I hereby call a Special Meeting of the City Council to meet jointly with the Mayor and
City Commissioners of Oak Hill on Monday, March 31, 1997, at 7:00 p.m. in the cafeteria
(Manatee Hall) of the Indian River Elementary School, 650 South Roberts Road,
Edgewater. The purpose of the meeting is to consider Vol usia County's proposed utility
system for Southeast Vol usia County.

RESOLUTION NO. 97 -R -06
A JOINT RESOLUTION OF THE CITIES OF EDGEWATER
AND OAK HILL, FLORIDA, OPPOSING VOLUSIA
COUNTY'S PLANNING AND INTENT TO CONSTRUCT A
WASTEWATER TREATMENT PLANT IN SOUTHEAST
VOLUSIA COUNTY TO PROVIDE SEWER UTILITIES TO
RESIDENTS OF THIS AREA; REPEALING ALL
RESOLUTIONS IN CONFLICT HEREWITH AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Edgewater has previously constructed and
is operating a wastewater treatment facility to serve the City of
Edgewater population; and
WHEREAS, the Edgewater wastewater treatment plant is currently
operating at 45% to 60% of its design capacity; and
WHEREAS, the Edgewater wastewater treatment plant uses
advanced technology to provide the highest level of advanced
treatment possible to meet and exceed all Federal, State, and local
requirements; and
WHEREAS, the Edgewater wastewater plant has continuously
operated without failure since being constructed in 1992 to meet
all regulatory agency requirements and permit conditions; and
WHEREAS, the Edgewater wastewater plant has both the capacity
and ability to serve the current and future population in Southeast
Volusia County, up to and including anticipated growth equal to or
greater than the current size of the City of Edgewater at a more
economical cost than the construction of an additional Volusia
County wastewater plant; and
WHEREAS, the City of Edgewater has tested and applied for a
rerating of the wastewater treatment plant to 2.7 MGD from 2.4 MGD;
and
WHEREAS, the State of Florida Department of Environmental
Protection has made a preliminary study of Edgewater's plant,
engineering design and rerating criteria, and it is expected
Edgewater will subsequently obtain the rerating it requested; and

WHEREAS, the Cities of Edgewater and Oak Hill do hereby
declare and resolve jointly the following:
1. To oppose the permitting, construction, and
operation of any new wastewater plant by Volusia
County to serve Southeast Volusia County.
2. To work together to create an interlocal government
agreement to provide a cost effective solution to
wastewater problems using existing City plants to
their fullest capacity to provide services.
3. To oppose the funding and construction of
additional Volusia County utility plants, either
from governmental or private funding sources.
4. To request a full accounting of all monies expended
in the past on planning, preparing or in
anticipation of constructing utility plants in
Southeast Volusia County, including but not limited
to the sources of these funds and the specific
utilization of these funds.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Edgewater, Florida, and the City Commission of Oak Hill,
Florida:
Section 1. That this resolution effectively describes the
intent of the local elected officials to oppose Volusia County's
utility plants and to work together as cities to meet our
requirements and commitments.
Section 2. All resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed.
Section 3. This resolution shall take effect upon adoption.
