CALL TO ORDER
Mayor Schmidt called the Regular Meeting to order at 7:00 p.m. in
the Community Center.

INVOCATION. PLEDGE OF ALLEGIANCE TO THE FLAG
There was a silent invocation and pledge of allegiance to the
Flag.
APPROVAL OF MINUTES
A. Regular Meetinq of June 19. 2000
Councilwoman Rhodes made a motion to approve the June 19, 2000
minutes, second by Councilwoman Lichter. The motion CARRIED 5-0.
PRESENTATIONS/PROCLAMATIONS/PLAOUES/CERTIFICATES/DONATIONS
A. Paula Raqer. secretary for Chemical People for Druq Free
Youth. requestinq support of their proiect to seek fundinq for
additional counseling in area schools.
Paula Rager, 1910 Umbrella Tree Drive, Secretary, People for Drug
Free Youth, asked Council for their verbal support in backing
their project of seeking grant funding for additional counseling
in area elementary schools. She asked for a letter expressing
Council's support.
Councilwoman Lichter made a motion indicating their complete
support, not only for the grant but for the energy, desires and
commitment to this and their utmost support of this project,
second by Councilwoman Rhodes. The motion CARRIED 5-0.
CITIZEN COMMENTS
Ferd Heeb, 115 N. Riverside Drive, spoke about the fireworks
display on the July 4th and what a great job santori & Sons and
the Fire Department did. He asked the Council how they would
like a neighbor to orchestrate a rock concert in their
neighborhood or in front of their house inviting 50,000 people
and make no provision for parking, restroom facilities or crowd
control.
Mr. Heeb stated twenty years ago, when this event started, this
City had a volunteer Fire Department and this was an annual event
to bring this community together to celebrate our independence
and to join the community together with a cookout and fireworks.
He feels it is time to reconsider this due to the size of the
crowd that shows up. He feels it should be taken out of a
residential area. He feels this creates a hardship for the
people on Riverside Drive. He encouraged Council to take a look
at this event.

Councilwoman Rhodes asked if there was discussion regarding when
the gym is done with the bandshell that the fireworks could be
done out there. city Manager Hooper stated not that he knows of.
The Volunteer Fire Department and Chief Barlow had talked to him
the latter part of last week and they will address the Council in
a work session over some of the things that can be done for
better parking and facilities. They recognized this as a year
where there were approximately 50,000 people there.
Dominic capria, 606 Topside Circle, asked about the Budget
Workshop tomorrow night. He is concerned that they have been
talking for months about the $25,000 homestead for senior
citizens. He would think this Council would vote one way or
another before the budget presentations. He asked if that is
considered in the workshop budget. city Manager Hooper informed
him yes.
Rosemary Campbell, 119 S. Park Place, spoke in opposition to bed
and breakfast establishments in Edgewater on Riverside Drive.
Yvonne Bice, 210 N. Riverside Drive, read a prepared statement
she wrote opposing bed and breakfast establishments and child
care facilities on Riverside Drive in Edgewater or in any
residential area. She would like to keep the character of the
area as it now exists, purely residential.
Ms. Bice asked if there is some way to get more of the citizens
involved in something that is so important, as the Land
Development Code. This affects the whole City but when she spoke
to people, very few knew about it.
Councilwoman Lichter stated it was in the News Journal as well as
the City newsletter that everybody gets.
Ms. Bice spoke about going to the Library to look at the proposed
Land Development Code and they didn't even know where it was.
Councilman Vincenzi agreed that the notices in the paper just
don't get the message across.
Councilman Brown feels they need to describe the Land Development
Code a little bit more that these are the rules and regulations
people are going to be living under.
Councilwoman Lichter feels the City newsletter is the best way to
get information out. They started this process three years ago,
this didn't come out of the blue.
Mayor Schmidt feels it comes down to people do have somewhat of a
responsibility to themselves.
Ms. Bice again expressed she would like to see more people become
involved.
Councilman Brown stated one good thing is the glitch committee.
If things do come up that aren't right, they can change it within
six months.
Councilwoman Lichter spoke about there always being change.
Mike Visconti, 316 pine Breeze Drive, spoke about celebrating the
4th of July once a year. He congratulated Council for the $5,000
well spent for the fireworks. He spoke about how beautiful
Riverside Drive is but this only comes around once a year.
Mayor Schmidt was upset with the trash that was left behind.

Dave Ross, 2803 Needle Palm Drive, spoke about the advertising of
the Land Development Code. A land use hearing doesn't mean
anything to about 90% of the people. He suggested they spend a
little more money on the advertisements when ads are run that
tell what the agenda is. He spoke about flyers he and his wife
handed out and most of the people had no idea what was happening.
Mr. Ross further spoke about bed and breakfast establishments on
Riverside Drive. He has heard no one stand in front of Council
and say here is why they must consider having bed and breakfast
establishments on Riverside Drive.
Councilwoman Lichter explained how bed and breakfast
establishments were brought up originally. This pertains to the
whole City, not just Riverside Drive.
Mr. Ross hopes our zoning doesn't become a factor of economic
need.
Ferd Heeb, 115 N. Riverside Drive, spoke against bed and
breakfast establishments in residential areas. He feels this is
a mistake. He feels there is nobody that can make an economic
venture out of a bed and breakfast, except on Riverside Drive.
Mr. Heeb presented statistics of homes on Riverside Drive. He
feels a bed and breakfast is a commercial enterprise and should
be in a commercial area.
Councilwoman Rhodes asked why bed and breakfast establishments
are advantageous to us. City Manager Hooper explained it is an
economic decision. It is an area of prime real estate. He spoke
of the process someone would follow if they want a bed and
breakfast establishments.
Mr. Heeb spoke of there being an extreme difference between the
wording of this code, making it a conditional use. He spoke
about having to jump through hoops if they leave bed and
breakfast establishments in residential areas.
There were no further citizen comments.
CITY COUNCIL REPORTS
Councilwoman Lichter asked if the formula for the City to receive
money from the gas tax is written in stone. She feels it hurts
cities that need money the most. She spoke about the factors
involved. New Smyrna Beach gets double the money Edgewater does
from the gas tax. She asked if they could bring it up to the
County Council to revisit the formula.
City Manager Hooper explained the formula is set by State
Statute. He spoke about the agreement when the first local
option gas tax was put in place. In 2001, the tax agreement
expires and there is a Committee among the City Managers to
change that. He is on that committee and they are working to do
that.
Councilwoman Lichter spoke about a meeting she attended with the
Chamber where they established a date for the Clean Sweep Adopt a
Street in Edgewater. That will be October 28th. She further
spoke about what is going to be involved.
Councilwoman Rhodes spoke about the many phone calls she has
received over the last couple of weeks from the other side of the
fence from those that want to allow R.V. 's and boats. One
mentioned Codes should be enforced and one mentioned this city
looks seedy and needs to be cleaned up. They were in favor of
the Land Development Codes as they are written.

Councilwoman Rhodes informed Mr. Capria that in her book on the
very first page she wrote not to forget the senior homestead
exemption. Mr. Capria stated the only reason he mentioned it is
because he thought they should vote on it before the budget.
Mayor Schmidt had nothing at this time.
Councilman Vincenzi spoke about the Land Development Code Review
Committee meeting he attended. He is confident they will come up
with something reasonable over the next few months.
Councilman Brown publicly thanked everyone involved with the 4th
of July celebration. He feels the fireworks were well received
by everybody.
Councilman Brown also attended the Land Development Code Review
Committee meeting and he has a lot of the faith in the people
there. He feels they will come up with a good plan and some good
rules.
Councilman Brown went to the New Smyrna Beach parade. They
didn't receive an invitation until almost the day of the parade.
Most Council could not attend. It was very good and he was very
impressed with it.
Councilman Brown asked people to contact City Clerk Wadsworth or
himself regarding the railroad tracks. He spoke about the trains
running differently and pulling heavier loads. There is a
tremendous amount of vibration going through the ground that is
causing damage to homes. He would like to have any input from
anyone that lives near the tracks that has had any damage they
can attribute to vibration from the train. He had four people
ask about it.
Councilwoman Lichter asked what the status is of Amtrak. City
Manager Hooper stated there hasn't been any further decisions.
They are still talking and negotiating but they haven't planned
a method in which they are going to use those tracks.
Councilwoman Lichter feels they have to be leery of that
situation.
Councilman Brown spoke about granite rock being hauled on the
trains within the past year or year and a half.
PUBLIC HEARINGS. ORDINANCES AND RESOLUTIONS
A. 2nd Readinq. Ord. No. 2000-0-12. staff recommendinq approval
of the new Land Development Code and Official Zoninq Map.
sections concerninq the storaqe of boats and recreational
vehicles. restoration of vehicles and the prohibition of
temporary carports have been deleted and will be reviewed bv an
appointed citizen Ad-Hoc Committee (tabled from June 5. 2000)
City Manager Hooper presented the background information
regarding Ord. No. 2000-0-12. He further commented on the changes
made and input he has received since the last public meeting.
City Attorney Cookson read Ord. No. 2000-0-12.
Councilwoman Lichter doesn't know how Section 21-35.06 -
Neglected premises can be enforced because of the terms being
vague. She feels this needs to be made more definite.
City Manager Hooper explained throughout the code, there are
other things, such as the height of the grass. When it comes
down to aesthetics and neglected looks, you get into those vague
areas and that is one of the difficulties in enforcing it.
Ms. Plaskett explained that premises section actually has to do
with the building itself. There are other portions of the code
that deal with those other issues.

Councilwoman Lichter referred to Article X, Section 21-120.02 (k)
& (f), Page X-3 regarding this not being enough time. Ms.
Plaskett further commented on the notification process.
Councilwoman Lichter asked if it will work. City Manager Hooper
explained it is new. Councilwoman Rhodes stated it could be
changed if it doesn't. City Manager Hooper stated this is part
of the glitch stuff.
Ms. Plaskett informed Council the Attorney for the Code
Enforcement Board has reviewed these sections. She hasn't heard
from Mr. Nowell regarding any problems with this particular
language.
Councilwoman Rhodes asked Ms. Bice for the number in the code she
is in opposition to. Ms. Bice informed her section 21-34.12,
Page III-20.
Councilman vincenzi is not in favor of bed and breakfast
establishments. He doesn't see a need for bed and breakfast
establishments right now.
Councilwoman Rhodes stated taking the code out isn't going to get
rid of bed and breakfast. Councilman Vincenzi feels it would
tell people they aren't in favor of it. Councilwoman Rhodes
stated this code just defines the restrictions. Ms. Bice doesn't
want to see it in the zoning or in the Code book.
City Manager Hooper stated she is also referring to page III-7,
the matrix. Councilwoman Rhodes stated if there is no bed and
breakfast establishments allowed then the restrictions become a
moot point.
City Attorney Cookson explained it would just be removing the one
(c) in R-1. As he understands it, bed and breakfast would be
allowed in these other zoning districts so they would need to
leave in the language on the bed and breakfast. If it is to be
stricken, it would be from residential.
Councilman Vincenzi feels bed and breakfast establishments don't
add much to the community, economically or aesthetically.
Councilman Brown stated he has spoken to a lot of people on
Riverside that say they don't want one next to them but they
don't think it should be totally taken out if there are parts of
Riverside Drive that would allow it. Councilwoman Rhodes has a
problem with people on each side saying they care or don't care.
She feels the judgement should not be up to the people that live
on either side of you. That does not make for good neighbors.
Councilwoman Lichter stated if you take it out, a case can still
come up and on its merits be decided or not. City Manager Hooper
explained it would be a Comp Plan amendment at that point.
Councilwoman Lichter spoke about having day care centers for
children and adults in residential areas as well as churches.
She feels maybe the time hasn't come for bed and breakfast
establishments but some time it may come.
Mayor Schmidt stated so if they were to take it out of R-1 it
doesn't eliminate the possibility, it just makes a few more hoops
to jump through. City Manager Hooper stated it makes it so that
it is no longer a zoning issue, it's a land use issue.
Mayor Schmidt asked for citizen comments.

Ferd Heeb, 115 N. Riverside Drive, stated over the last few
years, for one reason or another, he has talked to almost
everybody that owns property on Riverside Drive. The people who
own property on Riverside Drive have two major concerns, traffic
and commercialization. He further spoke about commercialization
along Riverside Drive. Eight percent of the ad valorem taxes in
this city are paid by the properties on Riverside Drive. He went
on to speak in opposition of bed and breakfast establishments on
Riverside Drive.
Mr. Heeb suggested having Edgewater Landing host the celebration
next year on the islands across from it and invite everybody to
come there to watch the fireworks.
Mr. Heeb stated Riverside Drive is where they live and it is the
kind of residential area they would like to keep. It is a
pleasure living on the river and if he has to put up with
fireworks and crowds once a year, then so be it. He doesn't like
it and feels something different could be done. He thinks it is
going to get worse. He doesn't think you can have a fireworks
display in a community that is growing to the point where within
the next ten years, you will have probably 100,000 people coming.
Ms. Plaskett suggested there are other areas zoned R-1 beside
Riverside Drive. She spoke of other areas that have been annexed
into the City that they may by the pure nature of that property
have to rezone it to R-1. She suggested to Council that based on
the comments and the surveys of Councilmembers and the people
here, that they not take the C out of R-1 but to have a caveat to
allow them everywhere other than Riverside Drive. She feels that
will take care of the problem.
Councilwoman Rhodes spoke about this City Hall not be able to
exist for much longer. She feels this building would be perfect
for a bed and breakfast. Ms. Plaskett stated this is a
pUblic/semi-public use this is not an R-1 classification.
Councilwoman Rhodes suggested adding more restrictions. Ms.
Plaskett stated they could do that to.
Ms. Plaskett explained the Land Development Code was put together
by a professional planning consultant. This Code was developed
taking numerous other cities and counties and bed and breakfast
establishments are an accepted use allover this country. She
spoke about the bed and breakfast establishments in New Smyrna
Beach. She urged Council to look at all sides of the issue.
Rosemary Campbell, 119 Park Place, couldn't understand why they
combined bed and breakfast establishments with nurseries and
churches. She expressed concern with strangers coming from out
of town being in a residential area.
Councilwoman Rhodes feels there has to be a compromise. In order
to expand economic development, you have to allow some
commercial. Ms. Campbell stated our economic growth is growing
and property value is going up, without bed and breakfast
establishments.
Mayor Schmidt called a ten-minute recess.
city Manager Hooper spoke of an issue of deciding one street
can't have something that everybody else in that zoning district
is entitled to. That creates a problem. If they were to have a
different district for R-1, that is a possibility. He feels the
easiest thing to do is take it out of R-1. Things are coming
back to Council. If there is an issue or if somebody wants to
come in, they are going to go through the process. Council could
face it at that time.

Councilwoman Rhodes moved to take the (c) out of R-1, second by
Councilman Vincenzi. The motion CARRIED 5-0.
Ms. Bice thanked the Council for considering what the residents
of Riverside Drive felt was so important.
Paul Jenkins, willow Oak Drive, feels all of the adjoining
properties around a bed and breakfast should have input on it.
He spoke about weddings at bed and breakfast establishments and
the traffic they can generate. He feels this needs to be looked
at. Mayor Schmidt asked if that is any different than him having
a wedding at his house and having it catered in and having forty
cars. Mr. Jenkins feels again it comes back to private verses
commercial. You have a little more rights as a private residence
than a commercial business does.
There was further discussion regarding the amount of people in a
bed and breakfast establishment at one time. Councilwoman Rhodes
asked if the fire codes and occupancy codes determine how many
people would be allowed. City Manager Hooper further elaborated.
Mr. Jenkins had a problem with the wording in section 21-34.01(g)
- Home Occupations with regard to deliveries. He presented an
argument about item (h) with regard to equipment that can be
used. City Manager Hooper explained with someone that has a
complaint, problem, or nuisance, this gives tools to deal with
it.
Mr. Jenkins spoke about section 21-36.03 (b), Page III-24. He
spoke about businesses on Hibiscus and Guava that have things
stored in the front of their businesses.
Ms. Plaskett stated she spent two hours with Mr. Jenkins the
other day and they went over everyone of the issues he is
bringing up. She thought he understood the intent of this.
Mr. Jenkins stated they didn't go over this section.
Councilwoman Lichter stated she doesn't think anybody's intent in
this City is to put anybody out of business. In fact, they are
trying to encourage business. On the other hand, we have some
real eyesores. If this is the language it takes in the
commercial areas to fix them, clean them up and not hurt them,
then they have got to have a vehicle.
Mr. Jenkins stated he doesn't see anything in the Code that
solves the issue of boom boxes. Mayor Schmidt stated there are
noise ordinances to solve that. Mr. Jenkins spoke about the old
noise ordinance.
Mike visconti, 316 pine Breeze Drive, asked for the definition of
commercial. He doesn't see where commercial comes in for a bed
and breakfast establishment. He can't compare a motel/hotel with
a bed and breakfast. He doesn't feel they are the same at all.
Dave Ross, 2803 Needle Palm Drive, spoke about having problems
that need to be fixed. There is trash that needs to be cleaned
up and they need to beautify the city. He referred to section
21-34.04, Page III-15. Councilwoman Lichter asked him if the.
Committee would be discussing this issue. City Manager Hooper
stated yes.
Mr. Ross stated trailers are not included in the definitions. If
the Committee says abandoned trailers should not be allowed on a
property, he asked Council what does the Committee mean.
Mr. Ross stated vehicles cover watercraft, however it says
motorized. He suggested they define watercraft. Councilwoman
Rhodes read the definition. Mr. Ross wants to make sure it is
covered under abandoned vehicles.

Councilwoman Lichter stated if there is terminology missing or
words missing, when the Committee comes back with a report, there
is no reason in the world part of that report can't suggest that
those words be added or clarified.
Mr. Ross thinks any vehicle enclosed in a garage should be
allowed. City Manager Hooper spoke about the laws covering what
the City has access to. Mr. Ross suggested anything that is not
allowed outside, if a man can put it in his bedroom or his
garage, he thinks it ought to say in the Code that he can have
it.
Mayor Schmidt closed the public comment section.
Councilman Vincenzi made a motion to approve Ord. 2000-0-12,
second by Councilwoman Lichter who added eliminating the sections
that are under consideration. The motion CARRIED 5-0.
B. Res. No. 2000-R-12. Property owner Glen Herbert. 503 N.
Riverside Drive. requestinq a variance from the shoreline buffer
and from impervious surface requirements.
city Manager Hooper made a staff presentation. Staff supports
the recommendation to grant the variance.
Councilwoman Rhodes asked why they have rules if they don't
enforce them. She has a problem with making the rules and
ignoring them in certain instances.
city Manager Hooper spoke about when he and Lynne originally
toured the site, their first recommendation would have been no.
The gentleman went in and made some modifications that made his
pool and setbacks identical to the guys on both sides.
Ms. Plaskett explained when Volusia County implemented their
minimum environmental standards, they set them for all
municipalities.
Councilwoman Rhodes expressed concern with runoff into the Indian
River and the 50 foot setback rule was put in place for a reason.
Councilwoman Lichter feels it behooves them to have a checking
system, that the homeowner pays for, to check and see if things
are working the way they are supposed to. She feels they need to
have a plan.
City Manager Hooper spoke about inspections getting expensive and
difficult and the City catching the flack. Councilwoman Rhodes
feels they have to start somewhere.
Mr. Herbert was not available for comment.
City Attorney Cookson read Res. 2000-R-12.
Councilman Brown made a motion that they approve this according
to the new information they have received, second by Councilwoman
Lichter. The motion CARRIED 5-0.
CONSENT AGENDA
A. Construction Requlation Board Appointments (3) - Councilman
Vincenzi. Councilwoman Rhodes. and Councilwoman Lichter.
respectivelY. to consider appointinq Scott Waldroff to fill the
remaining term of Robert Howard. who resiqned: and reappointinq
Charles Cobb and Andrew Hunt for another 3-year term. both
requested reappointment.
B. Professional Grant Writer/Consultant Contract - Approval of
proposed Professional Services Aqreement

Councilwoman Lichter removed Item B. She stated she doesn't know
anything about this professional service group. She asked what
other cities does that outfit cover. Perhaps those cities might
be in competition with us for grants. city Manager Hooper
explained they cover only Volusia County. He will not have nay
others in Volusia County.
City Manager Hooper informed Council of the process they have
followed up to this point and what the Grant writer will do.
Councilwoman Lichter spoke about the timing. City Manager Hooper
stated he is working on a due date of August as the time to
submit whatever the City tells him.
Councilwoman Lichter further spoke about him only representing
Edgewater in Volusia County.
City Manager Hooper agreed to include a phrase that he will
notice the city and they get the right to approve or deny his
employment with any competing city. Councilwoman Lichter would
like to do that. city Manager Hooper agreed to.
Mayor Schmidt asked if they can vote for approval with the
stipulation he accepts that. City Manager Hooper stated if he
doesn't accept that, he'll be back. He has identified to Mr.
Hooper that that is an acceptable condition.
Councilwoman Lichter made a motion to accept the Consent Agenda,
including B with the stipulation stated. The motion CARRIED 5-0.
OTHER BUSINESS
There was no other business to be discussed.
OFFICER REPORTS
city Clerk Wadsworth had nothing at this time.
City Attorney Cookson had nothing at this time.
City Manager Hooper informed Council he handed out the summary of
the meeting that occurred with the Land Development Code Review
Committee.
1) Discuss existinq aqreement for placement of convenience
benches.
City Manager Hooper made a presentation regarding the benches
along u.S. #1 and other places. He spoke about the City
generally not being happy with the aesthetics of these benches
due to the advertisements on them and people moving them around.
He asked for direction from Council. We get $2,100 a year for
these benches. He suggested they look at replacing them with
some clean, aesthetically pleasing benches.
Mayor Schmidt spoke about how nice the benches are in South
Daytona that have garbage cans attached. He asked for staff to
look into this. City Manager Hooper stated if that is what
Council wants to do. This agreement is coming up for renewal and
he recommended they don't renew with the advertising and get into
making it their standard to look at bus stops.
Councilman Vincenzi asked what would happen to the current
City Manager Hooper stated we do not own the current ones.

Councilman Brown spoke about the fiberglass benches in Kennedy
Park. City Manager Hooper agreed to price some of this and bring
the data back to Council. Councilwoman Lichter and Councilwoman
Rhodes like the idea of the trash can attached. city Manager
Hooper informed Council there is grant money for such things.
Mr. Jenkins asked since they have approved advertising on the
street signs, is there going to be a problem when they deny this
person the bus bench advertising. City Manager Hooper explained
it is not denying as much as he has a contract with us and we
just don't renew that contract. Mr. Jenkins asked if they are
going to set a policy that says they aren't going to allow any
more advertising.
Mayor Schmidt and Councilwoman Rhodes feel the street signs are
great at night.
Mr. visconti stated he has brought it up before about the
benches. He further spoke about the benches in Port Orange. He
feels Council is on the right track.
City Manager Hooper informed Council this will come back before
them. It was the consensus of Council to look into this further.
2) Discuss amendinq a portion of Chapter 10 (Health and
Sanitation) Article V (Weeds, Grass and Brush: Standards for
Propertv Maintenance)
City Manager Hooper presented background information regarding
cutting out a 20 foot band around the perimeter of a lot. They
have sent out the first set of notices to about 1/5 of Florida
Shores. It has caused a lot of hard times and grief. It is
difficult to find people to come out and cut the area and the
city to pay them. There were two individuals that when they were
noticed wanted to debate the legality of the ordinance. There
are a few minor things they want to fix up with the ordinance.
What they will do if Council directs them to is bring this
ordinance back and some of the things that have been streamlined
with it. Volusia County has made a book that was put out after
the wildfires and it is an assessment. This is what they used in
Florida Shores. Our ordinance doesn't reflect this method. To
give it more teeth and strength, they want to identify the book
that has been adopted by the County and tighten up some of their
time lines. They have had a great deal of success.
City Manager Hooper went to the Board of Realtors to speak to
them. Their biggest concern was this was probably going to turn
over lots, lots that we have in Florida Shores that are vacant
and are from out of state. He responded by saying good, they
would like those lots sold to someone in the state that is going
to build a house there. They have had a difficult time of out of
state owners contacting someone local to hire a contractor to
fix. A few of the realtors are volunteering to do property
management for a fee. He has no problem doing that, that puts it
in somebody else's hands. He is going to readvertise and bring
this back identifying the handbook.
Councilwoman Lichter asked about virgin lots and not being able
to make the property owners do something. City Manager Hooper
explained that was the old code. This ordinance says if you have
a lot that has never been cleared you are still obligated if you
are adjacent to an occupied lot to go in and clear it.
City Manager Hooper informed Council of the Budget Workshop
tomorrow night. He is going to recommend they do a basic roll
over budget, meaning they continue what they have with the
allocations and everything they have right now. He pointed out
the capital projects. He is going to request they hold the
budget hearings and hear what the departments are looking to do.
It is just six months away instead of six weeks away that they
will make the final decision.

Mayor Schmidt asked if they still had to do the millage rate.
city Manager Hooper informed him yes. It is just basically last
year's budget is a roll-over. The departments will be
appropriated the same amount as they had last year.
Councilwoman Rhodes asked City Manager Hooper if he was
suggesting the millage rate stay the same. City Manager Hooper
informed him yes. Councilwoman Rhodes stated she might have a
little problem there. city Manager Hooper commented on
exceptions to that where they can't wait six months. He would
like to be financially cautious due to all of the capital
projects going on right now.
city Manager Hooper stated Turgot Avenue is going to be closed
tomorrow through Friday for the paving of the entrance of the
gymnasium.
CITIZEN COMMENTS/CORRESPONDENCE
Dave Ross, 2803 Needle Palm Drive, informed City Manager Hooper
that section 21-34.04 - Page 1II-15 is not part of the ad hoc
review. He feels this is probably the single most important item
in the new code.
Councilwoman Rhodes stated the one they just voted on is crossed
off and says it is under review by the Ad Hoc Committee. Mr.
Ross stated what is up for review is section 21-34.05, 21-34.06
and 21.35-04.
City Manager Hooper stated the advertisement was advertised to
include Section 21-34.04.
ADJOURNMENT
There being no further business to discuss, Mayor Schmidt
adjourned the meeting. The meeting adjourned at 9:45 p.m.
