08-29-1990 CITY OF EDGEWATER CAPITAL IMPROVEMENTS PROGRAM COMMITTEE MEETING AUGUST 29, 1990 MINUTES Mayor David Mitchum called the meeting to order at approximately 6:20 p.m. in the City Hall conference room. Present were: Mayor David Mitchum, Rob Ori and Ron Ferland from Dyer, Riddle, Mills & Precourt; and City Manager Elly Johnson. City Attorney Jose' Alvarez arrived later. Mayor Mitchum stated this meeting will be a brief dialogue. Mr. Johnson had copies of a suggested agenda for the next meeting when they'll have another member of the committee. Mr. Ferland stated he has the latest status report for distribution. He said they should be receiving the construction permit from DER on the water treatment plant, the intent to issue was published on August 17th, and in two weeks there was no filing for administrative hearing, so the permit should be forthcoming; Volusia County has issued their development order contingent upon the payment of $1,994 exaction for transportation; they have to get the Florida DOT driveway permit, which they're negotiating to reduce requirements put on issuance of that driveway permit, which is widening of 442 to provide a left hand turn lane as well as a right hand turn lane. He said they're finalizing the specifications and contracts for that and anticipate the total project should be ready for bid by September 30th which will be in accordance with any bond issue that may or may not come about. He stated in the special assessment program for the sewer /reclaimed water and water improvements, they have legal descriptions and the assessment map for the area completed and they're trying to resolve the differences between the City's information on City -owned parcels in Florida Shores and what the Tax Assessor has for City -owned parcels. He noted they have the assessment rolls from the Tax Assessor and have developed a methodology with each parcel owner to be assessed the value based upon how many increments of 125 by 40 foot lots they own. He explained they came up with that method to take care of irregular shaped lots that are not easily done by front footage, and its the same method used by the Tax Assessor. He stated they requested through the City Manager a new computer tape of the tax rolls because the previous one they gave us didn't give land value and that's the denominator they have to use for assessment for each particular lot. He said they completed the construction cost estimate for the utility and paving and drainage improvements and they're trying to break out that component of the utility improvements that is not going to be special assessment, such as water lines and pro rating the force main down Mango and pro rating the reclaimed water distribution system. He said he'll forward the total construction costs probably by Friday and they're not too far off from the original estimates. Mr. Ferland stated the impact fee ordinance revisions they talked about in Florida Shores are in the ordinance that will have first reading tonight and in Florida Shores they won't have impact fees per se, they're going to have assessments. Mr. Ferland stated they received the notice from the Department on the Administrative Hearing and it was forwarded to Cliff Schulman. Mr. Johnson noted they're talking about sometime in October and he's waiting for a response from some of the people in the group he's working with. Mayor Mitchum asked if they may get it resolved. Mr. Johnson replied he thinks they can work with the people. Mr. Ferland stated with the wastewater plant they had to come up with one additional day of storage because originally they were trying to operate the storage system for both the reject water and shellfish water and the State has said they want separate storage. He explained they put in the phase 2 aeration basin plus they doubled the size of one of the ground storage tanks and are in the process of once again revising those specifications in response to their comments for redundancy and mechanical reliability and those should be submitted to DER this Friday. Mr. Johnson asked if they'd heard anything from Geoff. Mr. Ferland replied Geoff Mansfield called and said he'd received the letter requesting assurance that we are not going to get bumped off the list and he's sending us the letter and it essentially says we're not being bumped off the SRF list. Mr. Johnson noted the list he got from the State says we're still at that position. Mr. Ferland stated he wasn't sure of the status of site certification. Mr. Johnson noted the City Attorney is working on that. Mayor Mitchum asked if it's the treatment plant site. Mr. Ferland replied yes, and he's not sure if he's proceeding with that or putting it on hold pending the resolution of the admin- istrative hearing. He added they need to have that before they can execute the loan agreement. Mr. Ferland stated Florida Shores paving and drainage issues should be discussed at the next meeting. He noted the water and wastewater rate study is today with first reading of the ordinance incorporating all the recommendations into the program. He said the Hacienda Del Rio purchase will be talked about at the next meeting. Mr. Ferland stated the stormwater master plan was submitted for conceptual permit from the Water Management District and they're requesting additional information on eight items and a lot is just clarification and trying to get a better under- standing of the whole program. He added there's nothing that isn't easily resolved. Mr. Ferland stated at the last Council meeting they talked about information related to participation in the reclaimed water system and they contacted four major cities: Altamonte Springs, Cocoa Beach, Port Orange, and St. Petersburg, and a memo he'll provide to them shows the number of properties available that can be served by the reclaimed water system, the number hooked up, and a participation rate. Mayor Mitchum commented on St. Petersburg's good rate. Mr. Ferland said it's 57 %, adding they've been in operation 10 years. Mr. Ferland noted Cocoa Beach is 74% and it's relatively new. Mr. Johnson stated their problem is they're running out of water and you can water every other day now. Mayor Mitchum asked how many they foresee for Edgewater. Mr. Johnson replied they think they can come up with some pretty good figures. Mr. Ferland noted in Florida Shores, they have a potential 6,000 water connections and at 70% participation would be 4,200, which is optimistic, and 35% might be more realistic. He added when they get outside Florida Shores they have more opportunities with larger lots and golf courses and citrus grove type operations and nurseries and things of that nature but it costs more to lay those lines. He pointed out that St. Petersburg's system was 75% grant funded. Mr. Ori said a couple of years ago they raised the cost from $6 to about $10 now and they'd encouraged people to hook up to get all the water they want at low rates. Mayor Mitchum asked if Cocoa Beach is making money from theirs now and Mr. Johnson replied no and they were charging $6 the last he heard, which was a cheaper alternative for them. Councilman Hatfield asked what our chances are of hitting the 1995 deadline. Mr. Johnson said he'd rather not make a prediction and asked they give them until they can get some things worked out and see how they can deal with this group. Mr. Ferland stated the real caveat is if they do everything they can to apply the effluent. Mr. Johnson said if they get this to where it's acceptable, there's a program related to it. Mr. Ferland said the City needs to realize there are caveats in that law that allow for continued discharge, or exceptions, and they structured the program so they qualify for those exceptions. City Attorney Alvarez arrived at the meeting at this time. Mayor Mitchum asked about the site certification for the sewer plant. City Attorney Alvarez replied that's almost done. Mayor Mitchum asked when the hearing date is scheduled. Mr. Johnson replied they're looking at October. City Attorney Alvarez said it's the first or second week in November. Mr. Johnson suggested they call a meeting in the next two weeks and get a revised agenda when they have the other member of the Committee. Mayor Mitchum asked they set the date. Mr. Ferland asked if they want to talk about the revenue bond in more detail and if the ordinance passes, that would be the time to proceed. Mr. Johnson noted they'll probably meet before second reading and that would give the Committee a chance to make a recommendation to Council. 2 CIP Committee Meeting Minutes August 29, 1990 City Attorney Alvarez asked if the transmission is part of the main transmission from the new water plant. Mr. Ferland replied yes. City Attorney Alvarez asked if they know who owns it. Mr. Johnson replied Magnuson owns it the last time he checked. City Attorney Alvarez asked if they have to go to Mr. Moynahan for that. Mr. Johnson replied yes, and he'd talked to him recently when he was up here and he'll check again to see if that's the one he still owns. City Attorney Alvarez asked how that will affect the land. Mr. Ferland replied the roadway right of way goes from 120 to 65 feet. City Attorney Alvarez asked if its a buildable lot, and Mr. Ferland said yes. City Attorney Alvarez asked what objections they could come up with, and if they give us an easement it would be an underground pipe and no maintenance to speak of. Mr. Ferland noted only if there's a line break, and the only restriction on the easement is you can't put a permanent structure on it but it's a 10 foot setback. Mayor Mitchum asked if it's our easement. Mr. Ferland replied they don't have it yet. City Attorney Alvarez asked if they'd be laying it on the setback. Mr. Ferland explained on a map where they'd be laying it due to cable and other things in the roadway and the pavement goes right to the edge and they have the single lane and the median and they're trying to stay out of that pavement and are taking the 10 foot. City Attorney Alvarez suggested Mr. Ferland have someone do the legal and he'll prepare an easement and send it to him and see what he says. Mayor Mitchum asked if this is the only place they have this problem. Mr. Ferland said yes. City Attorney Alvarez asked if Mr. Johnson is getting anywhere on negotiations for the hearing. Mr. Johnson replied he's to talk with the man tomorrow and he'll get in touch when he gets his comments, which he understands aren't going to be of any consequence unless they're in disagreement with what we put together. City Attorney Alvarez commented on the amount of money required for the hearing and the hope to settle it now.
