COMMUNITY CENTER MINUTES CALL TO ORDER Chairperson Linda Johnson called the regular meeting of the Citizen Code Enforcement Board to order at 2:02 PM in the Community Center. ROLL CALL Members present: Linda Johnson, Alice Haldeman, Glenn Barnhill, Ed Corn, and Ben Wagner. Also present were Code Officer Robin Bell, Code Officer Mike McGrath, Board Attorney Ty Harris and Recording Secretary Shontella Jackson. Absent was Ben Delnigro and Larry Leaf has officially resigned. APPROVAL OF MINUTES The Minutes for the regular meeting of March 12, 2009 were presented to the Board for approval. MOTION by Alice Haldeman, SECOND by Ed Corn to oat the minutes of Regular Citizen Code Enforcement Board on March 12, 2009 as written. MOTION CARRIED UNANIMOUSLY. SWEARING IN OF WITNESSES: Code Officer Robin Bell and Code Officer Mike McGrath. CASES IN COMPLIANCE: Postponing Case #2009 -CE -2046; Brian D. Burns & Lezlie J. Peterson of 307 N. Ridgewood Ave., Edgewater Florida; Charles Becker. Violation of Section 21 -60.04 — Prohibited signs. Code Officer Mike McGrath presented the case summary to the Board. Code Officer Mike McGrath presented staff's recommendation to find Charles Becker in repeat violation of Section 21 -60.04 of the Land Development Code assessing a citation fine of $150.00 and for a lien to be placed on the property if not satisfied by April 15, 2009. This case was worked and managed by Code Officer Mike McGrath. No one was present to testify. MOTION by Ben Wagner, SECOND by Ed Corn that the Board finds Charles Becker in repeat violation nf Section 21 -60.04 of the Land Development Code assessing a citation fine of $150.00 and for a lien to be placed on the property if not sa tisfied April 15, 2009. MOTION ARRIED 4 -1. Case #2009 -CE -2012. 2729 Kumauat Dr., Edgewater, Florida: Thomas Ingram. Violation of Section 19 -11 — Meters connection. Code Officer Mike McGrath presented the case summary to the Board. Code Officer Mike McGrath presented staff's recommendation to find Thomas Ingram in violation of Section 19 -11 of the Code of Ordinances assessing a citation fine of $75.00 and an additional fine of $50.00 per day each day the neglected premises violation exists past April 10, 2009 and for a lien to be placed on the property if not satisfied by April 15, 2009. This case was worked and managed by Code Officer Mike McGrath. Code Officer Mike McGrath presented photographs for the Board to review labeled Exhibit A thru G. No one was present to testify. MOTION by Ed Corn, SECOND by Glenn Barnhill that the Board finds Thomas Ingram in violation of Section 19 -11 of the Code of Ordinances assessing a citation fine of $75.00 and an additional fine of $50.00 per day for each day the violation exist past April 10, 2009 and for a lien to be placed on the property if not satisfied by April 15, 2009. MOTION CARRIED UNAMIOUSLY. Case #2009 -CE -2029, 2729 Kumquat Dr., Edgewater, Florida; Thomas Ingram. Violation of Section 21 -35.04 — Neglected premise. Code Officer Mike McGrath presented the case summary to the Board. Code Officer Mike McGrath presented staff's recommendation to find Thomas Ingram in violation of Section 21 -35.04 of the Land Development Code assessing a citation fine of $75.00 and an additional fine of $50.00 per day each day the neglected premises violation exists past April 10, 2009 and for a lien to be placed on the property if not satisfied by April 15, 2009. This case was worked and managed by Code Officer Mike McGrath. Code Officer Mike McGrath presented photographs for the Board to review labeled Exhibit A thru G. No one was present to testify. MOTION by Alice Haldeman, SECOND by Ed Corn that the Board finds Thomas Ingram in violation of Section 21-35.04 of the Land Development Code and continue the citation fine of $75.00, an additional fine of $50.00 per day each day the violation exist past April 10, 2009 and for a lien to be placed on the property if not satisfied by April 15 2009 It is also recommended that the Board issue a Board Order requesting the City Manager approve the removal of debris by City staff if the violation is not corrected by April 10,200 and that - a lien is placed on the property. MOTION CARRIED 4 -1. Case #2009 -CE -3001, 2729 Kumquat Dr., Edqewater, Fl orida; Thomas Ingram. Violation of Section 10 -44 — Declaration of illegality and nuisance. Code Officer Mike McGrath presented the case summary to the Board. Code Officer Mike McGrath presented staff's recommendation to find Thomas Ingram in violation of Section 10 -44 of the Code of Ordinances and continue the citation fine of $75.00 and an additional fine of $616.62 to secure the property and for a lien to be placed on the property if not satisfied by April 15, 2009. This case was worked and managed by Code Officer Mike McGrath. No one was present to testify. MOTION by Ben Wagner, SECOND by Ed Corn that the Board finds Thomas Ingram in violation of Section 10 -44 of the Code of Ordinances accessing the citation fine of $75.00 and an additional fine o f $616.62 to secure the property, also for a lien to be placed on the property if not satisfied by ADO 15, 2009.M CARRIED UNAMIOUSLY.
