05-24-1989 CITY OF EDGEWATER CHARTER REVIEW COMMITTEE REGULAR MEETING WEDNESDAY, MAY 24, 1989 CONFERENCE ROOM, CITY HALL A regular meeting of the Charter Review Committee was held on Wednesday, May 24, 1989, in the conference room of City Hall beginning at 3:09 p.m. Members present were Susan Wadsworth, Gigi Bennington, Domminick Fazzone, and Mary Martin. Jose' Alvarez was excused and Jack Hayman was absent. The members discussed the duties of the City Clerk. It was noted the duties are now shared by Mrs. Wadsworth and Mrs. Koser due to lack of staff. After some discussion the members agreed the sections regarding the City Manager, City Clerk and Finance Director would need to be redone. Mrs. Wadsworth reported the cost of holding elections was still being researched by elections office. Mrs. Martin passed around a draft letter to organizations and groups in the area regarding the charter review and who to contact if there were any questions. The members agreed to have their names and phone numbers included in the letter to alleviate the number of calls that may come in to City Hall. Section 3.09: City Clerk. Proposed new wording - There shall be a city clerk who shall be appointed by the city council. The clerk shall give notice of council meetings to its members and the public and shall keep the journal of its proceedings which shall be a public record. In addition, the city clerk shall be the official custodian of public records, elections clerk, and shall have other responsibilities as provided by general law and by ordinance. Section 4.01: City Manager. Proposed new wording - There shall be a city manager who shall be the chief administrative officer of the city, under the direction and supervision of the city council. He shall be responsible to the council for the administration of all city affairs placed in his charge by or under this charter. Page 1 `rr w Section 4.02: Appointment; Removal; Residency; Compensation - (a) No changes (b) Refer to the City Attorney (c) The manager shall reside in the city while in office within six (6) months of permanent appointment. (d) No changes Section 4.03: Acting City Manager - No changes Section 4.04: Powers and Duties of the City Manager - proposed wording The city manager shall: (a) Appointment and, when he deems it necessary for the good of the service, suspend or remove all city employees provided for by or under this charger, except as otherwise provided by law, this charter or personnel rules adopted pursuant to this charter. He may authorize any administrative officer who is subject to his direction and supervision to exercise these powers with respect to subordinates in that officer's department, office or agency. (b) Direct and supervise the administration of all departments, offices and agencies of the city except for office of city clerk, city attorney, city boards and commissions, as provided by this charter or law. (c) No changes (d) No changes (e) No changes (f) No changes (g) No changes (h) Keep the council fully advised as to the financial condition and future needs of the city and make such recommendations to the council concerning the affairs of the city. (i) Perform such other duties as are specified in this charter or may be required by the council and by law. Section 4.05: Not needed. (to be replaced with Section 4.06) Section 4.06: (to become 4.05) Personnel System - The members questioned whether this would be in conflict or replace the Merit Board in the charter. It was noted the Merit Board should also make recommendations to Council regarding policies and procedures. Section 5.01: No changes Page 2 Section 5.02: Non- N v00 Partisan Elections - Proposed wording: All nominations and elections for the office of city council members or mayor shall be conducted on a non - partisan basis without regard for or designation of political party affiliation of any nominee on any nomination petition or ballot. Section 5.03: Nominations - Proposed wording: Candidates for the office of mayor and city council members shall be nominated for such office by the filing of a written notice of candidacy with the designated city official at such time and in such a manner as may be prescribed by ordinance. The name of any qualified elector of the city shall be printed upon the ballot to be used at each regular or primary municipal election as a candidate for the office of mayor or city council member, if there is filed with the city clerk a petition in accordance with the following provisions to -wit: (a) Such petition shall state the name of each person whose name is presented for a place upon the ballot and that he is a candidate for the office of mayor or city council member. (b) Such petitions shall be signed by at least one percent (1 %) duly registered, qualified electors of the city. (c) Same as Section 138, City Code of Ordinances (d) Same as Section 138, City Code of Ordinances (e) Same as Section 138, City Code of Ordinances (f) Section 139, City Code of Ordinances Section 5.04: Form of Ballots - Hold for wording from Supervisor of elections. Section 5.05: Use Section 140 and 140A from City Code of Ordinances. Section 5.06: Council Districts; Adjustment of Districts - proposed wording: (a) Number of Districts - there shall be four city council districts. (b)Report; Specifications - Mrs. Wadsworth was asked to contact Mrs. Odom. It was recommended that the City Council form a committee to handle redistricting. Further discussion is to be continued on June 7th. Mrs. Bennington stated she would try to get someone to do a first draft of the proposed charter for the next meeting.
