status of the above - referenced litigation.
Pursuant to the attached letter, the City Manager and I recommend
that the Council authorize the continued representation of the City

Dear Mr. McMahon:
Please accept this letter as confirmation of our meeting on July 1, 1994, wherein
Attorney Ken McIntosh and I agreed to provide legal representation to the City
of Edgewater in the above - referenced lawsuit at an hourly rate of $125.00. We
will send all bills incurred in this lawsuit directly to the City for payment.
We will send the City monthly bills for attorneys fees. Additionally, we agreed
that Attorney Krista Storey would be the City staff member in charge of managing
the litigation and coordinating the defense of this lawsuit.
We will keep both Attorney Storey and you fully advised of the status of the
litigation. We are available to meet the City Commission if you so desire.
If the above - stated terms of employment meet with your approval, please sign the
acceptance and return same to us by facsimile.

KENNETH W. McINTOSH
Mr. McIntosh was born in Ridgewood, New Jersey, on February 1, 1931. He
received an A .B . degree from Stetson University in 1952 and a LL. B . from Stetson
University College of Law in 1954. He was admitted to the Florida Bar in 1957. He
served as Municipal Judge for the City of Sanford from 1961 to 1964 and Prosecuting
Attorney for Seminole County from 1965 to 1971. He has been the City Attorney for
Casselberry since 1961; Attorney for Seminole Community College since 1980; and
Attorney for South Seminole -North Orange Wastewater Transmission Authority since
its creation.
Mr. McIntosh is a member of the Seminole County Bar Association (President,
1965), The Florida Bar (Member, Family Law Section), The Association of Trial
Lawyers of America, The American Bar Association and Phi Alpha Delta Legal
Fraternity.
Mr. McIntosh is married and has four children. He resides in Seminole
County .
NED N. JULIAN, JR.
Mr. Julian was born in Long Beach, California, on March 28, 1942. He
received an A. B . degree from Stetson University in 1964 and a J. D. from Stetson
University College of Law in 1967. He is admitted to practice before the U. S .
District Court, Middle and Southern Districts of Florida (1968); U. S. Court of
Appeals, 11th Circuit (1976) ; and the U. S . Supreme Court. He served as Assistant
Public Defender for the Eighteenth Judicial Circuit from 1969 to 1971; Trustee of the
Fred R. Wilson Law Library from 1971 to 1977; City Attorney for Longwood from 1974
to 1979; Attorney for the Sanford Housing Authority from 1973 to 1988 and 1992 to
date; and City Attorney for Lake Mary from 1988 to 1994. He has been Attorney for
the School Board of Seminole County since 1979. He has also served as a Certified
Court Mediator since 1988.
Mr. Julian is a member of the Florida School Board Attorneys Association
(President, 1984- 1985) , the Seminole County Bar Association (President, 1974) , The
American Bar Association, The Florida Bar and Phi Alpha Delta Legal Fraternity.
Mr. Julian is married and has two children. Ile resides in Sanford.

WILLIAM L. COLBERT
Mr. Colbert was born in Fort Benning, Georgia, on November 1, 1943. He
received a B .S . degree from the University of Florida in 1967 and a J . D . from
Florida State University College of Law in 1969. He was admitted to practice before
the U. S . Supreme Court in 1973. He served as Staff Counsel for the Florida Public
Service Commission from 1970 to 1971; Municipal Judge for the City of Oviedo from
1971 to 1973; Prosecuting Attorney for the City of Altamonte Springs from 1971 to
1976; Chairman of the Seminole County Sheriff's Department Civil Service Board from
1972 to 1988; Chairman of the Grievance Committee for the Eighteenth Judicial Circuit
from 1977 to 1979. He has been City Attorney for Oviedo since 1979, City Attorney
for Sanford since 1981 and City Attorney for St. Cloud since 1992.
Mr. Colbert is a member of The Florida Municipal Attorneys Association
(President, 1991 -1992) , Eighteenth Circuit Judicial Nominating Commission
(Chairman, 1992 - 1994), The Seminole County Bar Association, The Florida Bar, The
American Bar Association and Phi Alpha Delta Legal Fraternity.
Mr. Colbert is married and has three children. He resides in Seminole

FRANKLIN C. WHIGHAM
Mr. Whigham was born in Opp, Alabama, on October 19, 1948. He received a
B.S. degree from Florida State University in 1971 and a J.D. (with honors) from the
Florida State University College of Law in 1974. He was admitted to practice before
the U. S. District Court for the Middle District of Florida in 1975 and the U. S.
Supreme Court in 1981. Ile has served on the 18th Judicial Circuit Grievance
Committee (1980 -1982) and the Seminole County Bar Association Law Week Committee.
He has represented the City of Altamonte Springs Health Facilities Authority in Bond
Issues since 1982 and the Seminole Community Mental Health Center, Inc. since 1981.
Mr. Whigham is a member of The Seminole County Bar Association, The Florida
Bar and The American Bar Association.
Mr. Whigham is married and has two children. He resides in Lake Mary.

CLAYTON D. SIMMONS
Mr. Simmons was born at Tyndall Air Force Base, Florida, on November 17,
1944. He received a B.S. degree from Florida State University in 1966, a M.A.
degree from Ball State University in 1971 and a J.D. from Nova University College
of Law in 1980. Ile served as a Captain in the United States Air Force from 1967 to
1973 and is currently a Lt. Colonel in the U.S. Air Force Reserves.
Mr. Simmons is a member of Eighteenth Judicial Circuit Grievance Committee
(Chairman, 1992), The Seminole County Bar Association (President, 1990), The
Florida Bar, The American Bar Association and Phi Alpha Delta Legal Fraternity.
Mr. Simmons is married and has four children. He resides in Lake Mary.
ROBERT K. McINTOSH
Mr. McIntosh was born in Augsburg, Germany, on October 3, 1955. He
received a B . A . degree (cum laude) from Stetson University in 1977 and a J. D . (with
honors) from University of Florida College of Law in 1983. He speaks Spanish
fluently.
Mr. McIntosh is a member of Central Florida Legal Services, Habitat for
Humanity, The Seminole County Bar Association, The Florida Bar, The American Bar
Association and Order of the Coif.
Mr. McIntosh is married and has two children. He resides in Seminole County.
DONNA L. SURRATT - McINTOSH
Ms. McIntosh was born in Madison, Wisconsin, on November 1, 1955. She
received a B.B.A. .B degree (cum laude) from Stetson University in 1977 and a J.D.
(with honors) from the University of Florida College of Law in 1983. She was an
instructor for Appellate Advocacy for the University of Florida College of Law from
1982 to 1983. She serves as City Attorney for the City of Lake Mary and Assistant
City Attorney for the cities of Casselberry, Oviedo, Sanford and St. Cloud. She
speaks Spanish fluently.
Ms . McIntosh is a member of The Florida Municipal Attorneys Association, The
Seminole County Bar Association (Director, 1992; Treasurer, 1993; Secretary,
1994), Central Florida Legal Services (Vice President, 1994), The Florida Bar and
The American Bar. Association.

honors) from the University of Florida College of Law in 1984. She is admitted to
practice in the U. S. District Court, Middle District of Florida and the U. S.
Bankruptcy Court for the Middle District of Florida. She served as a Judicial Clerk
for the 5th District Court of Appeal from 1984 to 1985.

MARTHA H. McINTOSH
Ms. McIntosh was born in Sanford, Florida, on May 29, 1965. She received a

DOUGLAS STENSTROM
Mr. Stenstrom was born in Sanford, Florida, on September 5, 1921. He
received an A . B . degree from the University of Florida in 1942 and a LL.B. (cum
laude) from the Stetson University College of Law in 1948. In 1978, he was awarded
a LL.D. from the Stetson University College of Law. He served as Seminole County
and Probate Judge from 1949 to 1954; the Florida State Senate from 1954 to 1960;
Attorney for the Seminole County School Board from 1954 to 1979; Chairman, Board
of Trustees, Stetson University from 1973 to 1977; Chairman, Florida State Board
Independent Colleges and Universities from 1971 to 1974.
