for the installation of a sewer line. Those assessments will be a substantial burden to pay, especially for an owner of vacant land, who has no current use for the improvement. By the way, I have not received a separate bill as of today for that assessment. The proposed assessment for paving will be a great burden. I am unsure why the City Council chose to place the paving and sewer line assessments on top of each other, but I respectfully ask them to reconsider. It seems my annual payments to the City, including real property taxes, would be tripled. Who can afford it? Also, on a separate topic, I ask them to reconsider what may have been another recently enacted ordinance. As I understand it, cleared but unimproved land cannot have grass grow higher than one foot. Formerly it was two feet high. I try to keep my property clean and free of debris. On the other hand, some uncleared lots look like junk yards, with abandoned tires and other discards notoriously displayed. Yet I am unaware of violations issued against such properties. Where is the logic and justice in that situation? I trust that the City Council will act prudently and rescind the proposed assessment and correct the grass cutting law. My mother with lives at this Parcel. ID: 3480201003000, Lots 300 do 301 is legally blind,does not own a car, lives on $500.00 a month S. S. and can hardly make end meet to live herself. She has some pavement in front of her house that has been there for years. We have tried to sell her house for 3 years without luck because she can't keep it up.To get the money for another house smaller or apartment, she has to have a dollar amount out of this old house. Noboby can give her that, so she has no choice but the live there. The reason why I't writing is because she can't make another payment for something she has no USE for...and to said "FAILURE TO PAY ANY ASSESSMENT WHEN DUE MAY SUBJECT THE PROPERTY OWNER TO LOSS OF TITLE TO THE PROPERTY", IS stupid! WE DO NOT WANT THE STREET PAVED IN FRONT OF HER HOUSE, IT DOES NOT NEED IT. THE STREET IS ALREADY PAVED. My mother is 80 years old and has lived in this house LOT 300 301 for over 30 years. I feel like this is very UNFAIR to this old woman. We all agree that the roads in Edgewater need to be improved, but in my mothers case and other limited income people consideration needs to be made.
