MINUTES
CALL TO ORDER
Mayor Thomas called the Special Meeting (Closed Meeting) to order
at 4:00 p.m. in the Council Chambers.
MEETING PURPOSE
The purpose of the Attorney-Client Session was to discuss the
settlement negotiations in the pending litigation to which the
City is a party, to wit: Anthony Cassata v. City of Edgewater,
Circuit Court, Seventh Judicial Circuit, Volusia County, Case No.
2008-21134-CINS in accordance with Florida Statute 286.3011(8),
Florida Statute (2009).
Mayor Thomas stated the closed attorney-client session between
the City of Edgewater City Council and City Attorney would
commence. Those not authorized to attend would be asked to exit
the room during the course of the meeting. He expected the
closed session to take approximately 1 hour. The names of those
who would be in attendance were as follows: Mayor Michael L.
Thomas, Councilwoman Harriet Rhodes, Councilwoman Debra Rogers
who was not present, Councilwoman Gigi Bennington, Councilman Ted
Cooper, City Manager Tracey Barlow, and City Attorneys Carolyn
Ansay and Aaron Wolfe. Staff was not permitted to the closed
attorney client session.
City Attorney Ansay informed Council they were requesting that
they get their guidance and counsel on the Anthony Cassata v.
City of Edgewater case which was pending in the Circuit Court in
Volusia County. They had a court reporter as they are required
to do under Florida law set up in the Conference Room. They were
going to break and go over there. She was ready to take down
everything they say as is required under the Statute. The
transcript would be sealed and held until the litigation was
concluded. Under the law they have to release it if anybody asks
for it. Her partner Aaron Wolfe, has been defending the case and
he would take over.
The Council recessed at 4:01 p.m. to proceed to the City Hall
Conference Room for the closed attorney-client session.
Mayor Thomas stated the closed attorney-client session had been
concluded and the public meeting was hereby reopened at 4:38 p.m.

There being no further business to discuss, Mayor Thomas
adjourned the meeting at 4:38 p.m.
