Planning Department
1. The plan must comply with Article XVIII for Indian River Boulevard — SR 442
Corridor Design Regulations. This article addresses building location and
landscape buffer, architectural design standards and signs.
Given LDC information. Will provide additional information with resubmittal.
2. The application reflects two parcels of land for this project. They must be
combined or a joint use driveway agreement is necessary.

3. Add a note to the plan indicating the total amount of impervious surface on site.
Will add.
4. Details regarding the screening of the dumpster must be provided in accordance
with Section 21 -34.08 (a).

5. Indicate eventual stormwater outfall to a public conveyance.
Will add. Will discharge to canal on west side of Fern Palm Dr eventually to 18'" Street
canal.
6. Provide copy of Vekusia Cott nty DOT access permit or letter of exemption.
Will provide letter of clearance or exemption from DOT.
7. Provide copy of Department of Health permit or letter of exemption.

8. Show drive up station location so compliance with the variance granted to Section
21 -52.03 (g) can be verified.

Parkins
1. A mountable curb must be installed at the point where Guava Drive exits onto SR
442.
OK Will show detail.
2. The conditions placed on the variance requests approved by the Planning and
Zoning Board on January 14, 2004 were that "the applicant reduce the number of
parking spaces against the proposed building from 16 to 15." Removing space #8
and replacing it with a landscaped island can accomplish this.
Will show.
3. Specific square footage of the proposed restaurant and retail spaces must be
provided to calculate the required number of parking spaces.

4. Wheelstops must be removed in accordance with Section 21 -54.03 (b) unless
"certain stormwater conditions warrant their use ".
Will remove.
5. One loading berth is required per Section 21- 57.05, Table V -10.
Addition will be less than 5000 sq. ft. loading berth not required.
Landscaping
1. Indicate irrigation plans on landscaping plans. Applicant is advised to contact the
Volusia County Health Department regarding the new countywide "water wise
landscaping" ordinance.
Will show on resubmittal, preferred language provided.
Buildine Department
1. The plans appear to be Type V construction and a drainage pipe will be located
under the new addition. This may cause problems with the foundation if not
protected properly. The engineer of record must submit a detailed drawing
showing the separation between the drainpipe and the footings of the building.

2. The air conditioning units behind the building may be subject to damage unless
some poles are installed for protection.

3. Restaurant will need a grease trap. Size to be determined by the Utilities
Department.

4. Construction drawings shall comply with all Florida Building Codes for 120 mph
wind speed within the impact debris region.

Fire - Rescue Department
1. The required fire flow for this project is 1000 gallons per minute.

Utilities
1. A single backflow preventer is shown on three water meters. It is unclear of the
intent of what facilities are to be owned/maintained by the City. A single service
and backflow preventer is recommended.

Vehicle /pedestrian circulation
1. A bypass lane on the drive up facility is required.
Variance granted for this.
2. Sidewalks are required.
Existing sidewalks are sufficient. Will show on plans.
3. The improvements on Guava Drive should conform to Section 21 -52.05 and the
City Standard Construction details.
Shown on detail sheet.
Stormwater Management Requirements
1. A SJRWMD permit is required.
Waiting.
2. All drainage from the entire site should be treated /attenuated in the proposed
pond.

3. The connections to existing catch basins on Fern Palm is unclear.
Will clarify.
4. Permit coverage under FDEP NPDES is required if site is one (1) acre or larger.
City should be provided copy of NOI.

Parking /loading
1. Parking space #31 is required to have a fifteen (15) foot maneuver space.
Will provide conceptual on this item.
Other
1. The Guava connection to SR 442 should be permitted with FDOT. Copy of such
permit should be provided to the City.

Legal Department
1. Based on the review of the plan submitted, the applicant should comply with all
City, County, State and Federal requirements for this project.

2. The search updated from the First American Title Insurance Company does not
reflect the fee simple owner. The title company should provide a corrected update
reflecting that Mitch Patel is owner.

Department of Environmental Services
Water
1. The configuration of the backflow prevention device with the water meters
downstream is of great concern. The City must ensure water quality to the point
of delivery, which for this project would be at the respective water meters. If the
project is to remain in sole ownership, a single meter and backflow prevention
device is recommended. However, if the units are to be sold or leased separately,
backflow prevention devices must separately protect the individual meters. As
laid out currently, any contamination on the down stream side of the proposed
backflow prevention device could cause contamination in all three units. All

backflow prevention devices must be on the approved list, which is available at
the Environmental Services Administration Office located at 115 East Park
Avenue.

1. The sewer lateral and points of connection are not indicated on the plans.

2. If food preparation is to be included as part of the new addition, a grease trap is
required.
