Minutes
Mayor Wessler called the regular meeting to order at 7:00 p.m. in
the Community Center.

INVOCATION, PLEDGE OF ALLEGIANCE

pledge of allegiance to the Flag.
The invocation was delivered
Baptist Church. There was a
certificates of Appreciation to Police personnel for outstanding
work with Lisboa conviction
Mayor Wessler read a letter she received from State Attorney John
Tanner.
Mayor Wessler presented a certificate to Sgt. William Bennett and
certificates for delivery to Officer Dan Blazi, Investigator Don
Goodson, Telecommunicator Kathy smith, Detective Dave Gamell, and
Detective Leo Booth.
Sgt. William Bennett then gave a thank you speech.
Chief Schumaker then gave a speech.
Councilman Hays commended the following people who assisted the
victims of Hurricane Andrew: Jim Martin - Parks & Recreation,
Mark Stone - Police Department, A. J. Hutchins - Public Works,
Larry Shine - Public Works, Chuck Chamberlin - Public Works,
Arthur Nerber - Public Works, Larry Carson - Fire Department,
Jill Landerville - Fire Department, Peggy Cousins - Volunteer
Fire Department, Anthony Carrillo - Volunteer Fire Department.
Councilperson Gillespie asked for comments and suggestions of the
people who went to Miami.
Resolution 92-R-22 A resolution recoqnizinq City Government Week,
October 4 - 10, 1992; encouraqinq all citizens to support the
celebration and correspondinq activities
Mayor Wessler read Resolution 92-R-22. councilperson Gillespie
moved to accept Resolution 92-R-22, seconded by Councilman Hays.
Motion CARRIED 4-0.
APPROVAL OF MINUTES
Councilman Hays moved for approval. Councilperson Gillespie
seconded the motion. Motion CARRIED 4-0.

CONSENT AGENDA
A. Police Chief's request to go out for bids for three used non-
pursuit vehicles
Councilperson Gillspie moved to accept the consent agenda,
seconded by Councilman Hays. Motion CARRIED 4-0.
NEW BUSINESS
A. Change Order No. 2 for advanced wastewater treatment plant,
phase 1 expansion reducinq contract price by $1,334.81
Councilman Hays made a motion to approve, seconded by
Councilperson Martin. Motion CARRIED 4-0.
ORDINANCES, PUBLIC HEARINGS, AND RESOLUTIONS
FIRST READING
A. Ord. 92-0-19 with Annexation Aqreement of 94 + acres, Daytona
Beach community College South Campus
Mayor Wessler read Ordinance 92-0-19.
councilperson Gillespie asked if the City will be able to use the
facilities. Community Development Director Mark Karet stated
they usually enter into a separate use agreement.
Dr. John Justis, representing Daytona Beach Community College,
stated the facilities will be used from 7:00 a.m. until 10:00
p.m. It will be available for the City to use. Bruce Thompson
is the person who will make arrangements for use of the
facilities. Councilman Hays stated he is really happy to see the
City reach this point.
Councilperson Martin made a motion to accept Ordinance 92-0-19,
seconded by councilperson Gillespie. Motion CARRIED 4-0.
B. Res. 92-R-21 Authorizinq amendment of Volusia City-Council
Water Supply cooperative Agreement to offer Affiliate Membership
to Southern States utilities, Incorporated
Mayor Wessler read Resolution 92-R-21.
Councilman Hays asked if Southern States utilities, Incorporated
will be a voting or dues paying member. It was made clear they
would not be a voting or dues paying member.
City Manager McMahon stated the use of any water that would come
out of the co-op would be done on a purchase basis. Right now
that has not been discussed and it would be a business
arrangement.
councilperson Gillespie asked if this will bring in the West part
of the County. Mayor Wessler stated she hoped so.
Councilperson Gillespie made a motion to accept Res. 92-R-21,
seconded by Councilperson Martin. Motion CARRIED 4-0.
SECOND READING
Ord. 92-0-3 Arnendinq Comprehensive Plan pursuant to Settlement
Aqreement with Department of Community Affairs
Mayor Wessler read Ord. 92-0-3.
Mayor Wessler opened the Public Hearing. Due to no one wishing
to speak she closed the Public Hearing.

Councilman Hays made a motion to approve Ord. 92-0-3, seconded by
Councilperson Gillespie. Motion CARRIED 4-0.
Ord. 92-0-18 with Annexation Aqreement of 19 + acres located
between u.s. 1 and Mosquito Laqoon (Ranken Road area)
Mayor Wessler opened the Public Hearing.
Mayor Wessler read Ord. 92-0-18.
Mayor Wessler closed the Public Hearing.
Councilperson Gillespie moved to accept Ord. 92-0-18, seconded by
Councilperson Martin. Motion CARRIED 4-0.
Councilman Hays stated he attended an Environmental Quality
Policy Committee in Orlando and one of the biggest priority
issues is growth management.
City Attorney storey stated she would appreciate separate action
being taken on the annexation agreement. Councilperson Gillespie
moved to accept the annexation agreement, seconded by Councilman
Hays. Motion CARRIED 4-0.

COUNCIL/OFFICER REPORTS
city Attorney
City Attorney storey had nothing at this time.
city Manaqer
City Manager McMahon asked Council to take action on confirming
and accepting low bid on transfer station. The lowest bid was
for $9200. This will come from equipment replacement fund.
Councilperson Gillespie moved to accept the low bid of $9200,
seconded by Councilperson Martin. Motion CARRIED 4-0.
City Manager complimented Police Chief on his specifications for
the police cars. This is the best that he has ever seen.
City Manager asked Council to authorize a rebid on the City's
part of repaving Park Avenue.
utilities Director Terry Wadsworth explained the bids were too
high and asked to authorize that work to be done.
councilperson Gillespie moved to rebid, seconded by Councilman
Hays. Motion CARRIED 4-0.

Councilperson Gillespie
Councilperson Gillespie stated they explained City Government to
the 5th Grade Classes at Indian River Elementary and they were so
eager to learn. She stated Susan Wadsworth will be available for
groups that would like to come in all week. Chief Vola has
something for the City for Fire Prevention Week.
Councilperson Gillespie stated she gets along very well with the
City Attorney and regardless of the rumors she does not wish to
replace her.
Councilman Hays
Councilman Hays stated on Amendment Ten there is a legal
challenge to that because it may violate the constitution. He
stated he thinks it is important to let people know if the
Supreme Court lets that go to ballot how it may impact them as
far as Homestead Exemption. He stated it is important to get
this information to the public.
