05-17-1989 r' CHARTER REVIEW COMMITTEE SUMMARY MAY 17, 1989 Chairwoman Bennington called the meeting of the Charter Review Committee to order at 3:07 p.m. in the conference room of City Hall on Wednesday, May 17, 1989. Members present were Acting City Manager Susan Wadsworth, Councilwoman Gigi Bennington, Domminick Fazzone and Mary Martin. Jack Hayman arrived at 3:10 p.m. Also present was Beverly Kinney Secretary. City Attorney Jose' Alvarez was excused. There was discussion regarding the cost of holding elections of Mayor and Council in March instead of November.Mrs. Wadsworth was to get the figures and report back to the Committee. The committee discussed staggered terms of office. There was discussion about offering alternatives to the Mayor and Council when the Charter was presented for approval. Shangri -La Home Owners Association and the Pelican Cove West Home Owners Association were added to the current list of Edgewater Clubs and Civic Groups. Section 3.08 - Vacancies, Forfeiture of Office, Filling of Vacancies - (Model Charter): Discussed filling of vacancies (two year term - within ninety days, three year term - within six months - see attached). The Committee discussed forfeiture of office by having three consecutive absences. Committee agreed they wanted City Charter to be congruent with Model City Charter. Section 3.09 - City Clerk - (Model Charter): The Committee discussed the position of City Clerk. They agreed the City Clerk should work with the City Manager, not under the City Manager. Section should include In addition, the City Clerk shall be the official custodian of records, elections clerk, and shall have such other responsibilities as provided by general law and by ordinance" (from the New Home Rule Charter). It was agreed by the Committee, after some discussion, that the City Clerk should act as a "check and balance" person between the City Manager and the City Council. It was noted there was a conflict in Section 3.09 and Section 4.04 of the Model Charter regarding the City Clerk and the City Manager positions. Page 1 Nor Mrs. Wadsworth was requested to have information about the position of City Clerk for the next meeting. Mr. Fazzone moved to keep Section 3.09 with proposed section from the New Home Rule Charter and current job description of City Clerk which will be re- reviewed when Section 4.04 is reviewed. Mr. Hayman seconded. Motion Passed. Section 3.10 - Procedure - Meeting shall be at least twice every month with no less than twenty -four hours public notice for special meetings. The committee agreed to meet on May 24, 1989, and would start on Section 4.01. The members agreed not to meet on May 31, 1989, because of the Memorial Day Holiday, but would meet on June 7, 1989. It was noted the City Attorney would be available for the June 7th meeting. Section 3.11 - Ordinances in General - The only change recommended was (c) Effective date: to become effective immediately instead of in ten days. The members discussed public notice to citizens which is on the back of water bills and articles in the newspapers. Mr. Fazzone moved to adjourn, seconded by Mr. Hayman.
