CALL TO ORDER
Chairperson Linda Johnson called the regular meeting of the Citizen Code
Enforcement Board to order at 2:00 PM in the Community Center.

Ed Corn, Gail Anderson and Sherry Lester. Also present were Code Officers
Robin Bell and Mike McGrath, Code Supervisor Angela Desue, City Attorney Ty
Harris and Board Coordinator Tabitha Russell.
APPROVAL OF MINUTES
The Minutes for the regular meeting of November 12, 2009 were presented to
the Board for approval.

There was a consensus among the Board to move Cases # 2009-CE-1229,
#2009-CE-4061, and Public Comment to the beginning of the agenda.
STIPULATIONS AND AGREED ORDERS:
Case #2009-CE-9011 -500 Pullman Rd., Edgewater Florida: Bradley Stewart.
Violations of Sections - 19.41 (General Discharge Prohibitions) & 19.45 (SpeCific
Pollutant Limitations).
Code Supervisor Angela Desue presented the case summary to the Board. Code
Supervisor Angela Desue presented staff's recommendation to find Bradley
Stewart in violation of Sections 19.41 and 19.45 of the Code of Ordinances and
authorize the Citizen Code Enforcement Board Chairperson to execute the
Voluntary Stipulation and Agreed Order to achieve an amicable resolution for
compliance. It is also recommended that the Board waive the citation fees as
the Voluntary Stipulation and Agreed Order requires additional reimbursement.
City Attorney Mike Ciocchetti answered questions that the Board had in regards
to the Voluntary Stipulation and Agreed Order. There was discussion between
Bradley Stewart and the Board in regards to the violation. Environmental
Services Director Brenda Dewees answered questions that the Board had in
regards to the violations.
MOTION bv Ben Waaner, SECOND bv Ed Corn that the Board finds
Bradlev Stewart in violation of Sections 19.41 and 19.45 of the Code of
Ordinances and authorizes the Board ChairDerson to execute the
Voluntarv Stipulation and Aareed Order. The Board also aarees to
waive the citation fees.

NEW BUSINESS:
Case #2009-CE-1229, 218 N. Riverside Dr., Edgewater Florida: John and Stella
Yvonne Bice. Violation of Section 10-82 (Commercial Vehicles).
Code Supervisor Angela Desue presented the case summary to the Board. Code
Supervisor Angela Desue presented staff's recommendation to find John and
Stella Yvonne Bice in violation of Section 10-82 of the Code of Ordinances
assessing a citation fine of $75.00 and for a lien to be placed on the property if

not satisfied by January 20, 2010. This case was worked and managed by Code
Officer Robin Bell. Photos of the commercial vehicle were submitted to the Board
as Exhibit B. There was a brief discussion between the Board and Mrs. Bice
regarding the violation.

John and Stella Yvonne Bice in violation of Section 10-82 of the Code of
Ordinances and waives the $75.00 citation fee.

Supervisor Angela Desue presented staff's recommendation to find Roberta
Cahoon in repeat violation of Section 10-82 of the Code of Ordinances assessing
a repeat citation fine of $150.00 and an additional fine of $100.00 per day each
day the violation exists past January 15, 2010 and for a lien to be placed on the
property if not satisfied by January 20, 2010. This case was worked and
managed by Code Officer Mike McGrath. There was discussion between the
Board and Mike Amato who resides at the residence regarding the violation.
There was discussion between the Board and Planning Technician Pat Drosten
regarding Mr. Amatos business license. A copy of the license application was
submitted to the Board for review as Exhibit C.

Ordinances and assesses the reoeat citation fine of $150.00 and an

Code Supervisor Angela Desue presented the case summary to the Board. Code
Supervisor Angela Desue presented staff's recommendation to find Wayne and
Shannon Pearson in violation of Section 10-98 of the Code of Ordinances
assessing a citation fine of $75.00 and an additional fine of $50.00 per day each
day the violation exists past January 15, 2010 and for a lien to be placed on the
property if not satisfied by January 20, 2010. It is also recommended that the
Board issue a Board Order requesting the City Manager approve the cutting of
the grass by City Staff if the violation is not corrected by January 15, 2010 and
that a lien is placed on the property. This case was worked and managed by
Code Officer Mike McGrath. No one was present to testify.

Modification of the Citizen Code Enforcement By-Laws.
There was a brief discussion amongst the Board and City Clerk Bonnie Wenzel
regarding the modification of the By-Laws.

sends a favorable recommendation to City Council to modify the Citizen
Code Enforcement Board Bv-Laws.
