Citizen comments are to be limited to five (5) minutes CITY OF EDGEWATER PLANNING AND ZONING BOARD INFORMATION SUMMARY CASE # TA-1001 APPLICANT /AGENT: City of Edgewater REQUESTED ACTION: Land Development Code text amendments to Articles VI and XVIII permitting City franchise signage on public transportation benches and shelters. BACKGROUND: Enclosed are the affected pages from both Articles OTHER MATTERS: There will be two (2) public hearings at City Council for the proposed amendments. STAFF RECOMMENDATION Staff recommends sending a favorable recommendation to City Council for the amendments to the Land Development Code. Signs that are prohibited in the Indian River Boulevard Corridor include animated signs, billboards, off -site signs, flashing signs, snipe signs, portable signs (trailer signs), roof signs, beacon lights, bench signs, trash receptacle signs, gutter signs, signs on public property, immoral display, obstruction, streamers, spinners and pennants. Bench signs are prohibited except those placed on public transportation benches and shelters as approved through a competitive selection process pursuant to City standard procedures. b. No advertising or signage is allowed on any exposed amenity including but not limited to benches trash containers and fences. The criteria for approval of off -site selection shall be consistent with the conditions contained in the Sign Franchise Agreement and shall be subject to City Council approval. Minimum standards include: a. A leading edge of a franchise sign shall not be closer than ten feet (10') to a paved surface of a public right -of -way, unless approved by the City Manager. b. Signs bearing public information, as designated by the City Manager, may be placed in any zoning district. c. A franchise sign shall have a minimum clearance of nine feet (9') above the ground and a maximum height of sixteen feet (16') except those placed on public transportation benches and shelters as approved through a competitive selection process pursuant to City standard procedures. MARCH 10, 2010 MR. CHAIRMAN, MEMBERS, STAFF AND CITIZENS: FOR PURPOSES OF THIS DISCUSSION OF THE PROPOSED CHANGES TO THE LDC, I OFFER THIS OPENING COMMENT. I HAVE RESEARCHED THE CITY CHARTER, CITY ORDINANCES AND THE LDC TO FIND REFERENCES TO THE SIGNS WE ARE VOTING ON TONGHT. THROUGHOUT ALL OF THE DOCUMENTS THERE IS NO DEFINITION TO THE WORD FRANCHISE. I SELECTED THIS WORD BECAUSE OF THE CONITATION IT DENOTES WHEN USED IN BUILDING DISCUSSIONS. AFTER SOME TIME I FOUND A RELATED DEFINITION IN THE FLORIDA STATUTE, TITLE X, PUBLIC OFFICERS, EMPLOYEES AND RECORDS; CHAPTER 120 ADMINISTRATIVE PROCEDURE ACT; SECTION 120.52 DEFINITIONS AS USED IN THE ACT; PARAGRAPH (f), SUBPARAGRAPH (10): "LICENSE MEANS A FRANCHISE, PERMIT, CERTIFICATION, REGISTRATION, CHARTER, OR SIMILAR FORM OF AUTHORIZATION REQUIRED BY LAW, BUT IT DOES NOT INCLUDE A LICENSE REQUIRED PRIMARILY FOR REVENUE PURPOSES WHEN ISSUANCE OF THE LICENSE IS MERELY A MINISTERIAL ACT. IN TITLE XI COUNTY ORGANIZATION AND INTERGOVERNMENTAL RELATIONS; CHAPTER 125, SECTION 125.012, PROJECT FACILITIES, GENERAL POWERES AND DUTIES, PARAGRAPH (17) "TO GRANT EXCLUSIVE OR NONEXCLUSIVE FRANCHISES TO PERSONS, FIRMS OR CORPORATIONS FOR THE OPERATING OF RESTAURANTS, CAFETERIAS, BARS, TAXICABS, VENDING MACHINES AND OTHER CONCESSIONS OF A NONAERONAUTICAL NATURE IN, ON AND IN CONNECTION WITH ANY PROJECT OWNED AND OPERATED BY THE COUNTY. AGAIN IN TITLE XIV TAXATION AND FINANCE, REFERENCING MUNICIPALITIES MAY NOT OBLIGATE COMMUNICATIONS SERVICES WITH TAXES, FEES, ETC. AND IN TITLE XXIII MOTOR VEHICLES, IT REFERENCES LEASING AND RENTALS OF MOTOR VEHICLE FRANCHISES WITH MANUFACTURES. MY REASON FOR BRINGING THIS FORWARD IS THAT WE SHOULD INCLUDE A DEFINITION FOR THE WORD FRANCHISE IN OUR LDC. IT COULD INCLUDE THE SAME REFERENCES AS THE STATE STATUTES OF PROVIDE ONE OF OUR OWN. I REALIZE THIS IS ADDING TO THE SECTION BUT I BELIEVE IT COULD BE ADDED UNDER SECTION 21 -62.02 EASILY. THE SECTION RELATES TO BOTH TYPES OF FRANCHISE DEFINITIONS, ONE REFERENCE FOR LICENSE AND REFERENCES FOR MANUFACTURING AND RESTAURANTS, ETC. I FEEL MOST PEOPLE WHO READ THIS ARE ONLY THINKING OF LARGE SCALE VEHICLE RENTALS OR CHAIN RESTAURANTS WHEN IT COVERS ALL OF THE BUSINESS ENTITIES IN THE CITY. if City of Inc. / A TER . Barlow, City Manager As we have previously discussed, we are exploring the possibility of participating in the Florida Department of Environmental Protection (FDEP) Brownfield's Redevelopment Program. This program provides regulatory and financial incentives to property owners for remediation, redevelopment, revitalization and economic development of their land for the purposes set forth in Sections 376.77 - 376.84, Florida Statutes. The properties indicated on the attached map have been identified as candidate properties for designation as a Brownfield Site or as part of a larger Brownfield Area. Participation in the State's Brownfield program is something that we believe is of direct benefit to property owners as well as the economic health of our community. We are offering this opportunity for those who wish to participate however, participation in the program is completely voluntary. Property owners that do not want their property included in the City's designated Brownfield Areas or Sites can elect not to participate during the formal designation process. The Edgewater City Council will be holding a special workshop to discuss the City's participation in the State's Brownfields program.
