There was a pledge of allegiance to the Flag. APPROVAL OF MINUTES Regular Meeting of November 7, 1988 - Councilman Asting moved they adopt the minutes. Councilman Prater seconded the motion. Motion CARRIED 5-0. Special Meeting of November 9, 1988 - Councilman Prater moved they adopt the minutes of November 9th. Councilman Rotundo seconded the motion. Motion CARRIED 5-0. CONSENT AGENDA Request to purchase three patrol vehicles - Police Department; Request to purchase dispatch console and two mobile radios - Police Department; Performance bond for City Manager; and Job Description for Finance Director - Councilman Prater asked to remove item 3.D (Finance Director Job Description). Mayor Baugh requested a motion to accept the consent agenda. Councilman Prater so moved. Councilman Rotundo seconded the motion. Motion CARRIED 5-0. Mayor Baugh requested a motion to approve the consent agenda. Councilman Asting so moved. Councilman Prater seconded the motion. Motion CARRIED 5-0. Job Description for Finance Director - Councilman Prater suggested this be carried over to the next regular Council meeting of December 5th for the new Council to decide on this item. No Council member expressed an objection. ORDINANCES AND PUBLIC HEARINGS First Reading Ord. 88-0-30 Annexing Ranken property, east of U.S.l and north of Edgewater Landing - Mr. Powers read this Ordinance. ORD. 88-0-30 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, ANNEXING CERTAIN REAL PROPERTY TO THE CITY OF EDGEWATER, FLORIDA, LOCATED EAST OF U.S.Hl, BETWEEN RANKEN DRIVE AND ROBERTS ROAD, EDGEWATER, FLORIDA, PURSUANT TO FLORIDA STATUTES. SEC. 171.044; REDEFINING THE BOUNDARIES OF THE CITY OF EDGEWATER, FLORIDA; BY AMENDING THE APPROPRIATE SECTIONS OF THE CODE OF ORDINANCES; PROVIDING THAT UPON ADOPTION CERTIFIED COPIES BE FILED WITH THE CLERK OF THE COURT IN VOLUSIA COUNTY, THE DEPARTMENT OF STATE AND THE CHARTER REVIEW DEPARTMENT; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. Ord. 88-0-31 Rezoning Ranken property, east of U.S.l and north of Edgewater Landing from County R-3 to City MH-2 - Mayor Baugh stated this had been administratively withdrawn. Second Reading: Mayor Baugh requested a motion to go from the regular meeting to the public hearing. Councilman Prater so moved. Councilman Asting seconded the motion. Motion CARRIED 5-0. Mr. Powers read the Ordinance. Mayor Baugh asked for input from the audience. Mr. Cranston, 121 Joseph Avenue, Lot 20, asked if these are commercial lots. Mr. Powers explained it was B-4/R-3. Mr. Cranston asked the plans for that property. Mrs. Lynne Plaskett, Planning Assitant/Grant Administrator, replied there are no development plans at this time. Ord. 88-0-26 Rezoning Lots 1-8 and 21-29, Block B, Edgewater Park - Mr. Powers read this Ordinance. ORD. 88-0-26 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, ADOPTED PURSUANT TO FLORIDA STATUTE 166.041 (c) (1) AND SECTION 1100 OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, REZONING LOTS 1 THROUGH 8 INCLUSIVE AND LOTS 21 THROUGH 29 INCLUSIVE, BLOCK "B", EDGEWATER PARK, MAP BOOK 10, PAGE 154, PUBLIC RECORDS OF VOLUSIA COUNTY, FLORIDA; DIRECTING THE CITY CLERK TO ADVERTISE THIS ORDINANCE AS PROVIDED BY LAW; AMENDING THE OFFICIAL MAP OF THE CITY OF EDGEWATER ACCORDINGLY; CON- TAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. Mayor Baugh asked for audience input and there was none. Mayor Baugh requested a motion to close the public hearing and go back into the regular meeting. Councilman Prater so moved. Councilman Rotundo seconded the motion. Motion CARRIED 5-0. Ord. 88-0-25 - Councilman Mitchum moved they adopt the ordinance. Councilman Prater seconded the motion. Motion CARRIED 5-0. -2- Council Regular Meeting Minutes November 21, 1988 ,.,. .."", ORDINANCES AND PUBLIC HEARINGS (Continued) Ord. 88-0-26 - Councilman Rotundo asked why Mr. Cranston was against this rezoning. Mr. Cranston expressed concern for the intended use of the property abutting his own. Mrs. Lynne Plaskett explained the line being straightened out and rezoning it all to B-3. Councilman Rotundo moved they adopt this ordinance. Councilman Prater seconded the motion. Motion CARRIED 5-0. Ord. 88-0-27 - Councilman Prater moved they adopt Ordinance 88-0-27. Councilman Mitchum seconded the motion. Motion CARRIED 5-0. Ord. 88-0-28 - Councilman Asting moved they adopt this ordinance. Councilman Rotundo seconded the motion. Motion CARRIED 5-0. UNFINISHED BUSINESS Volusia County Environmental Protection Ordinance #88-15 - Mrs. Plaskett explained the review by the sub-committee of the Land Development and Regulatory Agency, pointing out they made changes to the County's ordinance to implement our changes. Councilman Rotundo asked if she approved of this and Mrs. Plaskett replied yes. Mr. Powers stated they're asking the City Attorney to draft it in our form. Councilman Prater moved they grant the request of the LDRA. Councilman Mitchum seconded the motion. Motion CARRIED 5-0. NEW BUSINESS Group health insurance - Mr. Powers explained the claims history and other factors such as State mandates that caused the increase in premiums. He read the various alternatives with costs to the City, including employees' share. He stated that 150% was paid in claims over the premiums for the first nine months of this year. Tom Sheridan, Florida Shores, asked if the accident frequency was the reason for this increase and Mr. Powers replied this was medical insurance claims. Mr. Sheridan asked if the casualty influenced this and Mr. Powers replied no, this is for health insurance. Danny Hatfield, 231 North Old County Road, asked about the union's involvement with this change and Mr. Powers explained the contract states the City will provide the insurance. Mr. Hatfield questioned if they shopped elsewhere and Mr. Powers replied no, but this won't happen next year. Councilman Asting moved they accept the City Manager's recommendation. Councilman Rotundo seconded the motion. Motion CARRIED 5-0. CITIZEN COMMENTS Freeman Newell, 2450 S. Ridgewood Avenue, asked about the ballfield road. Mr. Powers explained they met with the officials last week and they're looking at moving some portables and he received a letter asking for another 60 days to assess the impact of the portables. Councilman Mitchum reviewed the lease signed for one year and the discussions held with the meeting with the School Board officials last week. He expressed concern that they may be asked to move and stated he doesn't want to spend the money if that's going to happen. Mr. Newell stated that some employees didn't think we'd be asked to move. Don Bennington suggested they build on another piece of property instead of spending the money on the road. Councilman Mitchum stated they're discussing it and they're looking at 22 acres. Mr. Powers suggested they may renegotiate the lease. Mr. Bennington again stated we should build on our property. COUNCIL/OFFICERS REPORTS City Attorney Reports - City Attorney Alvarez was not present at this meeting. City Manager - Mr. Powers had no report. City Council - There were no City Council reports.
