CALL TO ORDER
Mayor Schmidt called the Regular Meeting to order at 7:00 p.m. in
the Community Center.

INVOCATION. PLEDGE OF ALLEGIANCE
There was a silent invocation and pledge of allegiance to the
Flag.
APPROVAL OF MINUTES
Reqular Meetinq of Februarv 7. 2000
Mayor Schmidt stated on Page 6, third paragraph, that it was vice
Mayor Vincenzi and himself who attended the meeting, not Dennis
Fischer.
Councilman Brown moved to approve the February 7, 2000 minutes
with correction, second by Councilman Vincenzi. The motion
CARRIED 5-0.
PRESENTATIONS I PROCLAMATIONS IPLAOUES/CERTIFICATES
A. Presentation. Joint Historic Preservation Grant for
archaeoloqical surveys and requestinq $5.000 for a matchinq
grant. Councilman Jim Ward
County Councilman Jim Ward made a presentation on behalf of the
Friends of Spruce Creek. He spoke about the global importance of
the Turnbull Bay Colony. He asked for Council's support on this.
He feels we need to get this done for the good of our community
in Southeast Volusia. He informed Council Dottie Brown and
Barbara Harrah were also present to answer any questions.
Mayor Schmidt asked whereabout the digs would be done in
Edgewater. Dot Moore, New Smyrna Beach, explained the highest
probability for sites are along the river shore. She asked
Council to be aware that the archaeological resources here
associated with the Turnbull Colony are just as important as any
of them in New Smyrna.
Councilwoman Lichter stated this first phase for us, which is
actually the second phase, is more exploratory here in Edgewater.
Ms. Moore stated they are seeking presence or absence in the
testing to identify areas and document those and then enable us
to go back to those areas to do further testing in the future if
they can.

Mayor Schmidt asked how they decide where the shovel is going to
hit the ground. Ms. Moore explained it is a judgement call.
Councilwoman Lichter stated no one is having their property dug
into unless they agree to it correct. Ms. Moore stated
absolutely not. She commented on how it was done in New Smyrna.
Councilwoman Lichter stated Mike Tanksley, Chairman,
Recreation/Cultural Services Board, has brought this issue to the
Board and they have unanimously opt to support this type of
project.
Mayor Schmidt asked about the money for this. City Manager
Hooper stated the money would really come out of beautification.
There was $10,000 set aside for this year for projects
unspecified. Staff supports the approval of this request.
Councilwoman Rhodes asked if there was anywhere else they could
get the funds. City Manager Hooper explained there is an
unspecified Reserve Account and ultimately that is where it will
come from. He isn't telling them that if they have a
beautification project in the future that is identified that it
won't get done. There is a place in the budget, it's got a line
item and they can take it immediately from that.
Councilwoman Lichter stated Planning Director Lynne Plaskett has
informed her that in our Comprehensive Plan, historic sites and
archaeological sites are mentioned as one of the goals. Due to
Ms. Plaskett being sick and not being present, she stated Ms.
Plaskett feels this will be a very worthwhile project to further
that planning goal. She further spoke about ecotourism.
Councilman Brown asked how they dispense the information they
collect from this and if they get a report. Ms. Moore asked
Bruce Piatek, Ormond Beach, to comment, which he did at this
time. He further commented on the grant and the stringent
requirements of the State. He believes their commitment to the
expenditure for the matching funds, the grant would go to the
legislature at the next session and it likely would be something
you could program into your budget for your next fiscal year.
Councilman Vincenzi stated he is not in favor of supporting this.
He is all for culture and history but he feels there are too many
other priorities they need to watch out for. As far as the needs
of the City, we voted down a senior tax exemption because of
money considerations. Councilwoman Rhodes and Councilwoman
Lichter stated they voted to postpone it because there wasn't
enough information.
Councilwoman Lichter spoke about the money coming from
beautification. That Committee is now Recreation/Cultural
Services and feels in the future budget that is the title that
should be there and then it gets used for cultural services which
translates into beautification, history and culture.
Mayor Schmidt commented on phone calls he received from two
ladies. They feel $5,000 is a decent amount of money that can be
spent on other things.
Councilwoman Rhodes asked if anyone received any in favor of
this. She didn't. Councilman Brown stated he has gotten quite a
bit of positive feedback in his store from customers that are
interested in the history of our area. He also received the same
phone calls everyone else received. He asked if they have a
program where they go into the local schools and talk about what
they found in our area to promote this more to get more people
interested. He would like to see something like that before he
would vote yes. If they could show him that they are going to do
something like that, he would be more inclined to give the money.

Mr. Piatek stated he doesn't know that he can specifically speak
to making a commitment related to the grant. He is here in
support of the grant but he is not writing it. It is a
partnership between the County and a number of city entities.
One of the things that was part of the initial grant project is
to have a number of days for the public to come out and get
involved and visit sites. He feels there are opportunities for
that but he can't personally commit to the Council that that is
part of the grant.
Councilwoman Rhodes asked Councilman Ward if most of the land is
publicly owned. Councilman Ward stated a lot of it is publicly
owned. Councilwoman Rhodes asked about the land from the river
two blocks west. Mr. Ward stated that is where the sites are
usually found. Councilwoman Rhodes asked if that would apply in
this case as well. Mr. Ward stated yes it would. Councilwoman
Rhodes stated most of the land in Edgewater between the river and
two blocks is privately owned. What are the odds you are going
to have any kind of a tourism benefit through people's lawns?
Councilman Ward stated we all have to be responsible to the
people who elect us but sometimes benefits of what we do are
outside of our community. If Council needs more information,
they would appreciate a continuance instead of voting it down.
Councilwoman Rhodes feels they need to be able to show where it
is a benefit to the City.
Councilwoman Lichter stated she remembers the same kind of
feeling about the mural across the street.
Councilman Vincenzi feels New Smyrna Beach will benefit from this
just like they always do with everything.
Councilwoman Lichter spoke about Port Orange also being involved
in this and she is not sure there is any archaeological evidence
of anything there and they gave $10,000.
Mike Visconti, 316 pine Breeze Drive, stated he was the Chairman
of the Beautification Committee for the last six years and since
it has been changed to Recreation/Cultural Services Board,
beautification is not even mentioned. He heard City Manager
Hooper saying if this is passed, it will come out of the
beautification funds. We appropriated these funds to beautify
the medians, which have not been started yet. We are trying to
beautify u.S. #1 and the corner of Park Avenue and u.S. #1 and we
hoped that money would be put towards those goals. Mr. Visconti
spoke about the $6,000 for the mural coming out of the
beautification committee. Now there is $5,000 coming out of the
beautification committee. Past committees fought and fought to
appropriate that money to beautify the city. He is not against
archaeology but the funds should be done the way they have
appropriated them for the beautification committee. He suggested
it come out of Parks and Recreation, why beautification?
Councilwoman Rhodes asked Mr. Visconti if this did not come out
of beautification, if he would be in favor of this. Mr. Visconti
stated yes, he is not against it.
Dick Martinez, 317 Schooner Avenue, stated we are a young country
and we forget we have a heritage and we have history that we
often fail to protect. He is in favor of this.
Mike Tanksley, 204 S. Park Place, Chairman, Recreation/Cultural
Services Board, spoke about JoAnne Sikes, Marie Goodrich, and
Laverna McGuiness being members of the board and being movers and
shakers in this community.

Mr. Tanksley spoke about the history that has been found in New
Smyrna being the same history they are expecting to find here.
They are expecting to find a lot of it. Enough so that hopefully
it will necessitate a museum for Edgewater. He asked for the
opportunity and chance to show the Council there is history here.
Councilman Brown asked what they would do to set a site up for
people to come and view. Is this money going to be applied
towards making this available or is it just for looking at it?
Mr. Tanksley stated this is step one of a very large plan. He
spoke about what happened with one of the very first sites in New
Smyrna. He spoke about a scale model that is on display in the
Museum of Fine Arts in Daytona. From that scale model, they can
take students and build a full-size house.
Councilwoman Lichter spoke about the shallowness of a dig. She
feels there is a lot of positive pluses for young people with
archaeology.
Councilwoman Rhodes made a motion to give them the $5,000, not to
come out of beautification. She thinks you can always find
something better to spend the money on but she feels our heritage
is important. Councilwoman Lichter seconded the motion. The
motion CARRIED 4-1. Councilman Vincenzi voted NO.
B. Soruce Creek Band Parents Association reauestina soonsorship
for Edaewater band students to oarticioate in Pasadena Tournament
of Roses Parade on New Year's Dav 2001 ($50 oer student: totalina
$350)
city Manager Hooper made a staff presentation. Staff recommends
approval. Mayor Schmidt asked if they had an original request
before this. City Manager Hooper commented on the vague request
they originally submitted. Mayor Schmidt asked if this is a
sponsorship that anyone could do for any of the kids also on a
private basis. City Manager Hooper informed him that is correct.
Councilwoman Lichter would like the kids to come back after and
comment on their experience.
Councilman Vincenzi moved for approval, second by Councilwoman
Lichter. The motion CARRIED 5-0.
C. sth arade student Anthony Lewis reauesting a donation for the
Student Ambassador Proaram. which will send him to Britain and
Ireland
Anthony Lewis, lS01 India Palm Drive, made a presentation
regarding the People to People Student Ambassador Program. He is
asking Council for $500.
Councilwoman Rhodes asked what he had to do to qualify. Mr.
Lewis stated there were 30 other students that also qualified.
Councilwoman Lichter asked where the rest of the money comes
from. Mr. Lewis informed her donations.
Mayor Schmidt asked when his trip would be. Mr. Lewis informed
him once school is out. Councilman Vincenzi asked if he would
come back and do a slide show. Mr. Lewis agreed.
City Manager Hooper stated staff recommended the same
contribution that was given, the $50 per student like the others.
Councilwoman Rhodes asked if there are any other students asking
for this. City Manager Hooper stated no. Councilwoman Rhodes
asked if there is potential for other students to come forward.
City Manager Hooper stated he is sure there is potential but
there hasn't been any other requests.

Councilwoman Rhodes asked Mr. Lewis how much he needs altogether.
Mr. Lewis informed her $4,290. Councilwoman Rhodes asked how
much he has so far. Mr. Lewis informed her $300 and something.
Councilwoman Lichter asked for a consensus without a vote about
the $500 versus $50. City Manager Hooper stated if you are going
to do a consensus you ought to make a motion on a number.
Councilwoman Rhodes expressed concern if they give Anthony $500,
how much does that leave them for other students or projects.
City Manager Hooper asked City Clerk Wadsworth if she knew the
amount that was budgeted. He thinks $5,000 was set aside for
that. He doesn't think they have spent any.
Councilwoman Lichter asked if he would be asking New Smyrna as
well. Mr. Lewis stated he would be asking New Smyrna also.
City Manager Hooper asked what happens if he doesn't reach the
amount to go. Mr. Lewis stated he is definitely going to reach
that amount. Councilwoman Rhodes stated but if you don't, you
are going to give us the money back. Mr. Lewis agreed.
Councilman Brown made a motion to approve $500.
Councilwoman Lichter asked if they have planned any type of
exchange with a city in Ireland or the British Isles. Mr. Lewis
stated no not that he knows of. Councilman Vincenzi seconded the
motion. The motion CARRIED 5-0.
CITIZEN COMMENTS
Mike Visconti, 316 pine Breeze Drive, stated at the last meeting
they were talking about the anti-litter campaign. He received
phone calls from people in Meadow Lake that would like to get
permission from Council to clean up Roberts Road from u.s. #1 to
Whistle stop Park.
Councilwoman Lichter stated the official program for Edgewater
will start after New Smyrna Beach. She also wasn't sure if
Roberts Road a County road or not.
City Manager Hooper stated the City should have no objections to
that but he doesn't want them to sponsor that because it becomes
a City program and there are forms and they are going through the
process. Insurance has to be obtained for those individuals. We
are about six months from that program.
Councilman Brown asked if they will be supplying bags or special
pick up times for these. Councilwoman Lichter stated they will
be wearing vests and there will be collection spots. The Chamber
and Regions Bank in New Smyrna is helping to sponsor this. By
the time it gets going, she hopes to involve the homeowners
associations, garden clubs, Rotary, and other groups.

Councilman Brown stated he was approached regarding child
registration. He found out the Chief does have a program. He
asked what they can do to help him promote this. Chief Schumaker
spoke about the program that started three years ago. Over the
past three years, they have fingerprinted approximately 600
people. He spoke about going to the schools to do
fingerprinting. They do not keep the fingerprints on file, they
are turned over to the parents.
Chief Schumaker spoke about a program they are getting ready to
start called Character Counts.
Councilman Brown would hope the newspapers would pick up on this
and make a big promotion for them. City Manager Hooper stated
they would also put that in the newsletter.
Councilman Vincenzi also complimented Terry Wadsworth for his
quick response to problems. He would like to bring before the
Council as an agendaed item how to solicit public opinion better.
He feels there should be some better way to get to know what
people want and how they feel about issues.
Mayor Schmidt stated at the MPO meeting this morning, Votran
announced they were going to have a meeting in March on changing
some of the routes and some of the stops. They had talked about
getting a bus to stop at the YMCA.
Mayor Schmidt stated the first week in March he would be out of
town and needs a volunteer from the Council to go to a Halifax
Indian River Task Force meeting. He is going to assign himself
to that group. The meeting is the first Tuesday of each month
from 2 p.m. to 4 p.m. and meet at the Halifax Harbor Marina in
Daytona. Councilman Vincenzi agreed to go in his place.
Mayor Schmidt stated today Ken, Terry and himself took a ride out
to Oak Hill to look at the sewer plant going up. He further
commented on the progress.
Councilwoman Rhodes feels Chief Schumaker is doing a good job.
She agreed with Councilman vincenzi regarding public forums. She
would like to have more input from the public.
Mayor Schmidt stated at the last meeting he brought up taking
their meetings on the road. One location has been secured. City
Manager Hooper stated they are both scheduled. Mayor Schmidt
also suggested using the Florida Shores Clubhouse.
Councilwoman Lichter spoke about the seniors and the rebate on
taxes. She has been under the impression that because Edgewater
did not get involved and vote for this break in taxes for
seniors, that would mean that none of our people could get
anything. She has found out that the portion of your taxes that
is County, if you are 65 or older, does have a break in taxation.
She is letting the seniors know that they have until March 1st to
get to Canal Street and fill out these forms.
Councilwoman Lichter spoke about the results of the senior
survey. She spoke about the Southeast Volusia Senior Advisory
Board. She thinks in the future it should be thought of as an
appointment.
Councilwoman Lichter spoke about the thirteen accidents that have
occurred on u.S. #1 and Roberts Road. They are definitely
planning some changes there. City Manager Hooper further
elaborated. Mayor Schmidt spoke about having a lefthand turn
lane. city Manager Hooper stated that is in the 60% plans that
he has just gotten in showing turn lanes and signals for u.S. #1.
Kathy Brooks informed her that within a two year period they will
be fixing that road and we will get a turn lane.

Councilwoman Lichter moved to accept the Consent Agenda, second
by Councilwoman Rhodes. The motion CARRIED 5-0.
OTHER BUSINESS
A. city Assessments - Rosemarie Miccichi requestinq a waiver to
Edqewater pavinq and wastewater assessments ($356.74 oer year)
Rosemarie Miccichi, 3012 Woodland Drive, presented her request to
have her paving and wastewater assessments waived.
Councilwoman Rhodes asked if they have precedence for this kind
of thing. City Manager Hooper commented on Florida Statute
196.012. Finance Director Michelle Goins has contacted the
Property Appraiser's office and there are 66 people within the
city that are in this category. He feels if they do this once,
they will probably see 65 other individuals come in that will be
talking about their assessment program. As much as he feels for
someone that is struggling to pay it, from a City point of view
and business perspective, staff recommends they do not grant the
waiver.
Councilwoman Lichter suggested putting this over a long period of
time, halfed and double the time. City Manager Hooper explained
it is difficult with the bonds and the program the City has out
there now. Every dollar you reduce the annual assessment income
means it has to be paid and it will come out of the general fund
or some other.
Councilwoman Rhodes asked Ms. Miccichi if she has been to any
agencies requesting assistance. Ms. Miccichi stated human
resources had helped her one time. As far as she knows, there is
nothing else out there. She would hate to lose her house.
Councilwoman Rhodes questioned her having a child. Ms. Miccichi
stated he is 17, he is still a student. Councilwoman Rhodes
asked how long they have lived there. Ms. Miccichi stated she
has had her home for two years.
Councilman Brown asked what the City does if she doesn't pay it.
city Manager Hooper informed him place a lien on it. After the
lien reaches a certain amount, you can request foreclosure or the
lien stays and a potential buyer in the future would have to pay
that amount before the closing. Councilman Brown asked if they
accrue interest every year or is it a lien for a certain amount
and that is it. City Manager Hooper informed him it includes
interest.

councilwoman Rhodes asked if this is something that will affect
her the rest of her life and she will never be able to work
again. Ms. Miccichi stated the disease she has is progressive.
Councilman Vincenzi asked about an attorney she has working on a
disability case. Ms. Miccichi stated she has disability pending,
yes, with S.S.I.
Councilwoman Rhodes asked if she anticipated that if she received
the social security, that you would be able to pay this. She is
trying to be able to make a compromise between what she needs and
what the city needs. Maybe if this could occur on a temporary
basis, they might be able to work something out. Ms. Miccichi
stated it may be able to be done but if her disability went
through six months from now, she couldn't give all of that money
in one lump. Councilman Rhodes explained she isn't saying she
would have to pay that back but if they could give her a break
for six months, she is aSking Ms. Miccichi if she anticipates in
the future she will be able to. Personally she is not willing to
grant a blanket where she would never have to pay again. Ms.
Miccichi stated the gentleman that lives with her takes care of
her financial business and asked if he would be able to speak.
Warren Kane further commented on Ms. Miccichi's situation. He
feels it is a question of presently temporarily as opposed to
permanently as he sees it. He thanked Ms. Goins who was
instrumental in getting them to this point.
Councilwoman Lichter asked if she can pay any of this amount at
this time. Mr. Kane stated he doesn't see how, not at this time,
absolutely not.
Councilman Vincenzi asked about deferring the payment for six
months and then see how her financial situation is. City Manager
Hooper stated if Council wanted to do something, he suggested
they take the money from the general fund and make the payment.
He is strongly urging them not to back away from an assessment
where you have a bond issue and outstanding debt. That
assessment is there not to be messed with. If you lower an
assessment, you are going to pen the door, for not just this
type, but anybody else that wants to re-evaluate. If the Council
wants to take general fund money on behalf of the Council, as the
City, that is a legal way to do it. It is one he doesn't suggest
because then you are taking taxpayers money to pay and subsidize
something. Councilwoman Rhodes stated there are probably plenty
of people that need money to meet their bills.
Mr. Kane stated he was wondering how many of the other 65 people
are in the position where they are unable to work to bring in
extra income. They are aware that she is not the only one with
problems but she seems to be in a different situation than most
other people. That is his view of it.
Councilwoman Rhodes stated she works for the church and there are
many members of their congregation that live on social security
alone. She doesn't like the idea of the City paying the bill
because she sees so many people that could use that help that we
aren't able to help. City Manager Hooper stated the only other
way would be to lower the assessments and that takes a public
hearing and you would have to go through an equalization board
and you would readdress the assessments. He strongly urged
Council that they don't want to do that.
Mr. Kane stated her income right now is nil. There lies her
immediate problem.

Councilman Brown stated the reason he asked about the lien is
because the City doesn't move in instantly and take property
away. If they put a lien on there, can they make the lien to
where there is no interest bearing. If it ever came to that, she
would have time to come up with the money down the line. He
didn't know if that is feasible. City Manager Hooper stated if
they just don't pay it is going to take the City a while to put a
lien on it. All of our liens are mandated and have to have an
interest bearing or else none of them do.
Councilwoman Lichter asked how much this is a month? City
Manager Hooper stated it is $356 dollars a year. Councilwoman
Rhodes stated $30 per month.
Ben DelNigro, 3130 Tamarind Drive, stated he feels for this lady
but if Council approves this for her, they are going to have to
approve it for a lot of other people.
Councilwoman Rhodes told her to come to Edgewater united
Methodist Church tomorrow and they will do something to help her.
Councilwoman Lichter stated she has person that she has adopted
with two children, a single mom and she helps her out a little
every month if she isn't going to make it. She thinks there are
private individuals hearing this story or as Harriet has offered
the facilities of her church that will help. Councilwoman
Lichter informed Councilwoman Rhodes she would also contribute.
City Manager Hooper commented on this being a governmental
function. He applauds what they have said and done but at the
same time that is not he role of government.
Councilwoman Rhodes stated we are all people and we have to try
and help each other.
Councilwoman Rhodes made a motion to deny the request, second by
Councilman Brown. The motion CARRIED 5-0.
There was a ten-minute recess at this time.
B. Franchise Aareement - Staff recommendina Council authorize
citv Manager or Mavor to enter into an aareement for Off-site
signs
City Manager Hooper made a staff presentation. Staff is
recommending approval.
Councilwoman Lichter asked if Florida Shores Clubhouse could have
one of these or if that would be inappropriate. City Manager
Hooper stated his understanding is they can make a list of where
we want them.
Mayor Schmidt stated these are the same type signs they have in
Daytona Beach Shores.
David Ridner, 2804 Unity Tree Drive, stated yes they are the same
type concept, different company.
Mayor Schmidt asked how many the City gets for free. Mr. Ridner
informed him one for every ten.
Mayor Schmidt asked if it comes in front of Council when they
decide where they will go or is that something that they talk
about but it is just common sense. city Manager Hooper stated it
comes back in front of Council. Mr. Ridner stated they decide
where they go totally.

Councilman Brown asked if these have been installed anywhere near
hurricane areas. Mr. Ridner stated Daytona Beach Shores and
listed other cities. He commented on people that have expressed
an interest in these signs.
Councilman Vincenzi moved for approval, second by Councilwoman
Lichter. The motion CARRIED 5-0.
C. Professional Plannina Consultant Contracts - Approval of
proposed continuina Services Aareements
City Manager Hooper made a staff presentation. He recommended to
Council that they use two firms, Land Design Innovations,
Maitland and Ghyabi Lassiter & Associates, Ormond Beach. Staff
recommends authorization for the Mayor or himself to sign the
contracts and it does not obligate or spend any money at this

city Manaaer
Discussion Land Development Code
City Manager Hooper informed Council they are in the final stages
of putting together the draft of the Land Development Code. It
will be presented to P & z this week. The Council will get their
copies at the same time. He gave the Code Enforcement Board
their sections last week. They are probably going to need a work
session or two to really go through. It is a major change in the
way we have done business. He spoke about the code in the past.
He further commented on some of the changes that have been made.
He spoke about having community meetings.
Code Enforcement Attornev
City Manager Hooper stated he went to the Code Enforcement Board
meeting last week and offered them the request that Council had
made that they look at sid Nowell. They have requested he draft
a contract, which Robin did, and they presented it to sid today.
He is going to look that over. He stated they will a contract
for Council review very soon.
Ocean Avenue Railroad Closina
City Manager Hooper stated April 3rd, 4th and 5th, FEC will be
closing the Ocean Avenue railroad crossing. Our share, which is
an estimate at this time, is $16,700. The railroad pays their
share of the track where there is pavement that goes across that
has to be replaced. If it is a City road that is our
responsibility. If it is a County road, it is the County's
responsibility. We really have no choices but to pay that as
part of the railroad's crossing permit that obligates the city to
make restoration when we have a problem.
