CALL TO ORDER
Chairperson Linda Johnson called the regular meeting of the Citizen Code
Enforcement Board to order at 2:01 PM in the Community Center.
ROLL CALL
Members present: Linda Johnson, Alice Haldeman, Glenn Barnhill, Ben Wagner,
Gail Anderson and Sherry Lester. Mr. Corn was excused. Also present were
Code Officers Robin Bell and Mike McGrath, Code Supervisor Angela Desue and
Board Coordinator Tabitha Russell.
APPROVAL OF MINUTES
The Minutes for the regular meeting of August 13, 2009 were presented to the
Board for approval.
MOTION by Glenn Barnhill. SECOND bv Ben WaGner to adoDt the
minutes of the ReGular Citizen Code Enforcement Board meetinG on
AUGust 13. 2009 as amended. MOTION CARRIED UNANIMOUSLY.

James Bierwagon - 1322 Queen Palm Dr. - was postponed to the November 12,
2009 meeting due to the property owner's illness.
Ms. Lester had a question for Mrs. Johnson regarding a case on the agenda that
was located on her street and asked Mrs. Johnson if she should abstain from
voting. Mrs. Johnson told her no; she should not abstain from voting just
because they both lived on the same street. She defined conflict of interest
under the Sunshine Law and referred her to the Boards attorney for future
guidance.
'-.) There was a consensus among the Board to move Case # 2009-CE-7069 (A, B,
C) to the beginning of the agenda as the property owner was present for the
hearing.
NEW BUSINESS:
Case #2009-CE-7069 (A, B, C), 2620 Queen Palm Dr., Edgewater Florida: James
Turner. Violation of Sections 10-80, 10-83 & 10-113 (Outdoor Storage,
Neglected Premises, and Inoperable Vehicles).
Code Supervisor Angela Desue presented the case summary to the Board. Code
Supervisor Angela Desue presented staff's recommendation to find James Turner
in violation of Sections 10-80, 10-83 & 10-113 of the Code of Ordinances
assessing a citation fine of $75.00 for each violation and an additional fine of
$50.00 per day each day the violations exists past September 11, 2009 and for a
lien to be placed on the property if not satisfied by September 16, 2009. This
case was worked and managed by Code Officer Mike McGrath. Code Officer
McGrath stated that the inoperable vehicle had been moved and the premises
had been cleaned up. All citations however were still outstanding. Code Officer

has not been brouaht into comDliance, the Board assesses the daily

finds Steven Padget in violation of Section 10-83 of the Code of
Ordinances and waives the citation fine of $150.00.MOTION CARRIED

ELECTION OF CHAIRMAN AND CO-CHAIRMAN:
Linda Johnson was nominated for Chairwoman by Glenn Barnhill. No other
nominees were presented.
MOTION bv Glenn Barnhill. SECOND bv Ben Waaner to re-elect Linda
Johnson as Chairwoman of the Citizen Code Enforcement Board.
MOTION CARRIED UNANIMOUSLY.
Ben Wagner was nominated for Co-Chairman by Linda Johnson. No other
nominees were presented.
MOTION by Linda Johnson. SECOND by Gail Anderson to elect Ben
Waaner as Co-Chairman of the Citizen Code Enforcement Board.

CODE COMPLIANCE REPORT:
Code Supervisor Desue informed the Board that the new City Code of Ordinance
books would be provided at the October 8, 2009 meeting. She asked that each
Board member bring their current Code book to the meeting so that they can be
exchanged with the new book. Mrs. Johnson requested a reminder be sent with
the October agenda.
PUBLIC COMMENT:
None.
BOARD DISCUSSION:
Mr. Wagner wanted to express his appreciation for the nomination/election to
Co-Chairman. He also stated he appreciates the fact that Mrs. Johnson is willing
to stay on another year as Chairman as he looks forward to working with her and
that she does an excellent job in that position.
