COMMUNITY CENTER MINUTES CALL TO ORDER: Mayor Hayman called the Regular Meeting to order at 7:00 p.m. in the Community Center. APPROVAL OF MINUTES Reqular Meetinq of September 18, 1995 Councilwoman Martin made a motion to approve the September 18, 1995 minutes, second by Councilman Hatfield. The motion CARRIED 4-1. CITIZEN COMMENTS REGARDING AGENDA ITEMS ONLY (Other than public hearinqs) A gentleman representing Habitat for Humanity asked if it would be the proper time to speak. Mayor Hayman informed him it is an agenda item and asked him to make his presentation during that time. Andy Anderson, 1730 pine Tree Drive, questioned if Item 5C is regarding the article in the newspaper pertaining to putting vehicles in your backyard. Mayor Hayman informed him yes it is and asked that Mr. Anderson make his remarks during the public hearing. Mr. Anderson agreed. ORDINANCES AND RESOLUTIONS A. First reading and public hearing Ord. 95-0-14 Comprehensive Plan Amendment B. First reading and public hearing Ord. 95-0-15 Amendment to list of permitted uses in B-2, Neighborhood Business District Mayor Hayman went over the procedure for the public hearing. Mayor Hayman presented the background of Ord. 95-0-14 and Ord. 95-0-15. Mayor Hayman read Ord. 95-0-14. Community Development Director Mark Karet made a presentation regarding Ord. 95-0-14 and Ord. 95-0-15. Councilwoman Martin asked if this changes the number of employees allowed. Mr. Karet stated by making it industrial, the limits on the employee cap will be eliminated. There was a discussion regarding the church. Mr. Karet explained they could not make significant expansion. There are some exceptions within our Code that will permit some sort of minor rounding off of the structure but they will not be able to make any significant expansion. vic Glidewell, 2510 Evergreen Drive, stated on the proposed amendment that is coming up, I am assuming that we are talking about zoning it into a light industrial area. A light industrial area to him would mean that raw materials are being brought in and finished products are being sent out. He has no problem with this on Hibiscus but he does have a problem with Guava. Guava is no wider than a neighborhood street in Florida Shores. Mr. Glidewell commented on the traffic problem this will cause and the safety of the people that use Guava Drive. Mr. Glidewell commented on other problems this rezoning will cause. Mayor Hayman asked Mr. Karet to comment on the width of the road and the right-of-way and whether the width continues past 26th Street. Mr. Karet explained there are no proposed changes to the width of the right-of-way. If we were going to develop an industrial area today, the right-of-way for Guava would be larger. Mr. Karet stated there is no zoning action being taken at this time. The Comp Plan is being amended to Industrial and if that is approved by DCA and the city Council, then a particular zone change would be proposed. Page -2- Council Regular Meeting November 6, 1995 '-' ..., Mark Hampton, Hampton & Associates, stated at a meeting some months ago, there was a discussion as far as what the exact limits of the zone would be. He asked to look at this. Mr. Karet informed him he could and elaborated on Mr. Hampton's concerns. Cliff Clark, 1818 Evergreen Drive, asked if Fern Palm Drive was ever finalized as far as being zoned commercial. Mr. Karet explained there are two portions that abut Fern Palm. These are properties that begin with frontage on Guava and go back to Fern Palm Drive. Mr. Clark asked what about the businesses that are just north of SR 442 on Fern Palm. Mr. Karet elaborated on Mr. Clark's concerns. Mr. Clark questioned how much further they were going to progress. He commented on the noise coming from the auto shop and the increase in noise if this is changed to heavy industrial. Bud Roberts, 423 N. Riverside Drive, stated he is not against the industrial zoning but he feels there needs to be some type of cap. His main concern is the overflow of body shops. They would soon turn into used car lots and junk yards. We can't keep these under control now, what are we going to do when it is changed to industrial. He expressed concern with the zoning behind the building he owns which is duplex. You are going to have companies running two and three shifts. He doesn't know how some of this is going to be controlled. He feels caps have to be found that the people can live with. He asked Council to give this a lot of consideration. Mayor Hayman asked Mr. Karet to elaborate on Mr. Roberts' concerns. Mr. Karet referred to junk yards and used car lots and explained retail sales is not permitted in an industrial district. Mr. Karet commented on any future caps that may be imposed. The place to do that would be in the underlying zoning regulations. He feels the Comprehensive Plan needs to reflect the character of the use that is occurring in the area. Mr. Karet spoke about when this was discussed two years ago with DCA, they felt increasing the cap would be inconsistent with the Comp Plan. Councilman Hatfield questioned there being no junk yards in light industry. Mr. Karet explained it is not a permitted use. Councilman Hatfield asked how much light industry is on Guava Drive now. Mr. Karet stated of the 52 acres, approximately half of that is developed and out of that there are approximately 80% of the businesses on Hibiscus and Guava Drives can be classified as industrial type uses or heavy commercial. Councilwoman Martin questioned Guava being mostly storage buildings. Mr. Karet stated there are a number of storage buildings on Guava. There is also a number of contracting offices. Most of the warehousing has seemed to go over to Guava as opposed to Hibiscus. Councilman Mitchum spoke about businesses operating two and three shifts. This does not grant that right. Mr. Karet stated this does not grant that right because this is the Comprehensive Plan and you wouldn't be changing the zoning on any property until such time that Council decided to do that. If you were to rezone the property industrial without making any alterations to the industrial district, yes. There is no limit now on the number of shifts. Page -3- Council Regular Meeting November 6, 1995 '-' ....." councilman Mitchum expressed concern with the duplexes that are backed up to that property and businesses making noise all night that can be heard. He questioned if and when this is zoned and there are no stipulations put in it, then they have the right to operate 24 hours a day. Mr. Karet informed him yes they would. There was further discussion regarding businesses working 24 hours a day. Mr. Karet explained no zone changes have been brought forward to Council for their approval at this time. That certainly is something that would be in order because of the way this area was created. It was established as a neighborhood business. In 1984, it was legitimatized but with a cap. We do have a situation where we have incompatible uses sitting right next to each other. We can bring that forward when this comes back from DCA which will be approximately three months. Mayor HaYman feels a stage is being set for a situation that is going to be more difficult later on than what we have right now. Mayor HaYman closed the public hearing. City Attorney storey explained this public hearing is a transmittal hearing to determine if this should now move on to the Department of Community Affairs for comment and then DCA would come back for another public hearing before it would be enacted or take effect. Councilwoman Martin feels there are an awful lot of exceptions that need to be looked into before we get into this change. Councilman Mitchum stated he is not in support of what has been presented by Mr. Karet at this point. Councilman Mitchum moved for approval which would authorize a submittal of this to the DCA for their comments. It does not mean that any change is taking place in the existing land use map and the existing businesses are not effected at this point. Councilman Hays seconded the motion. He agreed with staff's position that there are some issues that need to be addressed in this area. He can't totally support everything. He feels the concerns expressed need to be addressed. He asked Mr. Karet to take the time to sit with each Councilmember and address some of the problems. City Attorney storey stated although this would be for transmittal purposes, if the Council makes substantial changes to the proposal after it comes back from DCA, Mr. Karet would have to discuss the changes with DCA and they will make a determination as to whether they want additional data and analysis to support those changes. Mr. Karet explained there is going to be a lot of work involved in order to get this through DCA successfully. He would like to go forward to DCA with something that Council supports and is happy with. Councilman Mitchum withdrew his motion, Councilman Hays withdrew his second. Councilman Hatfield expressed his feelings regarding this matter. He feels it is going to hurt more people than what the Council is trying to do to help. He feels this is a unique parcel. Councilman Hatfield moved for denial of Ord. 95-0-14, second by Councilman Hays. Page -4- Council Regular Meeting November 6, 1995 'w' .., city Attorney storey stated if the Council thinks they may want something of this nature but reworked the public hearing could be continued and request staff to bring this back at another time. otherwise it would require readvertising and the advertising requirements now are quite extensive. Mayor Hayman feels there are significant concerns and he feels they need time for the public to network with staff as well as the elected body to express their concerns and interests. Councilman Hatfield explained why he feels they need to decide if this area is broken and if they have to fix it. Councilman Mitchum commented on the three employee limit being a concern in that area. Councilwoman Martin feels this needs to be studied a lot more. Councilman Hatfield questioned withdrawing the motion and put a three to six month table on it. Mayor Hayman feels they may run into some constraints if they try to continue it. The motion CARRIED 5-0. B. First reading and public hearing Ord. 95-0-15 Amendment to list of permitted uses in B-2, Neighborhood Business District Councilman Mitchum feels this item is a related problem. He questioned if they need to go into public hearing. City Attorney storey stated they could open and close it due to Mr. Karet already making comments. Mayor Hayman read Ord. 95-0-15. Mayor Hayman opened the public hearing. Mayor Hayman closed the public hearing. Councilman Mitchum made a motion to deny Ord. 95-0-15, second by Councilman Hatfield. Councilman Hays stated there were specific problem areas and asked that this be brought back for further consideration. The motion CARRIED 5-0. C. Public hearing Ord. 95-0-12 Establishing regulations for outside storage of vehicles, equipment and materials Mayor Hayman went over the background pertaining to Ord. 95-0-12 and the staff recommendation. City Attorney storey commented on the enforcement policy and explained it is not as written in our Code. We have directed enforcement at residential areas and if it is the Council's wish to continue that policy, then the Code needs to be amended. City Attorney storey commented on the Code prohibiting any storage of abandoned, junk or discarded vehicles anywhere in the City but that has not been the enforcement policy over the past few years. That is the issue staff is requesting Council direction on. City Attorney storey explained this is a continuation from the October 12th meeting and since this has already been published and is being continued, she advised the Mayor he could just reopen the public hearing. Mayor Hayman reopened the public hearing. Page -5- Council Regular Meeting November 6, 1995 ....... """" Inez Walker, 3307 Victory Palm Drive, questioned how this is going to be enforced. She spoke about places that should have already been taken care of with the current Code. There was a brief discussion regarding a burned out house on pine Tree Drive in the 1800 block. Doris Hill, 112 Lincoln Road, spoke against the passing of this ordinance. She commented on specific sections in the Land Development Code. If this ordinance is approved, there will be a direct conflict with the City's Land Development Codes. She feels strict code enforcement and beautification need to be encouraged. Andy Anderson, 1730 pine Tree Drive, spoke about an article in the News Journal on November 4th pertaining to a law that would allow the storage of inoperable vehicles and other materials in backyards as long as they are fenced and screened from view. If this passes, who is going to police this. He doesn't feel we have enough people in the City to police this. Randy Hess, 2019 Kumquat Drive, presented pictures of what he has to view everyday such as construction equipment, culverts, and pipe that are being stored on Kumquat Drive. He feels if you are going to enforce an ordinance making the residents screen in their junk, then how can the City get away with storing equipment on Kumquat Drive. City Manager McMahon stated the contract allows the storage of materials in the process of construction on public property and the public property is limited. He further commented on the storage of materials during construction. Mr. Hess questioned if this is going to keep happening every time the City has a construction project. He feels his neighborhood is being invaded and questioned when this is going to end. City Manager McMahon stated he doesn't know of any other construction projects the City plans to do. He commented on this being an unfortunate thing that has to occur. Mayor Hayman further commented on the storage of equipment and materials being an inconvenience. He commented on the vandalism of equipment. There was a discussion regarding finding a place where the construction equipment can be stored. Mr. Hess suggested the property owned by the City on Mango Tree Drive which is zoned commercial. Mayor Hayman asked Mr. Hess to see him after the meeting or leave his phone number. He would be glad to speak to him. Cliff Clark, 1818 Evergreen Drive, stated it was his understanding that this ordinance change was going to be for tighter restrictions. He feels if this ordinance is passed, there will be more problems. Mr. Clark commented on problems he has had with his neighbors pertaining to junk in their backyard. Mr. Clark would like to see the Code Enforcement Officer given the authority to patrol and issue tickets and to not have matters taken care of on a complaint basis. Mr. Clark commented on home occupancy. Mr. Clark feels the ordinance should have tighter restrictions. Page -6- Council Regular Meeting November 6, 1995 ....... .""" william Connell, 1810 Umbrella Tree Drive, encouraged the Council to stay with the present ordinance. He spoke about a problem he had with his neighbor who went through a phase of buying, repairing and testing motorcycles. He again urged the Council to stay with the present ordinance. Pat Teehan, 1316 to be enforced. for junk and the someone actually Royal Palm Drive, questioned how this is going He spoke about a situation where he was cited only way they could have known about it is if came on the property. Mr. Teehan spoke about being president of the East Coast Cruisers Car Club and this should be allowed as a hobby. He feels the Council needs to sit down and talk with the people. Dan Ray, Edgewater, not City limits, spoke about what may be junk to someone may not be to someone else. He spoke about people being fined $250 per car and being able to get a $50,000 lien on their homes if the fine is not paid. Mr. Ray feels you need to have people that know what they are doing to enforce the law. Mr. Ray commented on the definition of junk or abandoned cars. Bob Fritz, 2939 pine Tree Drive, spoke in favor of the change. He feels the ruling that is on the books right now is outdated. Peoples lifestyles and hobbies are different today. His hobby is restoring cars which can not be done in 30 days. He feels he should have the right to do a hobby that he enjoys. Mr. Fritz spoke about the City enjoying his hobby when they ask to borrow cars for the parade. He feels a compromise should be made that will make everyone happy. Mike Visconti, 316 pine Breeze Drive, endorsed this ordinance. He feels Edgewater needs this law for the benefits of all concerned homeowners who take pride in the community. He spoke about the CARE slogan. He urged Council to pass this ordinance. Henry Dardinski, 2704 Sabal Palm Drive, feels the Council should be ruled by the residential Code. He spoke about the eyesores being hidden from the public by putting up a fence. He asked Council to consider what is best for the property owners and taxpayers in this City as a whole. Charles Johnson, 2420 Victory Palm Drive, suggested a guideline for the enforcement of the code to be obtaining a permit for restoration. There was a brief discussion regarding obtaining permits to restore cars. Mr. Johnson commented on car covers being part of the permitting process. Glenn Smith, 2709 Lime Tree Drive, commended Council and staff for the work they have done on this ordinance. He sYmpathized with the people concerned about their property and property value. Mr. Smith stated he hates junk sitting in yards and cars that are abandoned and he sYmpathized with the people who have spoken about such problems. He feels Council needs to find some way to work with each citizen. Pat Collier, 2008 Willow Oak Drive, spoke in proposed ordinance. Mr. Collier urged Council to keep the existing ordinance the way it is or straighten it out where the City could be kept halfway beautiful. Mr. Collier submitted the petition to City Clerk Wadsworth. There was a five minute recess at this time. Mike Martin, 1724 S. Riverside Drive, stated they need to seek a solution that will work for everyone. He feels if the Council is going to insist on the existing ordinance they aren't going to get anywhere. Mr. Martin commented on this also being a safety issue. He feels industrial and residential areas need to be separated and treated differently. Jay Michael McKay, 1717 S. Riverside Drive, commented on the issue of unequal enforcement. He commented on the complaint basis. He feels this should be handled on a case by case basis. He feels the definition of junk and abandoned needs to be looked at. Pete Hellsten, 1717B S. Riverside Drive, spoke on his hobby being the restoration of boats and boats not needing to be licensed. He spoke about the permitting process being used to identify what is legitimate and what is indeed junk. This City has been an eyesore for several years. A lot of this was created by the City and it has to be dealt with on a City level. He asked the Council to be compassionate and considerate and take another approach because neither ordinance is going to solve the problem. Councilman Hays thanked everyone for coming. The ordinance the way it is now is not enforceable and something needs to be done. He feels the Code Enforcement Officer doing patrol should be looked at. He likes the idea of permitting but feels a limit needs to be put on this. He feels one vehicle in view is plenty. He feels the permitting process is the way to go. Councilman Hatfield does not want to get involved in a junk yard ordinance. He commented on the problems not being from the classic car owners and them being very clean people. He stated they are concerned about abandoned cars. He feels the permit is a great idea. He feels a compromise needs to be made. Councilman Mitchum stated the proposed ordinance addresses a lot of things the old one does not. There is only a small section that pertains to residential. He feels he has a right as a citizen and hobbyist to own and maintain a classic car. He further commented on being a classic car owner. Councilman Mitchum also likes the idea of permitting. He doesn't' know if that is the total ordinance. This ordinance as it is presented does not do away with anything but tightens up the existing ordinance. He feels this is an effective ordinance that we can instill and have some enforceability. He believes this is a workable ordinance. Councilwoman Martin expressed her concerns with the proposed ordinance. She also feels the permitting process would be a good idea. Page -8- Council Regular Meeting November 6, 1995 "-' """ Mayor Hayman commented on the problems he has with the ordinance. He spoke about the importance of a one owner car and a classic car that is registered to the original owner has a great deal of value and if the vehicle is reregistered it often costs several thousands of dollars to the owner of the vehicle. He also feels the permitting process would be a good idea. He feels the rights of the property owners need to be protected as well as the hobbyist's rights. Mayor Hayman spoke about enforcement equity. He feels the definition of junk needs to be addressed. He commented on City Manager McMahon's suggestion of having a permitting system with some established standards that require everyone to come in and get a permit. city Manager McMahon suggested continuing this in January. City Attorney storey explained the 1st Monday in January is a holiday and the third Monday is another holiday so to establish a date in January the Council would need to establish a date. Councilman Hatfield suggested the last meeting in December. City Attorney storey informed the Council they could continue this to December 18th. City Manager McMahon informed the public to turn in any written comments to Mark Karet by the end of November. Councilman Hays questioned if it would be fair to ask the members of the Car Club to submit a proposal that they can all live with instead of 100 different proposals. City Manager McMahon stated he was thinking of input from the citizens that have an interest in this. There was a brief discussion pertaining to the Car Club handing in one proposal. Mayor Hayman asked the President of the Car Club to choose someone to work with City Manager McMahon to help articulate some of the things that the club feels is important. He agreed. Doris Hill, 112 Lincoln Road, suggested the Council stick with the current codes because they have been approved under the Comprehensive Plan and they have been enforced all this while and just add to it a permitting system. Councilman Hays stated under the present code, he can take an automobile, back it up to his house and let it sit there forever and there is nothing anyone can do about it due to City employees not being allowed on his property to see if it is tagged. You can not enforce the ordinance the way it is. Councilman Hatfield made a motion to continue this matter December 18th, second by Councilwoman Martin. The motion CARRIED 5-0. D. Res. 95-R-23 structuring of Central Volusia Aquifer Partnership to develop, monitor, and manage regional water plans for Volusia County aquifer City Manager McMahon made a presentation regarding Res. 95-R-23. Councilman Hays elaborated on City Manager McMahon's comments. Mayor Hayman read Res. 95-R-23. Councilman Hays made a motion to approve Res. 95-R-23, second by Councilman Hatfield. The motion CARRIED 5-0. Page -9- Council Regular Meeting November 6, 1995 'W' """'" City Manager McMahon stated the County is asking for a preliminary report by the 15th of January from the Manager's Team throughout all the cities in the County to come back to the elected officials for their review. There was a discussion regarding having to have a consumptive use permit in order to be a voting member. Mayor Hayman spoke about how the cities that don't have consumptive use permits become involved in the planning process being done through the regional areas, the comp plans, and the intergovernmental coordination element. E. Res. 95-R-24 Approving form of agreement for construction and maintenance of required subdivision improvements City Attorney storey made a brief discussion regarding Res. 95-R- 24. Mayor Hayman read Res. 95-R-24. There was a discussion pertaining to surveyors having to have dual certification. Councilman Mitchum made a motion to approve Res. 95-R-24, second by Councilwoman Martin. The motion CARRIED 5-0. CONSENT AGENDA A. Volusia County Criminal Justice Information System Council CJIS Access Agreement B. Interagency Agreement between Edgewater Police Department and Qffice of State Attorney, Seventh Judicial Court for provision of services to victims of violent crime in Volusia County C. Revised Exhibit 1 to Addendum No. 2 to agreement between City of Edgewater and Quentin L. Hampton Associates. Inc. D. Maintenance agreement with Technicians Unlimited Inc. for Finance Department copy machine E. Maintenance agreement with Technicians Unlimited, Inc. for City Hall copy machine F. Maintenance agreement with Technicians Unlimited, Inc. for Fire Department copy machine G. Maintenance agreement with Technicians Unlimited, Inc. for Public Works copy machine Councilman Mitchum asked to have Item C pulled from the Consent Agenda for discussion. Councilman Mitchum made a motion to approve the Consent Agenda excluding Item C, second by Councilman Hatfield. The motion CARRIED 5-0. C. Revised Exhibit 1 to Addendum No. 2 to Agreement between City of Edgewater and Quentin L. Hampton Associates, Inc. Mayor Hayman presented the background of this matter. Councilman Mitchum commented on there being no increase in costs but the supporting documents show an addendum of $51,000. He has been informed this is just a reallocation. There is no increase. Councilman Mitchum made a motion to approve Item 6C, second by Councilman Hays. The motion CARRIED 5-0. Page -10- Council Regular Meeting November 6, 1995 ..... 'W OTHER BUSINESS A. Request of Mark R. Hall on behalf of David and Laura Taylor to correct boundary discrepancy City Attorney storey informed Council Mr. Hall is at the Oak Hill City commission meeting and he indicated if there were questions she could not answer he would make plans to attend in the future. City Attorney storey made a presentation to Mr. Hall's request. Councilman Hatfield made a motion to approve staff's recommendation, second by Councilwoman Martin. The motion CARRIED 5-0. B. Engineering proposal from Hartman and Associates to design water distribution system for Cory Estates City Manager McMahon made a presentation regarding the engineering proposal. utilities Director Terry Wadsworth further elaborated on the proposal. Mr. Wadsworth informed Council that Troy Layton is available to answer questions. Mayor HaYman asked Mr. Layton to stand up, which he did. Councilman Mitchum made a motion to approve the engineering proposal, second by Councilman Hatfield. The motion CARRIED 5-0. Councilman Hatfield questioned if the three or four areas in question would be handled individually. Mr. Wadsworth stated they have done a survey and prioritized by the amount of interest of people participating and follow up section by section. C. Southeast Volusia Habitat for Humanity request for donation Mayor HaYman presented a brief presentation. City Manager McMahon further elaborated on this request. Councilman Hays stated last year they each donated $20 and suggested doing the same. Each Councilmember agreed to donate $20. D. Purchase of Savin copier for Police Department from Adams Remco. Inc. Under State bid City Manager McMahon made a brief presentation. Councilwoman Martin made a motion to approve this request, second by Councilman Hatfield. The motion CARRIED 5-0. E. Purchase of two 1996 Ford Crown victorias from Don Reid Ford in Orlando under State bid Mayor HaYman made a brief presentation at this time. Councilman Mitchum made a motion to approve this request, second by Councilwoman Martin. The motion CARRIED 5-0. GENERAL CITIZEN COMMENTS/CORRESPONDENCE There were no citizen comments at this time. Councilman Mitchum Councilman Mitchum commented on the paving of Hibiscus and parking lot commitments discussed over the past couple of years. Councilman Mitchum further commented on paving and drainage commitments on behalf of a few properties on Hibiscus. City Manager McMahon asked Mr. Karet to follow up with the agreements and see that they are enforced after the paving is done. The paving would have to meet the standards of the City. Councilman Hays Councilman Hays commented on signage around the City. He asked to have some do not litter signs and the fines for littering signs. He has been asked by a few people and doesn't think it is a bad idea. ADJOURNMENT There being no further business to discuss, Councilman Hays made a motion to adjourn, second by Councilwoman Martin.
