01-21-2009 CITY OF EDGEWATER ANIMAL CONTROL BOARD MEETING January 21, 2009 Community Center, 102 N. Riverside Drive MINUTES ROLLCALL/CALL TO ORDER Chairwoman Donna Wagner called the January 21, 2009 meeting to order at 7:05 p.m. in the Edgewater Community Center. Members present were: Donna Wagner, Mary Wenderoth, Jamie Young, Karen Mason and Dr. Vanis(who arrived at 7:20). Attorney Ty Harris was absent. Also present was Johnnie Dail, Animal Control Officer and Barb Kowall, Board Coordinator. APPROVAL OF MINUTES Karen Mason made a Motion to accept the minutes from the June 25, 2008 regular meeting, Seconded by Jamie Young. Motion CARRIED 4-0 Karen Mason made a Motion to accept the minutes from the July 16, 2008 Dangerous Dog Hearing, Seconded by Mary Wenderoth. Motion CARRIED 4-0. Karen Mason made a Motion to accept the minutes from the September 18, 2008 Dangerous Dog Hearing, Seconded by Jamie Young. Motion CARRIED 4-0. Karen Mason made a Motion to accept the minutes from the November 18, 2008 Dangerous Dog Hearing, Seconded by Mary Wenderoth. Motion CARRIED 4-0. NEW BUSINESS Board Reappointments. Karen Mason, Mary Wenderoth and Donna Wagner's terms have expired. All three signed a statement to Council that they wish to be reappointed for another term. The Board Secretary stated the paperwork will be forwarded to Council for the first meeting in February. OLD BUSINESS Chapter 5 of the City Ordinance for"Animals and Fowl" The following changes were proposed by the Board to send to the attorney for approval. All of the changes had a Motion, a Second, and were all approved 5-0 by the Board. Page 3—(2) e. This sentence should read as follows: That the animal is leashed and controlled at all times it is not secured. Animal Control Bd.Meeting I Jan 21,2009 Page 5—Feral Cats. (red ink section) Should read: Feral Cat: Feral cats are "wild" or untamed, either due to birth or reversion from domestication to a wild state. Feral cats are free roaming and not interactive with humans and have no known owner. Feral cats are also considered a species of wildlife (see wildlife). Page 5—Definition of Heel Remove this definition entirely. Page 6—Owner: (2) We are deleting the second sentence. Should read: The owner must live on the premises with the animal. Page 6—Pet-sitter (nonprofit): Sentence 4 should read as follows: Persons that are approved by Edgewater Animal Services to provide temporary care for homeless animals that may need medical care are not considered pet sitters and time periods may extend past the allowable time if approved by Edgewater Animal Services. Page 10—(b) 1. The second sentence should read: Whenever possible, the membership shall include a licensed veterinarian, a member representing the holding or impounding facility currently under contract with the city, a dog owner, and a cat owner. Page 11 —Sec. 5-8 (paragraph under red section) Second sentence should read: Any premises that harbors more than one (1) unaltered dog or cat that is capable of breeding must obtain a breeders permit. Page 12 —Sec. 5-10. Feeding of wildlife prohibited. The first sentence should read: It shall be unlawful for anyone to feed, entice or encourage any stray wildlife, which includes feral cats as defined in section 5-2 or as otherwise prohibited by state law. Page 13—(b) 1. (in red ink) Last sentence in paragraph should read: If no owner is found within fifteen (15) days, the finder shall be conclusively presumed to be the owner of such animal. Page 17—Sec. 5-32. (a) The last sentence should read: License tags shall be valid for one year from the date of rabies vaccination and for only one animal; and city tag may be renewed until such time as rabies vaccination has expired. Page 21 —(15) (first sentence) Should read: Animals impounded due to care giver being incarcerated or hospitalized, the impounding facility or shelter having custody of the animal, will hold the animal up to five (5) days. Page 21 —(16) Delete line 16 altogether. Animal Control Bd.Meeting 2 Jan 21,2009 Page 21 —Sec. 5-41 (b) This sentence should read: If any impounded animal is not claimed within three (3) days after impoundment, or a surrendered animal is not claimed within two (2) days after impoundment, the animal shall be deemed unowned or abandoned and shall be disposed of pursuant to the requirements of this chapter and the rules and regulations of the impounding facility. Page 22 —(e). This sentence should read: Any unclaimed animal shall become the property of the impounding facility after the three (3) day hold period, and may be humanely destroyed after the fifth hold day period, maintained or disposed of by gift, sale or adoption pursuant to the requirements of this chapter and the rules and regulations of the impounding facility. Page 23—(2) (first complete sentence at top of page) "All other wild animals tamed from wild environments, etc. etc. to the end of the paragraph is to be deleted. Page 23 —Delete all of number(3). (End of changes) The Board also discussed a mandatory spay and neuter program. Karen Mason made a Motion for Mr. Corder to get with the City Attorney for her opinion to be discussed at the next meeting on February 18th. Jamie Young Seconded the motion and it CARRIED 5-0. ADJOURNMENT There being no further business, Jamie Young Moved to adjourn, Seconded by Mary Wenderoth. The Motion CARRIED 5-0.
