NO.: 2001-017 DATE: January 23, 2001 SUBJECT: Interlocal Water & Wastewater Agreement and Amendment # 1 Enclosed is a copy of the Interlocal Water and Sewer Agreement between the City of Edgewater and Vol usia County. The agreement was effective September 2, 1999 and superseded an existing Wholesale Water Service Agreement dated May 30,1996. Also enclosed is Amendment #1 to the Interlocal Water and Sewer Agreement dated December 20, 1999. The Agreement authorizes the sale of potable water to V.olusia County (250,000 gallons). The County agrees to pay $4.00 per gallon of water as a one-time capacity charge and $2.75 per 1,000 gallons as a service charge. The Agreement authorizes the sale of sewer capacity to the City of Edgewater (200,000 gallons). The City agrees to pay $4.50 per gallon of wastewater as a one-time capacity charge and $2.00 per 1,000 gallons as a service charge. Amendment #1 defines how the City will connect wastewater services to the County's new treatment plant. The Agreement further authorizes the "trade" of water and sewer capacity based on the cost per gallon (dollar value of water and sewer). This is important to eliminate or reduce the need to pay cash for capacity. The County has paid $300,000 to the City of Edgewater for the first 75,000 gallons of water capacity for Hacienda Del Rio and pays a monthly wholesale sewer service fee of approximately $20,000. INTERLOCAL W A TERand WASTEWATER AGREEMENT THIS INTERLOCAL AGREEMENT is made this ~ day of S"t~~"-^-- C) 1999, by and between the CITY OF EDOEW A TER, FLORIDA, a municipal corporation, hereinafter referred to as "Edgewater", and the VOLUSIA COUNTY, FLORIDA, a charter county, hereinafter referred to as "County". RECITALS WHEREAS, Edgewater, presently owns and operates a potable water supply, treatment and distribution system and a wastewater treatment, collection and disposal system within Southeast Volusia County, Florida, for the purpose of furnishing potable water and wastewater services to its customers; and WHEREAS, County presently owns and operates a water supply and distribution system o within Southeast Volusia County, Florida, for the purpose of furnishing potable water service to its customers; and WHEREAS, County presently is constructing a new .6 MOD regional wastewater treatment, collection and disposal system for the purpose of providing wastewater treatment service to its customers; and WHEREAS, Edgewater is authorized by Florida law to operate a potable water and wastewater system outside of Edgewater' s corporate limits; and WHEREAS, County is authorized by Florida law to operate a potable water and wastewater system within Volusia County; and o WHEREAS, the parties entered into an interlocal agreement dated October 3, 1994, which established utility service areas for each jurisdiction, which service areas are unchanged by the subject agreement, and -1- .- 0, o o ~;, '" ""'''WHEREAS,:' the parties previously entered into an agreement, dated May 30,1996, for the"""" purpose of providing potable water service south of Edgewater along US 1 by and between Edgewater and County in anticipation of a future long-term interconnection between the two water systems; and WHEREAS, the parties wish to supersede the May 30, 1996, agreement with this agreement; and WHEREAS, County has a need for additional potable water and Edgewater is willing to meet this need in accordance with the terms of this Agreement. WHEREAS, Edgewater has a need for long-term additional wastewater tre1atment and disposal and County is willing to meet this need in accordance with the terms of this Agreement. WHEREAS, Edgewater and County agree the most cost-effective method for water and wastewater service to Southeast Volusia County will be a regional approach of Edgewater providing wholesale water service to the County and the County providing wholesale wastewater service to Edgewater. NOW, THEREFORE, in consideration of the mutual promises herein contained, it is agreed as follows: 1. Incorporation of Recitals. The foregoing recitals are true and accurate and are incorporated herein by reference. 2. Defined Terms. Unless otherwise provided for in this Interlocal Agreement, Capitalized Words and terms shall have the following meanings: 2.1 "Anniversary Date" means each annual anniversary date of the first day of the Term. 2.2 "Cumulative Daily Average" means the cumulative daily average of water supplied or wastewater treated at any particular date during the Term of this agreement. Pursuant to paragraph 14, this figure is calculated at each Anniversary Date for the preceding 12 months: -2- u Q <.> 2.3 ' nmpact Fee" means ,the impact fee (capital charge) charged by Edgewater and/or the County as a condition precedent to connection to the Edgewater and/or County Water System or Wastewater System, as amended from time to time. 2.4 "MOD" means a unit of measurement equal to a million gallons per day. 2.5 "Notice Date" represents a potentially recurring date where either party would notify other party, pursuant to paragraphs 11 and 12 of this agreement, that their Cumulative Daily Average exceeded the Reserved Water or Wastewater Capacity or, if applicable, the Revised Reserved Water or Wastewater Capacity. 2.6 "Permit" shall mean any licenses, permits, zoning changes, zoning variance or other approvals from any government or government agency, whether federal, state, regional or local, necessary or convenient to the acquisition, construction, transfer, operation or expansion of the water distribution facilities or wastewater collection or transmission facilities, including but not limited to any general use permits, temporary use permits, individual use permits or transfer of permits issued by the St. Johns River Water Management District, the Department of Environmental Protection, the United States Army Corps of Engineers and all successor agencies. 2.7 "Potable Water" means water supplied by the Edgewater Water Works System which is intended to be fit for human consumption and which complies with the Department of Environmental Protection regulations, Section 62-555 as we1l as a1l state and local regulations pertaining to public drinking water systems. 2.8 "Prior Agreement" means the prevIOus agreement dated May 30, 1996, between Edgewater and County for the purpose of providing potable water to the unincorporated area south of Edgewater. 2.9 "Reserved Capacity" means water or wastewater capacity for which impact fees have been paid or compensated. -3-' ..:y ., ,r..:':.r;'l~~':-..-:.:,:"'.~-~- -.-- -""-""" 2.10 "Term" means that period which commences upon approval of the agreement u u O' by the Edgewater City Council and the Volusia County Council, and ends on the later of (i) the twentieth (20th) anniversary thereof, or (ii) if County exercises its option to extend pursuant to paragraph 18 of this agreement, then. the period shall continue in perpetuity, unless sooner terminated in accordance with the provisions of this agreement. 3. Representations of Ed2ewater. Edgewater makes the following representations to County: 3.1 Edgewater is duly organized and in good standing under the laws of the State of Florida, and is duly qualified and authorized to carry on the governmental functions and operations set forth in this agreement. 3.2 Edgewater has the power, authority and legal right to enter into and perform the obligations set forth in this agreement, and the execution, delivery and performance hereof by Edgewater: (1) has been duly authorized by the City Council of the City of Edgewater; (2) does not constitute a default under, or result in the creation of any line, charge, encumbrance, or security interest upon the assets of Edgewater, except as otherwise provided herein. 4. Representations of County. County makes the following representations to Edgewater: 4.1 County is duly organized and in good standing under the laws of the State of Florida, and is duly qualified and authorized to carryon the governmental functions and operations set forth in this agreement. 4.2 County has the power, authority and legal right to enter into and perform the. . obligations set forth in this agreement, and the execution, delivery and performance hereof by County: (1) has been duly authorized by the County Council of Volusia County; (2) does not constitute a default under, or result in the creation of any line, charge, encumbrance, or security interest upon the -4- u u o assets of County; except-as otherwise provided herein. 5. Statutory Authority. This agreement shall be considered an lnterlocal Agreement pursuant to Chapter 163.01, Florida Statutes. A true and correct copy of this agreement shall be filed with the Clerk of the Circuit Court in Volusia County. 6. Supply of Water. Edgewater agrees to supply and make available to County, upon commencement of the Term and payment to Edgewater of the required Impact Fee, 250,000 gallons (.25 MOD) of Reserved Water Capacity (Average Annual Demand) during the Term of this agreement. County agrees to obtain Reserved Water Capacity up to .25 MOD capacity at a rate of . four dollars ($4.00) per gallon. Edgewater and County agree the parties will exchange water capacity for wastewater capacity based on the per gallon charge. Notwithstanding the above, County agrees to purchase Reserved Capacity of no less than 75,000 gallons of water capacity within 6 months of the effective date of this agreement. Reserved Capacity of not less than 175,000 gallons will be provided to the County through an exchange of water for wastewater capacity. The parties recognize that the daily and monthly water consumption may vary. County shall be billed based on the actual consumption on a monthly basis. 7. Water Rates. The rate to be charged for the purchase of Potable Water supplied to County by Edgewater shall be two dollars and seventy-five cents ($2.75) per one thousand (1,000) gallons. Edgewater may adjust the rate to be charged. Notice of rate adjustment shall be provided by July 15 for enactment on the following October 1. The level of any rate adjustment shall not exceed 5% per year for any period since the prior adjustment. 8., . Treatmentc;of Wastewater. County agrees to supply and make available to Edgewater, upon commencement of the term and payment to County of the required impact fee, up to .20 MOD of wastewater capacity to Edgewater during the term of this agreement. The County will provide Edgewater with 6 months notice of the anticipated commencement date. The parties agree that the daily and monthly wastewater demand may vary. Edgewater shall be billed on a monthly basis based on actual consumption but not less than the amount of its Reserved Capacity. 9. Wastewater Rates. The rates to be charged for wastewater treatment and disposal supplied to Edgewater by County shall be two dollars ($2.00) per one thousand (1,000) gallons of wastewater. County may adjust the rates to be charged. Notice of rate adjustment shall be provided by July 15 for enactment on the following October 1. The level of any rate adjustment shall not exceed 5% on an annualized basis. 10. Audit of Water Consumption. On or after the occurrence of each Anniversary Date, Edgewater may audit County's consumption of water under this agreement by calculating the Cumulative Daily Average as of the most recent Anniversary Date. If the Cumulative Daily Average so computed exceeds the Reserved Water Capacity, then Edgewater shall provide County with notice to that effect. Edgewater may elect, at its discretion, one of the following options on or after the Notice Date: 10.1 Edgewater may provide no additional water capacity. 10.2 Edgewater may elect to increase the Reserved Water Capacity to ala minimum equal the Cumulative Daily Average so computed, and the increased amount shall become the Revised Reserved Water Capacity and County shall pay for Reserved Water Capacity at a rate of four dollars ($4.00) per gallon. -6- u u o ", II. '.". Audit of Wastewater Demand. On or after the occurrence of each anniversary date, County may audit Edgewater's wastewater demand under this agreement by calculating the Cumulative Daily Average as of the most recent Anniversary Date. If the Cumulative Daily Average so computed exceeds the Reserved Wastewater Capacity then County shall provide Edgewater with notice to that effect and County may elect, at its discretion, one of the following options on or after the Notice Date: 11.1 County may provide no additional wastewater capacity. 11.2 County may elect to increase the Reserved Wastewater Capacity to at a minimum equal the Cumulative Daily Average so computed, and the increased amount shall become the Revised Reserved Wastewater Capacity and Edgewater shall pay for additional reserved wastewater capacity at a rate of four dollars and fifty cents ($4.50) per gallon. 12. Ownership and Maintenance. Edgewater shall retain ownership and maintenance responsibilities for that portion of the water system north of the interconnection and for the master meter for water sold to the County. County shall retain ownership and maintenance responsibilities for that portion of the water system south of the interconnection and for the master meter for wastewater flows sent to the County. The wastewater master meter will be located adjacent to the Hacienda del Rio community. County shall retain ownership and general maintenance responsibility for the customer meters and associated piping, however, Edgewater and the County shall have mutual unlimited access to the master meters, all meter readings and test records. Edgewater specifically agrees to maintain the potable water meters in good working order and accuracy in accordance with applicable A WWA standards BO as to accurately measure any water transferred between the two systems. 13. Duration. The duration of this agreement for purposes of the sale and purchase of water service by County and the sale and purchase of wastewater service by Edgewater, shall be the -7- "~H'.".",~,. Notwithstanding any provision to the contrary, Edgewater or County upon written notice of not less than 36 months in advance may terminate this u Q Q agreement. 13.1 Termination of the agreement shall not effect ownership of Reserved Capacity. Reserved Capacity may be returned to the service provider based on agreement between the parties. 13.2 Termination of service provision shall not effect the receipt of service under the terms of this agreement. 14. Option to Extend Term. Edgewater and the County shall have the option to extend the Term of this agreement in perpetuity. In order to exercise this option, both parties must (i) agree and acknowledge in writing their intention to exercise that option no later than the seventeenth (17lh) Anniversary Date, (ii) pay the Impact Fee required by this agreement, and (iii) not be in default of any provision of this agreement. 15. Service Standards. Edgewater and County shall operate and maintain their respective water supply, water treatment and distribution systems and render efficient service in accordance with the regulations of this agreement and the Florida Department of Environmental Protection, or any other governmental agency having jurisdiction thereof. No Contest of Permit Application. Edgewater and/or County shall not contest, oppose, impede or interfere with any Permit application filed by Edgewater and/or County. 17. Indemnification. 17.1 Edgewater agrees that they will indemnify and hold harmless County to the extent permitted by law, from any and all liability, claims, damages, expenses, proceedings and causes -8- .v u o of action ofanykirrcb.nd/or nature, including reasonable attorney's fees, arising out of or caused by the negligence or intentional misconduct of Edgewater, including its employees and agents, in connection with the management, control, use, operation, maintenance or repair of Edgewater's Water and Wastewater System, provided, however, nothing herein shall be construed as a waiver of sovereign immunity or other limitations imposed by Florida Statutes Section 768.28. 17.2 County agrees that it will indemnify and hold harmless Edgewater to the extent permitted by law, from any and all liability, claims, damages, expenses, proceedings and causes of action of any kind and/or nature, including reasonable attorney's fees, arising out of or caused by the . negligence or intentional misconduct of County, including its employees and agents, in connection with the management, control, use, operation, maintenance or repair of County's Water and Wastewater System, provided, however, nothing herein shall be construed as a waiver of sovereign immunity or other limitations imposed by Florida Statutes Section 768.28. 18. Notices. All notices requited pursuant to this agreement shall be in writing, and shall be delivered to the parties by United States Mail, postage prepaid, as follows" Lawrence W. Severabilitv. If any section, subsection, sentence, clause, phase or portion of this agreement is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision of such holding, and such holding shall not affect the validity of the remaining portions hereof. -9- '-' u o 20. Attorney's Fees. In the event of any litigation arising out of this agreement, the prevailing party shall be entitled to an award of its reasonable attorney's fees and court costs incurred in such action. 21. Entirety. This agreement represents the entire understanding of the parties hereto. Any amendments shall be in writing and signed by both parties. 22. Applicable Law. The laws of the State of Florida shall govern the validity, interpretation, construction and performance of this agreement. Venue for any suit involving this agreement shall be in Volusia County, Florida. 23. Waiver. Unless otherwise specifically provided by the terms to this agreement, no delay or failure to exercise a right resulting from any breach of this agreement shall impair such right or shall be construed to be a waiver thereof, but such right may be exercised from time to time and as often as may be deemed expedient. Any waiver shall be in writing and signed by the party granting such waiver. If any representation, warranty or covenant contained in this agreement is breached by any party and thereunder waived by the other party, such waiver shall be limited to the particular breach so waived and shall not be deemed to waiver, wither expressly or impliedly, any other breach of this agreement. 24. Reservation of Capacity. This agreement shall not be construed to give rise to nor shall there be reservation of water capacity or wastewater capacity over and above the Reserved water and/or wastewater capacity for which all Impact Fees due and payable under this agreement have been fully paid or for any period existing beyond the Term of this agreement. 25. Termination of A2reement. In the event this agreement is terminated pursuant to any provision of this agreement, or at the end of the Term, both parties shall take all steps that are reasonably necessary to insure no further use of the other party's water service and/or wastewater service is made. -10- u .'-.) o 26. Effective Date. This agreement shall be effective upon approval by the governing bodies of Edgewater and the County and shall supersede the agreement for wholesale water services dated May 30, 1996. RECITALS WHEREAS, Edgewater and County agree all recitals of the Interlocal Water and Wastewater Agreement (September 2, 1999) are true, accurate and incorporated herein by reference; and WHEREAS, Edgewater and County agree the most cost-effective method for installing wastewater upgrades and improvements to transmit raw wastewater from Edgewater's collection system to o County's treatment system is through a change order with current County wastewater contractor, AKA Services, Inc. WHEREAS, County and Edgewater staff members have reviewed the proposed construction change order and concur that the proposed construction unit cost is fair and consistent with the existing construction contract by and between AKA Services, Inc., and County, and WHEREAS, County and Edgewater staff have reviewed proposed change order from Marshall Provost and Associates for design, permitting and construction phase services for the proposed wastewater interconnect and agree the professional services fees are reasonable. WHEREAS, this Amendment is consistent with Section 8 of the Interlocal Water and Wastewater o Agreement requiring Edgewater to direct 140,000 gallons per day of wastewater to the new County wastewater facility within six (6) months of completion of the County's new wastewater facility. - I - '" .,;.- J WHEREAS, alI water, wastewater rates and capital changes are consistent with the existing InterIocal Water and Wastewater Agreement. The update of the Land Development Code (LDC) r~sulted in major revisions of the Code. Prior to the July 2000 update, no major LDC changes had been adopted since November 7, 1994 (Ord. No. 94-0-26). The July 2000 update included a new formatting of the Code, an Article solely for new and expanded definitions, a clear matrix depicting the correlation between land use, zoning and permitted uses. Other improvements included improved and updated site design criteria consistent with the Water Management District and most of V olusia County's criteria. This was important to develop a . consistent design criteria for permitting through several jurisdictional agencies. The update included increased environmental (wetlands, flood plains, sensitive habitat areas) protection that is also consistent with the Water Management District and County. The July 2000 update included enhanced subdivision requirements, expanded historic preservation requirements and added a new Article to provide fire hazard prevention. Also new is an Article concerning airport development, since the Massey Airport was recently annexed. Also included was an Article related to concurrency requirements for new growth. At the time of adoption of the updated July 2000 LDC, the Articles not updated included: 1) inoperable, abandoned and/or wrecked vehicles, 2) vehicle restoration permits, 3) watercraft, trailers, recreational vehicles and campers, 4) tents/temporary carports, and 5) parking, storage of boats, recreational vehicles on residential lots. Attached is the work product of the Citizens Review Committee concerning their input related to the issues not addressed in the LDC update. Staff Recommendation: It is staff's intention to provide a detailed update of two or three Articles of the LDC at any time to allow Council more time for thorough review and comments. The updates should begin in March 2001 and be completed by May 2001. A. A vehicle shall be determined or defined as inoperable, abandoned and/or wrecked by Code Enforcement officials should any of the following be applicable: ] . The vehicle creates a threat to public health, safety or welfare due to its condition or the conditions in, under or around subject vehicle. 2. The vehicle causes violations of Federal, State or local environmental regulations by leaking non-contained hazardous fluids, such as oil, fuel, gear grease, hydraulic fluid, ethylene-glycol, or anti-freeze coolant additives and any other regulated chemicals which pose a threat to public health, safety or welfare by entering the groundwater supply, or significantly running off the vehicle onto surrounding area, creating dangerouslhazardous conditions for passing motorists or persons. 3. The vehicle is associated with discarded items accumulating tn, on, or around" its U immediate area, causing vehicle to meet criteria for "nuisance". 4. A vehicle that is stored with open hood, doors, hatches and compartments exposed to the general public or neighboring properties for any period exceeding twenty-four (24) hours. 5. A vehicle visible to the general public or neighboring properties which Code Enforcement Officials cannot establish ownership or the responsible party declines to resolve valid issues contained within this section shall be determined to be abandoned. B. Vehicles deemed to be inoperable, abandoned and/or wrecked shall not be stored in any zoning district except as provided for in Section 21-34.05. o '-> Q o .) December 12. 2000 21-34.05 Vehicle Restoration & Permits - For Residential Properties A. Any person seeking to openly restore a vehicle on property designated for residential use shall obtain a vehicle restoration permit issued by the Code Enforcement officials. The vehicle restoration permit shall be posted conspicuously at the residence during the period of restoration. B. The application for a vehicle restoration permit shall include the following: 1. Current photograph of the vehicle; 2. Description of restoration planes) including a schedule; 3. Vehicle identification number. C. A vehicle restoration permit authorizes the following: 1. Restoration may be performed in an open area. When stored the vehicle shall be stored in an area not visible to the public or neighboring properties. (per minutes of 11/30/00) 2. A Vehicle being restored shall be stored in an area hidden from view by opaque fencing, screening, custom car cover, or stored inside a garage. D. The term of the permit shall be one (1) year. Additional renewals will be available provided that restoration progress is consistent with the vehicle restoration application. E. Vehicles being restored shall be owned by the occupant of the property. F. Donor vehicles stored on property to supply parts for the permitted restoration vehicle shall comply with all of the above. u Q o .1 December 12. 2()()() 21-34.06 Watercraft, \\'atercraft Trailers, Motor Homes, Recreational Vehicle Trailers, Trailers, And Campers. The purpose of this Section is to establish criteria for the parking and storage of watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers, and campers on property designated for residential use. A. Watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers, and campers stored on property designated for residential use shall have a current and valid license tag, except any boat or trailer out of view of the general public or neighboring properties shall not be required to have a valid license tag. B. Watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers, and campers stored on property designated for residential use shall be maintained in an operable condition. Repairs shall not exceed three (3) months. c. Watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers, and campers may be parked or stored in a driveway, immediately parallel to the driveway, alongside the house or in the backyard subject to the following condition: 1. No watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers and campers or any part thereof may rest on or occupy airspace past the property line. D. Boat motors of watercraft parked or stored on property designated for residential use shall not be operated before 7 a.m. or after 10 p.m. E. Watercraft trailers, motor homes, recreational vehicle trailers, trailers and campers stored on property designated for residential use shall not be used as a dwelling, nor shall waste materials be permitted to discharge. F. Watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers, and campers parked or stored on a property designated for residential use shall meet reasonable standards of appearance and maintenance as follows: 1. The ground beneath the watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers, and campers shall be kept free of debris, including weeds and grass in excess of twelve inches (12"). 2. Watercraft trailers, motor homes, recreational vehicle trailers, trailers and campers tires shall be inflated, to tire specifications. 3. The watercraft, watercraft trailer, motor home, recreational vehicle trailer, trailer and camper shall be kept clean and not be allowed to become a nuisance that can be detected beyond the owner's property line. u u o ) December 12, 2000 4. Only routine repairs and maintenance may be performed on watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers, and campers stored in front yards. G. The owner of the watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers and campers must reside on the premises where the item is parked or stored. Additional property owned by the resident adjacent to the residence is considered to be a part of the premises for this purpose. The vehicles shall not be used for residential purposes, except during an emergency or natural disaster. H. Visitors may reside in their motor homes on property designated for residential use for a maximum of a two (2) week period with a permit. Waste material shall not be permitted to discharge. 1. A limit of one vehicle (watercraft, watercraft trailer, motor home, recreational vehicle trailer, trailer or camper) per 4,000 sq. ft. of lot area shall be allowed to be parked in the front setback and/or side yard. Additional vehicles may be parked in those areas for no longer than 2 weeks. u Q o 6 December 12, 2()()() 21-35.04 - Canopies I Temporary Car Ports and Tent I Gazebos A. Owners of canopies I temporary car ports and tents I gazebos shall be required to secure the above objects so as to prevent them from becoming airborne or from leaving the property where installed, as well as keep them in a good state of repair. B. The below specifications are intended to be minimum only and are no indication or guarantees of fitness for securing the temporary items covered under this section. Quantities and sizing will vary by the size of the item being secured. 1. All tie downs must be secured to solid, immoveable objects such as: mobile home anchors, concrete driveways, buildings, etc., or as per manufacturer's installation instructions or engineer's specifications. 2. All tie down leads must be a minimum of 3/16" galvanized or stainless steel cable or a minimum of 3/8" true nylon rope, (not polyethylene, polypropylene, or polyester) or sized as per manufacturer's installation instructions or engineer's specifications. 3. It is forbidden to use concrete blocks or weights of any kind as a method of tie down because attaching weights or other moveable objects to: canopies, temporary carports and tents I gazebos can cause those weights to be catapulted by wind lift. C. Canopies I temporary car ports shall be located in the driveway, immediately parallel to the driveway, in the side yard or back yard, but at no time shall they extend over the property line or into the public right-of-way. There shall be a limit of one such canopy I temporary structure in the front setback I front yard area and shall be as far from the front property line /street as the yard size or driveway permits. This location must not cause a safety problem. No enclosing or side tarps will be allowed in the front setback I front yard area. D. Tarps/tops of temporary structures shall be removed during hurricane warning conditions. E. Use of such canopies within the front setback/front yard, shall be limited to cover automobiles, watercraft, watercraft trailers, motor homes, recreational vehicle trailers, trailers, campers, and including other motorized vehicles. Introduction As a result of population growth and increasing non-residential development within the City of Edgewater, the ability of the City's Fire-Rescue Department to maintain its current level of service has been adversely impacted. The current level of service of the Fire-Rescue Department is a Fire/EMS response time of four-minutes or less to 90% of all incident calls within the city limits. The Fire-Rescue Department has developed a capital plan to adequately meet future demands for the continued similar level of service. The capital plan will require the implementation of new Fire/EMS Impact Fees and will be charged on all new development (residential and non-residential) to pay for the capital facility cost they impose on the City. The impact fees collected must be spent to provide a reasonable and rational benefit to the fee-paying development. The funds collected by the imposition of impact fees must be connected to the proposed capital improvements by the Florida Courts definition of "dual rational nexus of benefit" theory. The benefit that would be expected from, stich impact fees would assure adequate and consistent levels of service from the City ofEdgewater's Fire-Rescue Department. Population Growth In 1990, the City of Edge water's permanent population was 15,337 people. In 2000, the permanent population was 18,865, an increase in population of 23% since 1990. Over the 10 year period spanning from 1990 to 2000, the City of Edgewater has experienced an average growth in population of approximately 2.3% per year. The growth trend was estimated at 2.3% for the previous 10 years (1990-2000), current socioeconomic studies predict the growth trend to increase to approximately 3.23% for the next 10 years. The predicted increase in the growth trend is consistent with anticipated economic growth within the County. Other growth factors include a substantial amount of vacant land annexed into the City and anticipation of additional annexations to the south and west by the City of Edgewater. If the predicted growth trend continues, by 2005 the permanent population of the City of Edgewater will be 22,865, by 2010, the permanent population of the City of Edgewater will be 26,398, and by 2015, the permanent population of the City of Edgewater will be 30,262. Permanent population projections for the City of Edgewater are summarized in Table 1. Legal Framework Impact fees are "one time" charges that are assessed on new development (residential and non- residential) to fund the capital facility costs they impose on the community. Unlike other types of developer exactions, impact fees are based on a standard formula and a pre-determined fee schedule. Impact fees require that each new residential or commercial project pay its pro-rata share of the cost of new capital facilities and capital expenditures required to serve that development. Impact fees must only be used for capital expenditures and must be spent within six years of collection. Impact fees cannot be used to pay for non-capital items and recurring expenses such as personnel salaries and operating/maintenance expenses. Fire/EMS Service Unit The unit cost of Fire/EMS services to serve new development is based upon the average cost per FirefEMS call for service and the expected number of calls per unit per year for various types of land use. FirefEMS calls for service include medical emergencies, fires, hazardous conditions and false alarms. As noted above, the unit cost of FirefEMS service to serve different types of new development is based upon the expected number of calls for service per unit per year. Dividing the number of annual FirefEMS calls received from each types of land use category by the existing amount of development yields the service units required per development unit (dwelling unit, hotel room or 1,000 square feet of nonresidential building area). The annual number of calls for service per unit for land use categories ranging from single-family dwellings to industrial square footage (in thousands) is presented in Table 2. Other Factors o Other factors that must be considered when estimating the need to expand Fire/EMS services are: 1) the size of geographic area to be covered; and 2) response time. The current adopted level of service for a response time for Fire/EMS incident is four minutes. When the Fire/EMS service area to be covered and the number of incidents and calls increase such that the standard four-minute response time cannot be met, capital improvements must be made to provide for growth and service area expansion. In order to maintain the acceptable level of service of a four-minute response time, expansion ofFire/EMS services must be planned. City of Edgewater \ Fire-EMS Impact Fee ~ ~4 <.> o o \ . Conclusion During the past year, the City of Edgewater has annexed over 500 acres into the city. Some of this newly annexed area will be used for industrial development and some will be used for planned residential community growth. In the current fiscal year, approximately 1000 acres are planned to be annexed south of the City. The land use for this area is for planned residential community growth. Other annexations are anticipated and further development of existing lots in Edgewater (Florida Shores) is also anticipated. The lot-clearing ordinance for fire protection is causing many lots to be sold to builders for future residential dwelling units. The expansion and widening of S.R. 442 is also anticipated to cause additional growth in the western portion of the City. The need for expansion of FirelEMS services in the next several years due to an increase in area to be covered, population growth, and an increase in the number of FirelEMS incidents/calls is anticipated. Planning to finance and offset the cost of new services (partially for existing residents) needed to maintain the level of service that currently exists within the community is recommended through the implementation ofFirelEMS impact fees for new construction. Impact Fees Sec. 1 Applicability. This article shall apply to the incorporated portions of the city. Sec. 2 Intent and purpose. This article is intended to implement and be consistent with the city's comprehensive plan. The purpose of this article is to ensure that new development bears a proportionate share of the cost of capital expenditures necessary to provide necessary public safety services in the city as contemplated by the comprehensive plan. I. Sec. 3 Rules of construction The provisions of this article shall be liberally construed so as to effectively carry out its purpose in the interest of public health, safety, and welfare. For purpose of administration and enforcement of this article, unless otherwise stated in this article, the following rules of construction shall apply to the text of this article: 1) If there is any difference of meaning or implication between the text of this article and any caption, summary table, or illustrative table, the text shall control. The term "shall" is always mandatory and not discretionary; the term "may" is permissive. ~Words used in the present tense snall-iiiCluaelnefUture, and words~in the \singular..;;.number"sfiall:::include'~lhe plural, and the-=plliiil-the~singurar: Unless \t~e context clearly indicate!,.the contrary. ,.-. __ __.J 'Fhe-pfiYase"used for" includes "arrangea-for~"'''designed for," "maintained for," or "occupied for." The term "Person" includes an individual, a corporation, a partnership, an incorporated association, or any other similar entity. The term "includes" shall not limit a term to the specific example, but is intended to extend its meaning to all other instances or circumstances of like kind or character. ? . u o o Sec. 4 Imposition of fees. a) Any person who seeks to develop land by applying for the issuance of a building permit for one of the land use types specified in section 5 shall be required to pay a fire protection and Emergency Medical Services (EMS) impact fee in the manner and amount set forth in this article. b) No building permit for any land use types specified in section 5 shall be issued by the city unless and until the impact fees required have been paid. The amount of the impact fees shall be set forth in the schedule. c) When change of use, redevelopment, or modification of an existing use requires the issuance of a building permit, the impact fees shall be based upon the net increase in the impact fee for the new use as compared to the previous use. Sec. 5 Fees. Call Unit $1,435.27 $287.05 $1,435.27 $124.87 $1,435.27 $1,435.27 $209.55 $1,435.27 $143.53 $1,435.27 $10.05 Sec. 6 In-kind contributions; refusal of adjustment; covenants. a) Independent calculations for credits for in-kind contributions made after the effective date of the ordinance from which this article derives shall be submitted to and approved by the city manager prior to effecting the contribution. b) The city manager's action in adjusting or refusing to adjust the impact fee pursuant to an independent calculation shall be in writing and must be transmitted by certified mail to the fee payer. 2 u c) The city manager shall require that a covenant running with the land be executed and recorded on the subject property where: The independent calculation is based on a use of land having a lesser impact then that upon which the schedule is based, as applicable; the property could be put to a use having a greater impact then that proposed with such use not requiring future approval by the city; or for such other reasons necessary to ensure compliance with this article. The covenant shall hold the fee simple interest in the land, and mortgagee, as appropriate. The covenant shall recite this article and the facts and reasons underlying its execution. It shall set forth the restrictions on the property and the terms and conditions under which it may be released. II. Sec. 7 Review a) Under this article, the schedule of each impact fee shall be reviewed at least once each biennium to update cost, credits and generation rates. Where the review warrants change to impact fees, this article shall be amended. b) The review shall include an analysis of the level of service for each impact fee. If the average level of service is not consistent with the level of service upon which the respective impact fee amount is based, the amount shall be adjusted based upon the then-existing level of service. o Sec. 8 Trust fund. The Fire/EMS impact fee shall be deposited in a Fire/EMS impact fee trust fund. The trust fund shall be invested by the city in interest-bearing sources and all income derived shall accrue to the trust fund. The funds shall be used only for capital improvement costs for which the impact fee was levied and which would add capacity needed to serve new development. The city manager shall identify in the city's annual budget those new capital improvements for which the Fire/EMS impact fees will be spent. The funds shall remain restricted to the Fire/EMS trust fund and the requirements of this article, and the city manager shall ensure that the funds are expended and accounted for in accordance with the provisions of this article. The city manager shall maintain such records and documentation necessary to allow the effective audit of the use of the Fire/EMS impact fees. Sec. 9 Collection; administrative fees. o a) The fee payer shall pay the Fire/EMS impact fee to the Fire/EMS impact fee trust fund prior to the issuance of a building permit which may be required for development listed in the schedule in section 5. No building permit may be issued for any development listed in section 5 until such fees have been paid or until the city has accepted title to land area meeting the standards set out in this section. For land uses not requiring a building permit, an alternative development order shall not be granted until the impact fees have been paid. 3 u b) In lieu of all or part of the impact fees, the city council may accept the offer by a fee payer to dedicate land and/or construct all or part of a Fire/EMS project. Such construction must be in accordance with state, county and city design standards, whichever may be applicable. The fee payer shall submit a project description in sufficient detail to allow the preparation of an engineering and construction cost estimate. c) If the city council accepts such an offer, the city manager shall credit the cost of this construction against the Fire/EMS impact fee otherwise due. The portion of the fee represented by the facilities construction shall be deemed paid when the construction is completed and accepted by the city or when the fee payer posts security as provided in subsection (d) of this section for the costs of such construction. The portion of the fee represented by land dedication shall be deemed paid when the title to the land dedicated for that purpose has been accepted by the city. d) Security in the form of a performance bond or escrow agreement shall be posted with the city council, made payable to the city in the amount approved by the city manager equal to 110 percent of the full cost of such construction. If the construction project will not be constructed within one year of the acceptance of the offer by the city council, the amount of the security shall be increased by ten percent compounded, for each year of the life of the security. The security shall be reviewed and approved by the city manager's office prior to acceptance of the security by city council. o e) No impact fee is required for the issuance of any building permit for residential use which does not result in an additional living unit. f) All funds collected pursuant to this article shall be promptly transferred for deposits into the Fire/EMS trust fund. Impact fee collections shall be used exclusively for land acquisition, capital improvements or expansion related to the public purpose for which such fees were collected, with the exception of impact fee administrative costs pursuant to paragraph (g) below. Funds shall be expended in the order in which they are collected. g) The city shall be entitled to retain up to four percent (4%) of the impact fees it collects as an administrative fee to offset the costs of administering this article. o h) If impact fee funds which were paid by check, draft, or other negotiable instruments, do not clear, the building permit or development order authorizing the development for which the impact fee was paid shall be suspended, and the city shall send by certified mail notice to the fee payer. If the impact fee, together with any charges for the funds not clearing, are not paid within ten business days following mailing of the notice, the building permit or development order shall be of no further force and effect for purposes of this article and a stop work order shall be issued and not lifted until such time as the impact fee is paid and the funds clear. Sec. 10 Refund. 4 o a) If a building permit expires and no construction has been commenced, the fee payer shall be entitled to a refund of the impact fee paid as a condition for its issuance, less the four percent (4%) of the fee retained as an administrative fee by the city. The fee payer shall be entitled to a refund equal to ninety-six (96%) of the impact fee paid. No interest will be paid to the fee payer on refunds due to noncommencement. Refunds resulting from the city's miscalculation of impact fees shall not be charged the administrative fees on the amount refunded. b) No refund shall be given for a change In land use or structure after occupancy has occurred. c) Any funds not expended or encumbered by the end of the calendar quarter immediately following six years from the date the impact fee was paid shall, upon application of the fee payer within 180 days of that date, be returned to the fee payer with interest at the rate of six percent per annum. Sec. 11 Exemptions and credits. a) The following shall be exempted from payment of impact fees: 1) Alteration or expansion of an existing building or use of land where no additional living units are created, where the use is not changed, and where no additional demand for Fire/EMS protection services will be produced over and above that produced by the existing use. o 2) The construction of accessory buildings or structures which will not produce additional living units over and above those in the principal building or use of the land. 3) The replacement of a building, mobile home, or structure that was in place on the effective date of the ordinance from which this article derives or the replacement of a building, mobile home or structure that was constructed subsequent thereto and for which the correct impact fee had been paid or other wise provide for, with a new building, mobile home, or structure of the same use, provided that no additional impact will be produced over and above that produced by the original use of the land. 4) The construction of publicly owned governmental buildings or facilities. 5) A use of structure or land which has been abandoned for a period of more than five years shall not be considered existing for purposes of exemptions or credits. Any previous payment of impact fees under this article shall be credited against the appropriate impact fees owed as a result of the change. The burden of demonstrating the existence of a use or structure or previous payment of impact fees shall be based upon the fee payer. When a use is existing, any additional fees shall be based upon the alteration to the existing use or structure. o 5 u u o b) Credit. 1) All improvements to and/or land dedication for Fire/EMS protection required under city development approval shall be credited against impact fee up to the total of the impact fee due. A fee payer, who proposes credit for construction, shall present cost estimates prepared by qualified professionals to be used in determining the amount of the credit. A fee payer who proposes credit for land dedication, shall present property appraisals prepared by qualified professionals and a certified copy of the most recent assessment of the property for tax purposes to be used in determining the amount to of the credit. However, the city retains the right to determine the amount to be credited by preparing engineering and construction cost estimates and/or property appraisals for those improvements and/or land dedication. a. b. Fee payers claiming credits for construction and/or land dedication shall submit documentation sufficient to permit the city manager to determine whether such credits are due and, if so, the amount of such credit. 2) Where alteration, expansion or replacement of a building or unit, or a change in land use existing on MM/DDNY, or presently existing which involves an increase in the number of units or square footage or a change in use resulting in a new impact on Fire/EMS capital facilities for which the impact fee is assessed, credit shall be given for the number of existing units or square feet based upon the previous land use and the impact fee shall only be assessed on the increased impact. 3) For an addition to an existing residential building in which additional living units are created, the fee payer shall provide to the city manager a certification of an architect setting forth the square footage of the existing building. For an addition to an existing residential building, the fee payer, at his sole option, may pay the impact fee for the addition as it alone was a new building rather than provide the certification of an architect setting forth the square footage of the existing building. c) Exemptions or credits must be claimed by the fee payer at the time of the application for a building permit. Any exemptions or credits not so claimed shall be deemed waived by the fee payer. 6 u o u Sec. 12 Appeals. Any decision made by the city manager or his designee in the course of administering this article, may be appealed in accordance with those procedures set forth in this Code for appeals of administrative decisions. Sec. 13 Lien; withholding of permits for nonpayment. a) If through error, omission, or intent the impact fee imposed under this article is not paid in full, the amount unpaid, together with statutory interest accruing from 30 days following date written notice by certified mail return receipt requested is sent to the then-present owner, shall be a lien against the property on which the specific development for which the impact fee is due. Notice of the lien shall be recorded in the official records of the clerk of the circuit court in and for the county. The lien shall have priority over all liens, mortgages, and encumbrances, except taxes. If the notice of lien is not recorded within three years following the date the building permit is issued for the development for which the impact fee is owed, the lien shall be of no force and effect, although the impact fee is owed, although the impact fee debt shall remain. If the lien remains unpaid for more then 30 days following the recording of the notice, it may be foreclosed in the manner provided by state law for the foreclosure of mortgages on real property. b) If the impact fee remains unpaid, no further building permits of any type shall be issued on the property for which the impact fee remains unpaid. Building permits, including certificates of occupancy and/or occupancy permits, may be issued only upon full payment of any previously 'owed impact fee, together with any interest owing, and current impact fee, if any. Sec. 15 Violations; relief. It shall be unlawful to violate this article, and any violation shall be punishable according to law; however, in addition to or in lieu of any criminal prosecution, the city or any fee payer shall have the power to sue for relief in civil court to enforce the provisions of this article. JOHN'S RIVER WATER MANAGEMENT DISTRICT MANDATES The SJRWMD has recently implemented new rules requiring lawn irrigation to follow a schedule based on odd/even residential addresses. Even addresses are authorized to irrig~te Thursday and Sunday; odd addresses are authorized to irrigate Wednesday and Saturday. The City of Edgewater has code requirements consistent with the SJRWMD concerning irrigation and has further adopted similar code requirements restricting the use of reclaimed water. City staff has researched the use of fines to assist in the enforcement of the irrigation/reclaimed water restrictions. V olusia County is attempting to develop an enforcement fine policy and procedure that is acceptable to the Volusia Circuit Court but has encountered numerous obstacles. The City of Altamonte Springs (Seminole County) has implemented an easier enforceable fine system that appears to be consistent with the intentions of V olusia County. The adopted enforcement fines include one warning to the resident followed by fines that start at $50 and escalate to $500 for repeat violations. Violating residents are notified and the fines are placed on the monthly water bills. Altamonte Springs authorizes the issuance of notice of violations by code enforcement officials, police officers and utility meter readers. The enforcement fines are levied against the water account holders. The collected fines are incorporated into the Enterprise Fund. Staff believes a Policy decision is required by the City Council concerning the use of enforcement fines to achieve compliance with the City's and Districts water restriction mandates. Staff Recommendation: City Council direct staff to develop an ordinance for the purpose of implementing enforcement fines for violators of irrigation restrictions of the District and City. The program should include one warning and increasing fine amounts for repeat violators.
